Brunilda Pali described in 2015 the work of the American digital and media artist Sharon Daniel (University of California in Santa Cruz) in a special publication as a result of an interdisciplinary, international arts research collaboration. The new-media documentary Inside the Distance was shown in the StuK Art Center Leuven in that period and included fragments of restorative justice encounters. It was an effort to test the potential for activist art practice to have a direct role in changing social conditions. To hear about what the project meant for Sharon Daniel, but also about her current work ánd to explore how art can further play a role in changing justice, Ivo Aertsen and Annemieke Wolthuis interviewed Sharon Daniel and Brunilda Pali. More stories were shared to combine art and restorative justice. |

Restorative justice as implemented in many countries adopts a rather narrow approach, where responding to crime and other types of injustice is being restricted to the interpersonal level. ‘Society’ as important pillar in restorative justice does not play an important role in daily practice, and linkages to the institutional and political level are seldom established. Such practice risks to replicate or to strengthen structural inequalities in society. One possible strategy to deal with this challenge, is to engage in network oriented approaches in order to develop a better understanding of system injustices, and to contribute to more encompassing and sustainable response mechanisms in society. Can and should the restorative justice movement build alliances with other social movements in order to realise this perspective? The article is structured along the following lines. First, various visions of ‘structural violence’ are reflected upon. Reference is made, for example, to the issue of (de)colonisation and concomitant forms of ‘epistemic injustice’. Considerable attention is given to the complexity and the multilayered nature of underlying causes of injustices in the respective social fields, and to the risk of simplification and polarisation in society but also within social movements. The discussion then focuses on practices of dealing with conflict, diversity and participatory decision making within the respective social movements, and whether and how restorative justice can offer inspiration and practical support. Thirdly, broader strategies on social transformation are discussed, dealing with, for example, how the interchangeable roles of warrior and healer can be adopted, and how, at a more general level, restorative oriented partnerships can be formed. |

Restorative justice practices and policies have been growing in Belgium during last three decades. This article looks in particular at policy developments in the Flemish Community. It reconstructs how restorative justice has adopted a legal basis in 2005 and 2006 respectively in adult criminal law and juvenile justice. The rise and fall of the Belgian model of ‘restorative prisons’ is discussed. Special attention goes to the role of the Belgian State reform process, where the regions were given more competencies also in restorative justice matters. We investigate how this process of devolution has shaped the restorative justice landscape for the sectors of penal mediation, restorative mediation and conferencing. Some ambivalences in policy making are shown. Moreover, in recent years there are signs of a declining political interest in restorative justice. |

In this article, an analysis is made of two response models for different forms of abuse and violence that occurred in the past on children in institutional settings. Two programmes are compared, as they operated during last 10 years in Belgium: on the one hand the Centre of Arbitration for sexual abuse and violence in the Catholic Church at the national level, on the other hand the Commission for Recognition and Mediation for various types of abuse and violence in youth and educational institutions and other organisational contexts in the Flemish Community. Both models are analysed and compared at the conceptual and empirical level from a restorative justice approach, looking at the elements that may reveal a certain form of restorative justice and/or may contain lessons for the further development of restorative justice. The background and origins of both programmes are presented into detail, followed by a comparison with respect to the political options on the basis of their creation, the composition of their boards, their scope of application and their procedures. Some numbers and characteristics of cases dealt with are presented. |

This article discusses the concepts of society and community involvement as they appeared in the articles of the Dutch-Flemish Tijdschrift voor Herstelrecht (Journal of Restorative Justice) during last 20 years. It shows how the journal from its very beginning adopted a strong focus on criminal justice reform, although restorative practices within the community occupied a considerable space in the consecutive volumes as well. Studies on restorative justice programmes in Belgium and The Netherlands, such as victim-offender mediation and family-group conferences, revealed a predominant orientation on interpersonal relationships stressing the role of the community of care. In the same sense, also community mediation and other community oriented restorative practices focus on the personal well-being of people and the improvement of personal and social relationships. Hence, both theory and practice face two important challenges in developing restorative justice: (1) which role to give to a larger community and how to operationalize its involvement, and (2) how to deal with underlying causes of crime and social-structural injustices? Referring to European action-research projects and to conceptual models developed outside Europe, a case is made for designing restorative justice methodologies and programmes involving civil society in a more encompassing way and linking micro to macro societal levels. Developing strategic alliances with new social movements could be the way forward. |

Organizing restorative justice practices around crimes involving extremist violence remains a difficult task. It is not self-evident to bring perpetrators with very specific and radical ideas into contact with their victims. Nevertheless, interesting initiatives have been made in a number of European countries. In Spain, Italy and Northern Ireland, among others, initiatives were taken in response to the extremist violence that these countries experienced at the end of the 20th century. These initiatives have a very specific context and praxis, initiated ad hoc with attention to the specific needs of those involved. In no case can they be considered standard models or generalized practices. This contribution describes some of these initiatives in Spain, Italy and Northern Ireland and reflects on the potential uses of these dialogues in general. |

In this article, some of the findings of a practice and policy oriented research project on ‘radicalisation’ are discussed. The research was carried out in a partnership between three Belgian universities and two field organisations during the years 2017-2019. The project aimed at a ‘Constructive analysis on the attitudes, policies and programmes that relate to “radicalisation”’ (CONRAD). Restorative justice offered the initial framework to design and to set up the project. This article offers some findings and reflections on the opportunities (and the limits) that were found in the project with respect to the relevance of restorative justice. This part of the research was done on the basis of a frame-analysis on the one hand, and field work on the other. The article first presents the restorative justice assumptions that formed the backbone of the project. Then, the method of ‘inductive frame-analysis’ is presented as this was applied to a sample of media and policy documents that reported about ‘radicalisation’ and ‘de-radicalisation’ related issues in Belgium. This resulted in the identification of four frames and eight counterframes. The field work in the form of ‘participatory action research’ with young persons and their organisations in the cities of Brussels and Verviers is then discussed, revealing a complex situation of social tensions. It is argued then that the use of frames and counterframes can help those involved in, or concerned about, social problems to look at these issues from another perspective, through another lens. Based on the method of photo-elicitation, cartoons related to frames and counterframes were designed in the project as a tool to facilitate talking about ‘radicalisation’ from different perspectives. The article ends with reflections on the relevance of restorative justice in dealing with ‘radicalisation’ and violent extremism. A broad relational and participatory approach to respond to these ‘phenomena’ at societal level is proposed. |

This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond. |

Whether and under which conditions restorative justice can be applied to cases of corporate violence is explored starting from the phenomenon of corporate violence, defined as acts committed by corporations in the course of their regular activities but with harmful consequences for people’s health. Specific characteristics of different types of corporate violence are presented, as well as victims’ needs, experiences and expectations. The applicability of restorative justice, but also the need of its rethinking, is discussed through an analysis of the role of its key actors and the concepts of participation and restoration. |

Empirical research on restorative justice shows that offenders can apologise to victims. Because of the ritual component of restorative justice and the possible influence on the justice system, certain questions arise: how do victims perceive these apologies? Is it important for victims that these apologies are sincere? The aim of the article is to discuss these questions through three topics, namely the physical aspect of the ritual, the symbolic meaning for victims and the relation between the offender’s apologies and the victim’s reaction. |

This article presents some of the results of a study in which 25 adult men were interviewed who took part in restorative mediation in the French speaking part of Belgium and were desisting from crime. Their narratives were used to find out whether participation in restorative justice influenced positively their journey towards desistance; if so, which factors in restorative mediation supported this change process and how these factors had been helpful. The results suggest that restorative mediation has the potential to contribute to desistance in a humble, but significant way. Core aspects of mediation supported mostly already started desistance processes and they were helpful in a mainly cognitive way. The authors propose to further investigate the specific and helpful ‘presence’ of mediators and to reflect upon the apparent absence in restorative mediation of practical follow-up support towards desistance. |
