A forensic mental health report is requested in about 30% of more serious cases presented to the criminal court. These reports can be used at sentencing and advise the judge on criminal responsibility, recidivism risk, and possible treatment measures, but is not a formal factor in decisions about guilt. The current study focuses on the (unwarranted) effect of forensic mental health information on conviction decisions. Using an experimental vignette study among 155 criminology students, results show that when a mental disorder is present, conviction rates are higher than when such information is absent. In line with the story model of judicial decision-making, additional analyses showed that this effect was mediated by the evaluation of guilt rather than by the evaluation of other physical evidence. Implications for further research and practice are discussed. |

Werkstraffen en reclasseringstoezichten helpen vaak veel beter om mensen weer op het rechte pad te krijgen, en te houden. Ook mediation in strafrecht zou een prominentere plaats moeten krijgen. Tenslotte stellen de auteurs dat de samenwerking tussen partijen beter kan. Er is nog teveel landjepik. |

In this study we examine whether parental monitoring remains a protective factor in the lives of emerging adults, as well as the extent to which monitoring in other settings replaces the protective role of the parents. We use data collected for the TransAM project, a longitudinal survey of 970 emerging adults (18-24 years) to examine monitoring in a range of different contexts using an instrument based on Stattin and Kerr’s parental monitoring scale (2000). Results indicate that whilst parental control plays a protective role in the first years of emerging adulthood, we find no evidence that monitoring in other settings replaces the protective role of parents. However, monitoring of the self, i.e., self-control, has an increasingly strong relationship with delinquency during emerging adulthood. |

This article presents findings from a longitudinal study of 81 young recidivists examined over fifteen years. By the age of 25, 50 percent had desisted for at least three years. 60 percent had had no new police contacts during the last two years. Four stages could be distinguished in the desistance process. Apart from a small number of explicit persisters, all of the young adults did consciously consider whether the benefits of their criminal activities outweighed the disadvantages. With just a few exceptions, the decision to quit was not motivated by an altruistic goal, nor by extreme fear, but mainly motivated by the feeling of being too old for criminal life and by striving for a pleasant self-esteem. It is concluded that when young adult recidivists give up crime, this must be seen as an extreme and extremely late form of maturation. |

Voor risicogerichte handhaving van regelnaleving door bedrijven is het niet alleen van belang inzicht te verkrijgen in hoe vaak een bedrijf de regels overtreedt, maar ook welke regels worden overtreden. Patronen in de aard van regelovertreding kunnen indicatief zijn voor de achterliggende oorzaak van regelovertreding en daarmee nuttige kennis opleveren voor het vormgeven van effectieve handhavingsstrategieën. In deze studie brengen we patronen in de aard van regelovertreding in kaart voor 494 Nederlandse Brzo-bedrijven die vallen onder de Europese Seveso III-richtlijn. We maken hiervoor gebruik van zowel de diversiteitsindex als latenteklasseanalyse. Onze resultaten laten zien dat diversiteit in regelovertreding sterk samenhangt met de frequentie waarmee bedrijven regels overtreden. Regelovertredende bedrijven blijken doorgaans geen specialisten, maar generalisten. Implicaties voor toezicht en handhaving worden besproken. |

Reports by citizens are a great source of information for the police. Local residents often know well what is going on in their neighborhood and which situations are suspicious. In this study, an online survey was conducted to investigate what drives citizens to report to the police. A wide range of individual, social and institutional drivers were explored. The results show that the more often people have reported anything to the police in the past, the higher their risk perception, self-efficacy, citizen participation and police legitimacy. Furthermore, participants with a higher degree of self-efficacy, response efficacy, trust in the police and police legitimacy appeared to be more willing to report in the future. An open question regarding what motivates people the most to report show that response efficacy (the idea to what extent reporting has an effect on increasing safety and reducing crime) and altruistic values (justice, to help society and punish the perpetrators) were mentioned most frequently. |

It is unclear to what extent criminal record screening policies can explain low employment rates after release. This descriptive study provides more insight into this matter by examining whether ex-prisoners applied for a certificate of conduct, found employment and whether this job was found without such a certificate. To answer these questions interview data on ex-prisoners (N=931) are combined with data on criminal record screenings. Only 6 percent applied for a certificate, half of which were granted. Many ex-prisoners did not report any employment, but almost all working ex-prisoners found this job without a certificate. These findings bring nuance to discussions on the role of criminal record screening after release. |

In our daily decision-making processes, attitudes play an important role. An attitude is an evaluative judgement of a person, object or an issue on a scale of favorability. A large amount of research has been done on the role of attitudes in our daily decision-making processes. There is, however, a gap in empirical knowledge when it concerns the role of attitudes in the professional judicial decision-making process. It has been accepted that the professional judicial decision-making process has a subjective element, but this subjective element remains unexplained. Attitudes are inherently personal and subjective, and they can make our decision-making process easier. They can, however, also be the basis for biases and prejudices. Herein lies a potential risk, especially in the professional judicial decision-making process. If attitudes play a role in the decision-making process of judges there is a possibility that impartiality, one of the judiciary’s core professional values, might be unobtainable. To see whether attitudes play a role in the professional judicial decision-making process semi-structured interviews will be conducted among judges, who will also be asked to fill in a scenario survey. Hopefully the obtained data will lead to a start in filling this gap in empirical knowledge. |

Previously we have published an article about misunderstandings regarding trauma and PTSS. In this contribution we deal with other popular beliefs regarding trauma. We focus on trauma among professionals as a consequence of their work. It is explained that a professional does not have to witness violence or another severe case directly in order to develop some form of trauma. Next to that we focus on the misconception that professionals suffering from trauma can receive treatment without support of their loved ones and social network. It is explained that social support is not only relevant but necessary in treating trauma effectively. |

Prison visitation is important for protecting against social isolation during imprisonment. It is also essential for maintaining contacts that are important for life in prison and after release. It is therefore not surprising that both nationally and internationally important policy measures and scientific research have been undertaken on the topic. Nationally, however, limited scientific research is available regarding how many, how often and from whom prisoners receive visits, how visits are experienced and the possible effects of visitation, thus leaving many questions unanswered. Meanwhile, in the past ten years great changes have been made to visitation in Dutch prison policy and practice. Given these recent developments, both scientists and practitioners could benefit from an overview of the current state of affairs of visitation. This article aims to bridge the gap between research, policy and practice by summarizing findings from the Life in Custody study. This study includes a description of how visitation is organized legally, at the policy level and in practice, a thorough review of prior research on visitation and an analysis of the most recent national data on the prevalence and frequency of visitation, while considering important differences between prisoners and prisons. |

An exceptionally high prevalence of financial debt problems can be found among prisoners, but criminological knowledge on the link between debts and crime is limited. Previous studies are hindered by a lack of information on types of debts, informal debts and background characteristics. This article provides first and detailed insights in the types and amount of debts during and after prison in the Netherlands. Based on data from the Prison Project we show that the majority of prisoners report having debts during prison, show how different types of debts are related and how these debts change six months after release. |

This contribution provides an overview of the legal and criminological research into the decision following the determination of a supervisor that the conditions of a freedom-restricting sanction are not met. It is an important decision, on the one hand because it can result in a more severe sanction than was initially imposed, on the other hand because a decision that is perceived as unfair can influence the extent to which suspects and convicts are willing to comply with conditions, and recidivism. Yet little research has been conducted into this decision. The legal safeguards with which it is accompanied are lagging behind those of the original sentencing decision. Undeserved according to penitentiary experts. The scarce empirical research shows that decision-making involves many different layers and that the actors involved have different goals, ranging from deterrence and emphasizing the credibility of the system to the successful completion of the sanction. Even in countries where regulations have been tightened considerably, the discretionary power of direct supervisors, such as employees of the working project or therapists, is still large. This raises the question to what extent the final decision maker (usually a judge) still has sufficient room to make an independent decision. |

There is no clear answer to the question if corruption makes victims. Currently an (international) discussion is taking place about this matter. On the one hand it can be discussed that corruption in general does not know any direct victims and that corruption can even take place without any damage. On the other hand it is known that corruption can cause tremendous public and financial damage, with society as a whole as the victim of this crime, whether or not in primary gradation. In the underlying article these two perspectives will be discussed and applied on two cases. Special attention will also be paid to the impact and relevance of pointing out the victims. |

This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6). |
