In deze bijdrage leggen de auteurs de Nederlandse en Belgische onwaardigheidsbepalingen langs de lat van het arrest ‘De Roemeense erflater’ en constateren dat artikel 4:3 BW Europeesrechtelijk niet bij de tijd is, in tegenstelling tot de wetgeving van België op dit punt. Verder plaatsen zij het arrest in een breder perspectief en gaan zij in op artikel 1 van het Eerste Aanvullende Protocol bij het EVRM in samenhang met artikel 14 EVRM. Zij concluderen dat ook als family life niet in het geding is, de eis van een onherroepelijke veroordeling niet gesteld mag worden als aan de overige voorwaarden van artikel 4:3 lid 1 sub a of b BW wordt voldaan, maar een onherroepelijke veroordeling niet kan volgen wegens het overlijden van de dader. |

The article discusses the tension between social solidarity and religious freedom as demonstrated by the refusal of the ultra-Orthodox sects in Israel to comply with COVID-19 regulations. The article provides a detailed description of the refusal to comply with the regulations restricting mass prayer services in synagogues and studying Torah in the yeshivas, thus interfering with the ultra-Orthodox religious life. The article suggests possible explanations for that refusal, based on either religious beliefs or a socio-political claim to autonomy, and discusses whether the polity should be willing to tolerate such a refusal on the basis of the cultural defence. The article concludes that despite the drastic restrictions on religious life caused by the social distancing regulations, and the special importance of freedom of religion, reducing the pandemic’s spread called for awarding priority to solidarity over religious freedom, and the enforcement of social solidarity legal duties – the social distancing regulations – on all. |

Scientific studies have shown the effect of social crises on the nature and magnitude of domestic violence. Since the beginning of 2020 we are facing a worldwide corona pandemic. There is a widespread fear that the measures as a consequence of this pandemic have led to a significant increase in domestic violence. In this study news reports on the assumptions about the effect of the pandemic on domestic violence were inventoried. Subsequently, an overview was made of current empirical research projects on the assumed effect on domestic violence. The methodological aspects and the preliminary results of these studies are discussed. |

This article analyses the legal position of Christian communities in the Roman Empire before the middle of third century CE. It will be argued that the treatment of this group, which has often been marked as unique by both public opinion and academic debate, can only be explained by placing Christianity within the broader societal and administrative framework of the Roman world. A comparison with the treatment of other contemporary religious groups is necessary for a better understanding of the underlying principles and mechanisms that collectively shaped the Roman authorities’ attitudes towards these religious communities. |

This article deals with restorative justice practices in Surinam. It is based mainly on anthropological literature and preliminary research findings of four indigenous villages in Surinam, and is part of a broader study of Indigenous and Marron communities. In these villages the age-old customary law approach to conflict remains a lively practice, especially in the rainforests where central authority has little influence. The author highlights a number of restorative aspects of indigenous (criminal) justice practices, such as the group conferencing model of the Krutu and the role of the community (rehabilitation). Other aspects are not at all restorative, such as cases of double punishment (ne bis in idem), corporal punishment and the lack of the possibility of appeal. Because the trend of opening the hinterland seems to be unstoppable, it is recommended to coordinate national law and customary law and improve cooperation between indigenous and central authority. The article gives some suggestions for reforming the Surinamese Penal Code. |

In this article, we report on our initial findings (from the field) regarding conflict resolution among the Maroons in Suriname. After first providing some background information about the Maroons (section 2), we describe their manner of conflict resolution after a crime has taken place and we explain what justice within this context entails for them (section 3). Subsequently, we try to distil ‘the useful elements’ from the Maroons’ approach to crime, that is to say elements with which modern restorative justice, i.e. restorative justice that meets, inter alia, human rights and constitutional requirements, can be nourished and strengthened. We also discuss some of the challenges we have encountered, where the traditional legal system and the modern criminal justice system come together (section 4). Then we try to build some possible bridges between the two legal systems (section 5). The contribution concludes with providing a window on the future of the development of restorative justice in Suriname and the Netherlands. |

Previously we have published an article about misunderstandings regarding trauma and PTSS. In this contribution we deal with other popular beliefs regarding trauma. We focus on trauma among professionals as a consequence of their work. It is explained that a professional does not have to witness violence or another severe case directly in order to develop some form of trauma. Next to that we focus on the misconception that professionals suffering from trauma can receive treatment without support of their loved ones and social network. It is explained that social support is not only relevant but necessary in treating trauma effectively. |

In a recent research study entitled Encountering ‘The Other’: Victim Offender Dialogue in Serious Crime the impact and outcomes for victims/survivors of meeting with the prisoner participants who had caused them harm were examined. In the vast majority of those cases, organised within the context of the Victim Offender Mediation Program (VOMP), forgiveness was offered by victims and received by offenders. This research, utilizing a qualitative multiple case study method, examined twenty-five randomly selected cases referred for victim/offender mediation over a 10-year period, in which victims/survivors, following a period of preparation, had participated in at least one day-long dialogue with their offenders facilitated by trained personnel. This article addresses only one of the research questions posited in this study, namely, the ways in which apology and forgiveness played a part in those dialogues and in the experience of the participants following their mutual encounters. It is argued that granting forgiveness can have great power in its effects when experienced by the participants. |

This paper focuses on the practice of youth justice (termed ‘youth protection’ in Belgium) in which professional actors ascribe deviant behaviour of youngsters to different cultural and migration backgrounds. Intra-European Roma migrants and refugees from the Northern Caucasus in Belgium are chosen as case studies. Discourse analysis of 55 youth court files and 41 expert interviews with professional actors show that deviant behaviour of these young people is explained in different manners. Two discourses are identified: ‘criminal vagabonds’ and ‘war torn children’. These discourses and their effects in practice differ tremendously for both groups. The broader discussion this article touches upon is the selective inclusion and exclusion in the institutions of formal social control, through social practices of culturalisation. |

This study aims to provide insight into allegations of child sexual abuse in the context of divorce, and related, proceedings by analyzing the decision-making process of civil judges. To this aim, interviews with 13 judges and 11 lawyers were conducted and a focus group was organized with different specialists. It is concluded that in the eyes of the judges, allegations of child sexual abuse in this context are not rare, and some of the professionals signal an increase of allegations in the last decade. The presence of an allegation poses a dual issue: it points out problems within the family, as well as causes problems for the child. This dual nature makes it even more complex for judges to make decisions, especially concerning contact between father and child. The validity of the allegation becomes less important than its presence when judges consider the children’s best interests. The judges’ aim to create conditions for the family within which the child’s safety is best protected, can as an unwanted consequence delay the process, which in itself can be damaging for the child. |

De studie beoogt aan de hand van 87 dossiers van gezag- en omgangsonderzoeken door de Raad voor de Kinderbescherming (RvdK) meer inzicht te krijgen in situaties waarin de ene ouder de andere ouder in het kader van een (echt)scheiding beschuldigt van seksueel misbruik van kinderen. De dossiers zijn gekoppeld aan bijbehorende civielrechtelijke beschikkingen en het Justitiële Documentatiesysteem. Hierdoor is de problematiek van verschillende kanten belicht. Uit het onderzoek blijkt dat het over het algemeen complexe zaken zijn, waarin naast de BSKM nog meer problemen zijn binnen de gezinnen. De aard van het vermeende seksueel misbruik is ernstig, en de kinderen gemiddeld jong. Regelmatig is de beschuldiging geuit bij politie en hulpverlening vóór de rechtszaak en het raadsonderzoek. De rechtszaken betreffen over het algemeen procedures omtrent gezag, verdeling van zorg- en opvoedingstaken en omgang. Vrijwel nooit is vast te stellen of het seksueel kindermisbruik heeft plaatsgevonden. Slechts drie ouders zijn veroordeeld voor het misbruik. Eén vader is vrijgesproken, twee vaders zijn niet nader vervolgd omdat zij ten onrechte als verdachte waren aangemerkt. Civiele rechters die beslissingen moeten nemen over de kinderen staan voor een dubbel dilemma: het al dan niet serieus nemen van de beschuldiging kan schadelijke gevolgen hebben voor kinderen, en daarnaast kan, vanwege de onzekerheid over de gegrondheid, een beslissing tot nader onderzoek ook schadelijk zijn omdat dit het proces verlengt. De RvdK adviseert de rechtbank regelmatig om definitieve beslissingen omtrent de kinderen aan te houden, in afwachting van bijvoorbeeld hulpverlening of een ondertoezichtstelling. Het is echter doorgaans niet de waarschijnlijkheid van het SKM, maar de gevolgen van de beschuldiging zelf waar de RvdK zijn zorgen regelmatig over uit. Hierdoor lijkt het dat de beschuldiging, en niet het potentiële misbruik, een katalysator is voor onwenselijke gevolgen voor de kinderen. |

In this article several perspectives on studying taboos within social sciences are described. Originally, taboo, a concept that was already used within Polynesian societies early 1800, referred to food that was not allowed to eat. Anthropologists analyzed taboos especially in a functionalistic manner, as contributing to the maintenance of existing power balances within societies. These and other studies on taboos all illustrate the fact that taboos are very much a social construction and are very much time and place dependent. In contemporary western societies taboos are associated with ‘open secrets’ and ‘silencing’. Within criminology certain topics are considered taboo as a research object (e.g. explaining crime through ethnic, cultural or religious characteristics), while others claim that there are no criminological research taboos left. |

A taboo serves the social order for it facilitates social control. This article will focus on taboos related to sexual contact by youngsters. The way authorities guard sexual taboos is indicative of the way authorities envision the organization of society. It is this organization through the control of youth and sex which will receive attention. In the classic study by Mary Douglas on pollution and taboo dirt is understood as ‘matter out of place’. The sexual teenager is an illustration of this ‘matter out of place’ because it is difficult to categorize sexual teenagers on the basis of asexual children and sexual adults as an organizing principle for society. In criminal law lewd conduct by youngsters refers to wrong sex at the wrong age. By criminalizing these sexual transgressions the proper place of youth and sex is once again restored. This is necessary for it will be argued that the interests of society are somewhat under pressure because of transgressions when it comes to children as asexual and when it comes to sex as something for within a relationship. The perpetrator of lewd conduct should be understood as a scapegoat reestablishing when and how sex should take place. By restoring the asexual child and the sexual relationship it is hoped sex and youngsters can once again offer some guidance in a social order lacking these clear markers. |

This essay argues that the breaking of taboos is an effective means to increase one’s definition-power and discredit the establishment. But rhetorical warfare and satire may also turn into its opposite: strengthening fanaticism. First, the author discusses the controversy surrounding the cartoons of Charlie Hebdo and the militant pleas for maximum artistic freedom, articulated by Salman Rushdie and others. In the second part of this essay the author argues that advocates of an inviolable right to freedom of expression, including the right to insult, may create their own taboos. Within the tabloid press and the outrage industry this ‘right’ gets more aggressive functions. Finally, some ambiguities about political correctness and the racism-taboo are discussed. |

This article describes the attitudes of Turkish and Moroccan Dutch regarding cousin marriages, using two qualitative studies. Last year the Lower House of the Dutch parliament passed a bill involving a ban of cousin marriages. The main reason for the ban is that many of these marriages are supposed to be concluded forcibly. The new law will mostly affect immigrant groups, since such marriages occur frequently in this population. This article describes the significance for the enforceability of the ban for these groups as well as the attitudes towards cousin marriage. Legitimacy problems seem to arise because a part of the Turkish and Moroccan Dutch respondents feel that the state should not interfere with the individual choice for a marriage partner. Yet there is also evidence for regulatory compliance on normative grounds, even among those who oppose the bans, due to democratic procedures and religious norms. |

This articles offers an overview of four centuries of ‘forbidden relations’ in The Netherlands. From the late sixteenth century onwards, the dominant Calvinist church tried to ‘purify’ the Dutch nation by persecuting all forms of fornication, adultery, incest, and sodomy. The French period (1795-1813) separated church and state, and removed several forms of forbidden relations from the penal code. But social control on relations remained intense. An ‘ideal’ marriage was based on equality of the spouses in terms of social background, religion and age. Parents as well as the local community made sure young people made the ‘right’ choice. Competition between religious groups intensified in the late nineteenth century and mixed marriages became even more problematic. In the 1960s and 1970s all this began to change, and many rules and norms regarding partner choice were relaxed. An example of the changes over time are unmarried cohabitations which transformed from a crime (sanctioned by banishment) to deviant behaviour (sanctions through withholding poor relief) to a more or less normative ‘trial marriage’. |
