Hoeveel gevaar voor de openbare orde moet een gastlidstaat tolereren van een langdurig gevestigde Unieburger en zijn familie? Artikel 28 Richtlijn 2004/38/EG beoogt aan gevestigden een hogere bescherming tegen uitzetting te geven. Volgens de considerans (overweging 24) moet bescherming tegen verwijdering sterker zijn naarmate de Unieburger en zijn familieleden beter in het gastland geïntegreerd zijn. Als zij vele jaren op het grondgebied van het gastland hebben verbleven, zeker wanneer zij daar geboren zijn en er hun hele leven hebben gewoond, mogen verwijderingsmaatregelen slechts onder uitzonderlijke omstandigheden worden genomen. Artikel 28 heeft geleid tot nogal wat jurisprudentiële verwarring. Van extra bescherming blijkt nauwelijks sprake te zijn. |

National and international security are becoming increasingly interdependent. The question is whether this leads to a certain level of militarization of the police and constibularisation of the military. In some of their operations and units, the Dutch police apply tactics, technologies and organizational principles that resemble those of the military. The police also contribute to international peace support operations and stability missions to train or monitor police in post-conflict areas. The Dutch army has been involved in some sort of interim policing during several stability missions and increasingly support the Dutch police in law enforcement operations by providing search and analytical support. Finally, as a police force with a military status, the Royal Marechaussee has acquired a structural and strong position in the Dutch police system. Although there is some sort of convergence, the authors conclude that the level of militarization of the police and constabularisation of the military remains limited. |

This article investigates the role of ‘implicit religion’ in extremism, including those forms that do not explicitly call upon formal religion. Extremist quasi-religious narratives expose an exclusionary logic, which is mirrored by radical ways of thinking about counter-extremism. This unfailingly leads to more polarization. Extremism can only be countered by radical openness. Resilient democracy requires that citizens, politicians and professionals are willing and able to maintain open hearts and minds. Implicit religion can support this. Spiritual counselors and scientists of religion need to support the creation of spiritual narratives and rituals that strengthen democratic resilience. |

Illegal (IUU) fishing is a relatively understudied area within criminology. In this article the authors briefly describe what IUU fishing entails, what is known about the consequences of such fishing, and will list law enforcement issues. They illustrate how illegal fishing can be organized in different ways, and will give some examples of fish fraud. The authors also discuss the (massive) measurement issues. The ecological impact of IUU fishing constitutes an important reason for more research into this phenomenon. |

That criminal networks are active in the illegal exploitation of timber is increasingly acknowledged. The degree of organization of these networks, and the way in which they use (threats of) violence and corruption, is less known. This article describes and analyses, on the basis of various, including local, sources, how organized criminal groups in the Amazon rainforest illegally harvest trees which they sell on the (international) market and how they try to stay immune from the law by using threats, violence, fraud and corruption. This article also discusses the first results of a three-year pilot (2014-2017) of community-based forest monitoring and protection with waterproof GPS-camera’s, developed with communities and with support of the Brazilian Public Prosecutor’s Office. |

Fermentation production processes for biofuel lead to sustainable energy, but the fermenters can also be used to dispose illegal wastes. Although it’s known that the fermentation business is susceptible for illegal behavior, so far little empirical research is carried out about the modus operandi and criminogenic factors. In this study a crime script analysis (CSA) is conducted to map the criminal process. This analysis shows that the true nature of the illegal waste is concealed by trading without or with falsified (transport) documents and illegal blending. Legal traders operate illegal and form the crucial connection between disposers and end receivers. Criminogenic factors, such as complexity of regulation and inspection, European policy differences and the lack of profitability of the fermenters, make the branch vulnerable for criminal behavior. Intervention options are formulated per phase of the criminal process and aim at prevention or increasing the chance being caught. |

The Netherlands are considered as an important hub for the illicit trade in species of endangered birds protected by the CITES convention. In this article the authors analyze five substantial criminal cases from three different perspectives. First, from a criminal business perspective, the cases illustrate that logistics vary from relatively simple to highly complex, but always require in-depth knowledge of the animals as well as regulations, to be able to keep the birds alive to make a profit, and to smuggle them to the Netherlands, respectively. Second, from a network perspective, it is clear that those who are involved in the illicit trade – suppliers, traders and customers – are part of a closed and often long-lasting group of people who know the trade. Finally, from a green criminological perspective, the authors conclude that harms of the illicit trade in protected birds are mentioned only to a limited extent in court rulings, contrary to what one might expect based on social construction theories of criminalization and sentencing. |

Around 36.000 men enter Dutch prisons every year. Nearly half of them are father. Imprisonment is destructive to father involvement. Many prisoners involuntary fail to stay connected with their family and are unable to reconnect with family after release. However, father involvement protects fragile families, children and fathers themselves from collateral consequences of imprisonment and even reduces recidivism. One of the first Dutch initiatives for fathers in prison came from voluntary organization Exodus. Since 2014, they run an 8-week workshop on fatherhood in a number of Dutch penal institutions. Fathers work on the restoration or reconstruction of their relationship with their children and parenting partners. In this article, we review participating fathers’ perceptions of the workshop and the changes in their attitude towards fatherhood. |

Uit de recente jurisprudentie over de Wet Bibob blijkt dat soms onduidelijkheid bestaat over de vraag wanneer strafbare feiten voldoende samenhang vertonen met activiteiten waarvoor de vergunning is aangevraagd of verleend. Uit jurisprudentie blijkt enerzijds dat sprake is van voldoende samenhang, indien de vergunning het plegen van strafbare feiten kan faciliteren. Anderzijds is het uitgangspunt van de Afdeling dat de horecabranche zeer kwetsbaar is voor (bepaalde) overtredingen, zodat zonder al te veel problemen – in de horecabranche – een samenhang wordt aangenomen tussen de strafbare feiten en de activiteiten waarvoor de vergunning is aangevraagd of is verleend. |

Human traffickers are usually depicted in public discourse as evil villains: the crème de la crème of organized crime. Although this image has also been dominant among scholars for a long time, it has become increasingly controversial. On the one hand, this debate is fueled by discussions amongst criminologists on criminal networks, on the other hand by the expansion of the legal definition of the crime since 2005. Apart from exploitation in the prostitution sector, various other forms of human trafficking are distinguished now, including labor exploitation. This article explores the question of which organizational forms play a role in labor exploitation. Through a review of the empirical research literature on labor exploitation, the authors show that in the field of labor exploitation, there is probably less involvement in criminal syndicates or criminal networks that maintain contacts with other criminal networks. In many cases, labor exploitation is committed by individuals or family businesses, or smaller loosely organized networks that are not necessarily embedded in other criminal networks. For researchers and policy makers alike, it is therefore advisable not to approach labor exploitation exclusively from the perspective of transnational organized crime. |

In the ‘participation society’ it is expected that citizens actively contribute to solving societal problems, including health care, immigration and security issues. A somewhat similar responsibilisation culture is visible in prisons, where prisoners are held responsible for their own rehabilitation. This article problematizes the way in which prisoners’ agency is promoted in Dutch prisons, considering prisoners’ constrained agency and the normative expectations that are tied to the approach. This critique is advanced through discussion of the promotion/demotion system that has been used in Dutch prisons since 2014. This system, comparable to the Incentives and Earned Privileges system in England and Wales, espouses both ‘hard’ and ‘soft’ behavioural norms. The soft behavioural norms reflect a citizenship ideal that extends beyond compliance with the law. It is argued that these normative expectations tied to agency have a limiting effect on prisoners’ autonomy. This article argues in favour of a shift from the citizenship ideal to an autonomy ideal, which applies the principle of minimum restrictions. Furthermore, access to education, reintegration courses and contact with family should be treated as a right, rather than a privilege, in order to maximise autonomy and minimise the harmful effects of imprisonment. |

Most state-corporate crime research is focused on crime or harmful outcomes in or by democratic states. The goal of this article is to investigate the applicability of this concept to relations between economic actors and non-democratic state actors. The concept of state-corporate crime is applied to three contexts in which corporations have become involved in international crimes such as genocide, war crimes and crimes against humanity. Each representing a turning point in the academic and public perception of ‘business and human rights’, the contexts that are analysed are Nazi Germany (1993-1945), Apartheid South Africa (1948-1994) and the Democratic Republic of the Congo (DRC; 1996-now). It is concluded that in non-democratic states with totalitarian of authoritarian regimes (such as Nazi Germany and Apartheid South Africa), the concept of state-corporate crime is applicable and explanatory. In such strong states, economic and state actors make use of mutual benefits while, on the whole, state-interests prevail. As a result, the harmful outcome of the dynamics between corporations and states can best be described as corporate facilitated state crime. In weak states (such as the DRC) economic actors are generally more powerful while their involvement in international crimes also runs via non-state actors. The blurred lines between economic actors and state actors (and their interests) makes it difficult to apply the concept, in its different forms, to state-corporate cooperation in weak states and ‘new’ wars. |
