Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling. |

Age limits, minimum and maximum, and both explicit and ‘covert’, are still used in the National Health Service to determine access to a range of health interventions, including infertility services and cancer screening and treatment. Evidence suggests that chronological age is used as a proxy for a host of characteristics in determining access to healthcare: as a proxy for the capacity of an individual to benefit from an intervention; for the type of harm that may result from an intervention; for the likelihood of such benefit or harm occurring; and, in some cases, for other indicators used to determine what may be in the patient’s interest. Age is used as a proxy in this way in making decisions about both individual patients and wider populations; it may be used where no better ‘marker’ for the relevant characteristic exists or – for reasons including cost, practicality or fairness – in preference to other available markers. This article reviews the justifications for using age in this way in the context of the existing legal framework on age discrimination in the provision of public services. |

This article argues in favour of lowering the voting age to 16. First, it outlines a respect-based account of democracy where the right to vote is grounded in a respect for citizens’ autonomous capacities. It then outlines a normative account of autonomy, modelled on Rawls’s two moral powers, saying what criteria must be met for an individual to possess a (pro tanto) moral right to vote. Second, it engages with empirical psychology to show that by the age of 16 (if not earlier) individuals have developed all of the cognitive components of autonomy. Therefore, since 16- and 17-year-olds (and quite probably those a little younger) possess the natural features required for autonomy, then, to the extent that respect for autonomy requires granting political rights including the right to vote – and barring some special circumstances that apply only to them – 16- and 17-year-olds should be granted the right to vote. |

Text and Data Mining (hereinafter, TDM) issue for the purpose of scientific research or for any other purpose which is included in the provisions of the new EU Directive on Copyright in the Digital Single Market (hereinafter, DSM). TDM is a term that includes Web harvesting and Web Archiving activities. Web harvesting and archiving pertains to the processes of collecting from the web and archiving of works that reside on the Web. In the following analysis we will elaborate briefly upon provisions in EU Copyright law which were discussed during the proposal for a new Directive on Copyright in the DSM as well as provisions which are included in the text of art.3 and art.4 of the new Directive 2019/790/EU per TDM. In addition, the following analysis presents legislation in very few EU Member States which pertains to TDM and preceded the rulings of Directive 2019/790/EU. Digital legal deposit remarkable examples from EU Member States are also presented in this paper. The example of Australia is also presented below hereto because it is one of the oldest and most successful worldwide. The National Library of Australia’s digital legal deposit is state-of-the-art. |

An employee’s functional impairment, which at the time of dismissal had had a duration of 11 months and with an uncertain prognosis, was not deemed a long-term one. For that reason, the Danish Western High Court found that the employee was not disabled within the meaning of the Anti-Discrimination Act or Directive 2000/78 establishing a general framework for equal treatment in employment and occupation. |

In this paper I propose to analyse the binary notion of personal data and highlight its limits, in order to propose a different conception of personal data. From a risk regulation perspective, the binary notion of personal data is not particularly fit for purpose, considering that data collection and information flows are tremendously big and complex. As a result, the use of a binary system to determine the applicability of EU data protection law may be a simplistic approach. In an effort of bringing physics and law together, certain principles elaborated within the quantum theory are surprisingly applicable to data protection law, and can be used as guidance to shed light on many of today’s data complexities. Lastly, I will discuss the implications and the effects that certain processing operations may have on the possibility of qualifying certain data as personal. In other terms, how the chances to identify certain data as personal is dependent upon the processing operations that a data controller might put in place. |

In this article, I am using Becker’s concept of moral entrepreneur to analyse the role of pain specialists in the labelling process, which has led to the normalisation of the use of opioid painkillers in the United States and ultimately to the death over 200.000 Americans. In general, the literature on labelling centres on crusading reformers, and the criminalisation and stigmatisation of transgressive behaviour. Here I will focus on the moral entrepreneurship of medical experts. What was their role in the normalisation process of opioid painkiller use and are there any similarities with the strategies of crusading reformers? My findings, based on qualitative analysis of documents such as newspaper articles and academic publications, show that, with two exceptions, pain specialists use the strategies of moral crusaders. First, in their narratives, pain specialists represented themselves as neutral objective experts without the emotional stance of moral crusaders. The second exception, which is related to the first, is that there was less emphasis in their narrative on creating villains, as they could not blame openly standard medical practice because they needed the support of the established medical world in order to normalise and legalise opioid painkillers. |

Door de Wkkgz vindt de buitengerechtelijke afwikkeling van medische schadeclaims plaats in het klachtrecht in plaats van het aansprakelijkheidsrecht. Zorgaanbieders moeten zelf proactief en oplossingsgericht schadeclaims onderzoeken en beoordelen. De rol van de patiëntencontactpersoon in het ziekenhuis, van de zorgverlener en de samenwerking tussen ziekenhuis en verzekeraar zijn daarmee ingrijpend veranderd. Dit overzichtsartikel bespreekt de eerste stappen naar implementatie van de Wkkgz, de aard van het klachtrecht, de noodzaak van triage, de werkwijzen van zelfregelende ziekenhuizen, de noodzaak van informed consent, BGK , de zeswekentermijn, de eerste resultaten van de Wkkgz-geschilleninstanties, en het wetsvoorstel tot wijziging van de Wet BIG. |
