    Thought experiments have been widely used in virtually all sciences and humanities. Law is no exception. We can find countless instances of such experiments in both the legal practice and the legal theory. However, this method has hardly been studied by legal scholars, which contrasts with the vast literature devoted to it in other fields of knowledge. This article analyses the role that some thought experiments – those where an imaginary legal change is made, and its social effects are observed – may play in law. In particular, we show why these empirical legal thought experiments might be useful for the practice and theory of law, the main principles for conducting them and how the law deals with them.

    In juli 2016 publiceerde het VN-Kinderrechtencomité General Comment 19 dat een uitgebreid overzicht biedt van de consequenties van het Internationaal Verdrag inzake de Rechten van het Kind (hierna IVRK) voor de overheidsbegroting. Na een korte inleiding van het begrip ‘beschikbare middelen’ dat een centrale rol speelt in het Kinderrechtenverdrag, biedt dit artikel een samenvattend overzicht van General Comment 19. Uit dit alles wordt snel duidelijk dat het overheidsbegrotingsproces van groot belang is voor kinderrechten, maar ook dat ervan uit kinderrechtenperspectief vele eisen aan dat proces te stellen zijn die staten voor behoorlijke uitdagingen plaatsen.

Living on the Other Side: A socio-legal analysis of family law and migration in Morocco

    In our research project ‘Living on the Other Side’, we aim to understand how (ir)regular migrants from the Middle East and West/Central Africa deal with the legal and formal aspect of their lives in Morocco by focusing on major life events, such as marriage, divorce, birth and death. Life does not simply stand still when residing in a foreign country – people continue to marry, divorce, have children and die. However, there is little empirical knowledge on what migrants actually do when faced with such events. Registering major life events secures a migrant’s legal identity and protects their human rights. Having a legal identity, most likely, influences the daily lives of migrants. A migrant, who does not formally exist in the eyes of the state, might not be able to access basic services, like health care and education. From a legal pluralist perspective, we aim to investigate how migration and family law intersect by conducting online and offline ethnographic fieldwork.

Nada’s onderzoek verkent de relevantie van het familierecht voor West-/Centraal-Afrikaanse migranten bij belangrijke levensgebeurtenissen. Zij geeft een sociaaljuridische analyse van de strategieën van migranten op basis van online en offline veldwerk in Marokko.

Nada Heddane is Promovenda bij het Van Vollenhoven Instituut voor Recht, Bestuur en Samenleving (VVI) van de Rechtenfaculteit van de Universiteit Leiden. In haar onderzoek bevraagt Judith wat de rol is van het familierecht in de levens van Midden-Oosterse migranten in Marokko. Deze kwalitatieve studie bekijkt de ervaringen van migranten door een juridisch-antropologische lens.

Dispute settlement among the Nigerian Igbo in Antwerp

    This is a case study in ‘new legal pluralism’ which is interested in the operation of plural legal orders in countries of the global North. It considers the way in which the Nigerian Igbo living in Antwerp, Belgium settle their disputes. It first presents the Antwerp Igbo’s organisation in a Union possessing a constitution with precise legal stipulations. It then finds that the Igbo take the law with them from their home region into a diasporic community. Next it looks into the concrete organisation of dispute settlement and presents five cases as exemplars. It then discusses the advantages and drawbacks of applying Igbo law and justice, the issue of women’s rights, and the plurality and flexibility of the system. The conclusion underscores the fact that legal pluralism is a universal empirical reality.

    This article considers why image-based sexual abuse (‘ibsa’) should be classified as a sexual offence. The article briefly considers harmfulness, and then moves to discuss the principle of fair labelling. Classification of offences should be informed by the wrongdoing they address. A conceptual analysis of sexual offences shows that sexual wrongs warrant labelling as sexual offences. The infringement of the right to sexual autonomy in ibsa means the nature of the wrong is sexual. Ibsa should be a sex crime.

    Door de coronacrisis heeft het gebruik van technologie in de rechtszaal een enorme vlucht genomen. In deze bijdrage wordt gereflecteerd op de vraag of – en zo ja, in hoeverre – videorechtspraak bepaalde fundamentele, rechtstatelijke beginselen van ons strafproces raakt. Hiertoe worden de (potentiële) effecten van remote justice besproken in het licht van het brede (niet strikt juridische) procedural justice perspectief waarbij de nadruk wordt gelegd op de deelaspecten participatie en zorgvuldigheid van besluitvorming.

    Criminological research has emphasized the importance of procedural justice of authorities during encounters with citizens. Theory and prior research propose that the procedurally just treatment by the police influences, possibly via legitimacy, citizens’ willingness to cooperate with authorities in the criminal justice chain. This article tests the hypotheses of procedural justice theory using Dutch data of the European Social Survey (N=1,616). The results show an association between the procedurally just treatment of citizens by the police and cooperation with criminal justice authorities. However, this association has not been explained by the legitimacy of the police.

    In 2014, the ECJ was presented with a preliminary reference from the District Court in Kolding on the matter of whether EU law provides protection against discrimination on grounds of obesity with regard to employment and occupation. Following the ECJ’s ruling, first the District Court and later the High Court found that an employee’s obesity as such did not constitute a disability within the meaning of Directive 2000/78/EC establishing a general framework for equal treatment in employment and occupation since his obesity had not constituted a limitation or inconvenience in the performance of his job.

    On 16 December 2020, the Supreme Court of Lithuania (Cassation Court) delivered a ruling in a case where an employee claimed that the employer, JSC ‘Lithuanian Railways’, did not apply the regulations of the company’s employer-level collective agreement and did not pay a special bonus – an anniversary benefit (i.e. a benefit paid to employees on reaching a certain age) – because the employee was not a member of the trade union which had signed the collective agreement. According to the employee, she was discriminated against because of her membership of another trade union, i.e membership of the ‘wrong’ trade union.
    The Supreme Court held that combatting discrimination under certain grounds falls within the competence and scope of EU law, but that discrimination on the grounds of trade union membership is not distinguished as a form of discrimination. Also, the Court ruled that in this case (contrary to what the employee claimed in her cassation appeal) Article 157 of the Treaty on the Functioning of the European Union (TFEU) is not applicable because it regulates the prohibition of discrimination on other (sex) grounds. Moreover, the Court found that there was no legal basis for relying on the relevant case law of the ECJ which provides clarification on other forms of discrimination, but not on discrimination based on trade union membership.

    According to German law, leave entitlements of an employee shall in principle expire at the end of the calendar year or a permissible carryover period. However, based on the case law of the ECJ, this shall only apply if the employer has previously enabled and summoned the employee to take leave and the employee has nevertheless not taken it. But what happens if an employee is incapacitated for work for a longer period of time and therefore is unable to take his or her annual leave? Does the employer also have to inform this employee about their leave entitlement? The Federal Labour Court (Bundesarbeitsgericht, ‘BAG’) recently had to deal with this question in two cases and now the ECJ will have to address this matter. This is because the BAG has asked the ECJ to decide whether and when an employee’s entitlement to paid leave can expire if an employee loses their ability to work during the course of the leave year, while the employee could have taken at least part of the annual leave before becoming incapacitated for work, but the employee was not properly informed by the employer about their leave entitlement.

    The Vaslui Tribunal has recently annulled an individual dismissal decision issued during the state of alert in Romania due to formalities which had not been observed by the employer. While the judge invested with determining the matter limited their analysis to the elements contained in the individual dismissal decision, the judicial assistant ascertained, within a competing opinion, that the dismissal decision should have been annulled for other reasons, namely for the fact that, in reality, the employer had implemented a collective redundancy process without observing the procedure and employees’ rights in the event of such dismissal. Relying on the provisions of Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies, the judicial assistant has made an exhaustive analysis of the conditions required for the existence of a collective dismissal.
    While the competing opinion does not have the same effect as a court ruling, it is part of the judicial procedure and, from this perspective, the independence and impartiality of all the members of the court and their obedience solely to the law is maintained.

2021/2 Warning strike timing (HU)

    This case involved an employer who claimed that a trade union organised an unlawful warning strike. The Curia (the highest judicial authority in Hungary) found that the trade union violated its obligation to cooperate with the employer according to Act No. 7 of 1989 on Strikes. The Curia and also the Regional Courts made some clear points on the question of the timing of a warning strike. The employer must be notified of a planned strike in sufficient time, which requirement also applies in the case of warning strikes. The time can be considered as sufficient if the employer is able to fulfil its rights to protect its property, prevent damage resulting from the strike, to carry out its duties to protect life and property, and to organise work accordingly. Failing this obligation, the warning strike is unlawful. The notice shall state the date and time that such action will commence.
