In recent years scientific interest in various aspects of prison climate has increased exponentially. At first, such research was being initiated and undertaken predominantly within Anglo-Saxon penology but, more recently, research into prison climate is also increasingly taking place elsewhere, including in the Netherlands and Belgium. In this article the authors offer an overview of Dutch and Belgian research on prison climate. They discuss the literature from two broad angles: first, the characteristics of prisons and incarcerated individuals that determine the quality of prison climate; and, second, research on the impact of prison climate on inmates themselves.

Penal protection orders (PPOs) aim to protect initial victims from repeat victimisation and in a broader sense from any danger for his or her dignity or psychological and sexual integrity and may therefore be important instruments for victim safety. However, knowledge on the actual practice of the PPOs and the successes, dilemmas and challenges involved is scarce. In this article, we describe the legal framework and actual enforcement practice of Dutch PPOs. The theoretical framework leading our explorative analyses regards Lipsky’s notion of ‘street-level bureaucracy’ and the succeeding work of Maynard & Musheno and Tummers on coping strategies and agency narratives of frontline workers. Using interview data from criminal justice professionals, victims and offenders, we describe the conditions of the enforcement practice and answer the question which coping mechanisms and types of agencies the professionals tend to apply in order to meet the legislative aims and to protect victims as effectively as possible. Results show that the five conditions described by Lipsky are clearly present. So far, in almost all situations the process of monitoring violations is reactive and because knowledge on risk indicators for violent escalation is still limited, it is difficult for frontline workers to decide how many and what type of resources should be invested in which cases. This results in a ‘moving away from clients’ strategy. However, within this context in which reactive enforcement is the default, we also found several examples of coping that represent ‘moving towards clients’ strategies.

In this essay the authors argue that social and genetic explanations for behavior are intertwined, and that genetically informed research designs can be a valuable addition to the toolbox that is available to criminologists for examining causal relationships and intergenerational transmission. From this ‘toolbox’ perspective, the authors discuss four study approaches: twin and family designs, genome-wide association studies, polygenetic scores and Mendelian Randomization. Finally, they address a number of practical considerations for applying genetically informed research designs in criminology.

In this paper we describe the first results of a recent cohort study conducted at Ghent University and focus on the applied study design. Existing cross-sectional studies regarding sexual victimization are not able to make causal statements about its risk and outcome factors. This cohort study aims to answer these questions. Results of this study confirmed that students are often confronted with sexual assault and seldom consult existing support services. This paper emphasizes the advantages of a longitudinal design within victimological research including the possibilities and difficulties that accompany it.

In the present study, the role of genetic and cultural transmission in intergenerational continuity of rule-breaking behavior (RBB) was investigated. Based on the resemblance within 3,982 Dutch twin pairs, aged 13 to 17 years, the relative importance of genetic (G), shared environmental (C), and unique environmental (E) influences on RBB was estimated. Cultural transmission, the process of passing on knowledge, norms and values, can lead to similarities within families, and forms part of the shared environment of children growing up in the same family. The authors found no evidence for shared environmental influences, and consequently no indication of a role for cultural transmission. Genetic influences explained 60 percent of the variance in rule-breaking behavior at age 13 to 17, implying that intergenerational continuity at this age is mainly driven by genetic transmission.

This study focusses on determinants of willingness to report cybercrime to the police or to other organizations and motivations for (not) reporting victimization. In this study, a questionnaire containing vignettes is used. Vignettes are semi-experimental designs in which hypothetical situations are presented and certain factors can be manipulated between and within respondents. Factors that are measured within the vignettes are the type and seriousness of the offence, the relationship between offender and victim and which possibilities for reporting the offence are available.
It is shown that the type of offence is an important determinant for willingness to report the offence, which is highest for fraud, followed by hacking and malware. Likewise, willingness to report is higher for more serious offences than for less serious offences. These results are comparable to results on willingness to report traditional crimes.
With regard to psychological determinants, results are not in line with previous results on willingness to report traditional crimes. For the relationship between offender and victim, mixed results are found. If the offender is an acquaintance of the victim, willingness to report to the police increases, but willingness to report to another organization decreases, compared to the offender being unfamiliar to the victim. Another surprising result is that no correlation is found between attitudes towards the police and willingness to report offences. Also unexpectedly, it is found that respondents who have previously reported crime and were unsatisfied about this experience, were more willing to report offences than respondents who never reported crimes before.
Regarding motivations for willingness to report, it is found that, in general, motivations for reporting cybercrime are strongly comparable to motivations for reporting traditional crime, however, differences in motivations are found between the different types of cybercrime.

De maatschappij verwacht in toenemende mate dat toezichthouders de effecten van hun toezicht inzichtelijk maken. Dat geldt ook voor de Belastingdienst. Dit artikel bespreekt de theorie en de praktijk van effectmeting in het fiscale domein en levert zo een bijdrage aan de ontwikkeling van effectmeting van het (overheids)toezicht. Vastgesteld wordt dat in de praktijk een aantal uitdagingen het hoofd moet worden geboden wil de Belastingdienst daadwerkelijk tot een integrale effectmeting van het toezicht komen. Dit zijn: het expliciteren van de beleidstheorie, het vinden van de juiste determinanten van compliance, het meten van effecten van preventieve activiteiten, het opzetten van methodologisch verantwoord onderzoek en de organisatorische inbedding van effectmeting.

Taking the recent European Commission’s Report on the application of Mediation Directive 2008/52/EC as a starting point, the authors set out to reconstruct the pattern of ADR/mediation activities undertaken by the EU and the Council of Europe over the past 40 years. The authors conclude that the European initiatives have been conducive to a broadening and deepening of the ADR debate. Remarkable shifts can be observed in the emphasis placed by the European agencies during this period, notably a shift from emancipatory to efficiency-based arguments. The inherent coupling of private mediation and public adjudication entails risks however for each of these distinct conflict resolution strategies. The authors call for advanced research designs to generate the data needed for a genuine evidence-based policy in this domain.

There is an impressive body of literature dealing with the so-called ‘cruelty link’. Two directions can be distinguished: animal abuse as a part of domestic violence and cruelty against animals as a predictor of a penchant for violence in later life. Related to these topics are a lot of methodological problems, for example regarding research designs, definitions of (domestic) violence and animal abuse, practices of cultural bias and prejudice regarding the position of animals in society and problems regarding the recognition of abuse. This contribution deals further more with the problematic claims of correlation and causation between violence against humans and animals. What is the risk of identifying ‘false positives’, that is making uncritical assumptions and accusations of (a penchant for) violent behaviour based on the (mis)interpretation of certain behaviour against animals?

Violations of human rights by transnational corporations and by other ‘private’ global actors raise problems that signal the limits of the traditional doctrine of ‘horizontal effects’. To overcome them, constitutional law doctrine needs to be complemented by perspectives from legal theory and sociology of law. This allows new answers to the following questions: What is the validity basis of human rights in transnational ‘private’ regimes – extraterritorial effect, colère public or external pressures on autonomous law making in global regimes? Do they result in protective duties of the states or in direct human rights obligations of private transnational actors? What does it mean to generalise state-directed human rights and to respecify them for different social spheres? Are societal human rights limited to ‘negative’ rights or is institutional imagination capable of developing ‘positive’ rights – rights of inclusion and participation in various social fields? Are societal human rights directed exclusively against corporate actors or can they be extended to counteract structural violence of anonymous social processes? Can such broadened perspectives of human rights be re-translated into the practice of public interest litigation?
