    This article gives a complete and detailed overview of research evaluations and outcomes of restorative justice projects in the Netherlands over the past decades. It involves developments where clearly restorative justice inspiration was visible. The author describes restorative practices with juveniles and the so-called project ‘Herstelbemiddeling’ (restorative mediation) that started in the nineties. Most evaluations had positive outcomes, but nevertheless there was no continuation from the political side. The author also examines the introduction of the country wide ‘victim-offender conversations’ which are carried out by the national victim support organization. Although this choice is justified because of the vulnerability of some victims and the chance of revictimisation, the author questions if victim organizations can really - in the best interests of the victims – turn away from problems related to the (hardened) treatment of offenders. Victim-offender conversations are to be respected and to be continued, but they cannot be seen as a restorative justice practice.

    In this article, the author evaluates whether the development of restorative justice in Belgium over the past ten years offers an opportunity to ‘celebrate’, as the Journal for Restorative Justice does. Developments in practice show that mediation is available at all stages of the judicial procedure for adult offenders and mediation and conferencing are available according to youth law. Research has been carried out on various topics, covering a variety of practices. Furthermore, it has elaborated the concept of restorative justice, inspired innovative practices and influenced policy-making. Belgium seems to be peculiar in the relation between practice, research and policy, which tend to influence one another. Compared to the Netherlands, Belgium does have more reasons to celebrate the development of restorative justice.

    In the Netherlands victim-offender mediation is scarcely organized. However, the Dutch criminal procedure does offer possibilities for the implementation of mediation. In this article four modalities are discussed. At the stage of police investigation the police can refer parties to a mediation service. At the stage of the prosecution the public prosecutor can offer mediation as a condition for dismissal. When the case has been laid before a Court, the parties can involve in mediation after the proceedings have been stayed. The result of the mediation can then be taken into account by the Judge in the penal decision. When it comes to the more serious offences there should be possibilities for mediation at the stage of the penal execution. However, because of the contrasts between the principles of mediation and the criminal procedure, all of the modalities will have to find a balance between these principles.

    On 4 February 2011, after a period of 17 years, Migiel van Kinderen took formal leave as the Rotterdam ombudsman. In these 17 years he succeeded in introducing mediation as another and often more effective method of dealing with disputes between citizens and their government, despite the fact that there was no formal basis for settling this type of disputes through mediation. In the interview, the specific characteristics of this ‘ombudslike’ mediation are discussed.

    When a lawyer has his/her intake meeting with a client and ponders whether the case is to be taken to court or whether it is appropriate for mediation, different parameters have to be considered.
    Mr Green finds out that this photovoltaic installation does not produce the output initially guaranteed, and his lawyer will first have a look at the terms and conditions on guarantee and liability in the sales contract. The lawyer should consider time, cost, potential outcome and future relations between the parties, and compare these four parameters in a situation whereby proceedings in court are initiated with a situation whereby a mediation is started up. The assessment of each of these parameters in court proceedings and mediation is entirely different, and understanding these differences will assist in opting for court proceedings or mediation, or a combination of both. Reflexivity will be key.

    This article is a first report on the longitudinal study of forty Moroccan and Dutch criminal men. The research was started in 1982. The author returned to the subject in 1988. In 2008, the author started a new research project with the same men.
    The focus of this article is on the process of desistance. Ten men already ended their criminal period in the late eighties (the ‘early desisters’). In between time, two of them relapsed. Nine men can be called ‘late desisters’. They had many more obstacles to face in their re-integration, such as long-term employment and addiction to hard drugs. The combination of getting regular work, marriage and a permanent place of living is very effective in the process of desistance. But in the end, personal qualities, such as discipline, taking up responsibility and motivation, will be decisive.

    In recent years many changes occurred in procedural divorce law and divorce practice in the Netherlands. The bottomline of these changes is that divorcing partners themselves should settle the consequences of the divorce as much as possible by mutual agreement. The author describes how in the same period divorce mediation boomed, especially after the introduction in 2009 of the so-called collaborative divorce. This type of mediation is characterised by the presence of lawyers acting for each of the two parties and the line-up of a team of experts. In general the supply of divorce guidance has diversified substantially. It is important that clients are able to choose the form of divorce guidance that suits them best. Divorce mediators should have enough experience and knowledge to handle the psychological as well as the legal aspects of a divorce. Finally the chances of a good ‘after marriage’ are enhanced by ensuring access to affordable mediation for all divorcing couples.
