Auteurs Prof. Tom Zwart
SamenvattingAuteursinformatie

Terrorism can only be brought to an end if Islam and the Muslim community are enlisted as allies in combating it. Underlying militant jihadism is a violent interpretation of Islam which can best be challenged with the assistance of Islam and the Muslim community. Since the effects of the current state-led approach are questionable, while its criminal law component is close to exceeding the limits set by the rule of law and turns Muslims into a suspect community, it is important to test by way of a pilot whether an approach based on Islam can reap more promising results.

Access_open The Influence of Strategic Culture on Legal Justifications Comparing British and German Parliamentary Debates Regarding the War against ISIS

Tijdschrift Erasmus Law Review, Aflevering 2 2021
Trefwoorden strategic culture, international law, ISIS, parliamentary debates, interdisciplinarity
Auteurs Martin Hock
SamenvattingAuteursinformatie

This article presents an interdisciplinary comparison of British and German legal arguments concerning the justification of the use of force against the Islamic State in Iraq and Syria (ISIS). It is situated in the broader framework of research on strategic culture and the use of international law as a tool for justifying state behaviour. Thus, a gap in political science research is analysed: addressing legal arguments as essentially political in their usage. The present work questions whether differing strategic cultures will lead to a different use of legal arguments. International legal theory and content analysis are combined to sort arguments into the categories of instrumentalism, formalism and natural law. To do so, a data set consisting of all speeches with regard to the fight against ISIS made in both parliaments until the end of 2018 is analysed. It is shown that Germany and the UK, despite their varying strategic cultures, rely on similar legal justifications to a surprisingly large extent.

SamenvattingAuteursinformatie

Political parties in the Netherlands have been calling for a ban on Hizb ut-Tahrir for years. But what do we actually know about this movement, its supporters and how they relate to Dutch society? This article is one of the first attempts to paint a more complete picture. It shows that the movement and its supporters adhere strictly to the course of the (re) establishment of the caliphate that was mapped out by founder Taqiuddin al-Nabhani in the 1950s. However, the assumption that the movement would advocate or encourage the use of violence requires nuance. These insights are not ‘static’ or ‘comprehensive’ and should be seen as a contribution to the discussion of the nature of the movement. The question of how the course – ideas and activities – of Hizb ut-Tahrir relates to democratic society will be addressed in a subsequent article.

Access_open State Obligations to Counter Islamophobia: Comparing Fault Lines in the International Supervisory Practice of the HRC/ICCPR, the ECtHR and the AC/FCNM

Tijdschrift Erasmus Law Review, Aflevering 3 2020
Trefwoorden Human rights, positive state obligations, islamophobia, international supervisory mechanisms
Auteurs Kristin Henrard
SamenvattingAuteursinformatie

Islamophobia, like xenophobia, points to deep-seated, ingrained discrimination against a particular group, whose effective enjoyment of fundamental rights is impaired. This in turn triggers the human rights obligations of liberal democratic states, more particularly states’ positive obligations (informed by reasonability considerations) to ensure that fundamental rights are effectively enjoyed, and thus also respected in interpersonal relationships. This article identifies and compares the fault lines in the practice of three international human rights supervisory mechanisms in relation to Islamophobia, namely the Human Rights Committee (International Covenant on Civil and Political Rights), the European Court of Human Rights (European Convention on Human Rights) and the Advisory Committee of the Framework Convention for the Protection of National Minorities. The supervisory practice is analysed in two steps: The analysis of each international supervisory mechanism’s jurisprudence, in itself, is followed by the comparison of the fault lines. The latter comparison is structured around the two main strands of strategies that states could adopt in order to counter intolerance: On the one hand, the active promotion of tolerance, inter alia through education, awareness-raising campaigns and the stimulation of intercultural dialogue; on the other, countering acts informed by intolerance, in terms of the prohibition of discrimination (and/or the effective enjoyment of substantive fundamental rights). Having regard to the respective strengths and weaknesses of the supervisory practice of these three international supervisory mechanisms, the article concludes with some overarching recommendations.

Trials in absentia of foreign terrorist fighters in the Netherlands and Belgium

Tijdschrift Crimmigratie & Recht, Aflevering 1 2020
Trefwoorden the right to be present, trials in absentia, foreign terrorist fighters, The Netherlands, Belgium
Auteurs Mr. Zoë Heij
SamenvattingAuteursinformatie

Judgements rendered in the accused’s absence form a special category of criminal judgements that undoubtedly do not provide for the same safeguards that would be in place when a judgement is rendered in the accused’s presence. Nonetheless, provided that strict conditions are adhered to, trials in absentia can be compatible with the accused’s right to be present. This article examines the standards that have been developed under international human rights law, providing for the normative framework, to see to what extent the trials in absentia of foreign terrorist fighters in the Netherlands and Belgium comply therewith. By pointing to analogies and contrasts, this article wishes to contribute to finding answers to this dilemma.

Auteurs Mr. T.J. Kodrzycki en Mr. J.G. Geertsma
SamenvattingAuteursinformatie

Sharia in het Westen (I)

Tijdschrift Tijdschrift voor Religie, Recht en Beleid, Aflevering 3 2019
Trefwoorden Sharia in het Westen, islamitisch recht, religieus recht, rechtsvergelijking, juridisch pluralisme
Auteurs Prof. dr. mr. Maurits S. Berger
SamenvattingAuteursinformatie

The notion of ‘sharia in the West’ is by now fairly well established, both in social, political and scientific circles, but both the terms ‘sharia’ and ‘West’ remain difficult to define. It is therefore striking that the combination of these two terms is used with such self-evidence. This article wants to answer the question: what exactly is the sharia that Western Muslims arguably want, and how is this sharia received in the West? To this end, a model is presented that provides a description of the complex interaction between sharia as practiced by Western Muslims on the one hand, and the conditions that the Western environment sets for it on the other. The model shows that ‘sharia’ cannot be compared to a law system, and that the Western environment has a major influence on the extent and ways in which Muslims apply sharia. From a Western perspective, the model shows that sharia issues are mainly discussed in legal terms, while most controversies are not of a legal nature, but rather a cultural one.

Trefwoorden Radicalisation and Terrorism, American Wars, Activism of Hope, Mental Health and Prevention
Auteurs Carl H.D. Steinmetz
SamenvattingAuteursinformatie

About half (54%) of Dutch mental health care have patients who radicalize. This delivery room for radical losers deserves more attention. The GGZ will then have to emerge from the stalled discourse, that radicalization is not a psychiatric disorder. An important breeding ground for these and other ‘delivery rooms’ are apart from factors like social and psychological influences, and grievances about social, economic and health inequalities (Bhui et al., 2014), the wars that are initiated annually by the United States from 1798, with or without the help of the United Kingdom, the European Union and therefore the Netherlands. This article argues that ‘fire should not be fired with fire’. It is argued for the implementation of Activism of Hope (Lleshi, 2018) with its own grandfathers, such as Martin Luther King, Mahatma Gandhi and Nelson Mandela. Finally, an action perspective for all young people in the tumultuous phase of adolescence is proposed for education- and care institutions.

Auteurs Heidi de Mare, Sigrid Burg, Gawie Keyser e.a.
SamenvattingAuteursinformatie

Between 2013-2017 there were many ISIS videos circulating. It was generally assumed that these videos would encourage young Muslims to radicalize and join ISIS. But what do we actually know about the imaginary world of young people? Do sociological aspects such as the economic, cultural and religious background play a decisive role in this? Can we use the films and TV series that young people see as an entry into their imaginary world? To what extent can image analysis provide knowledge that contributes to safety issues? Commissioned by the Department of Counterterrorism, Radicalization and Extremism (CTER) of the Dutch National Police, the IVMV Foundation invited, in a comparative pilot study, twenty Dutch youngsters (10 with a Muslim background and 10 police students) to share their viewing experiences with five trailers (3 Hollywood, 1 Netflix, 1 not explicit violent ISIS video) that touched on the ISIS issue. This resulted in a research report and a film (in Dutch as well as in English) that was presented in November 2017 (De Mare et al. 2017a; De Mare 2017b). A remarkable result was that their viewing experiences and feelings showed a lot of similarity.

Trefwoorden Sharia in Europa, religieus familierecht, legal pluralism, interpersoonlijk recht, interreligieus recht
Auteurs Prof. dr. mr. Maurits Berger
SamenvattingAuteursinformatie

The decision of the Court that Muslims from the Greek province of West Thrace can choose in matters of family law between civil or Islamic law, is not surprising. However, much can be said about the way in which the Court came to that conclusion. Because in doing so it uses principles and considerations that show a lack of insight in the status and functioning of a unique legal system, namely that of interpersonal law, or the coexistence on equal basis of several family laws. Similarly, the Court seems biased towards Islamic family law, which it consistently refers to as ‘sharia’. A critical discussion of this judgment is therefore appropriate.

Traces of Stoic Syllogisms and Ontology of Language in Proculus’s Jurisprudence

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 1 2019
Trefwoorden Stoicism, Roman Law, Theory of Language, Syllogisms, Classical Jurisprudence
Auteurs Pedro Savaget Nascimento
SamenvattingAuteursinformatie

This paper uses Stoic theory of language to gain more insight into Roman lawyer Proculus’s legal opinions on the meaning and understanding of ambiguous testaments, wills and dowries. After summarizing Stoic theory of language, the paper discusses its reception in Roman jurisprudence and situates Proculus in a Stoic legal/philosophical context. The meat of the article lies in the re-examination of Proculus’s legal opinions on ambiguities in light of Stoic theory of language, through: (1) the analysis of a case demonstrating that Proculus’s embeddedness in Stoic doctrine went beyond his technical competence in propositional syllogisms, going into the territory of Stoic physical materialism and, (2) the investigation of four cases that reveal how his approach to problems of ambiguity in unilateral legal acts converges with the Stoic conception of the parallelism between speech and thought.

Access_open Crimmigratie en bestuursrechtelijke criminologie: verwante concepten of verschillende disciplines?

Tijdschrift Crimmigratie & Recht, Aflevering 1 2019
Trefwoorden Crimmigratie, Bestuursstrafrecht, Bestuursrechtelijke criminologie, Intrekking van het Nederlanderschap
Auteurs Mr. dr. drs. Benny van der Vorm
SamenvattingAuteursinformatie

At first sight there seems to be a strong relationship between crimmigration and the criminology of administrative law enforcement. However, a further analysis shows that crimmigration fits more in the concept of the so-called integrated science of criminal justice. Crimmigration can be identified as an interdisciplinary concept, while the criminology of the administrative law enforcement should be classified as an empirical discipline. Nevertheless, both concepts complement each other with regard to the socio-scientific study of the practice of immigration law.

Access_open Fostering Worker Cooperatives with Blockchain Technology: Lessons from the Colony Project

Tijdschrift Erasmus Law Review, Aflevering 3 2018
Trefwoorden blockchain, collaborative economy, cooperative governance, decentralised governance, worker cooperatives
Auteurs Morshed Mannan
SamenvattingAuteursinformatie

In recent years, there has been growing policy support for expanding worker ownership of businesses in the European Union. Debates on stimulating worker ownership are a regular feature of discussions on the collaborative economy and the future of work, given anxieties regarding the reconfiguration of the nature of work and the decline of standardised employment contracts. Yet, worker ownership, in the form of labour-managed firms such as worker cooperatives, remains marginal. This article explains the appeal of worker cooperatives and examines the reasons why they continue to be relatively scarce. Taking its cue from Henry Hansmann’s hypothesis that organisational innovations can make worker ownership of firms viable in previously untenable circumstances, this article explores how organisational innovations, such as those embodied in the capital and governance structure of Decentralised (Autonomous) Organisations (D(A)Os), can potentially facilitate the growth of LMFs. It does so by undertaking a case study of a blockchain project, Colony, which seeks to create decentralised, self-organising companies where decision-making power derives from high-quality work. For worker cooperatives, seeking to connect globally dispersed workers through an online workplace, Colony’s proposed capital and governance structure, based on technological and game theoretic insight may offer useful lessons. Drawing from this pre-figurative structure, self-imposed institutional rules may be deployed by worker cooperatives in their by-laws to avoid some of the main pitfalls associated with labour management and thereby, potentially, vitalise the formation of the cooperative form.

Islam en mensenrechten: gaat dat nog lukken?

Tijdschrift Tijdschrift voor Religie, Recht en Beleid, Aflevering 1 2018
Trefwoorden sharia, mensenrechten, islam en mensenrechten, minimale mensenrechten, Islamitisch recht
Auteurs Prof. dr. mr. Maurits Berger
SamenvattingAuteursinformatie

The question central to this article is whether ‘Islam’ and human rights are compatible and, if not, whether there might be room to come to a minimum standard of human rights that can be shared globally. This article will demonstrate that, from the perspective of Islamic orthodoxy, principles that are fundamental to human rights, like equality and freedom of religion, pose unsurmountable problems, and the adjustment of these principles is theologically nearly impossible. However, a growing number of Muslim intellectuals holds the opposite view, using new theological methods to argue that these Islamic principles and human rights are compatible. Although they are warmly welcomed by human rights lawyers and activists, their methods are not uncontroversial, and they are still very small in number.

Auteurs Dr. Roel Meijer
SamenvattingAuteursinformatie

This article analyses the relation between Islam, politics and citizenship. It analyses three currents within Islam: Salafism, Islamism, and modernism. The central argument is that most modern Islamic currents do not have a concept of politics as an independent ‘field’ where compromises can be made concerning societal problems. The only current that provide the space for a pluriform, open political debate is Islamic modernism. Through its humanism and the centrality of the common good and not the text, modernism embraces not only the concept of politics as free space but also the concept of active citizenship.
