    The concept of family group conferences (FGCs) originated in New Zealand in 1989 as a tool and statutory right for extended family networks to arrange for the welfare and safety of a child that is neglected or abused by his/her own parents. Through successful FGCs, state intervention can be avoided while the resourcefulness of the larger community is mobilized. The concept has proliferated to many countries and therefore lends itself for analysis as a ‘legal transplant’. This contribution investigates the FGC as a transplant, focussing on how the concept has been adapted and incorporated in the legal systems of England and the Netherlands. In these two countries the ‘Big Society’ and austerity measures in the social domain are high on the policy agenda. How are such policy priorities blended – if at all – with the emancipatory ideal of granting family networks autonomy next to, or even over, publicly funded professionals? It appears that the FGC concept has been compromised in both England and the Netherlands, but in different ways.

    This Volume is a special issue, almost entirely dedicated to the TMD symposium that took place on 1 December 2016 at the premises of Intersentia Publishing company near Antwerp. The symposium addressed the current Belgian and Dutch plans for new legislation aiming to further the use of mediation by intending litigants. The TMD Editorial Board is honoured that an insight into the respective plans was provided by the highest level authorities, that is: Mr. Koen Geens, the Belgian Minister of Justice, and Mr. Dennis Hesemans, senior counsel to the Dutch Minister of Justice. The Board is equally honoured that on behalf of the European Commission, Mrs. Karen Vandekerckhove, Acting Head of Unit at DG Justice and Consumers, was willing to discuss the outcomes of the recent official Evaluation of the EU Mediation Directive 52/2008. These findings made it possible to assess the Belgian and Dutch plans in a broader European perspective. The presentations delivered by these three keynote speakers have been reworked and are included as main contributions in this Volume.

    Taking the recent European Commission’s Report on the application of Mediation Directive 2008/52/EC as a starting point, the authors set out to reconstruct the pattern of ADR/mediation activities undertaken by the EU and the Council of Europe over the past 40 years. The authors conclude that the European initiatives have been conducive to a broadening and deepening of the ADR debate. Remarkable shifts can be observed in the emphasis placed by the European agencies during this period, notably a shift from emancipatory to efficiency-based arguments. The inherent coupling of private mediation and public adjudication entails risks however for each of these distinct conflict resolution strategies. The authors call for advanced research designs to generate the data needed for a genuine evidence-based policy in this domain.

    In this article the authors compare Belgian and Dutch (draft) regulation of mass damage claims, and notably the prominent place reserved for the collective amicable settlement of such claims. Though collective action for the recovery of damage is still not possible in the Netherlands, Dutch law does provide for the possibility of the court endorsing collectively agreed settlements, since 2005. One of most notorious settlements, i.e. the Dexia case, is discussed, illustrating how individual victims may retain their standing to sue in court, although in such cases the courts show a tendency to cling to the terms of the collective settlement just the same (‘reflex effect or shadow of the settlement’). Mediation in brokering such high profile settlements does not necessarily follow the vested principles of mediation in ‘regular’ one to one disputes.

    Mr Ard van der Steur MP for the Dutch Liberals (VVD), has introduced three interconnected private member bills to anchor mediation more firmly into the Dutch legal system. This initiative grew out from dissatisfaction over the truly minimal implementation of EU Directive 2008/52 in the Netherlands. For one thing, the bill envisages stricter quality standards and registration requirements. Professional privilege, for instance, will only accrue to those who meet all requirements as Registermediators. Another interesting aspect of the bills concerns the duty for parties to indicate to court in the writ of summons whether mediation has been attempted, and if not, why not. If a legal question arises while a mediation is pending before a Registermediator, the latter may refer that question on behalf of the parties to a cantonal judge electronically, whereas proviso is made for the judge handing down judgment at short notice, in order not to interrupt the flow of mediation more than necessary. These are just some of the innovative aspects of the bills that are being discussed during this interview at the premises of the Dutch parliament.

    On 26 May 2013 Ard van der Steur, Netherlands MP for the liberal democrats, introduced a cluster of three mediation bills to secure the status of mediation as a sound alternative to traditional in-court adjudication in civil and administrative disputes. Although the starting point in these bills is that mediation should take place on a voluntary basis, there are some arrangements that may result in quasi compulsory mediation. One such arrangement is that the judge, on his own motion, may refer parties to mediation. Also parties have to proof that they first have attempted to settle their dispute through mediation and if not, why not.
