    Op 19 juli 2017 deed het Hof van Justitie van de Europese Unie uitspraak in de zaak Abercrombie & Fitch. Een opmerkelijke uitspraak, want het Hof acht het gerechtvaardigd dat een oproepcontract automatisch eindigt louter en alleen omdat de werknemer de leeftijd van 25 jaar heeft bereikt. In voorgaande arresten waar jongeren anders werden behandeld vanwege hun leeftijd leek het Hof heel strikt te zijn en die niet te accepteren. Is de uitspraak in de zaak Abercrombie & Fitch het begin van een andere houding of toch niet? In deze bijdrage onderzoekt de auteur dit door de uitspraak te plaatsen in de bredere context van leeftijd als discriminatiegrond en het Europese jeugdbeleid. Tegen die achtergrond is tot op zekere hoogte begrijpelijk waarom het Hof de Italiaanse maatregel gerechtvaardigd acht. Echter, met A-G Bobek, komt de auteur tot de conclusie dat voor de essentie van de maatregel leeftijd helemaal niet nodig is als onderscheidend criterium en dat het Hof in deze uitspraak eigenlijk een scheve schaats rijdt.

    The semi-public domain covers the places that are accessible to the public but which are controlled by private entities. Shopping malls, public transport, bars and sports events are examples of such places. In case of misconduct, the private manager may impose exclusion orders. This sanction relies on legal contracts and the exclusive nature of the right to property. The legal framework consists therefore primarily of private law. Exclusion orders may not be imposed without reason. Prevention of disorder and harm may be a legitimate reason. The length and range of the ban must relate to the gravity of the disruption. In addition to this, public laws on non-discrimination and privacy are applicable. The civil court is competent to check the exclusion orders in de semi-public domain. The author sees added value in complaints committees, in which both public and private actors partake. Complaint committees can thrive if their assessment frameworks are transparent.

Mr. dr. A.E. van Rooij verdedigde in 2017 aan de Vrije Universiteit Amsterdam haar proefschrift Orde in het semipublieke domein. Particuliere en publiek-private orderegulering in juridisch perspectief, uitgegeven bij Boom juridisch (Den Haag). Deze bijdrage is gebaseerd op dit promotieonderzoek. Inmiddels is zij werkzaam als wetgevingsjurist bij het ministerie van Binnenlandse Zaken en Koninkrijksrelaties en verbonden als onderzoeker aan de Faculteit Rechtsgeleerdheid van de VU.

    Despite enjoying distinct and privileged constitutional statuses, the Indigenous minorities of Malaysia, namely, the natives of Sabah, natives of Sarawak and the Peninsular Malaysia Orang Asli continue to endure dispossession from their customary lands, territories and resources. In response, these groups have resorted to seeking justice in the domestic courts to some degree of success. Over the last two decades, the Malaysian judiciary has applied the constitutional provisions and developed the common law to recognise and protect Indigenous land and resource rights beyond the literal confines of the written law. This article focuses on the effectiveness of the Malaysian courts in delivering the preferred remedy of Indigenous communities for land and resource issues, specifically, the restitution or return of traditional areas to these communities. Despite the Courts’ recognition and to a limited extent, return of Indigenous lands and resources beyond that conferred upon by the executive and legislative arms of government, it is contended that the utilisation of the judicial process is a potentially slow, costly, incongruous and unpredictable process that may also not necessarily be free from the influence of the domestic political and policy debates surrounding the return of Indigenous lands, territories and resources.

Yogeswaran Subramaniam is an Advocate and Solicitor in Malaysia and holds a PhD from the University of New South Wales for his research on Orang Asli land rights. In addition to publishing extensively on Orang Asli land and resource rights, he has acted as legal counsel in a number of landmark indigenous land rights decisions in Malaysia.

Colin Nicholas is the founder and coordinator of the Centre for Orang Asli Concerns (COAC). He received a PhD from the University of Malaya on the topic of Orang Asli: Politics, Development and Identity, and has authored several academic articles and books on Orang Asli issues. He has provided expert evidence in a number of leading Orang Asli cases. The law stated in this article is current as on 1 October 2017.

    This paper examines three Inter-American Court (IACtHR) cases on behalf of the Enxet-Sur and Sanapana claims for communal territory in Paraguay. I argue that while the adjudication of the cases was successful, the aftereffects of adjudication have produced new legal geographies that threaten to undermine the advances made by adjudication. Structured in five parts, the paper begins with an overview of the opportunities and challenges to Indigenous rights in Paraguay followed by a detailed discussion of the adjudication of the Yakye Axa, Sawhoyamaxa, and Xákmok Kásek cases. Next, I draw from extensive ethnographic research investigating these cases in Paraguay to consider how implementation actually takes place and with what effects on the three claimant communities. The paper encourages a discussion between geographers and legal scholars, suggesting that adjudication only leads to greater social justice if it is coupled with effective and meaningful implementation.

    The judgment of the Inter-American Court of Human Rights in the case of Kaliña and Lokono Peoples v. Suriname is noteworthy for a number of reasons. Particularly important is the Court’s repeated citation and incorporation of various provisions of the 2007 United Nations Declaration on the Rights of Indigenous Peoples into its interpretation of the American Convention on Human Rights. This aids in greater understanding of the normative value of the Declaration’s provisions, particularly when coupled with the dramatic increase in affirmations of that instrument by UN treaty bodies, Special Procedures and others. The Court’s analysis also adds detail and further content to the bare architecture of the Declaration’s general principles and further contributes to the crystallisation of the discrete, although still evolving, body of law upholding indigenous peoples’ rights. Uptake of the Court’s jurisprudence by domestic tribunals further contributes to this state of dynamic interplay between sources and different fields of law.

    The Framework Agreement on fixed-term work and the Equal Treatment (Framework) Directive do not forbid a provision that allows parties to postpone the operation of a retirement age clause in employment periods for fixed time, even if this means that they can be extended infinitely.

    The Court of Appeal has overruled the recent Employment Appeal Tribunal (EAT) decision in Efobi – v – Royal Mail [2017] IRLR 956 (reported in EELC 2017/41), restoring the previous position that a claimant in a discrimination case has the initial burden of proof – which ‘shifts’ to the respondent to provide an explanation of why its conduct was non-discriminatory if a prima facie case is proven.
    The Court of Appeal disagreed with Mrs Justice Elisabeth Laing’s ruling in Efobi, that section136 of the Equality Act 2010 had made a substantial change to the law when it was introduced, on the basis that it could not be fair that a respondent should have to discharge the burden of proof without the claimant first showing that there is a case to be answered. Lord Singh ruled that it could not have been Parliament’s intention to remove this initial burden of proof when it enacted the Equality Act.

    The non-discrimination principle and the freedom of occupation, as provided for in the Charter of Fundamental Rights of the European Union, do not prevent the EU from setting an age limit for pilots involved in commercial air transport, provided that this is done in accordance with Article 52(1) of the Charter.

    The Danish Supreme Court has ruled that the Danish authorities may have incurred liability by failing to act sufficiently quickly to amend the Danish Holiday Act to align it with EU law.

    An acquired mother tongue is – at least indirectly – connected to a person’s origin and therefore also linked to ethnic origin. Claims based on the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, the ‘AGG’) must be brought in writing within two months after knowledge of a possible discrimination. Time only starts to run for claims after the employer has provided an unsuccessful job applicant with a clear and definite statement that he or she has been rejected. The limitation period under the AGG will not be triggered by lapse of time only.

    The article examines the public debate about New Year’s Eve in Cologne in 2015. Theoretical starting point is the idea that public debates are forms of social communication in which reality is produced and social events become meaningful. On the basis of a framing analysis, it is investigated what significance New Year’s Eve in Cologne has as a medial event for society. The question here is how the event is described and explained, how it is mentioned and interpreted, what significance it collectively receives and how these insights can be theoretically interpreted. The analysis shows that different frames were possible, such as the problematization of the work of the police. Instead, the discourse focused on the sexual behaviour of refugees and securitization and sexualisation of migration takes place.

    Legal doctrinal scholarship engages with the problems of legal practice: it systematizes, comments on, evaluates and debates what goes on in law. These activities do not occur in a vacuum: they are embedded in scholarly traditions and theories. This paper discusses the role of the theoretical frameworks used in legal research and has two related aims. First, it aims to provide some practical conceptualizations and guidelines regarding theoretical and normative frameworks that are useful to understand and conduct legal research. Second, it aims to investigate the relationships between different kinds of normative frameworks and their relationship to empirical work. In the second part, an argument is made for a pragmatist understanding of the interplay between normative theorizing and empirical study. How do these work together in judgments about the state of the law?

    The Supreme Court has ruled in favour of a man seeking to establish that, if he died, his husband should be entitled to the same survivor’s pension as a female spouse would receive in the same circumstances. The Court unanimously held that an exemption in the Equality Act 2010 allowing employers to exclude same-sex partners from pension benefits accruing before December 2005, was incompatible with EU law and should be disapplied.

    Under Austrian law employees are entitled to more annual leave if they have worked for at least 25 years for the same employer. Employment with other employers is taken into account, but not for more than a total of five years. The ECJ will have to decide whether this limitation complies with EU law or whether it unlawfully restricts the freedom of movement of employees.
