    This paper uses Stoic theory of language to gain more insight into Roman lawyer Proculus’s legal opinions on the meaning and understanding of ambiguous testaments, wills and dowries. After summarizing Stoic theory of language, the paper discusses its reception in Roman jurisprudence and situates Proculus in a Stoic legal/philosophical context. The meat of the article lies in the re-examination of Proculus’s legal opinions on ambiguities in light of Stoic theory of language, through: (1) the analysis of a case demonstrating that Proculus’s embeddedness in Stoic doctrine went beyond his technical competence in propositional syllogisms, going into the territory of Stoic physical materialism and, (2) the investigation of four cases that reveal how his approach to problems of ambiguity in unilateral legal acts converges with the Stoic conception of the parallelism between speech and thought.

    The power to regulate on-board protection of merchant vessels lies with the flag state. However, the national models of regulation are not developed in a unilateral vacuum. In fact, the whole concept of flag state jurisdiction and legislative power has to be understood and exercised on the national level in close relation with the general regime of the international law of the sea. The aim of the article is therefore two-fold: first, it aims to provide a background for the country reports in this special issue by giving a brief insight into the problem of piracy in the twenty-first century and the international approaches towards this problem. Here the article also provides an insight into the legal background by presenting the concept of piracy in the law of the sea and connected law enforcement powers. Thus, this part of the article provides the overall context in which the discussions concerning on-board protection and the development of national regulations have occurred. Second, the article analyses the issue of on-board protection from the perspective of the legal framework in international law, as well as relevant international soft-law instruments, influencing the development on the national level. On-board protection of vessels as such is not regulated in the international law; however, international law provides a form of general legal setting, in which flags states navigate. Thus, this article aims to draw a picture of the international context in which flags states develop their specific legal approach.

The special provisions for air carriers under Austrian law only apply to air carriers that have their principal place of business in Austria.     An acquired mother tongue is – at least indirectly – connected to a person’s origin and therefore also linked to ethnic origin. Claims based on the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, the ‘AGG’) must be brought in writing within two months after knowledge of a possible discrimination. Time only starts to run for claims after the employer has provided an unsuccessful job applicant with a clear and definite statement that he or she has been rejected. The limitation period under the AGG will not be triggered by lapse of time only.

    Following consultations with its employees in accordance with the Finnish Codetermination Act (334/2007), a company informed the employees that it would close down its current office premises and move its operations, including all of its employees, to another location. An employee, whose employment contract expressly stipulated the location of the old office as the fixed place of work, refused to transfer and did not arrive at the new place of work after the transfer. The company considered the employee’s absence unjustified and terminated her employment with immediate effect. The Supreme Court held that an employer can, as an alternative to termination of employment, unilaterally amend material terms of employment provided it notifies the employees sufficiently clearly of the terms being amended, the time when the new terms would come into effect, the grounds for termination, and the consequences of not accepting the amendments.

    The Curia (Hungarian Supreme Court) stated in its ruling that length of service is not a protected characteristic under discrimination law. Length of employment cannot be considered as a core feature of the individual based on which he or she would belong to a specific group, as it is a result of his or her own actions. It therefore cannot be treated as a ‘miscellaneous’ ground for the purposes of the Hungarian Equal Treatment Act. Further, length of service cannot be linked to age discrimination. The length of service of an employee is not directly connected to age, therefore treatment of an employee based on length of service with a specific organisation cannot be considered age discriminatory.
    A claim based on discrimination must be supported by a comparator. Employees with different educational backgrounds and jobs with different the educational requirements, are not comparable for the purposes of equal treatment law.

    De communicatieve benadering van wetgeving heeft aanleiding gegeven tot de nodige wetenschappelijke discussie. In deze bijdrage gaat de auteur nader in op de aangevoerde kritiekpunten. Doel van dit artikel is te bepalen in welke opzichten de communicatieve benadering aanvulling of correctie behoeft. Conclusie is dat het achterliggende democratische ideaal nog steeds relevant is: de wens om burgers meer te betrekken bij de totstandkoming en de uitvoering van wetgeving. Tegelijk moet beter rekenschap worden afgelegd van de processen van in- en uitsluiting waarmee wetgeving onvermijdelijk gepaard gaat. Niet iedereen kan, mag of wil meepraten over de betekenis van de wet, niet elk gezichtspunt kan in het uiteindelijke wetgevende besluit erkenning krijgen.

    In deze bijdrage wordt tegen de achtergrond van de Wet NErpe bekeken hoe in twee nabuurstaten met een belangrijke en invloedrijke constitutionele cultuur, Frankrijk en Duitsland, het centrale toezicht op naleving van Europese Unierecht door lagere overheden c.q. deelstaten is geregeld. Opvallend is dat de federale staat Duitsland wel een algemene, niet specifiek voor het Unierecht geschreven, taakverwaarlozingsregeling kent, terwijl deze in de gedecentraliseerde eenheidsstaat Frankrijk ontbreekt. In Frankrijk wordt de noodzaak van zo’n algemene regeling betwijfeld: een regresrecht zou voldoende zijn om de lagere overheden in te tomen. De Duitse taakverwaarlozingsregeling is praktisch vrijwel onbruikbaar. In plaats van haar inzet te vergemakkelijken, heeft de grondwetgever in 2006 twee regresregelingen ingevoerd.

    Since the last years there is extensive ongoing debate in Belgium about jury trials at the Assize Court. These trials are an example of direct participation of citizens in the criminal justice system. Hence this jury has obtained a special position in the Belgian administration of justice. Jury deliberations behind closed doors and the isolation of jury members from the outside world contribute to the fascination for this legal phenomenon. The element of secrecy also explains why there is so little empirical research on the jury’s functioning and the jurors’ experiences during the process. By means of interviews with former jury members, we studied the influence of lay participation in a jury trial on their views and confidence in jury decision making. We found that a positive evaluation of participation in a jury may strengthen their involvement with and trust in jury decision making. However, our research also reveals that jury trials may lead to some unacceptable deficits in the proceedings and outcome of the process. These results are contextualised in the broader debate about the jury and the demand for reform of the assize court proceedings.
