    Het afgelopen jaar hebben burgemeesters naar aanleiding van ernstige steekincidenten en vanwege desastreuze gevolgen van de coronacrisis voor de meest kwetsbare buurten gepleit voor een integrale aanpak gericht op deze gebieden. Minister Dekker heeft daarop onder meer voorgesteld om de ouders van deze jongeren aan te pakken. Hij denkt daarbij aan het Britse jeugdstrafrecht, waar ouders een sanctie kan worden opgelegd vanwege wangedrag van hun kind. In dit artikel worden kritische kanttekeningen bij dit voornemen geplaatst.

    For social scientists undertaking critical research on elites in organisational contexts securing access is a challenging exercise that may rely on the use of several access strategies over extended periods. This process is further complicated by the existence of research ethics frameworks that establish boundaries to access strategies, posing dilemmas on how to best balance access needs with a commitment to ethical practices. This article focuses on such dilemmas – or the ‘ethics of access’ – through a reflection on PhD fieldwork during 2016-2017 in Luxembourg spent researching the European Investment Bank. The paper will conclude by calling for an overhaul of existing frameworks in order to foster more research on elites.

    The Singapore International Commercial Court (‘SICC’) was launched on 5 January 2015, at the Opening of Legal Year held at the Singapore Supreme Court. What prompted the creation of SICC? How is the SICC model of litigation different from litigation in the Singapore High Court? What is the SICC’s track record and what does it tell us about its future? This article seeks to answer these questions at greater depth than existing literature. Importantly, it examines these questions from the angle of reimagining access of justice for litigants embroiled in international commercial disputes. It argues that the SICC’s enduring contribution to improving access to justice is that it helps to change our frame of reference for international commercial litigation. Hybridisation, internationalisation, and party autonomy, the underpinning values of the SICC, are likely to be the values of the future of dispute resolution. International commercial dispute resolution frameworks – typically litigation frameworks – that unduly emphasise national boundaries and formalities need not and should not be the norm. Crucially, the SICC co-opts a refreshing public-private perspective to the resolution of international commercial disputes. It illuminates on the public interest element of the resolution of such disputes which have for some time fallen into the domain of international commercial arbitration; at the same time, it introduces greater scope for self-determination in international commercial litigation.

    For quite some years now, crimes of ‘the powerful’ have been studied by criminologists. While researching crimes of ‘the powerful’, researchers aim to maintain and safeguard their integrity and ethics. However, there seems to be a friction between, on the one hand, ethics of the researchers themselves and on the other hand, ethics (policies) of universities. Obviously, not only do they have to justify their actions and decisions to themselves and ‘science’ as a whole, they must justify their research to ethics committees (EC’s) of universities. It could result in complex and difficult situations when researchers suspect that EC’s themselves may be instruments and products of the powerful groups they are studying. In that case, EC’s might undermine ethics and research integrity themselves. What do certain EC- ‘conditions’ look like for research ethics and to which extent do they have to be adjusted or reconsidered when criminologists are researching ‘the powerful’? The key question that will be answered in this contribution is as follows: how can criminologist (re)act ethically responsibly when confronted with (un)ethical committees? To answer this and other relevant questions, after reviewing literature, we reflect on a biographical study of a legal arms trader. We then elaborate on the ‘ethics creep’ (Haggerty, 2004) that seems to haunt social sciences nowadays.

    The Netherlands are considered as an important hub for the illicit trade in species of endangered birds protected by the CITES convention. In this article the authors analyze five substantial criminal cases from three different perspectives. First, from a criminal business perspective, the cases illustrate that logistics vary from relatively simple to highly complex, but always require in-depth knowledge of the animals as well as regulations, to be able to keep the birds alive to make a profit, and to smuggle them to the Netherlands, respectively. Second, from a network perspective, it is clear that those who are involved in the illicit trade – suppliers, traders and customers – are part of a closed and often long-lasting group of people who know the trade. Finally, from a green criminological perspective, the authors conclude that harms of the illicit trade in protected birds are mentioned only to a limited extent in court rulings, contrary to what one might expect based on social construction theories of criminalization and sentencing.

    Changing ecological conditions in a globalizing world pose new challenges for human societies. Global warming, large-scale pollution, deforestation and species extinction have increasingly become topics on the international agenda. Even though many of these harmful activities are criminogenic, criminology pays rather little attention to environmental crimes and harms.
    Therefore, this article discusses the anthropocentric perspective within criminology and argues that a non-anthropocentric criminology can lead to new theoretical insights.

    Collective violence around football has been a topic of research since the 1980s. In the Netherlands, in recent decades the size and severity of this problem have decreased sharply and the number of incidents has stabilized due to measures taken. At the same time, these measures have resulted in an increase of football-related incidents outside stadiums and on other days than match days. Confrontations based upon prior mutual agreements, so-called arranged confrontations, are an example of this. Based on multiple research methods, in this article the underlying causes of arranged confrontations and processes influencing individual participation are addressed. Results show that this type of collective violence and partaking in it has various causes and explanations. These fit with extant research literature in the area of group crime and collective violence and are incorporated in the recently developed initiation-escalation model.

    This research paper looks at the relationship between substance use and delinquency among young adults (aged 15 till 25 years) in a probation service for addicted offenders. Using a qualitative research method, twelve young adults give their opinions on the origin and development of their own problematic behavior. Results indicate that there is a relationship between substance use and delinquency, though determining causality is difficult and differs on an individual basis. They explain that this relationship is usually established in a risky environment and gradually grows by encounters with both substance use and criminal behavior, often early on in childhood. Friends and family introduced them to a problematic lifestyle in which drugs, alcohol and criminal offences appeared to be normal. Looking for excitement, being part of a group and experiencing positive effects after using substances are factors that stimulate them to continue with this behavior. The downside being that these adolescents get deeper into trouble and develop a dependency for this lifestyle. At that moment, certain turning points can offer a way to escape from using substances and/or committing offences

    The current vignette experiment among 414 students in the Netherlands explores the effect of the police response on willingness to cooperate and examines whether this relationship is mediated by perceptions of the legitimacy of the police. This is done based on Tyler’s procedural justice theory and previous research among crime victims. The police response in the vignette was manipulated in two ways: the police offered a fair/unfair treatment and had/had not performed investigative actions. There was no police contact in a control group. The results suggest a positive effect of the police response on willingness to cooperate and imply that this relationship is mediated by perceived trust in the police.

    Tackling honour related violence is part of the Dutch policy on domestic violence. On the police level a centre of expertise was installed, the LEC EGG. Next to strategies with regard to detection, the LEC EGG has put forward instructions with regard to the application of police mediation in cases of honour related violence.     This narrative aims to identify a number of challenges for the future of (green) criminology. It discusses what the three traditional criminological questions about criminalization, etiology and the social reaction imply in a ‘green’ context. For each of those topics, we analyse where the goals of green and mainstream criminology align and pay attention to research projects on these topics in the Netherlands and Belgium. In the end, this allows us to identify the following challenges for the future of (green) criminology: theoretical foundations, methodological creativity, interdisciplinary research projects and dialogue, and a research focus that goes beyond a preoccupation with the Global North.

    Over the last decades the number of people who have been detained on the suspicion of terrorism has significantly grown. This has resulted in an increased scholarly interest in the topic of prisons and terrorism. However, the main focus of academic research has been the period of incarceration. Especially the question whether terrorists should be isolated from other prisoners has received considerable scientific attention. What happens after their release still remains opaque. In this article some preliminary insights will be shared on particular aspects of the societal reintegration of former suspected terrorist detainees. It presents some of the obstacles, dilemmas and opportunities. These insights where obtained through semi-structured interviews with both professionals and former detainees with a jihadist background.

    An explicit goal in the Dutch victim policy is to offer protection to victims of crime. Based on a EU Directive all member states shall ensure that victims receive a timely and individual assessment, to identify specific protection needs. In this paper the question is: which victims especially do need protection? More specific, it examines whether the victim-offender relationship, controlling for the confounders ‘type of crime’ and ‘gender of the victim’, contributes to the extent in which protection is a reason for reporting crimes to the police. For victims of domestic violence (by partners, ex-partners and (other) family members), the need for protection is an important reason for reporting – not just for women and girls, but also for men and boys.     In this article, the questions why scientific misconduct has become a subject of criminological research and how scientific misconduct relates to a production-oriented academic culture are examined. It is argued that the current academic career path produces an anomic academic culture. The authors further examine the slippery notion of the term ‘scientific misconduct’ and conclude that questions about the prevalence or increase of scientific misconduct are hardly answerable. They also point at a number of undesirable side-effects of the emerging culture of distrust and control in academia, amongst which socially disengaged, highly predictable and little innovative research. They end with a plea to recapture a truly academic culture.

    Scientific misconduct takes place at the heart of higher education organizations. Organizational culture (meso level) shapes scholars’ behaviors and perceptions (micro level) about what should be problematized while conducting research and teaching. In this paper it is argued that there are organizational mechanisms at place by which organizational goals (funding) and professional goals (recognition) become indistinguishable. The mechanisms are: pressure, loose social control, scarce resources and lack of alternatives. Scholars may strategically react to these mechanisms by accepting, fitting in, resisting or giving up. It is at the heart of these mechanisms and strategies that problematic behaviors may emerge.

    The current study examined the extent to which risk factors and treatment readiness were related to prison based treatment engagement (i.e. participation and completion), using a large sample of detainees who were a candidate for the Prevention of Recidivism program. Analyses showed that offenders who were treatment ready were over two times more likely to complete treatment programs, compared to offenders who were not. Risk factors did, for the most part, not correlate with treatment participation and completion. Outcomes underlined the importance of motivational aspects and showed the significance of enhancing treatment readiness amongst correctional resocialisation participants.

    In this article Huub Sprangers describes the development of the Dutch Mediatorsfederation, which started its activities at the end of 2013. Several pre-existing Dutch mediation organisations cooperate in this new federation.

Ir. H.F.A. Sprangers (1949) is oud-ondernemer. Hij was tussen 1999 en 2005 voorzitter van de Vereniging Bouwmediators.nl en haar rechtsvoorganger NMI Groep Bouw. Daarnaast was hij rond de eeuwwisseling actief voor de Regio NMI Mediators Haaglanden, voor wie hij een samenwerking met de Kamer van Koophandel realiseerde, en in dezelfde periode grondlegger, medeoprichter en vervolgens eerste voorzitter van de Nederlandse Mediatorsvereniging (NMv; 2000-2008). Hij is sinds 2008 erevoorzitter van de NMv en zat van 2002 tot juli 2011 namens de NMv in het bestuur van het Nederlands Mediation Instituut (NMI). Van 2005 tot medio 2011 was hij voorzitter/coördinator van het Centraal Mediators Beraad, een informele samenwerking tussen NIP sectie mediation (psychologen), NMv, NVvMA (advocaten), vFAS (familierecht) en VMSN (notarissen).     By introducing the historical concept of timescapes, we will investigate the transformation of a security to a risk culture in Dutch post war history. We will test Ulrich Beck’s paradigm of the risk society with respect to the Dutch policy arena, and we will analyze what drove this postulated transformation in the Netherlands. In the Netherlands, not the 1970s/1980s, but the 1990s saw the onset of this change. Concrete trigger moments and the rise of a new populist movement around 1999 signalled the beginning of this new mode of risk governance that was consolidated after 2001. With this description, an attempt to historicize the development of an all encompassing national security culture is provided.

    As a contribution to literature drawing together green criminology and studies of organized and corporate crime, this paper provides a case study of crimes and public health harms linked to the Naples garbage disposal crisis. The context is the inability of modern consumer society to cope with the problem of mass production of waste. In turn this leads to opportunities for both legal and criminal entrepreneurs to offer services that promise but fail to ‘dispose’ of the problem. The analysis draws upon environmental law and classic studies of organised crime.
