    In this contribution Ronald Leenes discusses the implications of technoregulation, i.e. regulation by means of technology. Starting from Julia Black’s definition of regulation he discusses how technologies are used to alter or modify human behaviour. One of the objections he raises concerns the intransparency of the norm that is thus enforced, and he argues that technoregulation easily becomes administration or discipline rather than law.

    Mireille Hildebrandt responds to the article of Ronald Leenes. She largely agrees with Leenes’ objection that technoregulation threatens to conflate rule-making (a task of the legislator) with administration (a task of the executive). In her reply she rejects the external perspective that is inherent in regulation as behaviour-modification, arguing that legal subjects are not to be seen as mere objects of regulation. At the same time she calls for a reflection on the normative implications of technological infrastructures for existing legal rights, e.g., on privacy, even if these implications were not intended by a regulator.

    This article demonstrates on the basis of a representative survey among the Dutch population (N=1,892) that it is not necessarily politically ‘rightist’ or ‘conservative’ to resist the toleration of illegal activities (‘gedoogbeleid’). Even though, generally speaking, political conservatives are most likely to be critical, this is merely because they unconsciously associate the latter with practices of tolerating illegal activities by marginal individuals. Whereas conservatives hence oppose the latter more than political progressives do, the latter for their part are more critical than conservatives about tolerating illegal activities by official agencies. These findings illustrate that gedoogbeleid does not have a universal legitimacy in the eyes of the public, but that its legitimacy is determined case by case by the concrete aims and targets addressed by this policy instrument.

    In Law’s Empire Ronald Dworkin offers a specific answer to the age old question of political legitimacy. According to Dworkin, legitimacy originates in a ‘true community’ that is able to generate associative obligations among its members. In this article I illustrate how this answer contrasts with the moral and political principle of justice. The question remains how a conceptual link can be found between a community-based view on legitimacy and a more universal demand for justice. I try to answer this question by offering a close reading of Law’s Empire and other basic essays in Dworkin’s philosophy of law. In my attempt to solve this problem I propose an alternative view on community and legitimacy. In opposition to Dworkin I claim that legitimacy is prior to the community.

    This paper argues that Somsen’s article, though brave in approach and daring in ideas, suffers from some fundamental flaws. First of all, it remains unclear how Somsen conceptualises the relationship between legitimacy and effectiveness, and what this means for his position towards the argument of a state of exception. Secondly, a plea for regulation by code has serious consequences for the claim to attain justice. Finally, geo-engineering poses some profound difficulties, both because of its consequences and because of its presuppositions.

    This article considers the question how knowledge of an impending ecological catastrophe is likely to impact on regulatory legitimacy and regulatory effectiveness. If the ultimate aim to safeguard meaningful human life on earth is in acute danger, this is likely to translate into zero tolerance towards non-compliance with environmental rules designed to avert catastrophe. This, in turn, will persuade regulators to employ normative technologies that do not engage with the moral reason of regulatees at all, but leave no option but to comply. In addition, regulators may turn to panoptic surveillance techniques that allow no breaches of rules to remain undetected. Finally, it is argued that if and to the extent that impending ecological catastrophe marks the end of maintaining the status quo as a plausible policy goal, regulators will be more sympathetic towards potentially apocalyptic technologies that carry greater promise for future gain than otherwise would be the case.

    This contribution offers a partial explanation of the differences between procedural systems. In most jurisdictions, civil procedural regulations constitute a carefully designed system. Generally, a number of underlying principles, guidelines, theories and objectives can be identified that clarify and justify more specific rules of procedure. It will be argued that the main differences between legal systems flow from different political and theoretical views of those who determine and shape the form of the legal process. This contribution identifies the ideological influences on the rules of procedure in a number of influential jurisdictions.

    There is a strange contradiction in the history of Dutch criminal justice. On the one hand, until well into the 20th Century, it was peculiarly backward in terms of criminal procedure that remained based on principles deriving essentially from the era of the first Dutch republic (17th and 18th Century) or even earlier. On the other, The Netherlands was one of the first countries in Europe to lastingly abolish capital punishment without the intermediate phase of continuing executions out of public view. In this, Dutch criminal justice was decidedly ahead of its times. This contribution examines this apparent contradiction that cannot be entirely explained by existing theories on (the abolition of) capital punishment. It must also be seen in the light of the historical role of publicity/transparency for the legitimacy of criminal justice in the Netherlands, its link to a legal culture of public confidence in the criminal justice authorities and the relatively late reception of Enlightenment ideals.

    Changing public safety problems as well as an increasing societal demand for public safety made way for new policy approaches. During the 1990s, the so called ‘integral safety approach’ was introduced in the Netherlands. This approach manifested itself mainly on the municipal level where the mayor is being held responsible for managing public safety and order. The central question raised in this article is: what are the consequences of an integral approach to public safety problems for the mayor when managing local order and public safety? We will demonstrate that ‘integrality’ is no clear cut concept. Careful inspection of the concept learns that it has multiple meanings. Of these various meanings, especially the ambition to address public safety problems by means of ‘new alliances’ characterized the actual implementation of integral policies. However, working together within these new alliances uniting various more or less independent actors from both the public and private sector, seemed to be hampered by a lack of coordination and control. In that sense, the introduction of the integral approach had consequences for steering and control of public safety policies. These consequences have to be addressed, especially by the mayor who is accountable for local order and safety. The mayor had attributed to him – first in practice, soon by law as well – the role of director of public safety policy on the municipal level. However, as we will demonstrate in this article, the mayor lacks an important trait needed for effective directorship: decisive powers. Therefore the mayor is not able to realize effective cooperation between partners within the new alliances of the integral approach to public safety problems. As a potential solution, we will describe the characteristics of a ‘model of anticipation’ granting the mayor a certain level of decisive powers to be used as an ultimum remedium.

    There is a large – and still growing – body of criminological literature on the relationship between crime and work. However, the exact nature of that relationship often remains diffuse. In this article we explored the relationships between organized crime and work. Based on analysis of the forty most recent cases of the Organized Crime Monitor we distinguished between two types of relations connecting organized crime and work. First, crimes can be based in the occupation of the offender when the occupation provides concrete opportunities to offend or facilitates the crimes of others. Secondly, the occupation of the offender can also be used as a shield concealing the illegal behavior or identity of the offender.

    This article offers an analysis of the side effects caused by the increased counterterrorism measures adapted in Dutch law and public policy after 9/11. Taking clues from Foucault's thinking on securitisation and Beck's risk society, it is argued that focus, referent subject and object of security measures and deployment of counterterrorism laws have shifted from the concrete individual to society and risk prevention as a whole (1), that this shift induces function creep (2) and a much quicker deployment of measures, resulting in an increasing suspect population (3). Rather than arguing against the legality and legitimacy of these measures, the authors analyse the epistemological shift in reasoning and unpack the various probabilistic arguments (as opposed to evidence-based arguments) behind the wave of securitisation after 9/11 - resulting in a lack of knowledge about, transparency and accountability of the generated side effects.

    Luigi Corrias challenged Han Somsen’s plea for an effective regulation in the wake of an impending ecological catastrophe. This article takes up some of the arguments that have been exchanged: First, the paper criticises Corrias’s call for an ‘eco-logos’ as an ethical evasion of the political dimension that regulations aiming at a radical policy change necessarily entail. Secondly, it disputes the assumption that Somsen’s argument invites the notion of Carl Schmitt’s state of exception. Thirdly, the paper discusses the possible effects that code law might have on the concepts of agency (lack of autonomy) and citizenship (loss of justice).

    Blad responds to Groenhuijsen by showing how political decisions in the Netherlands, after successful experiments with restorative justice for juveniles and adults, were based on the belief that criminal justice would lose its punitive foundation and tenor when restorative justice practices would become integrated in the justice system. Criminal justice should not be about resolving conflicts between victims and offenders and the type of mediation, that could lead to an agreement as an important element to be considered in sentencing, was therefore rejected. In so far as restorative justice ideology took influence, it seems to have been a misconception of restorative justice as merely a new form of penal abolitionism. The fact that restorative justice does not deny the legitimacy of the provisions in the substantive criminal law and that all important restorative projects co-operate with criminal justice agencies was apparently ignored. Against the background of the dominant political culture of ‘punitive populism’ and intensified use of severe punishments it seems highly unlikely that abandoning the ambition to develop a restorative justice paradigm would further the implementation of restorative justice.

    In het Nederlandse debat over de rol van vertrouwen in toezicht en handhaving heerst verwarring over het begrip vertrouwen. Dit artikel kijkt kritisch naar de argumenten en schept meer duidelijkheid over het begrip en de voor toezicht belangrijke relatie tussen vertrouwen en controle. Vertrouwen is onvermijdelijk aan de orde in toezichtrelaties en kan dus het beste expliciet in toezichttheorie geconceptualiseerd worden. De conceptualisatie van vertrouwen in de responsieve toezichttheorie van Braithwaite e.a. is echter aan herziening toe. Aan de hand van recente inzichten uit de vertrouwensliteratuur worden uitgangspunten en contouren van een mogelijke vertrouwensbenadering in toezicht geschetst.

    Two types of legalization can be distinguished. In type 1 legal relations between parties are changed, without consequences for others. In legalization type 2 a change in legal positions does have consequences for third parties. The gradual change in the legal position of patients, managerial measures and the transition to ‘demand driven care’ have changed the relations between patients and doctors, nurses etc. But they had also profound external effects. They have influenced especially other interests than the quality of medical care, like equal treatment of patients and professional discretion. Decision making about the granting of rights should incorporate these external effects.

    This paper approaches Walker’s work from the perspective of the ubiquity of human rights language within the rhetoric of global constitutionalism. Building on Walker’s description of the relationship between constitutionalism and democracy, what I wish to suggest is that the spread of human rights discourse is intimately connected with attempts to apply constitutional discourse beyond the state. By highlighting the way in which human rights have become place-takers for political legitimacy in discussions of international constitutionalism, the paper is intended to challenge Walker to state his own position more forcefully and to develop further his insight concerning the irresolvable tension in the iterative relationship between constitutionalism and democracy.
