In het kader van ontwrichtende criminaliteit ontstaat steeds meer aandacht voor de gebruikerskant. Zo ook voor de harddrugsgebruiker, die een ontwrichtende invloed op de samenleving heeft. Dit artikel beantwoordt daarom de vraag of strafbaarstelling van harddrugsgebruik legitiem en rechtvaardig is. Teneinde deze vraag te beantwoorden wordt getoetst aan de criteria voor strafbaarstelling en worden de argumenten die ten grondslag liggen aan de strafbaarstelling van de prostituant die misbruik maakt van prostituees die slachtoffer zijn van mensenhandel ter inspiratie gebruikt.

Political parties in the Netherlands have been calling for a ban on Hizb ut-Tahrir for years. But what do we actually know about this movement, its supporters and how they relate to Dutch society? This article is one of the first attempts to paint a more complete picture. It shows that the movement and its supporters adhere strictly to the course of the (re) establishment of the caliphate that was mapped out by founder Taqiuddin al-Nabhani in the 1950s. However, the assumption that the movement would advocate or encourage the use of violence requires nuance. These insights are not ‘static’ or ‘comprehensive’ and should be seen as a contribution to the discussion of the nature of the movement. The question of how the course – ideas and activities – of Hizb ut-Tahrir relates to democratic society will be addressed in a subsequent article.

Criminology has traditionally focused on urban areas where crime visibly concentrates. However, since the 1990s, attention for ‘rural criminology’ has steadily increased. First, rural areas are confronted with partly different and less visible crime problems, such as environmental crimes. Second, public actors such as enforcement and other agencies are less present and ‘available’ in rural areas, and people on average trust the government less to provide support when necessary. This chronicle presents an overview of international and Dutch research in the context of rural criminology. The paper addresses cultural differences between urban and rural areas, high-volume crimes, gender-related violence, alcohol and drug abuse, environmental crime, and enforcement in rural areas.

The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood.

This article discusses the problem of excessive drug use from a historical perspective. Cultural ambivalence towards excessive use of alcohol, tobacco, and drugs has roots going back into the seventeenth century. A case study is presented of the introduction and adaptation of tobacco in the Dutch republic. Dutch national and colonial drug regulation is discussed. It is concluded that regulations have been primarily motivated by anxieties about excessive behaviour among the labouring classes, endangering public order, and non-white users in the colonies. This has led to criminalization of excessive behaviour, and to the creation of a criminal underground economy.

A recent rehabilitation theory, the ‘Good Lives Model’ (GLM), states that interventions that work towards a higher well-being can reduce recidivism risk more sustainably by promising a happier, pro-social life, rather than just a less harmful one. Although the GLM theory appears promising, limited empirical research has examined its underlying assumptions, applicability and its effectiveness. Research into the GLM with youth is even more limited. Therefore, in the current study, we investigate the main etiological assumptions of the GLM in a large group of adolescents between 14 and 18 years old from the general population (N=5.776), by means of self-report survey data on well-being, primary human goods and delinquency. The results show that a lower subjective global well-being is related to delinquent behavior. Especially the primary human goods of relatedness and working towards a financially stable future appear to be important goals for interventions aimed at rehabilitation of juvenile offenders.

Young people’s delinquent behavior remains a social problem of concern to parents, local residents, teachers, police officers and administrators. With respect to effective interventions, the dominant focus is on ‘what works’. Relatively little is known about ‘who works’. In this study, based on a survey of 679 vmbo-pupils, it was investigated to what extent receiving ‘sternness with love’ from a professional may contribute to mitigating delinquency. For this research, unique graphically supported measuring instruments were developed that enable participants of the target group – including those who suffer from mild intellectual disabilities – to independently fill out the questionnaire. The results based on regression analyses suggest that there is no support for the supposed contribution of the interaction between sternness and love or of the three-way interaction between delinquent friends, sternness and love in explaining the variance of delinquent behavior. The results further show that having delinquent friends is related to participants’ delinquency. The results of these analyses also suggest that the relevant professional’s approach with ‘sternness’ or with ‘love’ moderates the relationship between delinquent friends and committing theft.

De Inspectie Justitie en Veiligheid (Inspectie JenV) houdt toezicht op de politie. In dit artikel kijken we of dat toezicht voldoet aan daaraan te stellen eisen van selectiviteit, responsiviteit en prudentie. Aan de hand van de zaak Hümeyra concluderen we dat de Inspectie JenV kennelijk niet heeft overwogen om de evaluatie over te laten aan interne of (andere) externe toezichthouders en zich ook niet heeft gebaseerd op een voorafgaande risicoanalyse (selectiviteit). Daarnaast heeft de Inspectie JenV haar onderzoek maar zeer beperkt in dialoog en interactie met de politie uitgevoerd en niet (ook) het perspectief vanuit de politie in beeld gebracht (responsiviteit). Bovendien heeft de Inspectie JenV geen rekening gehouden met de bijzondere positie van de politie (prudentie).

Twee jaar na inwerkingtreding van de Algemene verordening gegevensbescherming zet de auteur in dit artikel een aantal recente ontwikkelingen op het gebied van gegevensverwerking en -bescherming op de werkvloer uiteen. In het eerste deel van het artikel gaat zij in op de meer institutionele aspecten waaronder de evaluatie van de (U)AVG. De auteur ziet ingrijpende ontwikkelingen op het gebied van wetgeving en toezicht zoals de voorgenomen wetgeving over het gebruik van alcohol- en drugstesten op de werkvloer en de ontwikkelingen op het gebied van biometrie waaronder een hoge boete van Autoriteit Persoonsgegevens voor het gebruik van de vingerscan bij toegangscontrole. In deel 2 van dit artikel zal de huidige stand van de rechtspraak worden afgezet tegen de strengere normen uit de AVG.

The relationship between debts and delinquency is still unclear and knowledge about the prevalence and scope of debts among delinquents, which is needed to systematically explore this relationship, is lacking. The present study contains a systematic and scoping literature review on this relationship and analyzed data from risk assessment and client files (N = 250) from the Dutch probation service. Results show that debt and crime are strongly related and that debts among probation clients are highly prevalent and complex and underline the importance of inquiring more knowledge about debts as a potential risk factor for relapse during supervision.

In order to improve the effectiveness of offender supervision many studies have been conducted into risk factors for delinquency. Evidence was found that debts and crime are interrelated. However, understanding of potential underlying risk factors in this relationship is limited. Results of an analysis of client files (N=250) show that debts among probation clients are highly prevalent and problems with respect to education, work and mental and physical health seem to be important underlying factors in the relationship between debts and crime. In addition, interviews were conducted with both probation workers (N=33) and clients (N=16) to get insight into the possibilities to adequately support clients with regard to debts in order to stimulate successful resocialization. Results underline the importance of paying attention to possible underlying factors to effectively supervise clients.

This article relates criminological research on youth delinquency to the social development of adolescents. Starting point is a goal-framing approach which assumes that young people aim for the achievement of two goals: status (‘getting ahead’) and belonging (‘getting along’). Peers form an important context for achieving these goals. Therefore, the role of delinquency in peer networks is examined: on the one hand, the extent to which delinquency contributes to peer status, and on the other hand, how delinquency contributes to the formation of network relationships and, vice versa, how network relationships influence adolescents’ delinquency. Finally, several directions for further research are discussed.

The matter for this research is the request from the municipality of Eindhoven to map youth nuisance in the city of Eindhoven and to find explanations for differences between neighborhoods in order to provide policy makers with guidance. Quantitative and qualitative methods tested the social disorganization theory. Factors that may explain youth nuisance are a high degree of ethnic heterogeneity, low neighborhood participation and a high level of physical deterioration. In addition, youngsters who have unstructured leisure time prefer a place to hang out where there is no social control. Policy makers can use these insights to design their neighborhoods.

In the Netherlands, over the past 25 years mayors have had an increasing number of formal powers, based on administrative law, to fight against crime and disorder. Now, the Dutch mayors have the power to impose a restraining order, to close houses in case of drugs and/or drugs trade, or to decline a request for a permit when it might be used for illegal activities.
To implement these measures, the local government is highly dependent on (information provided by) the police. At this moment we do not have much information about this cooperation between local government and the police in the management of crime and disorder. This paper is based on an empirical study concerning this issue. It shows that the inter-organizational cooperation between local government and the police may differ strongly, however this cooperation still often depends on central factors and circumstances. An important factor is the (growing) distance between the police and local government in regard to the local approach of problems of crime and disorder. A significant number of local police officers concentrates mainly on the maintenance of law and order by criminal law enforcement instead of the implementation of administrative measures. As a result, local government is often unsatisfied about the contribution of the police. For example, the quality of the information provided by the police is often perceived as insufficient. In some cases local governments try to diminish the degree of interdependency with the police and to strengthen their own position in the local safety domain.
