Een scherpe stijging in het aantal drones en snelle vorderingen in dronetechnologie creëren nieuwe mogelijkheden en risico’s voor veiligheid en privacy. Door een beperkte toezichtcapaciteit is er behoefte aan gedragsinterventies die spontane naleving stimuleren. Het huidige onderzoek beschrijft psychologische factoren, zoals weerstand, die het regelnalevingsgedrag van dronepiloten beïnvloeden omtrent vliegen in no fly zones (gebieden waar men niet met een drone mag vliegen). De gemodelleerde antwoorden van 843 dronepiloten laten zien dat twee typen weerstand, inertie en scepticisme, invloed hebben op het gedrag van dronepiloten. Dit artikel beschrijft hoe deze inzichten door toezichthouders kunnen worden gebruikt om gewenst gedrag te bevorderen. |

We analyze two citizen collectives of ‘professional city makers’ who have shaped participation in circular area development in anticipation of the Dutch Environment and Planning Act. The activities of professional city-makers form an interesting new phenomenon that requires attention as well as the implications: it is precisely through the professionalism of the city-makers’ efforts that there is a regular tension in the participation process between their role as citizen and professional in their contact with the government. We therefore discuss how the participation of professional city-makers in area development exposes different paradoxes that must be taken into account in the further implementation of the Environment and Planning Act. In short, we argue that participation in the Act is presented in a traditional way and does not fit the new role of citizens in area development in the 21st century. |

In de procespraktijk werd de auteur geconfronteerd met de consequenties van het ontbreken van incidenteel hoger beroep in dit fiscale procesrecht. Dat heeft geleid tot het schrijven van een kort artikel waarin de situatie met het Nederlandse fiscale procesrecht wordt vergeleken en waarin de verschuiving van het recours objectif naar het recours subjectif wordt aangestipt en wordt gepleit voor invoering van incidenteel hoger beroep. |

The Luxembourg Court of Appeal (Cour d’appel de Luxembourg) confirmed that an employee dismissed with notice and exempted from performing their work during the notice period is no longer bound by the non-competition duties arising from their loyalty obligation and can therefore engage in an employment contract with a direct competitor of their former employer during that exempted notice period. However, the Court of Appeal decided that, even if the former employee is in principle entitled to use the know-how and knowledge they acquired with their former employer, the poaching of clients during the notice period must, due to the facts and circumstances and in the light of the rules applicable in the financial sector, be considered as an unfair competition act and therefore constitutes serious misconduct justifying the termination of the employment contract with immediate effect. |

In this article, I am using Becker’s concept of moral entrepreneur to analyse the role of pain specialists in the labelling process, which has led to the normalisation of the use of opioid painkillers in the United States and ultimately to the death over 200.000 Americans. In general, the literature on labelling centres on crusading reformers, and the criminalisation and stigmatisation of transgressive behaviour. Here I will focus on the moral entrepreneurship of medical experts. What was their role in the normalisation process of opioid painkiller use and are there any similarities with the strategies of crusading reformers? My findings, based on qualitative analysis of documents such as newspaper articles and academic publications, show that, with two exceptions, pain specialists use the strategies of moral crusaders. First, in their narratives, pain specialists represented themselves as neutral objective experts without the emotional stance of moral crusaders. The second exception, which is related to the first, is that there was less emphasis in their narrative on creating villains, as they could not blame openly standard medical practice because they needed the support of the established medical world in order to normalise and legalise opioid painkillers. |

The focus in this article is the ‘criminalisation’ of youth hanging around with the emergence of bans on hanging around. A critical social constructivist approach is used in this study, which draws predominantly on qualitative primary data collected between the late 1980s and 2010s. The article compares indigenous with immigrant youth, which coincides with, respectively, youth in rural communities and youth in urban communities. This study shows that there is discrimination of immigrant youth, which is shaped by several intertwining social phenomena, such as the ‘geography of policing’ – more police in urban areas – familiarity, sharing biographical information (in smaller communities), and the character of the interaction, normalising versus stigmatising. In further research on this topic we have to study (the reaction to) the transgressions of immigrant youth, and compare it with (the reaction to) the transgressions of indigenous youth, which is a blind spot in Dutch criminology. |

De positie van derden in het contractenrecht heeft zich sterk ontwikkeld. Zo zijn door de rechtspraak bij samenhangende rechtsverhoudingen uitzonderingen op het relativiteitsbeginsel aangenomen. Samenhangende rechtsverhoudingen komen veel voor in het bouwcontractenrecht, waardoor problemen kunnen ontstaan bij het vestigen van aansprakelijkheid. Mogelijk biedt de contractengroep als overkoepelend juridisch kader voordelen voor de regulering van samenhangende rechtsverhoudingen in het bouwcontractenrecht. |

In this article we focus on how tram drivers react when confronted with a situation of aggression in the tram. Their role in these situations has hardly been explored in recent Dutch studies on this topic. In our explorative research, which consisted of observation and interviews in The Hague, our aim is to gain the perspective of tram drivers on aggressive passengers. Through their eyes we describe a range of strategies which they use to restore public order. Our research shows that in order to understand the reaction of tram drivers a) this has to be placed in the sequential development of an aggressive interaction and b) this has to be related to the ways they give meaning to the aggression of passengers and their work context. Our research shows that there are two perspectives among tram drivers: a) a ‘business’ perspective, with an emphasis of tram drivers as employees who avoid risk situations and call for support in situations they cannot control and b) a personal perspective, in which tram drivers tend to follow more personal guidelines, in which masculinity plays a central role. Those who use the later perspective become more involved in violent and physical interactions. |

In this article I focus on the academic environment in which social psychologist Diederik Stapel worked and developed his career as a con academic. He published over 50 articles with fabricated data in top tier journals. This article is based on interviews with Stapel himself and document analysis. Especially, I pay attention to his socialization as an academic in his years at the University of Amsterdam, where he did his PhD (1986-2000). In my description of how social psychology developed in the nineties in Amsterdam it becomes clear that there was a strong emphasis on competition and publishing articles in top tier journals. Stapel conformed to this culture of competition and published almost as much as the two leading full professors of his department during the period 1995-2000. In the early nineties Stapel discovered that the use of questionable research procedures (QRPs) was common in social psychology. He realized that without using these procedures it was hardly possible to get good results and publish frequently in top tier journals. Though Stapel resented this partly and was disenchanted by this experience, he did integrate QRPs in his daily academic practice. He actually raised the issue of QRPs in a lecture in Oxford when he received the Jos Jaspars Early Career Award of the EAESP, but there was hardly any substantive response to his presentation. The academic culture in which Stapel developed his career can be described as ‘indifferent tolerant’. Though Stapel does refer to the circumstances which influenced his academic fraud, he does state that he himself is responsible for his massive scientific misconduct. |

In this article on the social production of the book Outsiders, I will situate its production in the daily practice of the social worlds in which Becker was involved. Therefore I focus on the relations, interactions and situations which were relevant for the form, content and success of Outsiders. For data, I use fragments from my email communication with Howard Becker, the collected interviews and other publications which show that Becker seeks to demystify Outsiders. My main contribution is that I use Becker’s own words to demystify the ethnographic practice of Outsiders and describe its mundane backstage reality, which is described by Fine as ‘the underside’ of ethnography (1993). |

In this article I will explore the concept of transgression within the realm of rock music using the biography of Lou Reed, known for such songs as ‘Walk on the Wild Side’ and ’I’m Waiting for the Man’. I discuss Lou Reed’s social transgressions as a reaction to and resistance toward institutions of social control such as family, media and the music industry, which stigmatized him as an outsider. This study, which is based on secondary material, such as biographies, interviews and songs, shows how Lou Reed transgressed social norms with respect to drugs, sex, and gender. |
