    The draft of the Dutch Whistleblower Protection Act that is currently discussed in Parliament can be regarded as an essential step forward in the protection of whistleblowers. However, it can be questioned if the Act will contribute in an optimal manner to the ideal of transparency and the fight against the abuse of power, which should be the main goal of the Act. The tasks and powers of the new House for Whistleblowers are rather unclear and they do not meet legal standards. The combination of advice and support to whistleblowers and independent research into major violations of integrity should be abolished.

    As a result of the democratization of technology we now seem to live in an era of ‘Wiki-regulation’. Increasingly transparency is considered to be the universal solution to all sorts of problems. In line with this dominant viewpoint there has been a proliferation of whistleblower initiatives in recent years. A newly established Dutch initiative is Publeaks. Launched by a large number of Dutch media outlets and aimed at protecting whistleblowers, shedding light on wrongdoings and encouraging investigative journalism, Publeaks is a website ‘for people to leak documents to the media securely and anonymously’. In this opinionated article the authors propose three arguments against this particular form of whistleblowing: the protection against unfunded accusations, the negative side effects of ‘scandal overkill’, and the value of non-transparency.

    The Advice Centre for Whistleblowers in the Netherlands (het Adviespunt Klokkenluiders) opened on 1 October 2012 and offers independent and confidential advice to (potential) whistleblowers. Even though the Advice Centre opened only recently, this article gives an overview of the findings of the Advice Centre up-to-date, because of its relevance for the public debate on whistleblowers. The article inter alia mentions the number of whistleblowers that needed advice from the Advice Centre, the sectors where they work(ed), the types of wrongdoing involved in the cases and it describes the questions and dilemmas of whistleblowers who approached the Advice Centre. The article also points out how the Advice Centre could help persons with raising their concern about possible wrongdoing or malpractice in the workplace.

    The private member’s bill ‘Huis voor klokkenluiders’ is a step forward in the protection of whistleblowers in The Netherlands. However, adoption of the bill will not end the discussion about the protection of whistleblowers, because the bill has several flaws. The new ‘Huis’ has too many roles, the ‘Fonds’ provides the wrong incentives, and whistleblowers who go straight to the relevant authorities are not protected. Therefore, the next step should be a general Whistleblowing Protection Act, which provides legal protection, both to public and private employees who report serious organizational deviances to the relevant authorities and who, in doing so, have acted with due care. Enforcement of the Act, including the award of compensation, should be provided by the industrial law courts and not by a ‘Huis’ or a ‘Fonds’.

    Whistleblowing and whistleblowers have received a lot of attention over the last decade, not just in popular discourse, also in academic research. So by now we know a lot about ‘the’ whistleblower; internal reporting procedures received less attention. That is remarkable, because from previous research we know that by far most reports of wrongdoing are (first) reported internally. Reporting in line seems the most logical step for most observations, but how well are Dutch public managers handling these reports, and what are the experiences of and with so-called confidential integrity advisors? The authors’ main research question is: How does the internal reporting system function in the public sector, and what improvements are possible? Here the authors answer these questions based on a survey conducted among Dutch civil servants, which was filled out by 7,543 respondents and on 25 in-depth interviews with confidential integrity officers.

    National governments have adopted a variety of approaches to the protection of whistleblowers. This article refers to examples in Slovenia, the United Kingdom and the United States of America, and ongoing work in Ireland, the Netherlands and Serbia. It is not always clear what would count as success, but none of the existing laws appears to have wholly achieved its aims. The Council of Europe aims to establish some common ground in Europe by drafting a Recommendation which will establish principles on which Member States should draft laws and establish systems. This article considers the work done so far on the draft Recommendation, discusses some of the most important and problematic aspects, and suggests improvements.

    This article seeks to aid understanding of the ways in which different policy purposes, approaches and legal options can be combined in the design of better legislation, using Australia’s recently passed Public Interest Disclosure Act 2013. It provides a guide to key elements of the new legislation, as an example of legislative development taking place over a long period, informed by different trends. In particular, it is one of the first national laws to seek to integrate divergent approaches to the ‘anti-retaliation’ model of whistleblower protection, including its place in the employment law system, it sets new standards for the role of ‘public whistleblowing’ in such a regime, and provides new responses on basic questions of coverage, including which individuals are able to gain the benefit of the legislation. This provides lessons as to how different legal approaches might be better integrated, in pursuit of a clearer understanding of the interface between whistleblowing and other integrity reforms.

    Whistleblowing research should more explicitly focus on underlying motives for the decision to report on organizational misbehavior. Arguably, these motives are connected to the factors that can explain the decision whether or not to blow the whistle. Reporting for egoistic reasons can probably be explained by other factors than reporting for altruistic reasons. This article aims to enrich the whistleblowing literature by proposing grid-group cultural theory as an alternative approach. This theoretical framework could provide more insight into reporting decisions by identifying various motives for such decisions and linking them with elements in the organizational culture that could explain them. As an illustration, the theory is applied in an ethnographic study in two investigative teams of the Belgian federal police. More research is, however, needed to fine-tune the conceptual framework and to test the preliminary findings of this empirical study.

    This article focusses on the share of Roma in the labour migration from Eastern and Central Europe to the Netherlands. By combining European reports on the situation of what is Europe’s largest minority group with insights from Dutch migration studies push and pull factors are identified as well as the mobility patterns of Roma involved in the process of migration. Attention is also paid to the ‘when and how’ of the Dutch response (‘agenda setting’) – at home and in the European context – to the growing importance of the Roma issue in Europe. As an example the position of Bulgarian Roma in larger cities like Rotterdam is explored further.

    Recent labour migration from Central and Eastern Europe has, next to positive economic facets, also negative aspects like nuisance. This article describes the nature of this nuisance and the circumstances causing this. According to key informants who have been interviewed for this study, the nuisances discussed in this article pertain to only a small part of the labour migrants. The nuisance related to labour migrants from Central and Eastern Europe mostly consists of loud ‘noises of living’ around the home and in public space. Considering the nuisance, the following aspects seem to be part of the cause: thin-walled houses and the (illegal) letting per room; poor commitment to the neighbourhood due to temporary stay; quarrels and acts of violence between labour migrants and excessive drinking; lack of privacy and therefore meeting in public space; and housing in neighbourhoods with an accumulation of social issues. In this article the authors describe these aspects and their occurrence.

    This article describes the migration history of the Netherlands after World War II. The emphasis is on labour migration as the article seeks to clarify that the inflow of foreign labour had a large impact on the magnitude and the course of migration flows towards and from the Netherlands. This is quite obvious for the period in which labour migration was the most important immigration type. However, this article also deals with the influence of labour migration of earlier periods on other migration types, which became the most important immigration types from the first oil crisis of 1973. Next to the immigration history, the inflow of foreign labourers also affected the emigration history of the Netherlands to a certain extent.

    This article describes the social position of Central and Eastern European (CEE) migrants in the Netherlands, in particular their labour and housing position, using the results of recent Dutch research by three different groups of scholars. We cannot speak of a homogeneous group of migrants. The prevailing image of the hard-working labour migrant, doing low-qualified and often low-paid work (even though many of them are highly skilled) and faced with poor working and living conditions is largely confirmed by the available research. However, there are also knowledge workers (‘kennismigranten’) among the migrants from CEE-countries working in the Netherlands. In addition, the authors also found partners and children of previous migrants from CEE-countries, and students. This diversity of the new group of migrants from CEE-countries forms a challenge for local governments to find appropriate instruments to lead integration on the right track.

    It is often overlooked that many migrants only stay temporary in the host country. From a policy view the question as to what extent labour market performance affects the decisions of migrants to return to their home country is highly relevant. Based on data on recent labour migrants to the Netherlands this question is investigated. From the host country perspective it is positive that unemployment and low income shorten the duration of stay. This implies that the overconcern by host countries being burdened by welfare seekers is unfounded. However, high-income migrants are also more prone to leave. Thus, even when policies of attracting highly qualified labour migrants are successful, this won’t have a sustainable effect on the labour market in the Netherlands. These migrants usually don’t stay very long in the country, but either move on or return to their home country.

    Since 1995 the influx of labour migrants in the Netherlands has increased steadily from over 10.000 in 1995 to around 47.000 in 2011. As a consequence, from 2007, searching a job is the main migration motive of non-Dutch immigrants to migrate to the Netherlands. On average, one third of all labour migrants were women. Explanations for the fact that a minority of the labour migrants coming to the Netherlands are women can be derived from the literature. Possible reasons are gender patterns (in the Netherlands and/or the countries of origin) and differences in the personal networks of men and women. In addition, the Dutch labour migration policy, and in particular the conditions applying to labour migrants (in terms of education and employment sector) as well as the restriction on the right of family members of labour migrants to work in the Netherlands, may limit the influx of female labour migrants.

    While reflecting on gender issues transgender persons and their issues are often neglected. Government institutions on various levels don’t know how to handle their gender nonconformity as neither male nor female. Also they are often targets of inappropriate police and judicial measures. Transgender persons are often sceptical and cautious when interacting with those professionals: a fair and respectful treatment is not to be expected. In this article the author takes on to explore this blind spot. She presents the results of a survey on the transgender discrimination and violence by police and judicial institutions in Germany. The author points out that this is a result of the ongoing structural discrimination of gender non-conform persons in a binary gender system. This topic is part of her PhD thesis on the experience of discrimination and violence of gender non-conform persons in general. Her qualitative study is based on narrative interviews and a group discussion with gender non-conform persons in Germany.

    Some people are born as men, but feel like a woman; some feel like both a man and a woman; and some feel neither man nor woman. Similarly, there are people who are born as women, but feel like a men, etcetera. For these people, their birth gender and gender identity do not (completely) correspond. The Netherlands Institute for Social Research (SCP) studied the lives of these so-called transgender persons. 459 transgender persons filled out an online questionnaire between September 2011 and April 2012. Half the respondents knew before the age of 10 that their gender identity did not correspond with their birth gender. Almost a third of the respondents are still (mainly) living in the closet. Negative reactions are quite common. And compared with the rest of the Dutch population, transgender persons are much more often declared unfit for work and suffer much more often from mental health problems.

    This article sheds light on an aspect of honour-based violence (HBV) that is rarely addressed: male victimisation. HBV is usually regarded as violence inflicted on women by men. Police cases of male victimisation of HBV and scarce literature on this subject illustrate the ways in which men can become victims of violence. Men can be victimised in the same way that women are, for example when they commit adultery, are openly homosexual, or through conflicts about the choice of a partner. A specific and contested form of male victimisation occurs when their families pressure them to commit violence in order to restore family honour. Men are less likely than women to claim victim status and their victimisation of HBV is therefore possibly underreported. The authors do not argue to neglect female victims, but to expand hegemonic images of HBV and gender roles to include male victimisation. More insight into these matters is necessary to ensure the right support for each victim of HBV and to enable men and women to resolve these conflicts together.

    There are not only biological differences between men and women; there are also differences in social roles for men and women. In the 1970s the term ‘gender’ was introduced in order to make a distinction between the biological sex and the social roles ascribed to the sexes. But what does that term gender actually mean and what does it add to our understanding of social life in general and especially within the field of law enforcement? In the first part of the article a brief historical overview of the introduction of and debate on the gender concept is presented. The second part zooms in on the actual use of gender in (criminological) research on law enforcement.

    Early studies of female drug dealers suggest that women are marginalized, passive victims. In contrast, more recent studies describe women as skilful and competent dealers. In a Bourdieu-inspired theoretical framework of ‘street capital’, the authors suggest that the truth is somewhere in between. Female dealers can be successful, but they face more obstacles than men do. The illegal hard drug economy is gendered and favours men. In this paper the authors discuss how female drug dealers develop particular strategies to prove they still belong in ‘the game’. Four such strategies are emphasized: desexualization, violent posture, emotional detachment and service-mindedness. These are common strategies for all drug dealers, but the gendered economy forces female dealers to be particularly careful about their business and self-presentation.

    This article explores the way in which a stated lesbian, gay or bisexual orientation or (trans)gender identity can be assessed in asylum cases. Recently, the Dutch Council of State sought guidance from the European Court of Justice on this topic. Decisions in which an asylum claim is rejected, because the stated sexual orientation is not considered credible, are often based on stereotypes regarding LGBTs, as the ‘Fleeing homophobia’ research has shown. Illustrated by Dutch examples of stereotypical reasoning, the author elaborates on the pitfalls that should be avoided. She concludes that, as sexual orientation is an extremely personal characteristic, it is in fact not possible to assess someone else’s sexual orientation. Therefore asylum authorities should not try to develop their ‘gaydar’, but should rely on the self-identification of the asylum seeker instead.
