    This article examines expressions of conspicuous consumption on 19 recent releases by the most popular Dutch rap artists of 2018. In line with Veblen’s (1899/2017) notion of conspicuous consumption, our content analysis of these rap lyrics shows that Dutch rappers ‘spend’ their money on all kinds of ostentatious and eye-catching luxury goods such as designer clothing and jewelry (‘drip’), cars or holidays, but also that rappers ‘stack’ some of the money they earn by putting it aside. Our results indicate that these expressions of conspicuous consumption seem to be rooted in, and fueled by, experiences with poverty, stigmatization, and discrimination.

    This article considers how empirical legal studies (ELS) and doctrinal legal research (DLR) interact. Rather than seeing them as competitors that are methodologically independent and static, it suggests that they are interdependent activities, which may each be changed by interaction with the other, and that this change brings both opportunities and threats. For ELS, the article argues that DLR should properly be understood as part of its theoretical framework, yet in practice little attention is given to doctrine in empirical work. Paying more attention to DLR and legal frames generally would help ELS meet the common criticism that it is under-theorised and excessively policy oriented. On the other hand, an embrace of legal thinking, particularly of critical legal thinking, might lead to loss of status for ELS in policy circles and mainstream social science. For DLR, ELS offers a chance for it to escape the threat of insular sterility and irrelevance and to participate in a founded commentary on the world. The risk, however, is that in tailoring legal analysis to what can be empirically researched legal scholars become less analytically ambitious and more safe, and their traditionally important role as a source of socially relevant critique is weakened. Inevitably, in offering different ways of moving to normative conclusions about the law, ELS and DLR pose challenges to each other, and meeting those challenges will require sometimes uncomfortable self-reflection.

    Living in a multicultural environment may be accompanied with an increased fear of crime. Residents may become alienated in a very diverse environment and withdraw themselves in their own social world. This ‘hunkering down’ may ensue feelings of unsafety. However, social scientists have done hardly any research on whether citizens who live in a multicultural environment in Western Europe actually feel more unsafe. This study seeks to contribute to fill in this knowledge gap. The authors’ research reveals that residents are more likely to feel unsafe in neighborhoods with a high degree of ethnic diversity. The aforementioned correlation is the most noticeable in neighborhoods consisting of people on medium incomes.

    Islamic schools are often criticized for indoctrinating children, which would violate the goals of education in a democratic society. This article explores whether, as a matter of principle, parents could legitimately choose to send their child to a school where he or she will be indoctrinated, for example because they believe that at a religious schools the opportunities for a child to be stigmatized are smaller. Besides, the article investigates whether it is plausible that children in Islamic school in the Netherlands are indeed being indoctrinated.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    This article aims to deepen scholarly understanding of the Law and Society Movement (L&S) and thereby strengthen debates about the relation between Empirical Legal Studies (ELS) and L&S. The article departs from the observation that ELS, understood as an initiative that emerged in American law schools in the early 2000s, has been quite successful in generating more attention to the empirical study of law and legal institutions in law schools, both in- and outside the US. In the early years of its existence, L&S – another important site for the empirical study of law and legal institutions – also had its center of gravity inside the law schools. But over time, it shifted towards the social sciences. This article discusses how that happened, and more in general explains how L&S became ever more diverse in terms of substance, theory and methods.

    This study departs from the notion that current high-tech crime developments bring various new challenges for the rather anthropocentric, instrumental and dualistic theoretical repertoire of criminology. The article reflects on these challenges and proposes the alternative ‘cyborg crime’ perspective. This concept is the result of an explorative research on the theoretical potential of the actor-network theory (ANT) for cybercrime. The study concludes that ANT and the ensuing cyborg crime perspective enables to grasp certain dimensions of cybercrime more profoundly. ANT can move us (criminologists) beyond the classical novelty debate surrounding cybercrime and stimulate theoretical innovation.

    Nederlandse kinderen lijken minder te weten over kinder- en mensenrechten dan andere kinderen in Europa. Om die reden zien beleidsmakers, wetenschappers en maatschappelijke organisaties een noodzaak om formele educatie op deze onderwerpen te introduceren in alle onderwijsniveaus. Wat denken middelbare leerlingen zelf hier echter over? Dit artikel onderzoekt het rechtsbewustzijn van kinderen in drie Nederlandse middelbare scholen ten aanzien van hun specifieke rechten als kinderen. Het wordt duidelijk dat kinderen ideeën en meningen hebben over hun rechten en daarmee een rechtsbewustzijn hebben, ook als zij geen rechtenjargon gebruiken. Hun rechtsbewustzijn bestaat uit moraliteit, wat verklaart dat zij bepaalde rechten zelf bedenken: sommige thema’s vinden zij zo belangrijk dat zij voelen dat ze deel uitmaken van hun fundamentele rechten als kinderen. Het integreren van mensenrechteneducatie in het schoolcurriculum zou een nodige, maar is een onvoldoende oplossing voor het ‘probleem’ dat voor ons ligt. Het is namelijk niet bewezen of meer kennis op deze onderwerpen ook leidt tot verandering van gedrag. De kinderen maakten namelijk ook bewuste keuzes om níet hun rechten in te roepen, maar om hun problemen anderszins op te lossen. Dit moet worden meegenomen om interventies effectief te laten zijn, zodat niet het tegenovergestelde van wat gewenst is, wordt bereikt. En effectieve interventies dienen daarnaast aan te sluiten bij het dagelijks leven van de kinderen. Volgens de leerlingen zijn kinderrechten vooral ook iets dat we moeten doen en oefenen.
    Dutch children seem to be less informed about children’s and human rights than their peers in other European states. Therefore, policy makers, academics and CSOs recognise a need to introduce formal education on these matters in all levels of schooling. But what do secondary school children themselves think about this? This article explores the legal consciousness of children in three Dutch schools on their specific rights as children. It has been evidenced that children have ideas and opinions about their rights and therefore have a legal consciousness, though without using the language of the law. Their legal consciousness consists of morality, which explains their ‘invention’ of certain rights: some themes are of such importance that they feel these are part of their fundamental rights as children. Integrating human rights education into the school curriculum may be a necessary, but is an insufficient solution to the ‘problem’ at hand. It has not been evidenced whether more knowledge changes their behavior. The children made informed decisions to not invoke their rights, and to solve their problems differently. Effective interventions need to take this into account in order to relate to their everyday lives and avoid having the opposite effect of what is intended. According to the students, children’s rights are mostly something to be done or practiced.

    The American Legal Realism movement, which originated in the beginning of the twentieth century and was active until the Fifties, can be seen as one of the founders of current Empirical Legal Studies because of the importance it attached to social scientific knowledge on behavior of – for instance – judges and others involved in the judiciary. The author sketches several characteristics of Legal Realism at that time. Exploring their range of thought he also examines whether Legal Realism’s studies can be seen as a research program. The recent emergence of New Legal Realism in the US and elsewhere leads to the question what characterizes this (re)new(al) movement. Finally it is argued that American Legal Realism especially contributed to scientific progress by posing new questions, changing focus and by stressing the importance of empirical evidence.

    In this paper, an attempt is made to work out a methodology for comparative legal research, which goes beyond the ‘functional method’ or methodological scepticism.
    The starting point is the idea that we need a ‘toolbox’, not a fixed methodological road map, and that a lot of published, but largely unnoticed, research outside rule and case oriented comparative law offers varying approaches, which could usefully be applied in comparative research. Six methods have been identified: the functional method, the structural one, the analytical one, the law-in-context method, the historical method, and the common core method. Basically, it is the aim of the research and the research question that will determine which methods could be useful. Moreover, different methods may be combined, as they are complementary and not mutually exclusive.This paper focuses on scholarly comparative legal research, not on the use of foreign law by legislators or courts, but, of course, the methodological questions and answers will largely overlap.

    Rechtseenheid speelt in de juridische dogmatiek en de rechtsvorming een grote rol. Op tal van fronten wordt er onderzoek naar gedaan, beleid over ontwikkeld, en komt rechtseenheidbeogende wetgeving tot stand. Bij nadere bestudering blijkt het daarbij echter niet steeds over hetzelfde te gaan. In dit artikel wordt een typologie van varianten van rechtseenheid ontwikkeld. De auteurs analyseren het debat en trachten het te ontdoen van de begripsmatige verwarring. Vervolgens werken zij een van de varianten uit, namelijk rechtseenheid tussen rechtsnormen die niet logisch tegenstrijdig zijn. Daarna wordt besproken welke actoren en instrumenten een rol spelen bij het bewerkstelligen van die variant van rechtseenheid.

    This article, which is based on the research conducted for the General Report ‘Relief in Small and Simple Matters in an Age of Austerity’ presented at the XV World Congress of Procedural Law, provides a contextualised and broad overview of these phenomena in the United States. After describing the general features of the federal and state judiciaries, including its adversarial model of judging, and the importance of the jury system, the article turns its attention to discuss the factors that affect the cost of litigation in the United States, the different models of litigation funding, the available legal aid mechanisms, and the procedural tools available for handling small and simple disputes. Furthermore, this article briefly revisits the discussion about the effect of austerity on the functioning of the United States legal system on the handling of small and simple matters and ends with a brief conclusion that summarises its contribution and sketches the points for future research on this important topic.

    Child safety is an important condition for the healthy development of children. Child maltreatment is an extensive problem in society with significant medical, emotional, cognitive, social and economic consequences. In policy-making, attention for this phenomenon has increased, resulting in new laws and measures. However, the Committee for Childs Rights of the United Nations formulated numerous recommendations for a better implementation of the Convention on the Rights of the Child in the Netherlands. This article focuses on how child safety and children’s rights are related and explores the implementation of the convention, considering relevant new laws and scientific (field) research.

    This article describes the European research project ALTERNATIVE, which studies the possible implementation of restorative justice approaches in intercultural conflicts. Besides theoretical research into concepts such as justice, security, conflict (transformation) and restorative justice, action-research was implemented in four diverse intercultural settings (Austria, Hungary, Serbia and Northern Ireland). In order to compare those settings, an innovative comparative research method was developed through which the various realities are ‘thickly described’ within evaluation grids. The article describes the different aspects of the research and reflects upon the question whether a more broad understanding of restorative justice, surpassing the judicial sector and aspects, is emerging.

    There is a distinct place for legal doctrinal methods in legal-interdisciplinary research methodologies, but there is value to be had in expounding that place – in developing a deeper understanding, for instance, of what legal doctrinal analysis has to offer, wherein lies its limitations, and how it could work in concert with methods and theories from disciplinary areas other than law. This article offers such perspectives, based on experiences with an ‘advanced’ legal-interdisciplinary methodology, which facilitates a long-term study of the growing body of practice generated by citizen-driven, independent accountability mechanisms (IAMs) that are institutionally affiliated with multilateral development banks. The article demonstrates how legal doctrinal methods have contributed towards the design and development of a multipurpose IAM-practice database. This database constitutes the analytical platform of the research project and also facilitates the integration of various types of research questions, methods and theories.
