Text and Data Mining (hereinafter, TDM) issue for the purpose of scientific research or for any other purpose which is included in the provisions of the new EU Directive on Copyright in the Digital Single Market (hereinafter, DSM). TDM is a term that includes Web harvesting and Web Archiving activities. Web harvesting and archiving pertains to the processes of collecting from the web and archiving of works that reside on the Web. In the following analysis we will elaborate briefly upon provisions in EU Copyright law which were discussed during the proposal for a new Directive on Copyright in the DSM as well as provisions which are included in the text of art.3 and art.4 of the new Directive 2019/790/EU per TDM. In addition, the following analysis presents legislation in very few EU Member States which pertains to TDM and preceded the rulings of Directive 2019/790/EU. Digital legal deposit remarkable examples from EU Member States are also presented in this paper. The example of Australia is also presented below hereto because it is one of the oldest and most successful worldwide. The National Library of Australia’s digital legal deposit is state-of-the-art.

This article relies on the premise that to understand the significance of Open Access Repositories (OARs) it is necessary to know the context of the debate. Therefore, it is necessary to trace the historical development of the concept of copyright as a property right. The continued relevance of the rationales for copyright interests, both philosophical and pragmatic, will be assessed against the contemporary times of digital publishing. It follows then discussion about the rise of Open Access (OA) practice and its impact on conventional publishing methods. The present article argues about the proper equilibrium between self-interest and social good. In other words, there is a need to find a tool in order to balance individuals’ interests and common will. Therefore, there is examination of the concept of property that interrelates justice (Plato), private ownership (Aristotle), labour (Locke), growth of personality (Hegel) and a bundle of rights that constitute legal relations (Hohfeld). This examination sets the context for the argument.

Cooperation by professionals dealing with cases of stalking by former partners is complex. First and foremost professionals should focus on a shared ambition in order to stop stalking. But in order to achieve that goal partners in safety and security should be in the clear regarding practical matters: how do they consult each other? What appointments are made? How is invested in the development of a mutual relationship and the understanding of each other’s tasks?

The structural vulnerability of the port of Rotterdam to organized crime is dealt with in this article from a broader, historical perspective. Using examples from ports in Italy and the United States, among others, the author shows how at the end of the last century local criminal groups managed to gain a dominant position in the handling of good flows. The author discusses various research reports that have been published over the years on the import of drugs into the port of Rotterdam and other European ports. Drug traffickers turn out to respond very flexible to stricter controls by simply moving to alternative ports or opting for transferring drug loads to small fast boats in open water. The author emphasizes that ports should not be studied as isolated transition points, but must be considered as nodes in networks that extend far inland and abroad. This is the only way to see the broader strategic and tactical options for stopping or reducing drug trafficking. In addition, attention must be paid to the problem of corruption among port workers, police and customs officers.

De accountancysector zit midden in een verandertraject dat moet leiden tot een duurzame gedrags- en cultuurverandering. Uit verschillende onderzoeken zou echter blijken dat de sector onvoldoende voortgang boekt. Dit baart de Minister van Financiën zorgen en daarom heeft hij de Commissie Toekomst Accountancysector (CTA) ingesteld. In deze bijdrage staat de auteur stil bij een drietal onderwerpen, die relevant zijn voor het onderzoek van de CTA naar de toekomst van de accountancysector. Dit betreft de taak en het plan van aanpak van de CTA, het rapport ‘Kwetsbaarheden in de structuur van de accountancysector’ van de AFM en de reacties bij de consultatie. Tot slot worden de voorlopige bevindingen van de CTA besproken.

For social scientists undertaking critical research on elites in organisational contexts securing access is a challenging exercise that may rely on the use of several access strategies over extended periods. This process is further complicated by the existence of research ethics frameworks that establish boundaries to access strategies, posing dilemmas on how to best balance access needs with a commitment to ethical practices. This article focuses on such dilemmas – or the ‘ethics of access’ – through a reflection on PhD fieldwork during 2016-2017 in Luxembourg spent researching the European Investment Bank. The paper will conclude by calling for an overhaul of existing frameworks in order to foster more research on elites.

Building on prior quantitative analyses by Rovers (1999) and Rovers and Boers (2009), the present article provides a quantitative overview of 60 years Dutch Journal of Criminology, with an emphasis on the period 1999-2018. Dutch criminology is beginning to lose sight of its first generation of researchers. Males still dominate the top 25 most published authors. A social network analysis of the co-author network on the one hand reveals a significant proportion of singletons. Many of the remaining authors on the other hand, are included in one giant component that links authors directly or indirectly by co-authorship.

Loïc Wacquant conducted ethnographic research in the ghetto of Chicago and describes the route to social mobility that black boxers try to follow as they train in the gym and build body capital. Based on similar research methods, this article compares the black boxers to two episodes of kickboxing in Amsterdam. Wacquant is not hopeful when it comes to social mobility of the boxers, as he sees their boxing careers as confirmation of their low position in society. In the first Dutch episode, kickboxers manage to combine body work in the gym with working in the nightlife economy. They make money but are unaware of the danger of getting involved in criminal activities, and a number of fighters end up in prison or even dead. Currently, kickboxing is very popular with young Moroccans. Having seen what went wrong in the previous episode, Moroccan trainers keep a close watch on their pupils, and make sure they realize that what happens outside and after kickboxing is what really matters.

In de Caribische gebiedsdelen geldt met betrekking tot kwesties van personen-, familie- en erfrechtelijke aard als geschreven regel van conflictenrecht dat het daarop toepasselijke recht het recht is van de ‘gewone verblijfplaats’ van betrokkene(n). Bij de praktische toepassing van deze algemeen geformuleerde regel rijzen de nodige vragen. In deze bijdrage worden de belangrijkste daarvan besproken, om vervolgens met enige handreikingen te komen inzake de omgang daarmee.
