This article argues that it is legitimate for the state to practice soft paternalism towards changing hearts and minds in order to prevent behaviour that is discriminatory. Liberals accept that it is not legitimate for the state to intervene in order to change how people think because ideas and beliefs are wrong in themselves. It is legitimate for the state to intervene with the actions of a person only when there is a risk of harm to others and when there is a threat to social coexistence. Preventive action of the state is legitimate if we consider the immaterial and material harm that discrimination causes. It causes harm to the social standing of the person, psychological harm, economic and existential harm. All these harms threaten peaceful social coexistence. This article traces a theory of permissible government action. Research in the areas of behavioural psychology, neuroscience and social psychology indicates that it is possible to bring about a change in hearts and minds. Encouraging a person to adopt the perspective of the person who has experienced discrimination can lead to empathetic understanding. This, can lead a person to critically evaluate her prejudice. The paper argues that soft paternalism towards changing hearts and minds is legitimate in order to prevent harm to others. It attempts to legitimise state coercion in order to eliminate prejudice and broader social patterns of inequality and marginalisation. And it distinguishes between appropriate and non-appropriate avenues the state could pursue in order to eliminate prejudice. Policies towards eliminating prejudice should address the rational and the emotional faculties of a person. They should aim at using methods and techniques that focus on persuasion and reduce coercion. They should raise awareness of what prejudice is and how it works in order to facilitate well-informed voluntary decisions. The version of soft paternalism towards changing minds and attitudes defended in this article makes it consistent with liberalism. |

Since 1 April 2014, young adults aged 18 up to and including 22 years can be sentenced with juvenile sanctions in the Netherlands. This legislation is referred to as ‘adolescent criminal law’ (ACL). An important reason for the special treatment of young adults is their over-representation in crime. The underlying idea of ACL is that some young adult offenders are less mature than others. These young adults may benefit more from pedagogically oriented juvenile sanctions than from the deterrent focus of adult sanctions. Little is known, however, about the characteristics of the young adults sentenced with juvenile sanctions since the implementation of ACL. The aim of this study is to gain insight into the demographic, criminogenic and criminal case characteristics of young adult offenders sentenced with juvenile sanctions in the first year after the implementation of ACL. A cross-sectional study was conducted using a juvenile sanction group and an adult sanction group. Data on 583 criminal cases of young adults, sanctioned from 1 April 2014 up to March 2015, were included. Data were obtained from the Public Prosecution Service, the Dutch Probation Service and Statistics Netherlands. The results showed that characteristics indicating problems across different domains were more prevalent among young adults sentenced with juvenile sanctions. Furthermore, these young adults committed a greater number of serious offences compared with young adults who were sentenced with adult sanctions. The findings of this study provide support for the special treatment of young adult offenders in criminal law as intended by ACL. |

To address the potential of public policy on the governance of OARs it is necessary to define what is meant by public policy and the importance of public policy in designing an efficient governance framework. Critical components are the subject matter of public policy and its objectives. Hence, it is useful to consider declarations, policies and statements in relation to open access practice and examine the efficiency of these arrangements towards the improvement of stakeholders’ engagement in governance of OARs. Secondly, policies relating to dissemination of scientific information via OARs should be examined. In this regard, it is relevant to consider the public policy basis for Intellectual Property (IP) laws that concerning the utility of OARs. Therefore, economic theories relevant with the role of IP laws should be examined. Such examination depicts to what extend these laws facilitate the utility of OARs. In order to specify justifications for the desirability of OARs the objectives of social theories should be also considered. Thus, there is consternation that without legal protection against copying the incentive to create intellectual property will be undermined. As scholarly communication infrastructure evolves, it is necessary to recognize the efforts of the relationship between Intellectual Property Rights (IPRs) and communication technologies in the context of public policy and after engagement with it. After employing such multilevel approach, the paper argues about a socio-economic framework to enhance the governance of OARs through public policy. |

We analyze two citizen collectives of ‘professional city makers’ who have shaped participation in circular area development in anticipation of the Dutch Environment and Planning Act. The activities of professional city-makers form an interesting new phenomenon that requires attention as well as the implications: it is precisely through the professionalism of the city-makers’ efforts that there is a regular tension in the participation process between their role as citizen and professional in their contact with the government. We therefore discuss how the participation of professional city-makers in area development exposes different paradoxes that must be taken into account in the further implementation of the Environment and Planning Act. In short, we argue that participation in the Act is presented in a traditional way and does not fit the new role of citizens in area development in the 21st century. |

Public participation is an important issue in the forthcoming Dutch Environment and Planning Act (2021). The importance of participation is emphasized in numerous places in the parliamentary documents to the Act. This contribution discusses how the new Act gives legal substance to the objectives that the government is pursuing regarding participation and whether the involvement of citizens is indeed better imbedded by this act. It addresses the important subject of the ‘right moment of participation’ in the fragmented Dutch policy and decision system. Consecutively it deals with the question of potential legal consequences for non-compliance by administrative bodies to the legal participation obligations when drawing up plans and decisions. Can a citizen enforce (substantive) participation in the administrative court after the Environmental and Planning Act comes into force? The possibilities are limited. Findings show that the new Environment and Planning Act does not address the essential problems that arise with participation. The successful creation of local support, better quality and faster decision-making through participation all depend on how the (local) government shapes participation. From a legal perspective, the Environment and Planning Act makes little contribution to this. In the view of the authors this is not surprising, because the role of legislation in safeguarding substantive participation should not be overestimated. |

The Environment and Planning Act (EPA), which will enter into force in 2021, has been called the most influential legislative reform in the Netherlands since World War II. This article forms the introduction to a special issue devoted to the EPA, in which scholars from various disciplines reflect on the societal and legal ramifications of this new act. The authors introduce the different articles but also offer their perspective on the emergence of this new field of research. Socio-legal research into such a vast new regulatory field benefits from the application of multiple perspectives and different research methods. Conspicuously, the authors of the various articles differ on how to assess the new regulation of Dutch spatial planning. Some are pessimistic, others strike a more optimistic note. In this introduction two more perspectives on the law are offered. The perspective of prefigurative law (Davina Cooper) embodies the more optimistic view, whilst the perspective of outsourced law (Pauline Westerman) sides with the pessimists. |

The development of the Environment and Planning Act (Omgevingswet) in the Netherlands is an example of an ongoing reform of environmental and planning law that started with big ambitions. This article uses the case of environmental space (gebruiksruimte) to illustrate that it is hard to achieve those ambitions. A bill of the Environment and Planning Act contained regulations to assign environmental space to actors and/or locations. The regulations lacked in subsequent versions of the Environment and Planning Act, especially in the act itself. Despite the fact that on policy level the concept of environmental space can still be used, the lack of a legally binding mechanism for assigning environmental space makes it unlikely that the concept will be used. This hampers realising the ambition to create coherent policies that integrate environmental and spatial planning. It also puts achieving the goal of the law at risk. |

The Crisis and Recovery Act and the Environmental Planning Act are analysed in this article as a form of communicative legislation. This approach to socio-legal analysis draws attention to the need to understand the symbolic effects of legislation as independent drivers of compliance. The modest legal effects of the Crisis and Recovery Act are contrasted with the more sizeable symbolic effects of this legalisation. In addition, the ex-ante evaluation of the Environmental Planning Act shows that the proposed legal changes can only provide a small impetus to the desired culture change, nonetheless there is potential for areas of this law to have symbolic effects as well. These could potentially contribute independently to its success. |

A rapidly growing field of research and practice, restorative justice has primarily found its gravitational centre within the criminal justice system, as an alternative of dealing with the aftermath of crime. Less explored remains the application of restorative justice in complex, urban, or intercultural contexts, an application which raises a whole set of conceptual and practical challenges. This article is based on an action project which aimed to research conflict narratives in intercultural contexts and transform them through restorative praxis. Mostly used in educational, organizational, and health care settings, action research remains an underused but a highly interesting methodology for criminology and criminal justice research. Its alternative epistemology makes it particularly apt for scientific projects that aim both at investigating crime and justice related issues and at engendering change, either at the level of criminal justice or communities. Although action research has focused mostly on creating change at the level of practical knowledge, when conceived in a critical manner, action research aims not only at improving the work of practitioners, but also at assisting them to arrive at a critique of their social or work settings. Practice concerns at the same time problem setting or problem framing. By zooming into one of the case studies of the project, more specifically the social housing estates in Vienna, I focus in this article specifically on the tensions and dilemmas created by processes of engagement in a problematizing approach to the context and to practice. During these processes, together with other social actors, such as inhabitants and professionals, we named problems (in our case social conflicts) and framed the context in which we addressed them. I argue that participatory forms of inquiry, such as action research, should actively reframe rather than merely describe contexts and problems they work with. |

Met de Urgenda-zaak is niet alleen de dialoog geopend over de betekenis van het internationale klimaatrecht, de mogelijkheden voor algemeen-belangacties op andere gebieden en de verhouding tussen de Nederlandse staatsmachten, maar komt ook de rol van de nationale rechter in het internationale recht aan bod. Via de route van het EVRM wijst de Nederlandse rechter de Staat op zijn internationale verplichtingen – waaronder die van de positieve bescherming van mensenrechten – en brengt hij de rechtsopvattingen van internationaal en nationaal recht op één lijn. Dit getuigt van een actieve rol van de rechter. Geplaatst in het licht van internationale ontwikkelingen en het Rookverbod-arrest biedt deze rol ook mogelijkheden voor algemeen-belangacties wanneer de normen uit internationale verdragen in het concrete geval rechtstreeks toegepast kunnen worden door de rechter. |

Terrorism could be regarded as an extreme type of (violent) criminal behaviour. Against this background, there is much to gain if criminological attention would be extended to terrorism. In this overview, the authors describe how and to what extent criminological theories may provide a significant contribution to underlying causes of terrorism. Previous criminological contributions to the field of terrorism have primarily taken a theory-extended approach, including routine activity theory, rational choice theory and strain theory. However, so far such studies lacked empirical data. Further, to this day, not much is known about the empirical applicability of other criminological theories, including desistance theories, which warrant particular attention. In order for criminology literature to contribute effectively to our understanding of terrorism and to pursue better counter-terrorism policies, empirical evidence should first be obtained. In this way, terrorism researchers, in close collaboration with criminologists, can deepen our theoretical and empirical understanding of this relatively underexplored field. |

This article discusses how the law has approached disparate socio-technological innovations over the centuries. Precisely, the primary concern of this paper is to investigate the timing of regulatory intervention. To do so, the article makes a selection of particular innovations connected with money, windmills and data storage devices, and analyses them from a historical perspective. The individual insights from the selected innovations should yield a more systematic view on regulation and technological innovations. The result is that technological changes may be less momentous, from a regulatory standpoint, than social changes. |
