    In dit themanummer wordt bijzondere aandacht gegeven aan sanctiewetgeving. In dit redactioneel wordt ingegaan op de mogelijkheden om betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen aan te pakken, naast het gebruik van de Sanctiewet. Verkend wordt wat de aard en omvang van dit fenomeen is en welke juridische en niet-juridische middelen worden ingezet om de betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen te voorkomen en wat daarvan het effect kan zijn. Vervolgens zullen de beschikbare juridische middelen en quasi-juridische reacties en het gebruik daarvan worden geïnventariseerd. Ten slotte wordt gereflecteerd op de mogelijke effecten van het gebruik van deze instrumenten ter preventie van de betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen.

    The Austrian mediation landscape is quite inhomogeneous, with no universally applicable framework in place to safeguard best practice standards in mediation. Any commitment of mediators to codes of conduct or ethical guidelines occurs on an entirely voluntary basis. Control mechanisms exist in the form of complaint bodies instituted at the level of Austrian mediation associations.

    The notion of ‘sharia in the West’ is by now fairly well established, both in social, political and scientific circles, but both the terms ‘sharia’ and ‘West’ remain difficult to define. It is therefore striking that the combination of these two terms is used with such self-evidence. This article wants to answer the question: what exactly is the sharia that Western Muslims arguably want, and how is this sharia received in the West? To this end, a model is presented that provides a description of the complex interaction between sharia as practiced by Western Muslims on the one hand, and the conditions that the Western environment sets for it on the other. The model shows that ‘sharia’ cannot be compared to a law system, and that the Western environment has a major influence on the extent and ways in which Muslims apply sharia. From a Western perspective, the model shows that sharia issues are mainly discussed in legal terms, while most controversies are not of a legal nature, but rather a cultural one.

    The European Commission recently conducted a public consultation on the measures that may be taken to ensure the full application of the principle of equal pay between women and men. Its evaluation report is expected before the end of this year. The new Swiss legislation on monitoring and disclosure of the gender pay gap may be inspiration for future EU initiatives in this area.

    The Constitutional Court of the Republic of Latvia has ruled that provisions of the Law on Higher Education Institutions stipulating that professors and associate professors are elected to the office for a fixed period of time, i.e. for six years, and that only fixed-term employment contracts are to be concluded with them are not compatible with the Constitution of the Republic of Latvia (Latvijas Republikas Satversme) (the ‘Constitution’), which among other things provides that everyone has the right to freely choose their employment and workplace according to their abilities and qualifications. The restriction of this right in this case cannot be regarded as proportionate since the legislator has failed to implement the requirements of the Fixed-term Work Directive 99/70/EC.

    In a series of rulings the Austrian Supreme Court has made it clear that temporary agency workers are transferred to the transferee only if they are assigned to the transferor on a permanent basis. According to the Court, the facts of the cases at hand are not comparable to those of the ECJ ruling in Albron Catering BV (C-242/09). Hence the temporary agency workers remain with their original employer. However, some aspects of the Court’s reasoning seem unclear if not contradictory with regard to other recent judgments.

    The Danish Western High Court has ruled that the dismissal of an employee shortly after returning from childbirth-related leave did not constitute discrimination within the meaning of the Danish Act on Equal Treatment of Men and Women.

    The Federal Labour Court (Bundesarbeitsgericht – BAG) has decided that the entitlement to paid annual leave only expires at the end of the calendar year or at the end of a carry-over period if the employer has previously put the employee in a position to take his leave and yet the employee has not taken the leave out of his own free will. The court held that the employer must cooperate in granting the leave. He has to encourage the employee to take his – concrete numbered - leave and inform him accurately and in good time, that the entitlement to paid leave would otherwise expire.

    A worker was performing regular work tasks at their workplace when an attempted robbery took place. The worker suffered serious facial injuries as a result of an assault by one of the robbers and they filed a lawsuit against their employer claiming the latter was fully liable (both objectively and subjectively) for the work accident entitling them to reimbursement of all damages resulting from the accident.
    The question that was raised was whether the employer can be held subjectively liable for an accident at work despite the fact that it had taken the necessary measures foreseen and/or imposed by law to prevent such accidents.

The jurisdiction grounded its decision on the fact that this gave a strong advantage to older employees without objective justification.

    Among the asylum seekers arriving in Europe are unaccompanied minors (UMAs). As a result of the often traumatic experiences before and during their flight, many have mental health problems. The question is how they cope in the country of destination. After the flight, the plight is not over: destination countries are often not welcoming in all respects, UMAs may encounter violence in reception facilities, and experience stress related to the asylum procedure and possible family reunification, as well as worries about relatives left behind. Although UMAs are also known to be resilient, and most are supported by family members and/or significant others, there are worries about their transition to adulthood. When they turn 18, they have to deal with the developmental tasks that come with that age, as well as to come to terms with past experiences. At the same time their guardianship ends, and they are supposed to manage on their own in the relatively new country. Many UMAs seem to manage, but it would be helpful if the 18 years age limit could be used flexible when necessary.

    The authors discuss reparations, with particular attention to programs launched to do justice to the victims of the Holocaust. While focusing on the compensation scheme of the Dutch Railways to the victims of the transports during the Second World War, they examine in which respects the suffering and victimization of some victim groups are not or insufficiently recognized. They compare the establishment of the compensation scheme and the procedure for repayment with findings from victimological research into the recognition of victimization and reparation, including the symbolic value of compensation, recognition of suffering, inclusion and exclusion of stakeholders, and victim participation. The analysis concludes with a few considerations about how secondary victimization could have been prevented.

    This study is focused on the evaluation of successes and failures of the Common Market of the South (Mercosur). This analysis of Mercosur’s integration seeks to identify the reasons why the bloc has stagnated in an incomplete customs union condition, although it was originally created to achieve a common market status. To understand the evolution of Mercosur, the study offers some thoughts about the role of the European Union (EU) as a model for regional integration. Although an EU-style integration has served as a model, it does not necessarily set the standards by which integration can be measured as we analyse other integration efforts. However, the case of Mercosur is emblematic: during its initial years, Mercosur specifically received EU technical assistance to promote integration according to EU-style integration. Its main original goal was to become a common market, but so far, almost thirty years after its creation, it remains an imperfect customs union.
    The article demonstrates the extent to which almost thirty years of integration in South America could be considered a failure, which would be one more in a list of previous attempts of integration in Latin America, since the 1960s. Whether it is a failure or not, it is impossible to envisage EU-style economic and political integration in South America in the foreseeable future. So far, member states, including Brazil, which could supposedly become the engine of economic and political integration in South America, have remained sceptical about the possibility of integrating further politically and economically. As member states suffer political and economic turmoil, they have concentrated on domestic recovery before being able to dedicate sufficient time and energy to being at the forefront of integration.
