    In Italië kunnen faciliterende beroepsbeoefenaars als louche notarissen, advocaten en rechters, en ook andere facilitators die een maffiaorganisatie ondersteunen zonder daarvan lid te zijn, worden vervolgd wegens ‘externe deelneming aan een criminele maffiaorganisatie’. Die strafrechtelijke aansprakelijkheid is controversieel en leidt al decennialang tot debatten in de rechtspraak en literatuur. Deze bijdrage bespreekt de ontwikkeling van de Italiaanse strafrechtelijke aansprakelijkheid wegens externe en ook interne deelneming aan een maffiaorganisatie, en vervolgens de vraag of facilitators van criminele organisaties naar Nederlands recht vervolgd (zouden kunnen) worden wegens algemene deelneming aan deelneming aan een criminele organisatie.

    Analysing the national legal framework in relation to the protection of pregnant employees and employees who have recently given birth or are breastfeeding, provisions which transposed the regulations of Directive 92/85/EEC and of the conclusions in case C-103/16, Jessica Porras Guisado – v – Bankia S.A. and Others, the Constitutional Court of Romania ascertained that the dismissal prohibition of a pregnant employee is strictly restricted to reasons that have a direct connection with the employee’s pregnancy status. As for other cases where the termination of the employment contract is the result of disciplinary misconduct, unexcused absence from work, non-observance of labour discipline, or termination of employment for economic reasons or collective redundancies, the employer must submit in writing well-reasoned grounds for dismissal.

    The Federal Labour Court (Bundesarbeitsgericht, “BAG”) has held that a works council must be provided with the documents necessary for carrying out its duties at any time on request. A works committee or another committee of the works council formed in accordance with the provisions of the Works Constitution Act (Betriebsverfassungsgesetz, “BetrVG”) is entitled to inspect the lists of gross wages. This right to inspect is not limited to anonymized gross pay lists. Data protection considerations do not dictate that the right is limited to anonymized gross payrolls. The processing of personal data associated with the right of inspection is permitted under the European General Data Protection Regulation (“GDPR”) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, “BDSG”).

    Tegenwoordig bestaat meer aandacht voor burgers die om uiteenlopende redenen niet goed in staat zijn om zich aan juridische normen te houden, in het bijzonder ook aan strafrechtelijke normen. Het gaat om mensen wier cognitieve vermogens tekortschieten en/of die een onderontwikkeld vermogen van zelfcontrole hebben. Deze ontwikkeling kan worden beschouwd als een zekere mate van erkenning dat de maatschappij – en de overheid in het bijzonder – medeverantwoordelijk is voor het scheppen van de bestaansvoorwaarden waaronder mensen zich kunnen ontplooien tot verantwoordelijke burgers. In dit artikel betoog ik dat deze gedeelde verantwoordelijkheid niet alleen geldt voor de ontwikkeling van de mentale capaciteiten die nodig zijn om de normen van het recht te kunnen volgen, maar ook voor het bieden van toegang aan burgers tot de materiële normen zelf.

    In de Nederlandse rechtspraktijk kan de rechter een beroep op een strafuitsluitingsgrond verwerpen als blijkt dat de verdachte een zekere mate van eigen schuld heeft, ondanks dat de (overige) voorwaarden zijn vervuld. In de literatuur worden bezwaren aangevoerd tegen deze pragmatische benadering en zijn alternatieve aansprakelijkheidsmodellen tot stand gekomen: eigen schuld als zelfstandig strafbaar feit en de actio libera in causa. In deze bijdrage worden beide modellen beschreven en vergeleken met de Nederlandse benadering.

    Voor het evenwicht tussen de staatsmachten, maar ook voor de ontwikkeling van internationaal recht, is de wijze waarop de nationale rechter zijn rol vervult van belang: gedraagt hij zich als rechtsvormer of als een rechtshandhaver? Zowel de legitimatie en vorming van het internationale recht als de handhaving van de internationale verplichtingen van de Staat op nationaal niveau zijn hiervan afhankelijk. Deze belangen worden bezien vanuit internationaal perspectief en uiteengezet aan de hand van recente jurisprudentie.

    This article examines the tension between the constitutional obligation of judges to uphold rules of positive law and possibly conflicting standards of conduct arising from professional-ethical values. The theoretical analysis will be illustrated by the case of Hungary, an EU member state experiencing rule of law challenges since 2010 and where the 2018-2019 criminalization of homelessness exemplifies the studied tension. Inspired by the theories of Philip Selznick and Martin Krygier, rule of law will be viewed as a value that requires progressive realization and context-specific implementation. By contextualizing the relevant Hungarian constitutional framework with the content of the judicial code of ethics and judicial practice, it will be shown how the legitimate space for Hungarian judges to distance themselves from legislation possibly in conflict with rule of law values is reduced. Theoretical suggestions for addressing such rule of law regressions will be made.

    A recent challenge to the constitutionality of the Irish Workplace Relations Commission (WRC) has failed. The applicant in the case at hand argued that the WRC was unconstitutional for two reasons: (a) that the WRC carries out the administration of justice in breach of the general constitutional rule that only the courts may administer justice; and (b) several of the statutory procedures of the WRC were so deficient that they failed to vindicate the applicant’s personal constitutional rights. The High Court of Ireland dismissed both arguments.
