Sinds inwerkingtreding van de WAMCA kent de collectieve actie een procedurele tweedeling in een ontvankelijkheidsfase en een inhoudelijke fase. Inhoudelijke behandeling van de vordering vindt ingevolge art. 1018c lid 5 Rv pas plaats indien en nadat de rechter over de ontvankelijkheid heeft beslist. De vraag is in hoeverre de twee fasen los van elkaar kunnen worden gezien, nu elementen van de ontvankelijkheidstoets nauw zijn verweven met de inhoudelijke beoordeling. De auteur maakt een vergelijking met de Amerikaanse federale class action, die een soortgelijke problematiek kent, en betoogt dat een genuanceerde toepassing van art. 1018c lid 5 Rv aangewezen is. |

The role that Paul Scholten assigns to conscience in his legal methodology still leads to heated discussions in literature after almost 100 years. Recognizing that in case law the conscience of the judge can be of decisive importance is apparently problematic. It would facilitate political court rulings, make judicial judgment uncontrollable and could be arbitrary for the parties to the legal dispute. Not only Scholten’s view on the role of conscience in judicial decision making is “a stumbling block”. At least as great is the fuss about his representation of conscience. Only Christian lawyers could identify with this. This article attempts to shed new light on the above points of criticism by drawing attention to the following aspects of Scholten’s legal methodology: the role of the facts in establishing the law, the nature of the legal judgment and finally the grounds on which conscience may be determined. |

Long before the coming of the Bill of Rights in written Constitutions, the common law has had the greatest regard for the personal liberty of the individual. In order to safeguard that liberty, the remedy of habeas corpus was always available to persons deprived of their liberty unlawfully. This ancient writ has been incorporated into the modern Constitution as a fundamental right and enforceable as other rights protected by virtue of their entrenchment in those Constitutions. This article aims to bring together the various understanding of habeas corpus at common law and the principles governing the writ in common law jurisdictions. The discussion is approached through a twelve-point construct thus providing a brief conspectus of the subject matter, such that one could have a better understanding of the subject as applied in most common law jurisdictions. |

Wrongful convictions and miscarriages of justice, their reasons and effects, only rarely become the subject of academic debate in Poland. This article aims at filling this gap and providing a discussion on the current challenges of mechanisms available in Polish law focused on the verification of final judgments based on innocence claims. While there are two procedures designed to move such judgment: cassation and the reopening of criminal proceedings, only the latter aims at the verification of new facts and evidence, and this work remains focused exactly on that issue. The article begins with a case study of the famous Komenda case, which resulted in a successful innocence claim, serving as a good, though rare, example of reopening a case and acquitting the convict immediately and allows for discussing the reasons that commonly stand behind wrongful convictions in Poland. Furthermore, the article examines the innocence claim grounds as regulated in the Polish criminal procedure and their interpretation under the current case law. It also presents the procedure concerning the revision of the case. The work additionally provides the analysis of the use of innocence claim in practice, feeding on the statistical data and explaining tendencies in application for revision of a case. It also presents the efforts of the Polish Ombudsman and NGOs to raise public awareness in that field. The final conclusions address the main challenges that the Polish system faces concerning innocence claims and indicates the direction in which the system should go. |

In this article, we analyze which aspects of performance theory and the procedural justice-based model are explaining the trust of shopkeepers in the police and local government. Utilizing a survey of 156 shopkeepers and 94 semi-constructed interviews with shopkeepers, which are located at the South Shopping Boulevard in Rotterdam (The Netherlands), the study finds that shopkeepers have a relatively high trust in the police and local government. This is surprising because various attempts in the past 30 years to revive the high street by the government have failed to improve its bad image, as dwindling visitor numbers, poor turnover, limited range of retailers, empty shops and high crime and offence levels show only too plainly. The findings also highlight that ethnic minority respondents have more trust in local government than Dutch shopkeepers. The explanation therefor is sought in the dual frame of reference theory. |

Organizing dog fights is prohibited in the Netherlands. In such fights, two dogs have to fight each other, sometimes to the death. The animal suffering behind this is enormous. Little is known in the Netherlands about the phenomenon of dog fighting, both from a scientific point of view and through criminal cases. In this contribution, we outline the world behind dog fights by describing how dog fights work, who are part of the entourage and within which criminal infrastructure the dog fights take place. Finally, the problem is discussed and the current approach by the appropriate authorities is discussed and which gaps can be discovered. |

The aim of this study was to investigate the scale and network structure of prostitution in the northern provinces of the Netherlands. This study tries to answer three research questions – using a social network analysis – about (1) the size of the prostitution network, (2) the formation of subgroups, and (3) key positions within the networks. The findings show that approximately two thirds of the researched prostitution networks is still unregistered, while there are indications that the outcome of the estimate is in line with the actual situation. Furthermore, results show that prostitutes have a tendency to form subgroups on the basis of the same nationality, which indicates that homophily plays a role in the formation of subgroups. The identification of the actors who occupy key positions in the network were based on the key player problem (KPP). A striking finding was that organizers of prostitution (such as pimps) did not have a central position in the networks. These findings provide insight into the way in which prostitution is registered, and provide points of departure for interventions to disrupt the network or, on the contrary, to strengthen it. |

Criminology has traditionally focused on urban areas where crime visibly concentrates. However, since the 1990s, attention for ‘rural criminology’ has steadily increased. First, rural areas are confronted with partly different and less visible crime problems, such as environmental crimes. Second, public actors such as enforcement and other agencies are less present and ‘available’ in rural areas, and people on average trust the government less to provide support when necessary. This chronicle presents an overview of international and Dutch research in the context of rural criminology. The paper addresses cultural differences between urban and rural areas, high-volume crimes, gender-related violence, alcohol and drug abuse, environmental crime, and enforcement in rural areas. |

This article aims to clarify the phenomenon of iconoclasm and how it impacts today’s society, in spite of the lack of research on this topic. After establishing its complex and sensitive nature, a first assessment containing types of iconoclasm and various motives of iconoclasts is presented. Different forms of iconoclasm are distinguished, explained and illustrated using examples. Special attention is given to the subject’s sensitivity in modern society while establishing the connection of the topic with identity in multiple shapes and forms. The article aims at contributing to a future multi-disciplinary debate. |

This article argues that it is legitimate for the state to practice soft paternalism towards changing hearts and minds in order to prevent behaviour that is discriminatory. Liberals accept that it is not legitimate for the state to intervene in order to change how people think because ideas and beliefs are wrong in themselves. It is legitimate for the state to intervene with the actions of a person only when there is a risk of harm to others and when there is a threat to social coexistence. Preventive action of the state is legitimate if we consider the immaterial and material harm that discrimination causes. It causes harm to the social standing of the person, psychological harm, economic and existential harm. All these harms threaten peaceful social coexistence. This article traces a theory of permissible government action. Research in the areas of behavioural psychology, neuroscience and social psychology indicates that it is possible to bring about a change in hearts and minds. Encouraging a person to adopt the perspective of the person who has experienced discrimination can lead to empathetic understanding. This, can lead a person to critically evaluate her prejudice. The paper argues that soft paternalism towards changing hearts and minds is legitimate in order to prevent harm to others. It attempts to legitimise state coercion in order to eliminate prejudice and broader social patterns of inequality and marginalisation. And it distinguishes between appropriate and non-appropriate avenues the state could pursue in order to eliminate prejudice. Policies towards eliminating prejudice should address the rational and the emotional faculties of a person. They should aim at using methods and techniques that focus on persuasion and reduce coercion. They should raise awareness of what prejudice is and how it works in order to facilitate well-informed voluntary decisions. The version of soft paternalism towards changing minds and attitudes defended in this article makes it consistent with liberalism. |

The article analyses the jurisprudence of international tribunals on the education and housing of Roma and Travellers to understand whether positive obligations can change the hearts and minds of the majority and promote minority identities. Case law on education deals with integration rather than cultural specificities, while in the context of housing it accommodates minority needs. Positive obligations have achieved a higher level of compliance in the latter context by requiring majorities to tolerate the minority way of life in overwhelmingly segregated settings. Conversely, little seems to have changed in education, where legal and institutional reform, as well as a shift in both majority and minority attitudes, would be necessary to dismantle social distance and generate mutual trust. The interlocking factors of accessibility, judicial activism, European politics, expectations of political allegiance and community resources explain jurisprudential developments. The weak justiciability of minority rights, the lack of resources internal to the community and dual identities among the Eastern Roma impede legal claims for culture-specific accommodation in education. Conversely, the protection of minority identity and community ties is of paramount importance in the housing context, subsumed under the right to private and family life. |

Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling. |

Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate. |

The contribution of sport to reintegrating offenders receives limited attention, both in science and in the practice of probation and the prison system. From the perspective of desistance, this literature study concluded that sport can contribute to the development of individual capital, social capital and an alternative identity. However, the effect of sport is not necessarily positive. There are risks of negative influence or the reinforcement of problem behaviour. In counselling offenders, sport should be combined with other interventions to reduce recidivism. A personalized approach is required, based on the risk-need-responsivity model. |

This article discusses the concepts of society and community involvement as they appeared in the articles of the Dutch-Flemish Tijdschrift voor Herstelrecht (Journal of Restorative Justice) during last 20 years. It shows how the journal from its very beginning adopted a strong focus on criminal justice reform, although restorative practices within the community occupied a considerable space in the consecutive volumes as well. Studies on restorative justice programmes in Belgium and The Netherlands, such as victim-offender mediation and family-group conferences, revealed a predominant orientation on interpersonal relationships stressing the role of the community of care. In the same sense, also community mediation and other community oriented restorative practices focus on the personal well-being of people and the improvement of personal and social relationships. Hence, both theory and practice face two important challenges in developing restorative justice: (1) which role to give to a larger community and how to operationalize its involvement, and (2) how to deal with underlying causes of crime and social-structural injustices? Referring to European action-research projects and to conceptual models developed outside Europe, a case is made for designing restorative justice methodologies and programmes involving civil society in a more encompassing way and linking micro to macro societal levels. Developing strategic alliances with new social movements could be the way forward. |

Het afgelopen jaar hebben burgemeesters naar aanleiding van ernstige steekincidenten en vanwege desastreuze gevolgen van de coronacrisis voor de meest kwetsbare buurten gepleit voor een integrale aanpak gericht op deze gebieden. Minister Dekker heeft daarop onder meer voorgesteld om de ouders van deze jongeren aan te pakken. Hij denkt daarbij aan het Britse jeugdstrafrecht, waar ouders een sanctie kan worden opgelegd vanwege wangedrag van hun kind. In dit artikel worden kritische kanttekeningen bij dit voornemen geplaatst. |
