Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development. |

Hesdy Gerges is a heavyweight kickboxer whose career was interrupted because of his involvement in an cocaine transport. This article is analyzes the biography of this top fighter, describing the macro context of an expanding market for full-contact martial arts, the meso level of the gym and its relation to the criminal milieu, and the fighter and his body on the micro level. Hesdy is used to set an example, and since it takes more than seven years to reach a verdict, the impact on his private life and his career as a fighter is large. Welke toekomst voor herstelrecht in Brussel? |

SamenvattingAuteursinformatie |
This article critically examines the prospects of restorative justice in Brussels from the perspective of urban youth work. The insights issue from action research on the topic of ‘radicalisation’. The authors develop two arguments. The first tempers restorative optimism. It shows how restorative interventions are not necessarily the most adequate response to tensions and conflicts in urban settings. The second argument points out that resistance from urban youth workers regarding the implementation of restorative interventions should not be seen as a regrettable obstacle for academics who are eager to experiment with these interventions. Such a resistance can lead to new insights and fresh opportunities to radically rethink Restorative Justice. One of the ideas that the article brings to the surface comes down to this. In a city like Brussels, characterised by superdiversity, and clearly marked by social inequalities, academic researchers only gain credibility in initiating restorative interventions if they undeniably denounce these inequalities and fully express their engagement for social justice. |

Macht(eloos)Normalisering van seksueel grensoverschrijdend gedrag in de (top)sport |

Auteurs | Dr. mr. Anton van Wijk en Prof. mr. Marjan Olfers |
SamenvattingAuteursinformatie |
Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate. |

De ‘criminele sponsor’ van het lokale amateurvoetbal |

SamenvattingAuteursinformatie |
The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood. |

The focus of this article is on the role that football agents play in the world of professional football. Their role has also been associated with criminal activities such as money laundering, tax evasion, corruption and the exploitation of under-age players. The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football. |

Tijdschrift | PROCES, Aflevering 5 2020 |
Trefwoorden | sport, delinquency, desistance, probation, prison |
Auteurs | Dr. Lianne Kleijer-Kool, Dr. Jacqueline Bosker en Mr. Moniek Zuurbier |
SamenvattingAuteursinformatie |
The contribution of sport to reintegrating offenders receives limited attention, both in science and in the practice of probation and the prison system. From the perspective of desistance, this literature study concluded that sport can contribute to the development of individual capital, social capital and an alternative identity. However, the effect of sport is not necessarily positive. There are risks of negative influence or the reinforcement of problem behaviour. In counselling offenders, sport should be combined with other interventions to reduce recidivism. A personalized approach is required, based on the risk-need-responsivity model. |

Participatie onder drukMismatch tussen niet-westerse migranten en hulpverleners – acties tot betere allianties! |
Tijdschrift | PROCES, Aflevering 5 2020 |
Trefwoorden | Migration, acculturation, participation, cultural diversity, social work |
Auteurs | Dr. Youssef Azghari, Prof. dr. Janine Janssen en Dr. Christa Nieuwboer |
SamenvattingAuteursinformatie |
Two major shifts in the Dutch policy have changed how social professionals work for migrants. These two refer to the change from a multicultural in an assimilation policy and a participative society where people are more dependent on their network or resilience for dealing with their needs. Based on our exploratory interviews with eight professionals and a focus group of six participants with a non-western cultural background we conclude that what migrants expect from social professionals and what they can offer do not match. It is due to contrasting views and cultural differences. This has a negative impact on their participation. |
