Terrorism can only be brought to an end if Islam and the Muslim community are enlisted as allies in combating it. Underlying militant jihadism is a violent interpretation of Islam which can best be challenged with the assistance of Islam and the Muslim community. Since the effects of the current state-led approach are questionable, while its criminal law component is close to exceeding the limits set by the rule of law and turns Muslims into a suspect community, it is important to test by way of a pilot whether an approach based on Islam can reap more promising results.

In het kader van ontwrichtende criminaliteit ontstaat steeds meer aandacht voor de gebruikerskant. Zo ook voor de harddrugsgebruiker, die een ontwrichtende invloed op de samenleving heeft. Dit artikel beantwoordt daarom de vraag of strafbaarstelling van harddrugsgebruik legitiem en rechtvaardig is. Teneinde deze vraag te beantwoorden wordt getoetst aan de criteria voor strafbaarstelling en worden de argumenten die ten grondslag liggen aan de strafbaarstelling van de prostituant die misbruik maakt van prostituees die slachtoffer zijn van mensenhandel ter inspiratie gebruikt.

De auteur gaat in deze bijdrage in op de normering van (beperkt) onderzoek in smartphones en vergelijkbare apparaten, waarbij hij in de toekomst een rol weggelegd ziet voor de hulpofficier van justitie.

Restrictions imposed by the state on the exercise of religion are always the result of a weighing of interests by a judge, an administrative body or a legislator. This weighing of interests is strongly influenced by the context within the exercise of religion take place. In this article four different spheres are distinguished: the internal religious sphere, the public sphere, the sphere of private institutions and the government sphere. The particular relationship that these spheres have with neutrality characterizes the balancing of interests. This explains and justifies why wearing religious clothing may be restricted in some situations and not in others.

There is casuistry, where on the one hand it is the turn of the professionals from the investigation, enforcement and prosecution and on the other hand the turn of the social workers from the social domain. This is the case, for example, when domestic violence occurs in circles that are also involved in organized crime. In theory it is possible that the professionals involved work together, but it is also not impossible that they will get into each other’s waters because they have a different vision of the problem to be tackled and, of course, also have to fulfill other roles and tasks based on their positions. A professional must be able to handle complex situations of this kind.

This article describes the backgrounds, the development and first findings on youth courts in the Netherlands. A Dutch version of the USA youth courts was developed and piloted in 4 Amsterdam schools. Cases referred are small (partly illegal) incidents committed in the school environment. The Dutch youth court practice is described against the background of transformational change in society and the development of restorative justice and (peer oriented) development of citizenship. Although the model is still in development and schools are somewhat reluctant to deliver and refer cases, practice is growing.

De Pensioenwet is in 2007 in werking getreden. Deze wet geeft regels betreffende het – aanvullend – pensioen in de werkgever-werknemersverhouding. De Pensioenwet beoogt aan werknemers financiële en uitvoeringszekerheid te geven, opdat hun pensioenverwachtingen ook uitkomen. Kort na inwerkingtredingen ontstonden hierin al teleurstellingen van werknemers: de financiële en kredietcrisis sloeg een bres in het vermogen van pensioenfondsen en voor veel rechthebbenden waren kortingen nodig. Dit leidde tot een nu al jaren durend debat over de inrichting van het pensioenstelsel in de toekomst. Tegen die achtergrond geeft dit artikel een overzicht van de juridische aandachtspunten van tien jaar Pensioenwet.
