In the Netherlands, over the past 25 years mayors have had an increasing number of formal powers, based on administrative law, to fight against crime and disorder. Now, the Dutch mayors have the power to impose a restraining order, to close houses in case of drugs and/or drugs trade, or to decline a request for a permit when it might be used for illegal activities.
To implement these measures, the local government is highly dependent on (information provided by) the police. At this moment we do not have much information about this cooperation between local government and the police in the management of crime and disorder. This paper is based on an empirical study concerning this issue. It shows that the inter-organizational cooperation between local government and the police may differ strongly, however this cooperation still often depends on central factors and circumstances. An important factor is the (growing) distance between the police and local government in regard to the local approach of problems of crime and disorder. A significant number of local police officers concentrates mainly on the maintenance of law and order by criminal law enforcement instead of the implementation of administrative measures. As a result, local government is often unsatisfied about the contribution of the police. For example, the quality of the information provided by the police is often perceived as insufficient. In some cases local governments try to diminish the degree of interdependency with the police and to strengthen their own position in the local safety domain.

In this article Tom Daems and René van Swaaningen discuss work and life of the late Dutch historian Pieter Spierenburg. The article is based on an interview the authors conducted with Spierenburg in November 2018 as well as his published work and excerpts of an unpublished biography. The article discusses in particular themes related to his interest in, and contributions to, the history of crime and punishment, in particular Spierenburg’s path-breaking book The Spectacle of Suffering (1984), his relation to Norbert Elias and the Amsterdam School and his critique of Michel Foucault.

There is casuistry, where on the one hand it is the turn of the professionals from the investigation, enforcement and prosecution and on the other hand the turn of the social workers from the social domain. This is the case, for example, when domestic violence occurs in circles that are also involved in organized crime. In theory it is possible that the professionals involved work together, but it is also not impossible that they will get into each other’s waters because they have a different vision of the problem to be tackled and, of course, also have to fulfill other roles and tasks based on their positions. A professional must be able to handle complex situations of this kind.

Een bestuurlijke aanpak van ondermijnende criminaliteit, al dan niet als onderdeel van een integrale aanpak, is in Nederland inmiddels gemeengoed. Toch bestaan er nog volop misverstanden over, die ook aanleiding geven tot niet altijd terechte kritiek. Het handhavingsinstrumentarium waarop deze aanpak is gebaseerd vinden we in alle landen terug. De mate waarin het wordt toegepast om (zware en georganiseerde) misdaad te bestrijden verschilt echter, al naar gelang de aard, ernst en de historie van die problematiek. Een bestuurlijke aanpak is een manier om hogere drempels op te werpen voor criminele bedrijfsprocessen, maar is geen afzonderlijk alternatief voor het strafrecht.

Zowel door het wetsvoorstel bestuurlijk verbod ondermijnende organisaties als door de verruiming van artikel 13b Opiumwet wil de regering de ondermijning aanpakken. Probleem is wel dat de politie nauwelijks geschoold is in de van het strafrecht afwijkende procesregels uit het bestuursrecht.

In deze bijdrage wordt in het kort het onderwerp van dit themanummer geïntroduceerd. In dit redactioneel wordt de invloed en betekenis van de criminologie voor de publiekrechtelijke rechtshandhaving verkend. Daarnaast wordt aan de hand van de verschillende bijdragen aan dit themanummer het speelveld van deze vorm van criminologie verkend.

Violence in the name of honour has an ancient ring to it. But honour codes tend to be very flexible: cyber-space has given a new dimension to honour-related violence. Images and messages that are perceived as violations of honour also pass through social media. Unfortunately these stings on the good name of the family are quite difficult to remove. In this contribution is explained how violations of honour occur on the internet. Next to that will be described how currently in the Netherlands criminal law especially regarding vice is being adapted in order to deal with phenomena like sexting and sextortion. What are the consequences of these changes for dealing with modern forms of the violation of family honour?

In the early years of kickboxing in the Netherlands, a number of fighters got involved in criminal activities. Literature typically focusses on social learning, but as the inner city of Amsterdam in the eighties provides a specific setting, this article particularly describes a historical process. In the qualitative data from interviews, observations, and various documents, three questions: Who were these kickboxers? Where did they enter the criminal circles? Why did they go along with what happened there? It turns out, successful fighters easily came in contact with people from the underground, as they met in the gyms and in the night life where many fighters worked as bouncers. In a friendly atmosphere, the risks of seduction were hard to recognize for inexperienced fighters.

In criminology, explanations for engagement in externalizing or criminal behavior are often found within the direct (social) environment of the individual. More specifically, family functioning, the quality of family relations and parenting strategies during childhood and adolescence are found to be related to the development of externalizing problems or criminal behavior over the life-course. Although less well studied, the opposite might also be true: externalizing problems or delinquency during childhood and adolescence may in turn also affect some important (family-related) transitions over the life-course, such as engagement in romantic relationships, the transition to parenthood, parenting strategies and broader family functioning. Not surprisingly, in life-course criminology there is increasing attention for familial similarities in externalizing and delinquent behavior. What underlies intergenerational continuity of criminal behavior? Under which circumstances behavior is continued over the course of generations? What is the role of the family? What is needed to break intergenerational cycles and facilitate earlier and more effective interventions? In this article, a literature review is provided on the role of the family in intergenerational continuity of externalizing or criminal behavior over the life-course and across generations.

In this introductory chapter we provide an overview of criminological research into intergenerational transmission of criminal behaviour that currently is, and has been, conducted both internationally and in the Netherlands. The most important findings of these studies are also discussed. Next, possible explanations are discussed for intergenerational transmission of crime in general, and more particularly for families that are involved in more serious and organized crime. Moreover, possible ways in which intergenerational transmission of crime can be prevented are discussed. Finally, we give some directions for future research on this topic and will introduce the contributions to this special issue.

In The Netherlands not much attention has been paid towards the relationship between domestic violence and organized crime. In this contribution the question is addressed why this is. One of the answers is that there is doubt about the moral status of the victim of organized crime: it assumed that the victim has benefited from the proceedings of organized crime. When domestic violence and involvement with organized crime by one of the family members come together, the case becomes more complex and difficult to deal with. For that reason professionals and researchers should pay more attention to the overlap of both phenomena.

Previous research on intergenerational continuity of crime is primarily focused on transmission from fathers to children. In this article, we aim to give insight in the role of mothers in (the prevention of) continuity of organized crime. The results of our explorative study on 25 organized crime offenders based in Amsterdam and their partners and children, show that parenting skills and norms and values of mother seem to have an important role in both the intergenerational continuity of organized crime and the prevention of the transmission.

Dutch police research is predominantly of a policy supporting or evaluative nature. Significant publications, such as those that started police research in the 1970s, are rare. This loss is analyzed in this article. Firstly, the author describes how the research community has changed: police officers who were disillusioned with the organization and mastered scientific competencies were succeeded by university-educated researchers who had to earn a position in the police. Secondly, the police integrated the societal urge for change, transformed it into a style of management and immunized themselves in this way against innovation. Thirdly, researchers exchanged social scientific theories for policy concepts, focusing on efficiency and excluding a societal perspective on the police. Finally, by recognizing the impact of research as a criterion of success, researchers relinquished their judgment on the quality of their research to police managers. Improvement of the situation depends first of all on the creativity and boldness of researchers.

Illegal weed cultivation is increasingly perceived as an important societal problem. Most of existing research in this area focuses on the criminal organisations active on the cannabis market and the criminal profits that are gained here. The current study however focuses on the actors at the bottom of the cannabis market – the home growers – and aims at answering the following research question: what factors influence the chance of encountering an illegal weed cultivation at a certain residential address? In this study, the risk and protecting factors are taken into consideration on both the individual level (e.g. family composition and financial position of residents) and the neighbourhood level (e.g. social cohesion, physical disorganisation, level of criminality in a certain neighbourhood). In the current study, data of 401 illegal hemp cultivation sites discovered between 2011 and 2016 in homes in Eindhoven, the Netherlands, were analysed. Data from various quantitative data sources – like municipal data (BRP and data from the Social Domain) and data from the municipal neighbourhood monitors – were combined and analysed through a multilevel logistic regression. The results suggest that the likelihood of an illegal weed cultivation site is most prominently influenced by individual factors. Being married for instance seems to decrease the risk, whereas being divorced seems to increase the risk. The housing type also turns out to be of influence. On a neighbourhood level, physical disorganisation and the presence of other hemp cultivation sites in the neighbourhood are the only predictors for hemp cultivation. The results are discussed in the light of criminological theories regarding participation in crime, using the theoretical concepts motivation, opportunity, and control.

The present article examines the financial life of 131 jihadi travellers (JTs), also known as foreign terrorist fighters, from the Netherlands. For the purpose of the research, access was acquired to all their banking transactions in the year preceding their departure: over 60,000 transactions in total. Their income from work or employment, various forms of social assistance, student grants, and other income or expenditure were examined. The data provided a good picture of their financial independence, i.e., the extent to which they were capable of making their own living or needed to claim assistance from the authorities. The analysis shows that it is highly exceptional for Dutch JTs to be financially independent. Only 5 percent have sufficient income from work or employment without making any claims on the government for financial assistance, and are free of mounting debts. The low score can for a large part be explained by the fact that almost half of the JTs are under 23 years of age and/or receive a student grant. Their financial picture largely resembles ordinary students. Older JTs (over 22 years of age, and not having received a student grant for at least one year) underperform, however. Only 9 percent are financially independent. Financial support could perhaps be used to monitor or steer recipients’ role in society.

By the end of 2020, the European Public Prosecutor’s Office (EPPO) will be operational. The EPPO will be tasked with investigating, prosecuting and bringing to judgement criminal offences against the EU budget. The substantive competence of the EPPO could in the future be extended to terrorism and other serious cross-border crimes. This article will first describe the background, structure and competences of the future EPPO. Then the procedural guarantees will be discussed and the problem of ‘forum shopping for evidence’. This problem entails that the choice in which Member State to conduct an investigative measure could be made on the basis of the less stringent rules in that Member State regarding, for example, the right to privacy. The article will end with a proposal on how to prevent forum shopping for evidence.

Door het Europees Parlement en de Raad van de Europese Unie is nieuwe wetgeving aangenomen om witwassen en terrorismefinanciering te voorkomen ten aanzien van wisselplatforms voor virtuele valuta en aanbieders van bewaarportemonnees. De afspraken maken deel uit van een grotere set aan maatregelen tegen financiële criminaliteit en belastingontduiking.
In dit artikel wordt besproken in hoeverre het risico op witwassen via virtuele valuta in Nederland adequaat wordt beheerst en of de aangenomen maatregelen van de EU hiervoor voldoende zijn.
