Ethnic profiling by governments unfortunately has a worldwide interest. If we look at the Dutch situation, it turns out that the problem is not limited to the police. Serious problems also arise when it comes to checking the legality of tax benefits and detecting benefit fraud. In this contribution, the authors draw attention to racial discrimination due to the use of profiles by government institutions in the Netherlands. It seems that our anti-discrimination legislation is in good order and that raises the question of whether legal refinement is needed or whether solutions should be sought outside the legal sphere. The authors think the latter strategy and make suggestions for a more holistic solution direction. |

Ever since the 2015 start of what is now often referred to as the European ‘migration crisis’, European member states have been struggling with one of the key fundaments of the European Union and in particular the Schengen Agreement: the principle of free movement. Whereas this principle entails that people should be able to move freely within the Schengen Area, as a result of the ongoing securitization and politicization of migration, Member States are exploring the different opportunities the Schengen Border Code allows them to monitor intra-Schengen cross-border mobility. In doing so, countries seem to have two options: either to temporarily reintroduce border controls or to – permanently – carry out police or immigration controls in an area around the border. In this article we explore and critically assess the choices various countries have made and what seems to be the position of the European Commission in all this. |

The main question of this contribution is whether the use of ethnic profiling in migration control is an infringement of the prohibition of racial and religious discrimination. To answer this question, the regulation on migration control is analyzed and the trend of mixing criminal law with migration law is criticized. The influence of quota of irregular migrants who should be expelled and penalizing of illegal residence is studied. Taken into account the jurisprudence on the issue, the author argues that profiling based on race and religion is forbidden, which is also the case if nationality is used in profiles against EU-citizens. |
