To address the potential of public policy on the governance of OARs it is necessary to define what is meant by public policy and the importance of public policy in designing an efficient governance framework. Critical components are the subject matter of public policy and its objectives. Hence, it is useful to consider declarations, policies and statements in relation to open access practice and examine the efficiency of these arrangements towards the improvement of stakeholders’ engagement in governance of OARs. Secondly, policies relating to dissemination of scientific information via OARs should be examined. In this regard, it is relevant to consider the public policy basis for Intellectual Property (IP) laws that concerning the utility of OARs. Therefore, economic theories relevant with the role of IP laws should be examined. Such examination depicts to what extend these laws facilitate the utility of OARs. In order to specify justifications for the desirability of OARs the objectives of social theories should be also considered. Thus, there is consternation that without legal protection against copying the incentive to create intellectual property will be undermined. As scholarly communication infrastructure evolves, it is necessary to recognize the efforts of the relationship between Intellectual Property Rights (IPRs) and communication technologies in the context of public policy and after engagement with it. After employing such multilevel approach, the paper argues about a socio-economic framework to enhance the governance of OARs through public policy. |

This article relates criminological research on youth delinquency to the social development of adolescents. Starting point is a goal-framing approach which assumes that young people aim for the achievement of two goals: status (‘getting ahead’) and belonging (‘getting along’). Peers form an important context for achieving these goals. Therefore, the role of delinquency in peer networks is examined: on the one hand, the extent to which delinquency contributes to peer status, and on the other hand, how delinquency contributes to the formation of network relationships and, vice versa, how network relationships influence adolescents’ delinquency. Finally, several directions for further research are discussed. |

Multi-national corporations are increasingly facing attention and disapproval by different actors, including authorities, public and (non-) commercial organizations. Digital globalization and especially social media as a low-cost, highly interactive and multidirectional platform shape a unique context for this rising attention. In the literature, much attention has been devoted to top-down approaches and strategies that corporations use to avoid stigmatization and sanctioning of their behaviour. Reactions to corporate harm are, however, seldom researched from a labelling perspective. As a result, corporations are not considered as objects towards whom labelling is targeted but rather as actors who hamper such processes and who, as moral entrepreneurs, influence which behaviour is labelled deviant. Based on theoretical analysis of literature and case studies, this article will discuss how the process of labelling has changed in light of the digitalized, late-modern society and consequently, how the process should be revisited to be applicable for corporate deviance. Given a diversification of moral entrepreneurs and increasingly dependency of labelling and meaning-making on the online sphere, two new forms of labelling are introduced that specifically target institutions; that is bottom-up and horizontal labelling. |

Voor deze editie van het estafette-interview spraken Rein Halbersma en Karin van Wingerde namens de redactie van Tijdschrift voor Toezicht met Hanzo van Beusekom. Van Beusekom trad in juni 2018 toe tot de raad van bestuur van de Autoriteit Financiële Markten (AFM), waarvoor hij eerder tussen 2003 en 2010 ook al werkzaam was. Binnen het bestuur van de AFM is hij verantwoordelijk voor domeinoverstijgend toezicht en voor vernieuwing. Hij ziet het als zijn belangrijkste opdracht om het toezicht van de AFM meer data- en technologiegedreven te maken. Halbersma en Van Wingerde spreken met Van Beusekom onder meer over zijn terugkeer naar de AFM, over de kernwaarden van de AFM en over de uitdagingen waarvoor toezichthouders zich gesteld zien in een toenemende globale en digitale wereld. |

Whereas the starting point of victimisation is clearly marked by a co-occurence of harm and wrong, the end of victimhood is not as straightforward. What is more, because victimisation is a social construct, the label of ‘victim’ is established in social interaction, meaning that third party observers have a role in the understanding of the (limits of) victimisation. In this article, I suggest that third party observers may understand attempts at restorative justice, more specifically, an apology, as an indicator of recovery of the victim. If this is true, they may expect the victim to decrease emotional display that signals victimisation after receiving an apology. If the victim continues to display similar signals of victimisation, this may result in negative victim-oriented responses. In an exploratory repeated measures vignette study, I show that third party observers evaluate the victim less positively after the victim received an apology than before they received this apology. The results imply that in understanding the (limits of) victimhood, we should consider the dynamics between victim and offender but also a broader circle of third-party observers. This is also important for restorative justice. |

This contribution places the provisions of the Treaty creating a free trade area and customs union between the Member States (Articles 28-31 TFEU) in their wider context. It then focuses on the interpretation of Article 30 in the jurisprudence of the Court of Justice of the European Union (CJEU). Throughout, it casts sideways glances at corresponding provisions of General Agreement on Tariffs and Trade (GATT). As it turns out, the abolition of customs duties and charges having equivalent effect, and the establishment of a customs union between Member States, were important milestones in the development of European unification. They became overshadowed later by more spectacular developments in the case law on the free movement of goods, persons and services. As a consequence, the importance of the customs provisions is widely underrated. Brexit concentrates the minds in this respect, as an important economy is about to rearrange and even recreate the basic building blocks of its international trading relations. |

This paper uses Stoic theory of language to gain more insight into Roman lawyer Proculus’s legal opinions on the meaning and understanding of ambiguous testaments, wills and dowries. After summarizing Stoic theory of language, the paper discusses its reception in Roman jurisprudence and situates Proculus in a Stoic legal/philosophical context. The meat of the article lies in the re-examination of Proculus’s legal opinions on ambiguities in light of Stoic theory of language, through: (1) the analysis of a case demonstrating that Proculus’s embeddedness in Stoic doctrine went beyond his technical competence in propositional syllogisms, going into the territory of Stoic physical materialism and, (2) the investigation of four cases that reveal how his approach to problems of ambiguity in unilateral legal acts converges with the Stoic conception of the parallelism between speech and thought. |

The present article examines the financial life of 131 jihadi travellers (JTs), also known as foreign terrorist fighters, from the Netherlands. For the purpose of the research, access was acquired to all their banking transactions in the year preceding their departure: over 60,000 transactions in total. Their income from work or employment, various forms of social assistance, student grants, and other income or expenditure were examined. The data provided a good picture of their financial independence, i.e., the extent to which they were capable of making their own living or needed to claim assistance from the authorities. The analysis shows that it is highly exceptional for Dutch JTs to be financially independent. Only 5 percent have sufficient income from work or employment without making any claims on the government for financial assistance, and are free of mounting debts. The low score can for a large part be explained by the fact that almost half of the JTs are under 23 years of age and/or receive a student grant. Their financial picture largely resembles ordinary students. Older JTs (over 22 years of age, and not having received a student grant for at least one year) underperform, however. Only 9 percent are financially independent. Financial support could perhaps be used to monitor or steer recipients’ role in society. |

Op 17 december 2018 verscheen de nieuwe Richtlijn tot vaststelling van het Europees wetboek voor elektronische communicatie in het Publicatieblad. Op diezelfde dag werd ook de nieuwe Berec-verordening gepubliceerd, die ook op 20 december 2018 in werking trad en rechtstreeks toepasselijk is, dus geen omzetting behoeft in de nationale rechtsorde. Veel is vertrouwd en is alleen in een ander jasje gestoken, maar daarnaast zijn er veel detailaanpassingen waarvan het afwachten is wat die gaan betekenen. Hoe dan ook zal dit nieuwe Europese telecomkader tot aanpassingen in de Nederlandse Telecommunicatiewet leiden. In deze bijdrage wordt ingegaan op de totstandkomingsgeschiedenis van het Europees wetboek en de belangrijkste inhoudelijke wijzigingen voor de praktijk. Ingegaan wordt op de connectiviteitsdoelstelling en het realiseren van zeer snelle vaste en mobiele netwerken, marktregulering, toegangsverplichtingen, universele diensten, eindgebruikersbescherming, nieuwe tariefregulering voor internationaal bellen en het institutioneel kader. |

When it comes to learning, mapping turns out to be an effective tool. There is a wide variety of information maps, such as mind maps, argument maps and concept maps. This paper develops a teaching method that puts mapping at the centre of a seminar. It builds upon ideas of cognitivism and constructivism. The proposed didactic method incorporates a new variant of mapping, Basic Building Blocks Map (BBB Map), with a specific style of teaching. It is argued that this teaching method leads to engaged and active student participation. By dividing the subject up into small pieces and searching for answers to questions interactively, the student will learn more effectively. The paper concludes by providing teachers tools to put the method of BBB Mapping into practice. |

The Life In Custody-study is a large scale, prospective panel study, aimed to examine the quality of prison life in The Netherlands. This paper describes the LIC-study by giving a detailed overview of the data collection procedure, and strategies to optimize response, and presents the first nationwide results on prison climate in The Netherlands. Results show that the data collection procedures utilized were successful in obtaining a high response rate (which was an exceptional 81%) and reaching a representative group of prisoners. Furthermore, results show that the perceptions of prison climate vary across prison regimes, and to a lesser extent across age groups and time spent in detention. |

The basics of how to conduct participant observation are not taught in law schools. This is striking because this methodology has become a common feature of qualitative research and could be very useful in sociolegal research. For those interested in studying ‘law in practice’ instead of ‘law in the books’, qualitative research methods like participant observation are inevitable. However, participant observation is, at best, secondary in the literature on qualitative research in the sociolegal discipline, while there is no guidance on how to conduct this technique whatsoever.Therefore, this article is written with two audiences in mind: It should serve as a useful reference and guide for those who teach qualitative research methods in legal education and who are looking to enhance their knowledge and skills concerning participant observation; it is also meant to serve as a basic primer for the beginning sociolegal researcher who is about to become a participating observer for the first time. |

In legal education, criticism is conceived as an academic activity. As lecturers, we expect from students more than just the expression of their opinion; they have to evaluate and criticize a certain practice, building on a sound argumentation and provide suggestions on how to improve this practice. Criticism not only entails a negative judgment but is also constructive since it aims at changing the current state of affairs that it rejects (for some reason or other). In this article, we want to show how we train critical writing in the legal skills course for first-year law students (Juridische vaardigheden) at Vrije Universiteit Amsterdam. We start with a general characterization of the skill of critical writing on the basis of four questions: 1. Why should we train critical writing? 2. What does criticism mean in a legal context? 3. How to carry out legal criticism? and 4. How to derive recommendations from the criticism raised? Subsequently, we discuss, as an illustration to the last two questions, the Dutch Urgenda case, which gave rise to a lively debate in the Netherlands on the role of the judge. Finally, we show how we have applied our general understanding of critical writing to our legal skills course. We describe the didactic approach followed and our experiences with it. |
