    This article introduces the concepts of play and playfulness within the context of legal-philosophical education. I argue that integrating play and playfulness in legal education engages students and prepares them for dealing with the perpetual uncertainty of late modernity that they will face as future legal professionals. This article therefore aims to outline the first contours of a useful concept of play and playfulness in legal education. Drawing on the work of leading play-theorists Huizinga, Caillois, Lieberman and Csikszentmihalyi, play within legal education can be described as a (1) partly voluntary activity that (2) enables achievement of learning goals, (3) is consciously separate from everyday life by rules and/or make believe, (4) has its own boundaries in time and space, (5) entails possibility, tension and uncertainty and (6) promotes the formation of social grouping. Playfulness is a lighthearted state of mind associated with curiosity, creativity, spontaneity and humor. Being playful also entails being able to cope with uncertainty. The integration of these concepts of play and playfulness in courses on jurisprudence will be illustrated by the detailed description of three play and playful activities integrated in the course ‘Introduction to Legal Philosophy’ at the Vrije Universiteit Amsterdam.

    In Bezug auf den überlebenden Ehegatten des Erblassers hat der polnische Gesetzgeber einige besondere Regelungen geschafft, die sich auf die Verstärkung seiner Stellung richten. Die besondere und einmalige Rolle, die ein Ehegatte im Lebensbereich des anderen Ehegatten spielt, spricht eindeutig für die Bevorzugung des überlebenden Ehegatten auf den Todesfall des anderen Ehegatten.
    In der polnischen Rechtsordnung kann der Pflichtteilsberechtigte die Herausgabe oder die Eigentumsübertragung von Sachen aus der Erbschaft nicht verlangen. Der Pflichtteilsanspruch ist lediglich ein Geldanspruch, der sich gegen die Erben richtet. Die Hauptgedanke der polnischen Regelung in Bezug auf das Pflichtteil ist positiv zu bewerten. Einerseits kann der Erblasser über den Nachlass auf den Todesfall frei zu verfügen. Andererseits wird indirekt die Sicherung des Interesses von nahestehenden Personen durch den Geldanspruch auf Zahlung des Pflichtteils garantiert. Die Höhe des Pflichtteilanspruchs ist dabei als ein Kompromiss zwischen dem Erblasserwillen und den Bedürfnissen der nahestehenden Personen des Erblassers zu betrachten.

State-corporate crime en niet-democratische regimes: betrokkenheid van bedrijven in internationale misdrijven

    Most state-corporate crime research is focused on crime or harmful outcomes in or by democratic states. The goal of this article is to investigate the applicability of this concept to relations between economic actors and non-democratic state actors. The concept of state-corporate crime is applied to three contexts in which corporations have become involved in international crimes such as genocide, war crimes and crimes against humanity. Each representing a turning point in the academic and public perception of ‘business and human rights’, the contexts that are analysed are Nazi Germany (1993-1945), Apartheid South Africa (1948-1994) and the Democratic Republic of the Congo (DRC; 1996-now). It is concluded that in non-democratic states with totalitarian of authoritarian regimes (such as Nazi Germany and Apartheid South Africa), the concept of state-corporate crime is applicable and explanatory. In such strong states, economic and state actors make use of mutual benefits while, on the whole, state-interests prevail. As a result, the harmful outcome of the dynamics between corporations and states can best be described as corporate facilitated state crime. In weak states (such as the DRC) economic actors are generally more powerful while their involvement in international crimes also runs via non-state actors. The blurred lines between economic actors and state actors (and their interests) makes it difficult to apply the concept, in its different forms, to state-corporate cooperation in weak states and ‘new’ wars.

    The Dutch freedom to set up schools has become illusory. The foundation standards (the number of students) are high and the current interpretation of the concept of direction (religion or philosophy of life) does not seem to be sufficiently connected with today’s pluriform society. The alternative of direction-free planning of schools had practical and fundamental objections. Parent statements are insufficiently reliable and a school without direction does not have a foundation. An extension of direction is neither without disadvantages: the government will have to test whether there is a sufficiently coherent concept to be able to count as a direction.

    The Netherlands changed from a culturally homogenous society into a religiously plural society. This had an impact across public and denominational schools. The pluralisation of the pupil population raised the issue of the so-called pillarized educational system. In this contribution I explore this theme in the context of the freedom of education laid down in article 23 of the Dutch Constitution, and the right of every child to get acquainted with the diversity of its society’s traditions, and to position itself in the plural Dutch society. Moving beyond the pillarized system, all education can then become truly special, preparing children for normative citizenship.

    Various studies show that the views on the drug problem and appropriate policy responses have undergone profound changes from the 1960s onward. This article is analysing one of these changes, the decriminalisation of drug use, reflecting a fundamental change of view: understanding drug use as a health issue and not as crime. A useful heuristic to understand this type of change is Thomas Kuhn’s paradigm concept. He sees a paradigm as a set of beliefs that are shared by a scientific community and accepted by a wider community. A paradigm change is therefore a socio-psychological process rather than rooted in new scientific or research facts.
    The author analyses the change from the dominance of a crime to the dominance of a health paradigm reflecting its social-historic context, starting with the widely shared concerns about substance use related health problems in the 20th century. These concerns translated into two different views on the essence of these problems, a crime and a health paradigm. The first served as fundament of the international drug control efforts, resulting in the still governing drug prohibition. Yet, the health paradigm was also of influence from the start and gradually gained weight. From the 1970s onwards the health paradigm became more important as part of a wider reform movement. It started in the Netherlands and the UK as bottom-up process criticising criminalising the users of illicit drugs as inappropriate, detrimental for their health and inhumane. The health paradigm was seen as more appropriate.
    The author reflects on the benefits and disadvantages of the health paradigm. Its primary benefit is that it helps to understand the health problems related to drug use. A key disadvantage is its close relationship with the disease paradigm. The latter fits well with the generally negative view on drugs as dangerous or evil. It is encompassing the risk of ‘pathologising’ all forms of drug use and denying phenomena of unproblematic use for, among other things, recreational or spiritual purposes. Like the crime paradigm it can serve for control purposes. The drug user remains subject of control or disciplining policies and is not in charge of his/her own life. An additional problematic issue is that ‘softening’ the approach towards the users seems to be mirrored by a harder, more punitive approach to the producers and sellers of the substances, which are seen as villains, making available the drugs which deserve harsh punishment for ‘devastating’ the lives of users.
    The author concludes with a short discussion of the well-being paradigm as possible alternative for the health paradigm. It covers a broader spectrum than the health paradigm and helps to grasp the negative impact of (problem) drug use, reducing well-being, but is also useful in understanding the positive sides, enhancing well-being.


drs. Franz Trautmann
Drs. Franz Trautmann was Senior Drug Policy Advisor bij het Trimbos-instituut in Nederland. Hij werkte meer dan tien jaar aan harm reduction-programma’s in Amsterdam en leidde sinds 1990 tal van nationale en internationale projecten rond de ontwikkeling van preventie, behandeling en harm reduction-programma’s in verschillende landen en kwalitatief, praktijkgericht onderzoek (Rapid Assessment and Response). De laatste vijftien jaar legde hij zich tevens toe op onderzoek naar het functioneren van de internationale drugsmarkt en naar de beleidsrespons daarop. Enkele weken na het aanleveren van de laatste versie van zijn bijdrage, op 11 juni 2016, overleed hij geheel onverwacht.

Othering refugees: exclusion, containment and spaces of hope

    The article examines mechanisms of othering the refugees illustrated on one refugee camp in Germany. Based on the theoretical strand of the foreigner dispositif, I analyze spatial and architectural compositions of the camp to outline the differentiation of ‘we’ (nation state) and ‘others’ (refugees). In the process of othering space excludes, controls and identifies refugees as ‘others’. However, being identified as the other, space can also be conceived as a specific space of hope. The findings shed some light on the link between othering, space and identity.

Lynn Musiol is a master student Interna­tional Criminology at the University of Hamburg.

    In 2005 and 2006 three state-funded Islam- and imam training programs started at Amsterdam Free University, Leiden University and Hogeschool Inholland, after more than two decades of political and public debate. These confessional programs were to educate a Dutch ‘polder imam’. Recently however, the closure of two programs was announced.
    This article places the establishment as well as the closure of these programs in a historical perspective. It explores two striking parallels between the motivations in favor of an imam training and the ways the Dutch state has dealt with the institutionalization of religious plurality in the nineteenth and twentieth centuries.

    This article compares the situation of religious education in the Dutch and German school systems against the background of the relationship between church and state. In the Netherlands most schools are confessional schools, whereas in Germany most schools are public schools. The way in which the school subject of religious education is taught differs in its form. In both countries difficulties arise in relation to religious education which leads to the future of the Dutch school system of public and confessional private schooling being disputed and in Germany the school subject of confessional religious education being under pressure. Despite laws concerning religion and education the theme of religious education is still debated in the public domain.

    This contribution explores the possibility of teaching international law in a critical fashion. I examine whether the training which is taking place at law schools is establishing and sustaining a cultural hegemony (a term borrowed from Antonio Gramsci). I ask whether the current focus on technical practice-oriented teaching is a condition which should be questioned, even disrupted? In my thoughts on reorientations of this culture, a central term is the German word Bildung. Bildung refers to knowledge and education as an end in itself (John Dewey) as well as an organic process (Hegel), and therefore incorporates a wider understanding than the English word ‘education’. In terms of international law, a notion of Bildung allows us to acknowledge the political nature of the discipline; it may even allow us to ‘politicize’ our students.

    In Das Recht der Freiheit Axel Honneth develops his concept of social freedom. In this article I discuss Honneth’s project and critique one of its crucial aspects: Honneth’s views on the disruptive role of legal freedom in our society and its dependent relation to the sphere of social freedom. I argue that in his attempt in Das Recht der Freiheit to reactualize Hegel’s discourse on the realization of freedom for our time, Honneth risks mistranslating Hegel’s discourse of ‘right’ by denying the sphere of legal relations a constitutive role for true freedom, and that because of this Honneth’s own theory of social freedom suffers: it becomes less clear whether it can still offer helpful insights into the proper place of legal freedom in our society.

    Religion in the public domain has been a theme of remarkably current interest for a long time in our country as well as elsewhere in Europe. Not only in dialogue and debate, but primarily also via specific occasions, practices, and situations. One can think here of the position of the many redundant church buildings, the granting of permits for public religious manifestations, the ringing of church bells or public calls to prayer, the role (or abandonment of the role) of governments in rituals following disasters and accidents, the structure of citizenship rites and other forms of civic/civil ritual, the involvement of governments in religious celebrations in the public domain such as processions or Iftar meals, et cetera. This contribution explores the place of religion in the public domain in a specific way, i.e. on the basis of practices: its starting point lies in traceable manifestations of religion in our culture and society, in practices and rituals. After some conceptual orientation, this approach takes the form of a general panorama of religious-ritual presences and manifestations in that public domain and a further exploration of those via a model of so-called ritual-sacred fields.

Momenteel is hij hoogleraar Liturgische en Rituele Studies aan de Faculteit Geesteswetenschappen van de Universiteit van Tilburg en directeur van het aldaar gevestigde interuniversitaire Instituut voor Liturgische en Rituele Studies. Hij is tevens vicedecaan Onderzoek van de Faculteit Geesteswetenschappen. Hij doet onderzoek naar en publiceert over actuele rituele dynamiek.     The primary goal of this article is to survey the various criminological study programmes in the Netherlands and Flanders and of the jobs students attain after graduating in criminology. The theoretical question posed is to what extent the enormous expansion of criminology over the last decade has contributed to the scientific development of criminology as a discipline and to better-informed crime policies. Though the answer to this question remains limited to an ‘it depends on how you look at it’ position, the author is not pessimistic. Taking into account the current grim penal climate and the fact that the criminologist is a relative newcomer on the Dutch labour market, the positions criminology students have been able to gain – with jobs within the police force, in research and policy-development as prime fields – give reason to be hopeful, if reflexivity and overview remain the primary educational goals and practical skills training is not seen as the ‘trick box’ for the ‘quick fix’ of the safety problem.
