De ‘fall from grace’ van witteboordencriminaliteit

    In criminology, it is generally assumed that the high social status of white-collar offenders prevents them of being targeted by criminal law enforcement. But when they do, they suffer greater social and economic damage because of this high social status. Empirical research on the consequences of criminal law enforcement and conviction for white-collar offenders is scarce, and limited to the US and the UK. This paper used biographies of convicted former executives in business and public office in the Netherlands, to analyse these consequences and the process of the ‘fall from grace’ of white-collar offenders. The consequences are described in four life-domains: health, the private sphere, the occupational sphere and the social sphere. The results show that Dutch executives, in line with findings for the Anglo-American white-collar offenders, experience status degradation and suffer much collateral damage of criminal law enforcement. After the initial horror of imprisonment, they endure prison life fairly well. Individual competences and remaining social and economic capital enable them to return to normal life, although they cannot return to pre-conviction levels of social status.

    In a recent decision, the Labour Court awarded an employee € 7,500 for working in excess of 48 hours a week, contrary to working time legislation. The complainant allegedly regularly checked and responded to emails outside of business hours, occasionally after midnight. The Labour Court reiterated it is the employer’s responsibility to ensure that employees are not permitted to work beyond the statutory maximum period and that if an employer is aware that an employee is working excessive hours, must take steps to curtail this.

    In dit artikel staat centraal dat de beperking van de door het Hof van Justitie geformuleerde ‘cao-exceptie’ op het Europese mededingingsrecht tot ‘werknemers’ en ‘schijnzelfstandigen’ zich moeilijk tot een grondrechtenbenadering lijkt te verhouden. Zelfstandigen met een zwakke arbeidsmarktpositie hebben namelijk evenzeer behoefte aan collectieve middelen om hun arbeidsvoorwaarden te verbeteren en vallen ook onder grondrechtenverdragen. Door een uitgebreide beschouwing van de relevante rechtsinstrumenten van de VN, de IAO en de Raad van Europa en de uitleg die de toezichtorganen hieraan geven blijkt dat het grondrecht op vrijheid van (vak)vereniging, collectief onderhandelen en collectieve actie evenzeer aan deze groep lijkt toe te komen, en een te rigoureuze inperking vanwege het mededingingsrecht niet gerechtvaardigd wordt geacht. De conclusie bevat enkele gedachten over hoe het Europese mededingingsrecht met een grondrechtenbenadering overeenstemming te brengen. Daarbij passeren zowel de recente ontwikkelingen rondom het zelfstandigenvraagstuk in Nederland als initiatieven op Europees niveau de revue.

    Women are less likely to commit criminal acts than men. This gender gap appears to be particularly pronounced in white-collar crime. This systematic literature review examines existing theories, such as the situational hypothesis and the ‘gendered theory of focal concerns’ and evaluates to what extent they find support in empiricism. The results seem to offer the most support to the ‘gendered theory of focal concerns’. This nourishes the hypothesis that with an increase of women at positions in the upper tiers of the company ladder a decrease in the prevalence of white-collar crime can be expected. However, it is also possible that the explanation of corporate crime does not lie in a lack of femininity, but in a lack of gender diversity. Furthermore, limited access to informal criminal networks, the ‘old boys networks’, seems to play an important role in the gender gap of white-collar crime.

    Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime.

Access_open Right to Access Information as a Collective-Based Approach to the GDPR’s Right to Explanation in European Law

    This article presents a perspective which focuses on the right to access information as a mean to ensure a non-discriminatory character of algorithms by providing an alternative to the right to explanation implemented in the General Data Protection Regulation (GDPR). I adopt the evidence-based assumption that automated decision-making technologies have an inherent discriminatory potential. The example of a regulatory means which to a certain extent addresses this problem is the approach based on privacy protection in regard to the right to explanation. The Articles 13-15 and 22 of the GDPR provide individual users with certain rights referring to the automated decision-making technologies. However, the right to explanation not only may have a very limited impact, but it also focuses on individuals thus overlooking potentially discriminated groups. Because of this, the article offers an alternative approach on the basis of the right to access information. It explores the possibility of using this right as a tool to receive information on the algorithms determining automated decision-making solutions. Tracking an evolution of the interpretation of Article 10 of the Convention for the Protection of Human Right and Fundamental Freedoms in the relevant case law aims to illustrate how the right to access information may become a collective-based approach towards the right to explanation. I consider both, the potential of this approach, such as its more collective character e.g. due to the unique role played by the media and NGOs in enforcing the right to access information, as well as its limitations.

    In this paper I propose to analyse the binary notion of personal data and highlight its limits, in order to propose a different conception of personal data. From a risk regulation perspective, the binary notion of personal data is not particularly fit for purpose, considering that data collection and information flows are tremendously big and complex. As a result, the use of a binary system to determine the applicability of EU data protection law may be a simplistic approach. In an effort of bringing physics and law together, certain principles elaborated within the quantum theory are surprisingly applicable to data protection law, and can be used as guidance to shed light on many of today’s data complexities. Lastly, I will discuss the implications and the effects that certain processing operations may have on the possibility of qualifying certain data as personal. In other terms, how the chances to identify certain data as personal is dependent upon the processing operations that a data controller might put in place.

    Whether and under which conditions restorative justice can be applied to cases of corporate violence is explored starting from the phenomenon of corporate violence, defined as acts committed by corporations in the course of their regular activities but with harmful consequences for people’s health. Specific characteristics of different types of corporate violence are presented, as well as victims’ needs, experiences and expectations. The applicability of restorative justice, but also the need of its rethinking, is discussed through an analysis of the role of its key actors and the concepts of participation and restoration.

    This contribution reports on a delimited part of a larger, exploratory study, the main question of which was: How do aldermen perceive threats, what are their behavioral intentions and what is the influence of threats on the process and the outcome of decision-making? This question was answered with the help of Q-methodology, semi-structured interviews and case studies. This article discusses the results of the Q-methodology and the semi-structured interviews. The case studies will be reported separately later on. Through the Q-methodology three patterns in perception were found in dealing with threats: ‘combative and decisive’, ‘vulnerable and thoughtful’ and ‘down-to-earth and accepting’. The interviews show that it usually concerns instrumental threats that are deliberately used to influence decision making, which usually take place in the private sphere and vary from verbal aggression to physical violence. Most threats come from individuals, but some come from groups, in some cases there is a relationship with criminals. In the cases reviewed, the consequences in the private sphere are far-reaching, there are indications for the influence on public functioning (from hardening to great caution). There is almost always a report, a fuss in the media can affect the authority of the official.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    Studies have shown that the effects of scientific research on law and policy making are often fairly limited. Different reasons can be given for this: scientists are better at falsifying hypothesis than at predicting the future, the outcomes of academic research and empirical evidence can be inconclusive or even contradictory, the timing of the legislative cycle and the production of research show mismatches, there can be clashes between the political rationality and the economic or scientific rationality in the law making process et cetera. There is one ‘wicked’ methodological problem, though, that affects all regulatory policy making, namely: the ‘jump’ from empirical facts (e.g. there are too few organ donors in the Netherlands and the voluntary registration system is not working) to normative recommendations of what the law should regulate (e.g. we need to change the default rule so that everybody in principle becomes an organ donor unless one opts out). We are interested in how this translation process takes place and whether it could make a difference if the empirical research on which legislative drafts are build is more quantitative type of research or more qualitative. That is why we have selected two cases in which either type of research played a role during the drafting phase. We use the lens of the proportionality principle in order to see how empirical data and scientific evidence are used by legislative drafters to justify normative choices in the design of new laws.

    In the United States, the term disproportionate minority contact (DMC) is used to refer to the disproportionate number of minority youth who come into contact with the juvenile justice system. Statistics on DMC in the United States put the issue on the political agenda and measures have been taken to reduce the inequality. In the Netherlands, there are some studies on the representation of ethnic minority groups in suspect statistics, but data regarding all ethnic groups at various stages of the juvenile justice chain are lacking. Due to this lack of information, DMC is not mentioned in Dutch research literature and is not a political issue. Therefore, the purpose of this article was to explore whether DMC existed in the Netherlands and whether elements of the US policy could be applied to the Dutch situation. To investigate this, the likelihood (odds ratio (OR)) was calculated for young people with a migration background to be registered and held as a suspect, to participate in an alternative punishment program (Halt) and their likelihood of incarceration. It turned out that the OR for young people with a non-Western migration background to be registered as a suspect was more than three times as high, with an OR of 5 or higher for some ethnic groups. The chances of a Halt-settlement were much lower for young people with a non-Western background. The odds of ending up in a youth prison was over six times higher for youngsters with a non-Western background compared to their Dutch native peers. For young people of Caribbean and Moroccan origin the likelihood was more than ten times higher. These results showed that DMC is present at all examined stages in the Dutch juvenile justice chain. The large overrepresentation of young people with a migration background (especially of Moroccan and Caribbean origin) shows that further research is needed in order to develop programs to reduce DMC. To establish this, it is important to register the ethnic origin of the individuals at all stages of the juvenile justice chain.

    This study explores the influence of police detention centres environments on police suspects’ psychological wellbeing and sleep problems. Results showed that suspects detained in a police cell experience a decreased psychological wellbeing, that they sleep poorly, and that their psychological wellbeing is related to sleep problems. Implications for police detention in relation to suspects’ psychological wellbeing and sleep problems, as well as directions for future research on police detention centre environments, are discussed.

    Deze bijdrage betoogt dat het mededingings- en gegevensbeschermingstoezicht beter op elkaar afgestemd moeten worden om consumentenbelangen in datagedreven markten te waarborgen. De nasleep van de Facebook/WhatsApp-concentratie laat zien dat het toezicht op digitale markten te wensen overlaat, ondanks de vele handhavingsacties in verschillende lidstaten. Vanuit het perspectief van het mededingingsrecht worden aanbevelingen voor een meer samenhangend toezicht op misbruik van economische machtspositie en concentraties gedaan, zowel inhoudelijk bij de toepassing van concepten als institutioneel bij het uitoefenen van bevoegdheden door de betreffende toezichthouders. Geconcludeerd wordt dat er ruimte is voor synergieën maar dat er ook sprake kan zijn van spanning tussen de twee rechtsgebieden.

    On 23 April 2018, the Belgian Ministry of Labour, together with a consortium of 12 European research institutes, held a symposium on the current state of the art and best practices for conciliation and mediation in collective labour conflicts within the European Union, and particularly in Belgium. The symposium was organized for two occasions. First, the 50st anniversary of the Belgium law, providing mediation services by the Ministry of Labour to prevent and mediate in collective labour conflicts. Second, the presentation of the results of an EU (DG Employment, Social Affairs and Inclusion) sponsored project in 12 EU member states.
    The management of collective labour conflicts is in all countries regulated differently. The study shows that also practices of third party intervention differ largely. Most countries differentiate conciliation (a relative informal process of facilitated negotiation), mediation (usually defined as a strong involvement of the third party, who gives recommendations to the parties), and arbitration. Mediators typically are not trained, certified or registered as mediators in most countries. In all countries there is a large potential for conciliation, particularly in early stages of conflict (preventive mediation), as well as in rebuilding of trust after conflict episodes. Ana Belén García is senior researcher at the University of Seville and KU Leuven, working in the departments of work and organizational psychology. She was coordinator of several EU funded research programs on social dialogue in organisations. The most recent project was on mediation in collective labor conflicts in 12 EU member states. Ana’s interest is on conflict management and mediation in organizations. She was editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’. Ana holds a PhD in Psychology and HRM from the University of Seville and KU Leuven. She is also a registered mediator.

Erica Pender
Erica Pender is a mediator and senior researcher at the University of Seville and KU Leuven in the department of Work and Organizational Psychology. She holds a PhD in Psychology from the University of Seville and KU Leuven focusing on trust and trustworthiness in organizations. After studying psychology at the University of Seville, she obtained her MSc at Maastricht University. She has coordinated two large-scale projects for the European Commission, and was co-editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’.

Francisco J. Medina
Fransisco J. Medina is professor in social and organizational psychology, and Dean of the Faculty of Psychology and Educational sciences, at the University of Seville, Spain. His interests are conflict management, mediation and organizational development. He is engaged for many years in the development of labor mediation in Spain, providing training for mediators. He is also an experienced consultant and mediator. Francisco published both internationally and in Spanish extensively on conflict management and mediation.

Martin Euwema
Martin Euwema is professor in organizational psychology, and chair of the research group Organizational and Occupational Psychology and Professional Learning at KU Leuven, Belgium. He is also co-director of the Leuven Center for Collaborative Management and visiting professor at University of Copenhagen, IESEG-Paris, Sevilla, and Tsinghua (Beijing). He has extensive experience as consultant and mediator for both profit and non-profit organizations. His fields of expertise are conflict management, mediation, leadership, and organizational and team development.

    #MeToo has played a significant role in the struggle to confront taboos around sexual violence, including the acknowledgment of male rape victims. In this article, the authors have examined reactions at three different moments in time (T1, T2, T3) to Dutch journalist Jelle Brandt Corstius, who shared his #MeToo experience via Twitter. The article shows that the Belief in a Just World, victim stereotypes and rape myths seem particularly useful concepts to examine different positive (supporting, compensating) and negative (blaming, distancing) observer reactions. Reactions are most negative at T2, when JBC’s case least adheres to stereotypes and rape scripts.
