De auteur presenteert autobiografische bronnen van zijn speciale aandacht voor, en professionele toewijding aan het terrein van economisch strafrecht. Hij werd op dat spoor gezet door de werken van Karl Marx, maar uiteindelijk ontdekte hij dat Marx maar weinig te bieden had als het om het recht gaat. Niettemin bleef zijn fascinatie voor de relatie tussen economie en (straf)recht. De auteur behandelt enkele – tegenwoordig belangrijke en intrigerende – voorbeelden die die fascinatie kunnen rechtvaardigen.

Uit het Perspectief-rapport (januari 2020) blijkt dat het besluit om het eigen leven te beëindigen zonder dat er sprake is van een medische grondslag niet samenhangt met de leeftijd van de betrokkene. Aan een wettelijke regeling die de zelfgekozen dood mogelijk maakt voor mensen met een ‘voltooid leven’, zoals voorgesteld door D66, bestaat daarom geen behoefte. De eis van een medische grondslag is echter onnodig restrictief en verdient dan ook heroverweging. Dat hoeft er niet toe te leiden niet-artsen bij de uitvoering van een besluit tot levensbeëindiging te betrekken.

Implementing a restorative policy is a difficult job for schools. In schools based on sanctions teachers need to know the rules, but in schools based on restorative justice everyone, especially students, understands the rules and believes in them. The relation has priority. Such a school needs a vision on the restorative method for parents, teachers and students to solve unacceptable behaviour and conflicts. It focuses on self-discipline instead of discipline.

Schools are tasked with helping children to become socially competent(er), both in the on- and offline world. If conflicts occur, schools find out how they can tackle this behaviour and prevent it in the future. Schools cover various tracks here. More and more schools have understood that they can actively involve children and young people in their preventive and problem-solving approach. They integrate methodologies and programmes that give children and young people the opportunity to take responsibility when a conflict occurs. Some of these methods and programmes are looked at more closely in this article. The article concludes with a future-oriented dream that responds to some current educational needs.

From day one of the journal Recht der Werkelijkheid (Journal of Living Law) the Legal Anthropology was welcomed. What once started as the jurisprudential study on Folk Law on the one hand and the cultural anthropological study of law on the other hand, evolved into an intensive collaboration among the researchers. Even more intensive under the subject Legal Pluralism. The legal anthropological studies extended over the years to subjects closer to the First World legal practices, i.e. the studies of social groups like the one on migrants. Under the concept of semi autonomous social fields many contributions on cultural versus legal norms were published. Later on, the legal anthropological expertise that sustained the comparative studies for international and supranational law was welcomed. The article thus shows that the journal provided room for the socio legal studies of law practices in other continents, expanded to those of other continents in the home continent as well as to those in all continents.

The COVID-19 pandemic caused overcrowded IC units. In the Netherlands a discussion erupted on what category of patients should be granted a bed, if there would not be enough place to treat everybody. In this article the medical guidelines for this situation as well as the public discussion are examined and related to Ulrich Beck’s theory of reflexive modernization. It is argued that discussion and regulation of this dilemma follow reflexive patterns, albeit patchy. The discussion and regulation displayed reflective understanding of the perilous position of the elderly and frail but issues of class and ethnicity were not discussed. This research revealed that Beck’s theory holds its own when tested in an empirical situation, but it has weaknesses in regard to the predicted emergence of cosmopolitan solidarity.

In het kader van ontwrichtende criminaliteit ontstaat steeds meer aandacht voor de gebruikerskant. Zo ook voor de harddrugsgebruiker, die een ontwrichtende invloed op de samenleving heeft. Dit artikel beantwoordt daarom de vraag of strafbaarstelling van harddrugsgebruik legitiem en rechtvaardig is. Teneinde deze vraag te beantwoorden wordt getoetst aan de criteria voor strafbaarstelling en worden de argumenten die ten grondslag liggen aan de strafbaarstelling van de prostituant die misbruik maakt van prostituees die slachtoffer zijn van mensenhandel ter inspiratie gebruikt.

Political parties in the Netherlands have been calling for a ban on Hizb ut-Tahrir for years. But what do we actually know about this movement, its supporters and how they relate to Dutch society? This article is one of the first attempts to paint a more complete picture. It shows that the movement and its supporters adhere strictly to the course of the (re) establishment of the caliphate that was mapped out by founder Taqiuddin al-Nabhani in the 1950s. However, the assumption that the movement would advocate or encourage the use of violence requires nuance. These insights are not ‘static’ or ‘comprehensive’ and should be seen as a contribution to the discussion of the nature of the movement. The question of how the course – ideas and activities – of Hizb ut-Tahrir relates to democratic society will be addressed in a subsequent article.

While the legal path to ending marital captivity has been cleared, socio-cultural obstacles continue to prevent victims from going to court. This article focuses on the religious and socio-cultural elements within the Dutch-Pakistani community that promote the continued existence of marital captivity, thereby zooming in on the importance of the nikah, the prevalence of (transnational) arranged marriages, and the concept of family honor.

Organizing dog fights is prohibited in the Netherlands. In such fights, two dogs have to fight each other, sometimes to the death. The animal suffering behind this is enormous. Little is known in the Netherlands about the phenomenon of dog fighting, both from a scientific point of view and through criminal cases. In this contribution, we outline the world behind dog fights by describing how dog fights work, who are part of the entourage and within which criminal infrastructure the dog fights take place. Finally, the problem is discussed and the current approach by the appropriate authorities is discussed and which gaps can be discovered.

The current study investigates the relationship between the Dark Triad personality traits (consisting of narcissism, psychopathy and Machiavellianism) and three different forms of aggression: online aggression, overt aggression and relational aggression. The sample consisted of 1,051 adolescents between 12 and 16 years old. Results show that psychopathy and Machiavellianism are positive predictors of the three forms of aggression, while narcissism is a positive predictor of online aggression only.

Criminology has traditionally focused on urban areas where crime visibly concentrates. However, since the 1990s, attention for ‘rural criminology’ has steadily increased. First, rural areas are confronted with partly different and less visible crime problems, such as environmental crimes. Second, public actors such as enforcement and other agencies are less present and ‘available’ in rural areas, and people on average trust the government less to provide support when necessary. This chronicle presents an overview of international and Dutch research in the context of rural criminology. The paper addresses cultural differences between urban and rural areas, high-volume crimes, gender-related violence, alcohol and drug abuse, environmental crime, and enforcement in rural areas.
