    The Employment Appeal Tribunal (‘EAT’) considers the Equality Act – and to some extent the Equal Treatment Directive – and gives guidance about harassment and victimisation claims as well as on principals’ liability for acts of their agents. In a decision that declines to expand the scope of harassment claims, the EAT has decided, in particular, that it is not enough for claimants alleging harassment to simply assert that they are disabled, without meeting the definition of disability or falling into another protected situation.

    Various forms of organized crime are concentrated in the Dutch province of North Brabant, bordering Belgium. In this essay it is argued that specific historic, geographic, social economic, cultural and social psychological factors created an enduring window of opportunity in which criminality can flourish. Brabant is portrayed as a marginalized province that suffered from war, exploitation by the central government, rural gangs, a lack of law enforcement, extreme poverty as well as from discrimination because of its mainly catholic population. Against this background the population developed a mentality of solving problems on their own. Their survival strategies implied not only legal activities like agriculture and small-scale production in private houses, workplaces and factories, but also smuggling and illegal alcohol production. In more recent times the production of synthetic drugs, growing cannabis and transport criminality became widespread.

    Previous research showed that job applicants with a criminal record have lower chances of obtaining employment compared to job applicants with no criminal record. At the same time empirical studies showed that having a job is especially beneficial for ex-delinquents, as employment was found to lower recidivism. The current study uses an experimental design to look into the influence of a criminal record on employment chances. For this purpose, 520 resumes and motivation letters were sent in response to vacancies published on the internet. All were identical except for the stated offence type (no offence, violent offence, property offence, or sexual offence), duration between conviction and application, business sector and ethnicity of the applicant. Results show no effect for type of offence or no offence on employment chances. However, a strong effect is found for ethnicity. Ethnic minorities with no conviction were even found to have lower chances of receiving a positive reaction compared to applicants with a Dutch name and a conviction for a violent offence.

    A claim for compensation for discrimination was not excluded simply because the applicant did not have the ‘objective qualifications’ necessary for the job. According to the German General Equal Treatment Act (the ‘Allgemeines Gleichbehandlungsgesetz’, or ‘AGG’), what is necessary for a compensation claim is a ‘comparable situation’. According to the latest decision of the German Federal Labour Court (the ‘Bundesarbeitsgericht’, or ‘BAG’) this can occur even if the applicant does not fulfill the general requirements to do the job.

    The Austrian Supreme Court has held that the selection of employees for redundancy because of their entitlement to an early retirement pension constitutes unfair dismissal on grounds of direct age discrimination. Although it was accepted that individual employers (here the Austrian Broadcasting Corporation) can pursue a legitimate aim within the meaning of Article 6(1) of Directive 2000/78/EC, the means to achieve that aim were not considered appropriate and necessary. The Court stressed that a balance must be struck between the interests of older and younger employees, taking into account that it is generally easier for younger employees to find a new job. In the case at hand, however, the employer had not managed to show that its redundancy selection programme met that requirement.

    A Spanish Supreme Court decision issued on 17 October 2016 (no. 848/2016) declares employee terminations void because the employer failed to respect the proper collective redundancy procedures based on the thresholds provided by EU Directive 98/59. The thresholds in the Directive refer to the number of employees at the establishment, whereas thresholds under Spanish law refer to the whole company. In implementing the Directive, Spanish law had aimed at being more favourable to employees, but this did not happen on the facts of this case.

    In a much publicised case, Uber drivers have won a first instance employment tribunal finding that they are ‘workers’ and not self-employed contractors. This decision means that they are entitled to basic protections, such as the national minimum wage, paid holiday (under the Working Time Directive) and protection against detriment for ‘blowing the whistle’ on wrong doing. The decision could have substantial financial consequences for Uber, which has around 40,000 drivers in the UK but Uber has already confirmed that it will appeal the decision, so we are unlikely to have a final determination on this question for some time.

    The Curia (Hungarian Supreme Court) stated in its ruling that length of service is not a protected characteristic under discrimination law. Length of employment cannot be considered as a core feature of the individual based on which he or she would belong to a specific group, as it is a result of his or her own actions. It therefore cannot be treated as a ‘miscellaneous’ ground for the purposes of the Hungarian Equal Treatment Act. Further, length of service cannot be linked to age discrimination. The length of service of an employee is not directly connected to age, therefore treatment of an employee based on length of service with a specific organisation cannot be considered age discriminatory.
    A claim based on discrimination must be supported by a comparator. Employees with different educational backgrounds and jobs with different the educational requirements, are not comparable for the purposes of equal treatment law.

Medische zorg aan irreguliere migranten: een status quo

    Nederland kent een financieringsregeling voor de verlening van medisch noodzakelijke zorg aan mensen zonder rechtmatig verblijf (‘irreguliere migranten’). Op papier lijkt deze regeling op orde. In de praktijk staat het internationaal erkende recht op zorg van de irreguliere migrant echter onder druk. De overheid pareert kritische signalen door structureel te verwijzen naar de vertrekplicht van de irreguliere migrant. Dit artikel bespreekt een aantal knelpunten rondom de toegang tot zorg van irreguliere migranten en sluit af met een pleidooi om op meer positieve wijze vorm te geven aan het recht op zorg van deze groep.

    Nederlandse kinderen lijken minder te weten over kinder- en mensenrechten dan andere kinderen in Europa. Om die reden zien beleidsmakers, wetenschappers en maatschappelijke organisaties een noodzaak om formele educatie op deze onderwerpen te introduceren in alle onderwijsniveaus. Wat denken middelbare leerlingen zelf hier echter over? Dit artikel onderzoekt het rechtsbewustzijn van kinderen in drie Nederlandse middelbare scholen ten aanzien van hun specifieke rechten als kinderen. Het wordt duidelijk dat kinderen ideeën en meningen hebben over hun rechten en daarmee een rechtsbewustzijn hebben, ook als zij geen rechtenjargon gebruiken. Hun rechtsbewustzijn bestaat uit moraliteit, wat verklaart dat zij bepaalde rechten zelf bedenken: sommige thema’s vinden zij zo belangrijk dat zij voelen dat ze deel uitmaken van hun fundamentele rechten als kinderen. Het integreren van mensenrechteneducatie in het schoolcurriculum zou een nodige, maar is een onvoldoende oplossing voor het ‘probleem’ dat voor ons ligt. Het is namelijk niet bewezen of meer kennis op deze onderwerpen ook leidt tot verandering van gedrag. De kinderen maakten namelijk ook bewuste keuzes om níet hun rechten in te roepen, maar om hun problemen anderszins op te lossen. Dit moet worden meegenomen om interventies effectief te laten zijn, zodat niet het tegenovergestelde van wat gewenst is, wordt bereikt. En effectieve interventies dienen daarnaast aan te sluiten bij het dagelijks leven van de kinderen. Volgens de leerlingen zijn kinderrechten vooral ook iets dat we moeten doen en oefenen.
    Dutch children seem to be less informed about children’s and human rights than their peers in other European states. Therefore, policy makers, academics and CSOs recognise a need to introduce formal education on these matters in all levels of schooling. But what do secondary school children themselves think about this? This article explores the legal consciousness of children in three Dutch schools on their specific rights as children. It has been evidenced that children have ideas and opinions about their rights and therefore have a legal consciousness, though without using the language of the law. Their legal consciousness consists of morality, which explains their ‘invention’ of certain rights: some themes are of such importance that they feel these are part of their fundamental rights as children. Integrating human rights education into the school curriculum may be a necessary, but is an insufficient solution to the ‘problem’ at hand. It has not been evidenced whether more knowledge changes their behavior. The children made informed decisions to not invoke their rights, and to solve their problems differently. Effective interventions need to take this into account in order to relate to their everyday lives and avoid having the opposite effect of what is intended. According to the students, children’s rights are mostly something to be done or practiced.
