F. Fabbrini is a PhD researcher, Law Department, European University Institute. For disclosure purposes I should reveal that in the 2009-2010 judicial term I interned as a law clerk for Justice Sabino Cassese of the Italian Constitutional Court, who happens to be the judge rapporteur of the decision of the Court under review in this essay. However, since I had already left the Court when the case was assigned to the judge rapporteur, I have never been involved in any activity essential to the preparation of the decision, or even preparatory or consequential to it. Needless to say then, that the opinions expressed in this essay are exclusively mine and do not intend to reflect the official position of specific Justices, much less of the Italian Constitutional Court.
