Terrorism can only be brought to an end if Islam and the Muslim community are enlisted as allies in combating it. Underlying militant jihadism is a violent interpretation of Islam which can best be challenged with the assistance of Islam and the Muslim community. Since the effects of the current state-led approach are questionable, while its criminal law component is close to exceeding the limits set by the rule of law and turns Muslims into a suspect community, it is important to test by way of a pilot whether an approach based on Islam can reap more promising results. |

The aim of this study was to investigate the scale and network structure of prostitution in the northern provinces of the Netherlands. This study tries to answer three research questions – using a social network analysis – about (1) the size of the prostitution network, (2) the formation of subgroups, and (3) key positions within the networks. The findings show that approximately two thirds of the researched prostitution networks is still unregistered, while there are indications that the outcome of the estimate is in line with the actual situation. Furthermore, results show that prostitutes have a tendency to form subgroups on the basis of the same nationality, which indicates that homophily plays a role in the formation of subgroups. The identification of the actors who occupy key positions in the network were based on the key player problem (KPP). A striking finding was that organizers of prostitution (such as pimps) did not have a central position in the networks. These findings provide insight into the way in which prostitution is registered, and provide points of departure for interventions to disrupt the network or, on the contrary, to strengthen it. |

Since 1 April 2014, young adults aged 18 up to and including 22 years can be sentenced with juvenile sanctions in the Netherlands. This legislation is referred to as ‘adolescent criminal law’ (ACL). An important reason for the special treatment of young adults is their over-representation in crime. The underlying idea of ACL is that some young adult offenders are less mature than others. These young adults may benefit more from pedagogically oriented juvenile sanctions than from the deterrent focus of adult sanctions. Little is known, however, about the characteristics of the young adults sentenced with juvenile sanctions since the implementation of ACL. The aim of this study is to gain insight into the demographic, criminogenic and criminal case characteristics of young adult offenders sentenced with juvenile sanctions in the first year after the implementation of ACL. A cross-sectional study was conducted using a juvenile sanction group and an adult sanction group. Data on 583 criminal cases of young adults, sanctioned from 1 April 2014 up to March 2015, were included. Data were obtained from the Public Prosecution Service, the Dutch Probation Service and Statistics Netherlands. The results showed that characteristics indicating problems across different domains were more prevalent among young adults sentenced with juvenile sanctions. Furthermore, these young adults committed a greater number of serious offences compared with young adults who were sentenced with adult sanctions. The findings of this study provide support for the special treatment of young adult offenders in criminal law as intended by ACL. |

In addition, it is also important to investigate what the legislation and initiatives yield. |

Wanneer een jeugdige te maken krijgt met jeugdreclassering, richt Jeugdbescherming Regio Amsterdam, verder te noemen Jeugdbescherming, zich bij de begeleiding van de jeugdige niet alleen op de jeugdige zelf, maar op het hele gezin. Conform de door Jeugdbescherming ontwikkelde methodiek, Intensief Systeemgericht Casemanagement, wordt het hele gezin betrokken. Deze methodiek wordt toegepast ongeacht het kader (het civielrechtelijke, strafrechtelijke of preventieve kader) waarbinnen Jeugdbescherming werkt. In tegenstelling tot in het civiele recht, lijkt de focus in de wet in het geval van het strafrecht echter vooral te zijn gericht op de individuele jeugdige verdachte of veroordeelde. In dit artikel wordt daarom onderzocht welke mogelijkheden de wet biedt om te werken volgens het Intensief Systeemgericht Casemanagement in het strafrechtelijke kader, tijdens de uitvoering van jeugdreclassering. Ook worden er aanknopingspunten in de doelstellingen van jeugdreclassering gezocht voor deze werkwijze. |

The Dutch policy of the ‘Participation Society’ intends to return many societal responsibilities to civil society. As religious organizations traditionally had undertaken that task, an increase in their participation is expected. However, the separation of state and religion often proves an obstacle. Also, there is quite some scepticism among religious organization regarding the role that a state should have in its caring duties. This contribution contains several insightful and critical articles on this subject: the introduction is by Gert-Jan Buitendijk, director-general with the Ministry of Interior, who is involved in the policy-making process of the Participation Society policy, followed by brief reflections by two scholars of religion and theology, and two representatives of the Islamic and Catholic communities. These contributions were the outcome of a lustrum symposium organized by the Journal for Religion, Law and Policy in november 2015, where academics, policy makers and representatives of religious organizations discussed the effects of the ‘Participation Society’ policies and laws in the Netherlands. |

During childhood, a child is entitled to receive special care and assistance. The child’s best interest should be a primary objective. The Dutch government has an obligation to guarantee the children rights. But do the closed youth care accommodations meet the requirements as stated in the International Child Rights Convention, as far as deprivation of liberty and treatment under coercion are concerned? The study concluded that some closed youth care institutions do not meet the requirements as stated in the above mentioned Convention. There is often no possibility of free expression, physical complaints may not be taken seriously, an adequate standard of living is not always provided and the level of education is often too low. Most of the minors indicate that they are bored during their stay in the accommodations. On this basis, limiting the fundamental rights of these youngsters is currently surrounded with inadequate guarantees. |

The relationship between group workers and their pupils in a youth prison influences treatment outcome. A positive relationship stimulates treatment motivation and readiness for change. The aim of this study was to review the role of hope in a correctional institutional setting for youth. Hope is defined as having a goal and a positive outcome expectation. Hope keeps group workers positive, motivated and inspired to overcome difficulties, and the hope of group workers stimulates pupils to openly reflect on the past, reconsider future possibilities, and become motivated to change their behaviour. There are obstacles, however, which hamper the hope of group workers and may instead trigger negative expectations, cynicism, and despair. Key elements for dealing with potential negative influences on a hopeful orientation are leadership and training. Also conscious reflection on one’s acts, thoughts and feelings can help group workers to deal with resistance reactions and aggression, and to remain hopeful. |

Over the last 60 years, attention has been drawn periodically to offenders in different age categories, such as young children, adolescents and young adults, and tor services and programmes that should be available for these groups. In 2011, the State Secretary of Security and Justice proposed a penal law for adolescents and young adults aged 15 to 23. Such a proposal requires a (empirical) view of young adult offenders (aged 18 to 24) and the penal sanctions they receive in comparison with adolescent (aged 12 to 17) offenders and adults (aged 25 to 30). Crime statistics show that prevalence, type and seriousness of crime committed by young adults are different from that of adolescents and adults. Self-report studies show fewer and smaller differences, but this may be explained in part by the more serious nature of offences committed by young adults, which are usually not addressed in self-reports. Outcomes support the idea that a separate approach and specific interventions for young adults are needed. Similarities with adolescents with regard to neurobiological development justify a focus on a more pedagogical and behavioral approach, which is also a key feature of penal justice for juveniles. |

Juvenile detention and the custodial measure ‘institutional placement order’ (plaatsing in een inrichting voor jeugdigen; PIJ-measure) are often administered by the court under conditions at first. It is unknown to what extend it is possible to make a distinction between a punishment and a treatment measure looking at both conditional penalties. In order to gain more information about the differences and similarities between these conditional penalties, the verdicts of juvenile offenders have been studied. The study involves a group of juvenile offenders with a conditional PIJ-measure and a group of juvenile offenders with a conditional juvenile detention. The results reveal that there are considerable similarities between the two groups. The high prevalence of behavioural problems and disorders in the group juvenile offenders with a conditional juvenile detention is particularly notable. Conditional juvenile detention may include treatment of the behavioural problems and disorders, but if the conditional juvenile detention is transformed into unconditional juvenile detention there will be no individual and specific treatment of these disorders. |

Since 2003, Dutch juveniles on remand who go to school or have work can be held in ‘night detention’: they attend their school or work during the day and spend the nights and weekends in a young offender institution. The authors examine how this form of youth detention relates to basic principles in juvenile criminal law and penitentiary law. They argue that based on international standards stating that juveniles should be detained with as few restraints as possible, night detention should be made available if circumstances allow it not only for juveniles on remand, but for juveniles subject to any form of detention. |

This article is based on research in the archives of the Rijkswerkinrichting in Leiden, the Netherlands, which served as a penitentiary for female vagabonds and beggars between 1886 and 1907. At an average 48 years of age, women were old; about four in ten were confined more than once. Contrary to males in similar institutions, females were almost exclusively from the lower echelons of society, and very few had ever been married. While material conditions in confinement compared positively to the living conditions before confinement, mortality was high. Women, like female detainees these days, mostly performed menial work that offers little prospect for successful reintegration. Most had probably led rough lives, with alcohol abuse, poverty and familial strife. The confinement of these women probably served more as a temporary respite than as a solution for these women's problems. |
