    There is casuistry, where on the one hand it is the turn of the professionals from the investigation, enforcement and prosecution and on the other hand the turn of the social workers from the social domain. This is the case, for example, when domestic violence occurs in circles that are also involved in organized crime. In theory it is possible that the professionals involved work together, but it is also not impossible that they will get into each other’s waters because they have a different vision of the problem to be tackled and, of course, also have to fulfill other roles and tasks based on their positions. A professional must be able to handle complex situations of this kind.

Experiencing aggressive incidents by forensic clients, continuous tensions in contact with clients and the confrontation with narratives about shocking events are specific characteristics of working in the forensic field that appeal to the resilience of professionals. This article discusses which characteristics of organisations, teams and individual professionals impact on resilience and how it can be enhanced.

    Background: In many European countries caring responsibilities are being reallocated to the older people themselves to keep the welfare state affordable. This policy is often legitimized with reference to the ethical principle of autonomy. Older people are expected to be autonomous, have freedom to make their own decisions, and be self-reliant and self-sufficient as long as possible.
    Aim: The purpose of this article is to explore whether and how older people can remain autonomous in order to continue living their lives in accordance with their own values in the context of declining professional caring facilities and shrinking social networks, and which concepts of autonomy can guide professionals and other involved parties in facilitating the choices of older people.
    Method: An empirical-ethical approach is used to interpret the moral values enacted in the caring practice for older people. Two cases are presented. One is the narrative of a woman who lives by herself; she has been hospitalized after a fall and hip fracture, but does not want to be operatied. The second is the narrative of man living in a residential home; he wants to be actively involved, doing good deeds like he always did as a Scout. The cases are evaluated with the help of two concepts of autonomy: autonomy as self-determination and relational autonomy.
    Results: In both cases the enactment of autonomy remains problematic. In the case of the woman there was not enough care at home to live up to her own values. After she was admitted to a hospital her wish not to be operated was questioned but ultimately honoured due to compassionate interference by close relatives and her oncologist. In the second case there was not enough space for the man to lead his life in the way he always had; his plans for improving the social environment in the care home were torpedoed by management and ultimately the man decided to step back.
    Conclusion: In order to do justice to the complexity of each empirical case that involves autonomy of an older person more than one concept of autonomy needs to be applied. Relying on self-determination or relational autonomy exclusively will give professionals and all involved parties a restricted view on the situation, where the wishes of older people are at stake. In both cases autonomy was overruled by system procedures and stereotypical ideas about old people as being weak and not able to make their own decisions. Both cases show, however, that older people - even if they are physically and mentally frail - long to remain morally responsible for the direction their lives are taking, in accordance with their own values. They communicate their wish to determine their own future and at the same time they are interdependent on others to realize their (relational) autonomy and require support in their attempt to maintain their identity. This conclusion has implications for the normative behaviour of the professionals who are involved in care and treatment of older people.

    Achtergrond: In veel landen wordt de verantwoordelijkheid voor de zorg voor ouderen naar de ouderen zelf verplaatst, dit teneinde de welvaartstaat betaalbaar te houden. Dit beleid wordt veelal gelegitimeerd met referentie naar het ethische principe van autonomie. Oudere mensen worden geacht autonoom te zijn, vrij te zijn om hun eigen beslissingen te nemen, en om zo lang mogelijk zelfredzaam te blijven.
    Doel: Het doel van dit artikel is om te onderzoeken of en hoe oudere mensen autonoom kunnen blijven teneinde hun leven in overeenstemming met hun eigen waarden te kunnen voortzetten in de context van teruglopende professionele zorgactiviteiten en krimpende sociale netwerken, en welke concepten van autonomie zorgprofessionals en andere betrokken partijen kunnen helpen bij het faciliteren van de keuzes door ouderen.
    Methode: Een empirisch-ethische benadering wordt gebuikt om de morele waarden in de zorgpraktijk voor ouderen te interpreteren. Twee casussen worden gepresenteerd. De eerste is het verhaal van een vrouw die op zichzelf woont. Ze is na een val waarbij haar heup is gebroken, in een ziekenhuis opgenomen, maar ze wil niet geopereerd worden. De tweede is het verhaal van een man die in een verzorgingshuis woont. Hij wil actief betrokken worden en goede dingen doen zoals hij die altijd heeft gedaan toen hij padvinder was. Beide verhalen worden met behulp van twee concepten van autonomie geëvalueerd: autonomie als zelfbeschikking en relationele autonomie.
    Resultaat: In beide casussen blijft de verwezenlijking van autonomie problematisch. In het geval van de vrouw was er thuis onvoldoende zorg om volgens haar waarden te kunnen leven. Toen zij in het ziekenhuis was opgenomen werd haar wens om niet te worden geopereerd tegen gehouden, maar uiteindelijk ingewilligd als gevolg van bemoeienis uit hoofde van barmhartigheid door directe verwanten en haar oncoloog. In het tweede geval was er voor de man onvoldoende ruimte om zijn leven te leiden op de manier zoals hij dat altijd had gedaan. Zijn plannen om de sociale omgeving in het verzorgingshuis te verbeteren werden door het management getorpedeerd en uiteindelijk heeft hij zich ervan teruggetrokken.
    Conclusie: Teneinde recht te doen aan de complexiteit van beide casussen die betrekking hebben op de autonomie van een oudere, dient meer dan één concept voor autonomie te worden ingezet. Het vertrouwen in zelfbeschikking of relationele autonomie alleen zal aan de professionals en alle andere betrokken partijen een beperkt zicht geven van de situatie wanneer het de wensen van ouderen betreft. In beide gevallen werd de autonomie ter zijde geschoven door protocollen en stereotypische ideeën over ouderen als kwetsbare personen die niet in staat zouden zijn om zelf hun beslissingen te nemen. Echter tonen beide voorbeelden aan dat ouderen, zelfs als ze fysiek en mentaal kwetsbaar zijn, de wens hebben om moreel verantwoordelijk te blijven voor de richting die hun leven zal nemen, in overeenstemming met hun eigen waarden. Zij geven de wens aan om hun eigen toekomst te bepalen en tegelijkertijd zijn ze onderling afhankelijk van anderen om hun (relationele) autonomie te verwezenlijken, én hebben ze behoefte aan steun bij hun poging om hun identiteit te behouden. Deze conclusie heeft gevolgen voor het normatieve handelen van professionals die bij de zorg en behandeling van ouderen betrokken zijn.

    A well-established body of epidemiological research suggests that the prevalence of mental health problems (mental disorders, psychological distress, and substance use) in prisoner populations far exceeds that of non-incarcerated people in the surrounding community. Poor mental health in prisoners is associated with multiple adverse outcomes, including suicidal behaviour. In the past decade, novel data in Belgium and the Netherlands have been published on this topic, which have not been synthesized to date. The aim of the current systematic literature review was to provide an up-to-date overview of the mental health of prisoners in Belgium and the Netherlands. Based on 24 empirical studies conducted in 1997-2018, the authors conclude that people with mental health problems are overrepresented in Belgian and Dutch prisons, providing both a challenge and a public health opportunity to address the mental health care needs of a vulnerable and hard-to-engage population. Investing in the prevention and treatment of mental health problems not only benefits the prisoners concerned, but equally, society at large.

    In legal education, criticism is conceived as an academic activity. As lecturers, we expect from students more than just the expression of their opinion; they have to evaluate and criticize a certain practice, building on a sound argumentation and provide suggestions on how to improve this practice. Criticism not only entails a negative judgment but is also constructive since it aims at changing the current state of affairs that it rejects (for some reason or other). In this article, we want to show how we train critical writing in the legal skills course for first-year law students (Juridische vaardigheden) at Vrije Universiteit Amsterdam. We start with a general characterization of the skill of critical writing on the basis of four questions: 1. Why should we train critical writing? 2. What does criticism mean in a legal context? 3. How to carry out legal criticism? and 4. How to derive recommendations from the criticism raised? Subsequently, we discuss, as an illustration to the last two questions, the Dutch Urgenda case, which gave rise to a lively debate in the Netherlands on the role of the judge. Finally, we show how we have applied our general understanding of critical writing to our legal skills course. We describe the didactic approach followed and our experiences with it.

    This article presents a perspective which focuses on the right to access information as a mean to ensure a non-discriminatory character of algorithms by providing an alternative to the right to explanation implemented in the General Data Protection Regulation (GDPR). I adopt the evidence-based assumption that automated decision-making technologies have an inherent discriminatory potential. The example of a regulatory means which to a certain extent addresses this problem is the approach based on privacy protection in regard to the right to explanation. The Articles 13-15 and 22 of the GDPR provide individual users with certain rights referring to the automated decision-making technologies. However, the right to explanation not only may have a very limited impact, but it also focuses on individuals thus overlooking potentially discriminated groups. Because of this, the article offers an alternative approach on the basis of the right to access information. It explores the possibility of using this right as a tool to receive information on the algorithms determining automated decision-making solutions. Tracking an evolution of the interpretation of Article 10 of the Convention for the Protection of Human Right and Fundamental Freedoms in the relevant case law aims to illustrate how the right to access information may become a collective-based approach towards the right to explanation. I consider both, the potential of this approach, such as its more collective character e.g. due to the unique role played by the media and NGOs in enforcing the right to access information, as well as its limitations.

    This article introduces the concepts of play and playfulness within the context of legal-philosophical education. I argue that integrating play and playfulness in legal education engages students and prepares them for dealing with the perpetual uncertainty of late modernity that they will face as future legal professionals. This article therefore aims to outline the first contours of a useful concept of play and playfulness in legal education. Drawing on the work of leading play-theorists Huizinga, Caillois, Lieberman and Csikszentmihalyi, play within legal education can be described as a (1) partly voluntary activity that (2) enables achievement of learning goals, (3) is consciously separate from everyday life by rules and/or make believe, (4) has its own boundaries in time and space, (5) entails possibility, tension and uncertainty and (6) promotes the formation of social grouping. Playfulness is a lighthearted state of mind associated with curiosity, creativity, spontaneity and humor. Being playful also entails being able to cope with uncertainty. The integration of these concepts of play and playfulness in courses on jurisprudence will be illustrated by the detailed description of three play and playful activities integrated in the course ‘Introduction to Legal Philosophy’ at the Vrije Universiteit Amsterdam.

    Studies have shown that the effects of scientific research on law and policy making are often fairly limited. Different reasons can be given for this: scientists are better at falsifying hypothesis than at predicting the future, the outcomes of academic research and empirical evidence can be inconclusive or even contradictory, the timing of the legislative cycle and the production of research show mismatches, there can be clashes between the political rationality and the economic or scientific rationality in the law making process et cetera. There is one ‘wicked’ methodological problem, though, that affects all regulatory policy making, namely: the ‘jump’ from empirical facts (e.g. there are too few organ donors in the Netherlands and the voluntary registration system is not working) to normative recommendations of what the law should regulate (e.g. we need to change the default rule so that everybody in principle becomes an organ donor unless one opts out). We are interested in how this translation process takes place and whether it could make a difference if the empirical research on which legislative drafts are build is more quantitative type of research or more qualitative. That is why we have selected two cases in which either type of research played a role during the drafting phase. We use the lens of the proportionality principle in order to see how empirical data and scientific evidence are used by legislative drafters to justify normative choices in the design of new laws.

    Legal doctrinal scholarship engages with the problems of legal practice: it systematizes, comments on, evaluates and debates what goes on in law. These activities do not occur in a vacuum: they are embedded in scholarly traditions and theories. This paper discusses the role of the theoretical frameworks used in legal research and has two related aims. First, it aims to provide some practical conceptualizations and guidelines regarding theoretical and normative frameworks that are useful to understand and conduct legal research. Second, it aims to investigate the relationships between different kinds of normative frameworks and their relationship to empirical work. In the second part, an argument is made for a pragmatist understanding of the interplay between normative theorizing and empirical study. How do these work together in judgments about the state of the law?

    The aim of this article is to examine the differences in perception of ‘fairness’ between developing and developed countries, which influence developing countries’ willingness to embrace the Base Erosion and Profit Shifting (BEPS) proposals and to recommend as to how to overcome these differences. The article provides an introduction to the background of the OECD’s BEPS initiatives (Action Plan, Low Income Countries Report, Multilateral Framework, Inclusive Framework) and the concerns of developing countries about their ability to implement BEPS (Section 1); a non-exhaustive overview of the shortcomings of the BEPS Project and its Action Plan in respect of developing countries (Section 2); arguments on why developing countries might perceive fairness in relation to corporate income taxes differently from developed countries (Section 3); and recommendations for international organisations, governments and academic researchers on where fairness in respect of developing countries should be more properly addressed (Section 4).

    This study investigates the effect of providing information about decision making on aggression of clients of the Dutch Employee Insurance Agency (UWV). The expectation is that providing adequate information leads to a decrease in aggression, because it influences feelings of informational justice and frustration. UWV-clients (N=1.415) participated in an experimental scenario study (adequate vs. limited information providing). Next to aggression, psychological, UWV and social demographic characteristics were measured. Compared to limited information, receiving adequate information results in lower aggression. Clients with more negative affect show more aggression, but receiving adequate information especially reduces aggression in these clients.

    Existing conceptualizations of the demos fail to treat issues of composition and performativity consistently. Recent literature suggests that both aspects are required in a satisfactory account of the demos. An analysis of this literature suggests several desiderata that such an account must meet. I approach the definition of demos with a conceptual framework derived from Margaret Gilbert’s plural subject theory of social groups. I propose an account of demos as a plural subject, constituted by joint commitment. This account offers an improved and consistent understanding of normativity, composition, agency, and cohesion of demos.

    Surinamese and Dutch Caribbean migrants have been overrepresented in (official) Dutch crime statistics for years. From Hirschi’s Social Control Theory and the Theory of African-American Offending, this study investigates to what degree racism based on skin color is related to self-reported offending among Surinam and Dutch Caribbean migrants in The Netherlands. A total of 91 online questionnaires were filled out regarding skin color, experiences with racism, and offending. Results show that darker-skinned respondents experienced more racism and that more racism was reported by the respondents who committed more offenses; especially regarding violent and drug-related offenses.

    This article discusses the importance of reflection for prison staff. Their work is both physical and emotionally incriminating. That increases risk on turnover, burn-out, psychosomatic diseases and negative experiences with prisoners. To render all challenges in their work it’s important to build up resiliency. One of the means to stimulate resilience is organized reflection. It is described how guided by experts, reflecting on own experiences can contribute to resilience of prison employees and strengthen their learning capacity. That is done by literature study and a description of experiences with organized reflection in PI Vught.

    This article presents an overview of the legal regime provided in the Spanish system of criminal sanctions regarding the control of dangerous sex offenders in the community. It focuses on the introduction, in 2010, of a post-prison safety measure named supervised release. We describe the context of its introduction in the Spanish Criminal Code, considering the influence of societal upheaval concerning dangerous sex offenders in its development, and also the historical and theoretical features of the Spanish system of criminal sanctions. We also analyse the legal framework of supervised release, the existing case law about it and how the legal doctrine has until now assessed this measure. After this analysis, the main aim of this article consists in evaluating the effectiveness and the proportionality of the measure, according to the principle of minimal constraints and the rehabilitative function of the criminal sanctions in Spanish law, stated in Article 25.2 of the Spanish Constitution.
