    Legal ethics may be taught indirectly, given resistance to ethics as a separate and presumably merely subjective subject. This may be done by stressing the importance of facts (as the vast majority of legal issues relate to contested facts), of professional role consciousness and of the importance of formal and informal respect for all concerned. This indirect approach is best integrated into the whole of the legal curriculum, in moot practices and legal clinics offering perceptions of the administration of legal justice from receiving ends as well. Basic knowledge of forensic sciences, argumentation and rhetoric may do good here as well. Teachers of law are to set an example in their professional (and general) conduct.

    Classic pragmatists like John Dewey entertained an encompassing notion of science. This pragmatic belief in the continuities between a scientific, ethical and cultural understanding of the world went into decline in the middle of the 20th century. To many mid-century American and English philosophers it suggested a simplistic faith that philosophy and science could address substantive questions about values, ethics and aesthetics in a rigorous way. This critique of classic pragmatism has lost some of its force in the last few decades with the rise of neo-pragmatism, but it still has a hold over disciplines like economics and law. In this article I argue that this criticism of pragmatism is rooted in a narrow conception of what science entails and what philosophy should encompass. I primarily focus on one facet: John Dewey’s work on art and aesthetics. I explain why grappling with the world aesthetically, according to Dewey, is closely related to dealing with it scientifically, for instance, through the poetic and aesthetic development of metaphors and concepts to come to terms with reality. This makes his theory of art relevant, I argue, not only to studying and understanding law, but also to teaching law.

    The current study investigates the relationship between the Dark Triad personality traits (consisting of narcissism, psychopathy and Machiavellianism) and three different forms of aggression: online aggression, overt aggression and relational aggression. The sample consisted of 1,051 adolescents between 12 and 16 years old. Results show that psychopathy and Machiavellianism are positive predictors of the three forms of aggression, while narcissism is a positive predictor of online aggression only.

    This paper, answering to a recent critique by Ben Laws to the concept of Self developed by narrative criminology, and recognizing its importance, shows that narrative criminology has formulated a complex dynamic definition of it, in addressing both the limit-experiences and the unconscious dimension. Such enlargement can be attained by adding to narrative criminology the contributions of psychosocial criminology, that considers also the emotional dimension of crime narratives and the enjoyment connected to crime: the offender Self, in this perspective, is a multiplex, not completely definable, sometimes alien entity, which can be exposed analysing in depth criminal narratives.

    This article seeks to examine the development of positive obligations under European law in the specific context of the rights of sexual minorities. It is clear that the law should respect and protect all sexualities and diverse intimate relationships without discrimination, and for this purpose it needs to ensure that sexual minorities can not only be free from state interference when expressing their sexuality in private, but that they should be given the right to express their sexuality in public and to have their intimate relationships legally recognised. In addition, sexual minorities should be protected from the actions of other individuals, when these violate their legal and fundamental human rights. Accordingly, in addition to negative obligations, European law must impose positive obligations towards sexual minorities in order to achieve substantive equality for them. The article explains that, to date, European law has imposed a number of such positive obligations; nonetheless, there is definitely scope for more. It is suggested that European law should not wait for hearts and minds to change before imposing additional positive obligations, especially since this gives the impression that the EU and the European Court of Human Rights (ECtHR) are condoning or disregarding persistent discrimination against sexual minorities.

    This article argues that it is legitimate for the state to practice soft paternalism towards changing hearts and minds in order to prevent behaviour that is discriminatory. Liberals accept that it is not legitimate for the state to intervene in order to change how people think because ideas and beliefs are wrong in themselves. It is legitimate for the state to intervene with the actions of a person only when there is a risk of harm to others and when there is a threat to social coexistence. Preventive action of the state is legitimate if we consider the immaterial and material harm that discrimination causes. It causes harm to the social standing of the person, psychological harm, economic and existential harm. All these harms threaten peaceful social coexistence. This article traces a theory of permissible government action. Research in the areas of behavioural psychology, neuroscience and social psychology indicates that it is possible to bring about a change in hearts and minds. Encouraging a person to adopt the perspective of the person who has experienced discrimination can lead to empathetic understanding. This, can lead a person to critically evaluate her prejudice. The paper argues that soft paternalism towards changing hearts and minds is legitimate in order to prevent harm to others. It attempts to legitimise state coercion in order to eliminate prejudice and broader social patterns of inequality and marginalisation. And it distinguishes between appropriate and non-appropriate avenues the state could pursue in order to eliminate prejudice. Policies towards eliminating prejudice should address the rational and the emotional faculties of a person. They should aim at using methods and techniques that focus on persuasion and reduce coercion. They should raise awareness of what prejudice is and how it works in order to facilitate well-informed voluntary decisions. The version of soft paternalism towards changing minds and attitudes defended in this article makes it consistent with liberalism.

    Islamophobia, like xenophobia, points to deep-seated, ingrained discrimination against a particular group, whose effective enjoyment of fundamental rights is impaired. This in turn triggers the human rights obligations of liberal democratic states, more particularly states’ positive obligations (informed by reasonability considerations) to ensure that fundamental rights are effectively enjoyed, and thus also respected in interpersonal relationships. This article identifies and compares the fault lines in the practice of three international human rights supervisory mechanisms in relation to Islamophobia, namely the Human Rights Committee (International Covenant on Civil and Political Rights), the European Court of Human Rights (European Convention on Human Rights) and the Advisory Committee of the Framework Convention for the Protection of National Minorities. The supervisory practice is analysed in two steps: The analysis of each international supervisory mechanism’s jurisprudence, in itself, is followed by the comparison of the fault lines. The latter comparison is structured around the two main strands of strategies that states could adopt in order to counter intolerance: On the one hand, the active promotion of tolerance, inter alia through education, awareness-raising campaigns and the stimulation of intercultural dialogue; on the other, countering acts informed by intolerance, in terms of the prohibition of discrimination (and/or the effective enjoyment of substantive fundamental rights). Having regard to the respective strengths and weaknesses of the supervisory practice of these three international supervisory mechanisms, the article concludes with some overarching recommendations.

    In this article, we focus on how the education system can be used to promote equality in the context of changing people’s hearts and minds – values, morals and mindsets. The duties contained in the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (‘Equality Act’) bind private and public schools, educators, learners, governing bodies and the state. The Equality Act calls on the state and all persons to promote substantive equality, but the relevant sections in the Equality Act have not been given effect yet, and are therefore currently not enforceable. We set out how the duty to promote equality should be concretised in the Equality Act to inter alia use the education system to promote equality in schools; in other words, how should an enforceable duty to promote equality in schools be fashioned in terms of the Equality Act. Should the relevant sections relating to the promotion of equality come into effect in their current form, enforcement of the promotion of equality will take the form of obliging schools to draft action plans and submit these to the South African Human Rights Commission. We deem this approach inadequate and therefore propose certain amendments to the Equality Act to allow for a more sensible monitoring of schools’ duty to promote equality. We explain how the duty to promote equality should then play out practically in the classroom to facilitate a change in learners’ hearts and minds.

    Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate.

    Why and how mediated contact between victims and offenders (and members from their networks) leads to positive outcomes, remains a difficult question to answer. Not surprisingly therefore, this topic has been the focus of attention of multiple articles in the past twenty years of this journal. In this contribution, the inspiring article of Borbala Fellegi (2008), titled ‘Explaining the impact of restorative justice. The “4-way interaction” of morality, neutralisation, shame and bonds’ is celebrated. Fellegi presents a theoretical framework in which the added value of restorative, mediated victim-offender meetings for the re-integration of offenders is outlined compared to other judicial responses to crime. Central to her argument is that the mediation process affects in particular the four criminogenic factors mentioned in the title. In this contribution two innovative, working mechanisms of the mediation process that she proposes, are highlighted. First, the preparation phase in which the neutral mediator initiates and facilitates discussion of the crime and its consequences for the victim(s) with the offender. Fellegi proposes that this mechanism can (start to) lift the criminogenic factor moral reasoning of the offender. Second, the restorative focus of the encounter itself between the victim and offender, in which both parties can express how they were affected, express their emotions (such as shame feelings of the offender) and discuss jointly how restoration and reparation might be achieved. This should reduce the criminogenic factor neutralisation, increase moral reasoning, and might contribute to integrative social bonds between the parties and their networks. Thus, Fellegi’s work has made innovative suggestions about the working mechanisms of victim-offender mediation – these suggestions offer useful hypotheses that can be tested empirically.

    This article tells the story of University of Strathclyde Mediation Clinic through the eyes of its founder. Taking its first case in 2012, by the start of 2021 it will be providing a free mediation service in 16 of Scotland’s 39 sheriff courts, covering more than half the country’s population. Yet it started with no plan, no budget and a few volunteers. The article makes the case that mediation clinics, like mediation itself, call for improvisation, coining the term ‘pracademia’ to describe how such clinics straddle the two worlds of practice and theory.

    This article examines expressions of conspicuous consumption on 19 recent releases by the most popular Dutch rap artists of 2018. In line with Veblen’s (1899/2017) notion of conspicuous consumption, our content analysis of these rap lyrics shows that Dutch rappers ‘spend’ their money on all kinds of ostentatious and eye-catching luxury goods such as designer clothing and jewelry (‘drip’), cars or holidays, but also that rappers ‘stack’ some of the money they earn by putting it aside. Our results indicate that these expressions of conspicuous consumption seem to be rooted in, and fueled by, experiences with poverty, stigmatization, and discrimination.

    A recent rehabilitation theory, the ‘Good Lives Model’ (GLM), states that interventions that work towards a higher well-being can reduce recidivism risk more sustainably by promising a happier, pro-social life, rather than just a less harmful one. Although the GLM theory appears promising, limited empirical research has examined its underlying assumptions, applicability and its effectiveness. Research into the GLM with youth is even more limited. Therefore, in the current study, we investigate the main etiological assumptions of the GLM in a large group of adolescents between 14 and 18 years old from the general population (N=5.776), by means of self-report survey data on well-being, primary human goods and delinquency. The results show that a lower subjective global well-being is related to delinquent behavior. Especially the primary human goods of relatedness and working towards a financially stable future appear to be important goals for interventions aimed at rehabilitation of juvenile offenders.

    The aim of this study was to provide more insight in prevalence and aetiology of juvenile frequent offending, employing police registered data as well as self-report information. We combined data about 519 youths that participated in a self-report study in the region of The Hague with police register data (the HKS system) from the police unit of The Hague. The results indicate that a substantial part of youths that report a large amount of offenses themselves are not formally known as ‘juvenile frequent offender’. Causal factors derived from four major criminological theories can be found in a more pronounced way among juvenile frequent offenders than among youths that incidentally commit offenses. In general, there are similarities between the characteristics of juvenile frequent offenders defined by police register data and those defined by self-reports, but, on average, frequent offenders that are known by the police spend more time unstructured socializing with friends. We conclude that research using the method of self-report is well capable to find juvenile frequent offenders, and that this method also leads to useful information about the causes of their delinquent behaviour.

    In the last decade neuropsychological insights have gained influence with regard to age boundaries in legal procedures, however, in Dutch civil law no such influence can be distinguished. Recently, voices have been raised to improve children’s legal position in civil law: to reflect upon the minimum age limit of twelve years for children to be invited to be heard in court and the need for children to have a stronger procedural position.
    In this article, first the current legal position of children in Dutch law and practice will be analysed. Second, development of psychological constructs relevant for family law will be discussed in relation to underlying brain developmental processes and contextual effects. These constructs encompass cognitive capacity, autonomy, stress responsiveness and (peer) pressure.
    From the first part it becomes clear that in Dutch family law, there is a tortuous jungle of age limits, exceptions and limitations regarding children’s procedural rights. Until recently, the Dutch government has been reluctant to improve the child’s procedural position in family law. Over the last two years, however, there has been an inclination towards further reflecting on improvements to the child’s procedural rights, which, from a children’s rights perspective, is an important step forward. Relevant neuropsychological insights support improvements for a better realisation of the child’s right to be heard, such as hearing children younger than twelve years of age in civil court proceedings.

    In our daily decision-making processes, attitudes play an important role. An attitude is an evaluative judgement of a person, object or an issue on a scale of favorability. A large amount of research has been done on the role of attitudes in our daily decision-making processes. There is, however, a gap in empirical knowledge when it concerns the role of attitudes in the professional judicial decision-making process. It has been accepted that the professional judicial decision-making process has a subjective element, but this subjective element remains unexplained. Attitudes are inherently personal and subjective, and they can make our decision-making process easier. They can, however, also be the basis for biases and prejudices. Herein lies a potential risk, especially in the professional judicial decision-making process. If attitudes play a role in the decision-making process of judges there is a possibility that impartiality, one of the judiciary’s core professional values, might be unobtainable. To see whether attitudes play a role in the professional judicial decision-making process semi-structured interviews will be conducted among judges, who will also be asked to fill in a scenario survey. Hopefully the obtained data will lead to a start in filling this gap in empirical knowledge.

    Van oudsher is in Nederland het vaccinatiebeleid bij jonge kinderen gebaseerd op vrijwilligheid. Onder meer naar aanleiding van een dalende vaccinatiegraad wordt er in toenemende mate voor gepleit in het vaccinatiebeleid elementen met een verplicht karakter op te nemen. Dit zien we ook terug in een wetsvoorstel dat de Tweede Kamer in februari 2020 aanvaardde. In deze bijdrage wordt de discussie over vrijwillig versus verplicht in kaart gebracht en besproken.
