In the Dutch public debate on honour-based violence on a regular basis this question is raised: should a special article be introduced for criminalising honour-based violence? However, it is striking that in this debate until now not much attention has been paid towards the different roles of family members in these violent conflicts. The main focus has always been on the so-called ‘material offender’, i.e. the offender that commits or threatens to commit a violent act. But what about family members that play a role in instigating this violence, the so-called ‘intellectual offenders’? In this article it is stated that in the Dutch context we should focus less on the introduction of new articles for punishing honour-based violence in the penal code and make better use of already existing laws and legal framework for addressing these severe violent acts. |

Dit artikel borduurt voort op de in 2014 en 2017 verschenen overzichtsartikelen over de twee belangrijke wetswijzigingen op het gebied van de jeugdbescherming en de jeugdzorg: de herziening van de kinderbeschermingsmaatregelen en de jeugdwet . De bedoeling van dit artikel is om een overall beeld te schetsen: een beeld dat duidelijk maakt hoe complex de ondersteuning aan kinderen en gezinnen is georganiseerd waarbij het recht op bescherming van de kinderen door de overheid ernstig onder druk staat. In het eerste deel van dit artikel wordt stilgestaan bij actuele ontwikkelingen stelselbreed. Vervolgens wordt stilgestaan bij de praktijk van de kinderbeschermingsmaatregelen. Achtereenvolgens komen aan de orde de evaluatie herziening kinderbeschermingsmaatregelen, het aantal kinderbeschermingsmaatregelen, de krapte bij de Gecertificeerde Instellingen (hierna: GI): wachtlijsten en de rechtspraak, corona en de invloed op jeugdbescherming, Perspectiefbesluit, Machtiging uithuisplaatsing en reikwijdte, Vaststelling omgangsregeling en Ineffectieve OTS. In het laatste deel van het artikel staan de bevindingen betreffende de Jeugdwet centraal. Daarbij wordt aandacht besteed aan onder meer de zogenaamde ‘drangtrajecten’, het woonplaatsbeginsel, de informatieplicht jegens de gezinsvoogd en het klacht- en tuchtrecht. |

In previous observational studies among operational police officers, some officers stated that if a victim is not willing to (officially) report a crime to the police, they are not able to police these cases. This rather cynical and fatalistic statement raises several questions. What do police officers mean when they say this? What do they actually do in those cases and why? In this paper we try to answer these questions based on explorative qualitative interviews with several police officers in two police teams in the Netherlands. The results show that even though police officers recognize these statements among their colleagues, they do not agree with them and in practice police officers show a lot of effort and involvement in these cases. In fact, police officers have several possible strategies available to deal with these cases. Which strategy they opt for depends on various pragmatic, organisational and moral considerations. |

When we consider a ‘court’ a judicial institution recognized by the state that renders judgment based on law recognized by the state, then the only ‘sharia courts’ to be found in Europe are located in the eastern province of Greece. Their jurisdiction is limited to Islamic family law, but a recent case before the European Court of Human Rights has rekindled the discussion on the scope of this jurisdiction, and opened the discussion on the desirability of such courts in a European country. This article presents an analysis of this discussion, based on literature study and fieldwork in the region. |

The question central to this article is whether ‘Islam’ and human rights are compatible and, if not, whether there might be room to come to a minimum standard of human rights that can be shared globally. This article will demonstrate that, from the perspective of Islamic orthodoxy, principles that are fundamental to human rights, like equality and freedom of religion, pose unsurmountable problems, and the adjustment of these principles is theologically nearly impossible. However, a growing number of Muslim intellectuals holds the opposite view, using new theological methods to argue that these Islamic principles and human rights are compatible. Although they are warmly welcomed by human rights lawyers and activists, their methods are not uncontroversial, and they are still very small in number. |

Violence in the name of the honour of the family and human trafficking are considered to be different phenomena. But in the impressive body of literature on both types of crime and as seen by specialists from the Dutch National Police, some indications can be found that there is a toxic relationship between the two forms of delinquency: human traffickers can call on the family-honour of their victims in order to blackmail them into prostitution and to keep them working in that field against their will. |

Tackling honour related violence is part of the Dutch policy on domestic violence. On the police level a centre of expertise was installed, the LEC EGG. Next to strategies with regard to detection, the LEC EGG has put forward instructions with regard to the application of police mediation in cases of honour related violence. In the traditional understanding of police culture as well as in the criticism against the use of the concept of ‘police culture’, not much attention has been paid towards the influence of the representation of police work and crime in the media. Although since the pioneering studies in the sixties and seventies of the last century it has been made clear that police work is not limited to dealing with crime and criminal justice, the mass media for decades have presented a completely different image: one of thrill seeking and hardcore action. Police officers themselves tend to ‘sensationalize’ their work. Police culture is no longer understood as a deterministic coping mechanism, but is rooted in active and constructive participation of police officers. As a consequence we must pay attention to representation of ‘the police’ by the media and ask ourselves how identity work by police officers is influenced by the representation of crime and the police in the (new) media. |

The author illustrates the complexity of cases mediators are confronted with by using two exemplary cases. Sometimes legal issues deriving from family law, divorce law and criminal law all are disputed at the same time, frustrating and even blocking all parties including their legal counsels who are also part of the conflict-system. When a conflict-system becomes contaminated, often support systems are mobilised. If a mediator wants to play a role in sorting out the process – which is not his fundamental task – it is best to seek co-operation with the legal counsels. |
