In two appeal cases considered jointly, the Court of Appeal (CA) has ruled that it is not direct or indirect sex discrimination, nor a breach of equal pay rights, to provide enhanced pay for maternity leave and statutory pay only for shared parental leave (SPL).

2019/34 Reduction of annual leave during parental leave is lawful (GE)

Tijdschrift European Employment Law Cases, Aflevering 3 2019
Trefwoorden Maternity and parental leave
Auteurs Nina Stephan en David Meyer
SamenvattingAuteursinformatie

The Higher Labour Court of Berlin-Brandenburg (Landesarbeitsgericht (LAG)) has held that the pro rata reduction of annual leave depending on the period of parental leave is lawful. In general, statutory holiday entitlement also exists for the period of parental leave. However, the employer has the right to reduce leave pro rata for each full month of parental leave according to Section 17 paragraph 1 sentence 1 of the Federal Parental Allowances and Parental Leave Act (Bundeselterngeld- und Elternzeitgesetz (BEEG)). The proportional reduction is in line with European law.

Both the French Supreme Court and the Versailles Court of Appeal held that an employer, who must ensure that liberties and fundamental rights of each employee are respected in the working community, may lawfully prohibit the wearing of any visible sign of political, philosophical or religious beliefs in the workplace, provided that the rule contained in the company rules and regulations applies without distinction to employees in direct contact with the customers of the company only. But in the absence of such rules, sanctioning an employee who refuses to remove her Islamic veil based on the wish of a customer, which does not qualify as a genuine and determining occupational requirement, amounts to an unlawful direct discrimination and should consequently be held null and void.

Trefwoorden Religious discrimination
Auteurs Morwarid Hashemi LLM
SamenvattingAuteursinformatie

Most scholars have argued that the Achbita judgment is not in line with the jurisprudence of the ECtHR, in particular with the Eweida judgment, and gives less protection to the employee than granted by the ECtHR. In this article, I provide a different perspective on the relation between both judgments and nuance the criticisms that followed the Achbita judgment.

Agencia Estatal de la Administración Tributaria – v – SJ, reference lodged by the Tribunal Superior de Justicia de Galicia (Spain) on 13 November 2018

Tijdschrift European Employment Law Cases, Aflevering 2 2019

The Higher Administrative Court of Münster (Oberverwaltungsgericht, the ‘OVG’) has held that a minimum body height of 163 cm for applicants to the police service, irrespective of gender, is lawful. At least, this shall apply if the determination of a minimum body height standard is a suitability criterion for access to the police service. Minimum standards solely serve the purpose of ensuring fitness for service and result from a comprehensive investigation. The investigation in this case established that suitability for the police service can only be guaranteed from a height of 163 cm upwards.

SamenvattingAuteursinformatie

The decision of the Court that Muslims from the Greek province of West Thrace can choose in matters of family law between civil or Islamic law, is not surprising. However, much can be said about the way in which the Court came to that conclusion. Because in doing so it uses principles and considerations that show a lack of insight in the status and functioning of a unique legal system, namely that of interpersonal law, or the coexistence on equal basis of several family laws. Similarly, the Court seems biased towards Islamic family law, which it consistently refers to as ‘sharia’. A critical discussion of this judgment is therefore appropriate.

In 2016 the Dutch Government Commission of Reassessment of Parenthood (GCRP) proposed a wide array of legal changes to Family Law, e.g. with regard to legal multi-parenthood and legal multiple parental responsibility. Although the commission researched these matters thoroughly in its quest towards proposing new directions in the field of Family Law, multi-parents themselves were not interviewed by the commission. Therefore, this article aims to explore a possible gap between the social experiences of parents and the recommendations of the GCRP. Data was drawn from in depth-interviews with a sample of 25 parents in plus-two-parent constellations living in Belgium and the Netherlands. For the most part the social experiences of parents aligned with the ways in which the GCRP plans to legally accommodate the former. However, my data tentatively suggests that other (legal) recommendations of the GCRP need to be explored more in depth.

Tijdschrift PROCES, Aflevering 4 2019

SamenvattingAuteursinformatie

Gender as a construct has been introduced into criminology half a century ago and has contributed to an understanding of the relation between gender and violence. Therefore, when improving resilience of professionals encountering violent behaviour, gender might be an important construct to take into account. We know from the literature that men and women do not experience victimization and perpetration in the same way but at the same time there are some blind spots with regard to male victimization and female perpetration. Increasing resilience against violence is only possible when we do not automatically use gender stereotyping in understanding and reducing violence.

The Supreme Court has ruled that a baker’s refusal to provide a cake with a slogan supporting gay marriage was not sexual orientation discrimination, nor discrimination on grounds of political belief. The Northern Ireland bakery was owned by Christians who had religious objections to gay marriage (they thought Christian doctrine holds that marriage can only take place between a man and a woman). Gay marriage is not legal in Northern Ireland, although it is in the rest of the United Kingdom. Gay couples can enter into a ‘civil partnership’ in Northern Ireland, which formalises the relationship and provides it with legal recognition in a similar way to marriage.
