De rijksministerraad en de Nederlandse ministerraad vergaderen volgens hetzelfde reglement van orde. In deze bijdrage wordt voorgesteld afzonderlijke orderegels voor de rijksministerraad in het leven te roepen. In deze orderegels kunnen onder andere de termijnen voor aanlevering van de stukken worden vastgelegd en kan voorzien worden in mogelijkheden voor de Caribische landen om de Raden van Advies te horen. Hierdoor worden de Caribische landen beter in staat gesteld hun rol in de rijksministerraad waar te maken. Dit is onder meer van belang omdat de besluiten van de rijksministerraad grote (maatschappelijke) gevolgen kunnen hebben voor de landen. Tijdens de coronacrisis is dit wederom gebleken. |

The aim of the present research was to gain insight into the topic of ‘task-related rule-breaking behavior’ (TRB) among Dutch police officers. TRB is a more refined alternative for the concept of noble cause corruption and has been defined as: police officers breaking rules or formal agreements for the purpose of acting in a manner that contributes to the lawful police task. Qualitative research has been conducted within one of the ten regional police forces in the Netherlands. Results show that TRB appears to be a relatively common phenomenon during policework. Behaviors are categorized in sixteen categories and five overarching outlines. In addition, attention is given to several important factors that could be related to TRB being distinguishable between police officers’ individual responsibility and organizational factors. To handle TRB, it is recommended to pay attention to the police officers’ approach of judging and rationalizing their own behavior, their level of knowledge, and social skills. Furthermore, organizational structure (i.e., spam of control) and police leadership may, among other factors, play an important role in encouraging TRB. Especially the way supervisors deal with police officers’ professional autonomy needs specific attention in order to reduce TRB. Autonomy needs guidance in the form of clear orders followed by feedback and coaching. Also, an active form of ethical leadership is needed. An action framework is presented that could be helpful to supervisors to judge and thereby reduce forms of TRB. |

Little is known about (former) partners of 1%motorcycle club members. Social professionals working with victims of domestic violence in shelters have regular encounters with these mostly female (ex-)partners. In this exploratory contribution we wonder what is known about domestic violence amongst people with (ex-)partners of 1%motorcycle club members and the consequences of the involvement of a motorcycle club for tackling this violence. Based on thirteen semi-structured interviews with social professionals working in a shelter, external professionals and (ex-)partners, the link between domestic violence and membership of a motorcycle club could not be verified. What this research does show is that safety is the number one priority in working with these (ex-)partners. Furthermore, it shows how complex it is to assess the seriousness of potential threat coming from these 1%motorcyle clubs. Further research on domestic violence in environments associated with organised crime and the cooperation between the judiciary system and social professionals is needed to improve safety and wellbeing for this specific group. |

In this article, we analyze which aspects of performance theory and the procedural justice-based model are explaining the trust of shopkeepers in the police and local government. Utilizing a survey of 156 shopkeepers and 94 semi-constructed interviews with shopkeepers, which are located at the South Shopping Boulevard in Rotterdam (The Netherlands), the study finds that shopkeepers have a relatively high trust in the police and local government. This is surprising because various attempts in the past 30 years to revive the high street by the government have failed to improve its bad image, as dwindling visitor numbers, poor turnover, limited range of retailers, empty shops and high crime and offence levels show only too plainly. The findings also highlight that ethnic minority respondents have more trust in local government than Dutch shopkeepers. The explanation therefor is sought in the dual frame of reference theory. |

Traditionally, the mayor has an important role as a citizen’s father and as a maintainer of public order. In the context of the so-called ‘undermining’ criminality, the mayor has been increasingly empowered with new legal instruments to combat undermining criminality. Some mayors see themselves as a sheriff. However, in the Dutch Municipal Act, the mayor only has a task of maintaining the public order. How does this task relate to combating undermining criminality? What is the role of the mayor in the combat of undermining criminality? Nowadays, there is no legal basis in the Dutch Municipal Act to equip the mayor with crime-fighting duties. This article proposes to equip the mayor with a legal duty as a crime fighter. |

Qualitative research in an immigration detention center in the Netherlands shows that detained unauthorized migrants consider the entry procedure in Immigration Centre Rotterdam procedurally just. These migrants are generally positive on the fairness of the entry procedure as their safety and welfare are guaranteed and existing procedural justice criteria are respected. However, they believe that immigration detention in itself is illegitimate and that they do not deserve to be detained. This shows that the focus on procedures and interactions is insufficient to understand the perceived legitimacy of immigration detention if shared values and consent with the legal basis of immigration detention are lacking. |

A forensic mental health report is requested in about 30% of more serious cases presented to the criminal court. These reports can be used at sentencing and advise the judge on criminal responsibility, recidivism risk, and possible treatment measures, but is not a formal factor in decisions about guilt. The current study focuses on the (unwarranted) effect of forensic mental health information on conviction decisions. Using an experimental vignette study among 155 criminology students, results show that when a mental disorder is present, conviction rates are higher than when such information is absent. In line with the story model of judicial decision-making, additional analyses showed that this effect was mediated by the evaluation of guilt rather than by the evaluation of other physical evidence. Implications for further research and practice are discussed. |

Because of the sharp contrast between the law-in-the-books and the law-in-action regulatory enforcement has always been a popular subject in socio-legal research. This paper looks back at forty years of Dutch research on regulatory enforcement, using several key publications in this journal from each decade. First, it is argued that these Dutch studies reveal three general themes: this research can be seen as a time machine that takes us back to some of the most important social and political events of the past decades, these studies emphasize the crucial role of individual enforcement officials, and in everyday enforcement state law only plays a limited role. Next, this review also discusses some of the strengths and weaknesses of Dutch research. Most studies on regulatory enforcement are more interested in the role of the state than in the role of citizens and businesses. As a result, research focuses more on issues of effectiveness and less on questions of legitimacy. Finally, empirical research is seen as more important than theory development. Based on this overview, the author introduces a new research agenda for future research on regulatory enforcement. |

Het Europees Hof voor de Rechten van de Mens (EHRM of Hof) heeft in de periode van september 2019 tot en met augustus 2020 weer diverse uitspraken gedaan over gezondheidsrechtelijke onderwerpen. Veel uitspraken borduren voort op of geven een nadere uitleg aan zaken waarover het Hof zich eerder heeft gebogen. Tegelijkertijd komt uit de uitspraken van afgelopen jaar het beeld naar voren dat het Hof in toenemende mate belang hecht aan de beschermingsplicht van de overheid, in het bijzonder bij gedetineerden, psychiatrische en verstandelijk beperkte patiënten en personen die anderszins kwetsbaar zijn. |

To control the COVID-19 outbreak Dutch government opted for a so-called intelligent lockdown. The virus as well as the lockdown caused significant personal and societal damage. It also created, however, a unique natural experiment. How did the forced stay in affect the crime levels? This article presents empirical data on crime trends during the lockdown. Initially, the general crime level decreased sharply. However, the general crime level quickly returned to pre-lockdown levels. Different types of crime displayed divergent trends, e.g. property crimes decreased sharply whereas online crime rates increased considerably. These trends fit rather well with an opportunity theoretical approach regarding crime. |

Four phases of the Corona crisis are distinguished: a first acute phase, the gradual transition to a new normal, the economic downturn and the long run. The article describes what happened in the courts in the first and in the beginning of the second phase, and what is subsequently likely to happen. In the acute phase the court buildings shut down, and adjudication came largely to a halt. The courts were late in opening up, and as a result backlogs of, in particular, criminal cases increased. The courts extended their use of digital tools (e.g. tele-hearings) that, while allowing cases to proceed, did not fully protect the rights of parties. While so far the volume of commercial cases and bankruptcies has not increased, a (rapid) increase is inevitable. Contract breach will be wide spread, and will give rise to fundamental legal issues. For economic recovery it is essential that the courts give clear and consistent guidance in these matters quickly. This requires the courts to reduce the currently long duration of civil cases, and to use the available procedures to get expeditious decisions of the Supreme Court. The courts will also need to develop their ICT-instruments rapidly to guarantee the rights of parties. After a difficult first phase, the courts now face the challenge to effectively guide society through the Corona crisis and its aftermath, and thereby play its role in the trias politica. |
