    This contribution provides an overview of the legal and criminological research into the decision following the determination of a supervisor that the conditions of a freedom-restricting sanction are not met. It is an important decision, on the one hand because it can result in a more severe sanction than was initially imposed, on the other hand because a decision that is perceived as unfair can influence the extent to which suspects and convicts are willing to comply with conditions, and recidivism. Yet little research has been conducted into this decision. The legal safeguards with which it is accompanied are lagging behind those of the original sentencing decision. Undeserved according to penitentiary experts. The scarce empirical research shows that decision-making involves many different layers and that the actors involved have different goals, ranging from deterrence and emphasizing the credibility of the system to the successful completion of the sanction. Even in countries where regulations have been tightened considerably, the discretionary power of direct supervisors, such as employees of the working project or therapists, is still large. This raises the question to what extent the final decision maker (usually a judge) still has sufficient room to make an independent decision.

    We analyze two citizen collectives of ‘professional city makers’ who have shaped participation in circular area development in anticipation of the Dutch Environment and Planning Act. The activities of professional city-makers form an interesting new phenomenon that requires attention as well as the implications: it is precisely through the professionalism of the city-makers’ efforts that there is a regular tension in the participation process between their role as citizen and professional in their contact with the government. We therefore discuss how the participation of professional city-makers in area development exposes different paradoxes that must be taken into account in the further implementation of the Environment and Planning Act. In short, we argue that participation in the Act is presented in a traditional way and does not fit the new role of citizens in area development in the 21st century.

    In the past five years, the Council of State, the National Ombudsman and several academics have criticized the way in which new legislation has been made. In their view, principles of law and the rule of law are insufficiently uphold due to an instrumentalist view on law. This criticism urged the authors to conduct an empirical study into the question how legislative drafters deal with legislative plans which are problematic from a legal or rule of law point of view, and how they justify their role in the legislative process. This study is explorative and qualitative in nature. During the summer of 2018, 24 legislative lawyers from five different Dutch ministries have been interviewed. The results show that the role of legislative lawyers can best be characterized as constructively critical. As their tasks encompass much more than solely the actual drafting of legislation, they more and more resemble their colleagues from the policy department. The authors suggest that legislative lawyers should articulate their distinctive professional ethics in order to strengthen the checks and balances within the ministries.

    Little is known about how ex-prisoners’ parole supervision experiences relate to desistance. The aim of this article therefore is to gain insight into the nature of release conditions and parole supervision of ex-prisoners and parolees’ perceptions of their supervision related to the desistance process. A total of 23 Dutch parolees were interviewed in depth at three waves starting in prison up to one year after their release, and the 69 interviews were combined with their parole files containing information about conditions, violations and sanctions. Parole files revealed the practice of highly engaged parole officers, who worked with parolees to strengthen factors known to foster desistance. However, the interviews showed that most parolees found their parole experience predominantly surveillance-oriented and not very helpful for desistance. Parole was experienced as most beneficial when parole officers used their discretionary power to adjust conditions creating ‘space’ for trial-and-error.

    The Life In Custody-study is a large scale, prospective panel study, aimed to examine the quality of prison life in The Netherlands. This paper describes the LIC-study by giving a detailed overview of the data collection procedure, and strategies to optimize response, and presents the first nationwide results on prison climate in The Netherlands. Results show that the data collection procedures utilized were successful in obtaining a high response rate (which was an exceptional 81%) and reaching a representative group of prisoners. Furthermore, results show that the perceptions of prison climate vary across prison regimes, and to a lesser extent across age groups and time spent in detention.

    This article introduces the concepts of play and playfulness within the context of legal-philosophical education. I argue that integrating play and playfulness in legal education engages students and prepares them for dealing with the perpetual uncertainty of late modernity that they will face as future legal professionals. This article therefore aims to outline the first contours of a useful concept of play and playfulness in legal education. Drawing on the work of leading play-theorists Huizinga, Caillois, Lieberman and Csikszentmihalyi, play within legal education can be described as a (1) partly voluntary activity that (2) enables achievement of learning goals, (3) is consciously separate from everyday life by rules and/or make believe, (4) has its own boundaries in time and space, (5) entails possibility, tension and uncertainty and (6) promotes the formation of social grouping. Playfulness is a lighthearted state of mind associated with curiosity, creativity, spontaneity and humor. Being playful also entails being able to cope with uncertainty. The integration of these concepts of play and playfulness in courses on jurisprudence will be illustrated by the detailed description of three play and playful activities integrated in the course ‘Introduction to Legal Philosophy’ at the Vrije Universiteit Amsterdam.

    Big data en, breder, data science, belooft veel voor toezicht. Om de beloften waar te maken moeten de nieuwe methoden en technieken wel worden toegepast in een inspectieorganisatie. Veel literatuur gaat over de beloften en bedreigingen van data science, weinig over de implementatie in organisaties. Deze bijdrage exploreert een aspect van dit onderwerp, namelijk de relatie tussen de nieuwe data scientist en de inspecteur. Beide vertegenwoordigen verschillende, en soms strijdige, essentiële kennisbronnen voor risicogebaseerd toezicht. Hoe kan er synergie tussen deze kennisbronnen worden bereikt? Deze bijdrage omschrijft deze uitdaging en verkent een drietal oplossingsrichtingen.

Promoting Conciliation and Mediation in Collective Labour Conflicts in Europe

    On 23 April 2018, the Belgian Ministry of Labour, together with a consortium of 12 European research institutes, held a symposium on the current state of the art and best practices for conciliation and mediation in collective labour conflicts within the European Union, and particularly in Belgium. The symposium was organized for two occasions. First, the 50st anniversary of the Belgium law, providing mediation services by the Ministry of Labour to prevent and mediate in collective labour conflicts. Second, the presentation of the results of an EU (DG Employment, Social Affairs and Inclusion) sponsored project in 12 EU member states.
    The management of collective labour conflicts is in all countries regulated differently. The study shows that also practices of third party intervention differ largely. Most countries differentiate conciliation (a relative informal process of facilitated negotiation), mediation (usually defined as a strong involvement of the third party, who gives recommendations to the parties), and arbitration. Mediators typically are not trained, certified or registered as mediators in most countries. In all countries there is a large potential for conciliation, particularly in early stages of conflict (preventive mediation), as well as in rebuilding of trust after conflict episodes. Ana Belén García is senior researcher at the University of Seville and KU Leuven, working in the departments of work and organizational psychology. She was coordinator of several EU funded research programs on social dialogue in organisations. The most recent project was on mediation in collective labor conflicts in 12 EU member states. Ana’s interest is on conflict management and mediation in organizations. She was editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’. Ana holds a PhD in Psychology and HRM from the University of Seville and KU Leuven. She is also a registered mediator.

Erica Pender
Erica Pender is a mediator and senior researcher at the University of Seville and KU Leuven in the department of Work and Organizational Psychology. She holds a PhD in Psychology from the University of Seville and KU Leuven focusing on trust and trustworthiness in organizations. After studying psychology at the University of Seville, she obtained her MSc at Maastricht University. She has coordinated two large-scale projects for the European Commission, and was co-editor of two handbooks in the Springer Series ‘Industrial relations and conflict management’.

Francisco J. Medina
Fransisco J. Medina is professor in social and organizational psychology, and Dean of the Faculty of Psychology and Educational sciences, at the University of Seville, Spain. His interests are conflict management, mediation and organizational development. He is engaged for many years in the development of labor mediation in Spain, providing training for mediators. He is also an experienced consultant and mediator. Francisco published both internationally and in Spanish extensively on conflict management and mediation.

Martin Euwema
Martin Euwema is professor in organizational psychology, and chair of the research group Organizational and Occupational Psychology and Professional Learning at KU Leuven, Belgium. He is also co-director of the Leuven Center for Collaborative Management and visiting professor at University of Copenhagen, IESEG-Paris, Sevilla, and Tsinghua (Beijing). He has extensive experience as consultant and mediator for both profit and non-profit organizations.     Public organizations seem to be in a permanent state of transition in an attempt to adapt to the outside world. A recent development is the emergence of hybrid professional roles in fields such as healthcare and primary education. These hybrids are a midway between managerial and professional roles and are expected to collaborate with stakeholders in tackling problems. This article focuses on the challenges of recently appointed hybrid professionals within a Police team in The Netherlands. We focus on their efforts to find a place and position in their team by analyzing some critical incidents in which they clashed with their fellow professionals. In doing so, they perform ‘identity work’ to find out who they are, both for themselves, as for colleagues. We conclude both identity and identity work don’t come natural in a hybrid professional reality and stress the need for facilitation of professional reflection at the organizational level.

    This article describes the subsequent waves of contract killings in the Netherlands since the twentieth century. Contract killings appear to happen especially within ethnic groups which are newcomers to Dutch society. The Chinese community in Amsterdam fought two internal ‘wars’. The first one was from 1918 till 1935 and circled around the trade in opium and arms. The second one took place between 1969 and the mid-seventies and was fueled by conflicts about the heroin trade. Then Turkish criminals took over the heroin trade, which resulted in a wave of Turkish victims of contract killings throughout the second half of the seventies and into the eighties. The cocaine trade came up in the eighties and was run first by Chileans and later by Colombians, which resulted in several murders within the criminal circles of these communities. While contract killings of (by birth) Dutch criminals had always been very rare, this changed from the mid-eighties. These killings not only took place in Amsterdam, but also in the southern provinces of Limburg and Brabant, as well as in Rotterdam. Most Dutch criminals specialized in cannabis growing and trading. In the nineties the number of contract killings reached a peak. By then Yugoslavs had entered the criminal scene in the Netherlands. They cooperated with Dutch criminals and offered their services as hitmen. From 2000 onwards the number of contract killings has been dropping constantly and has now reached a more or less constant level of around twenty yearly. In the last couple of years many young Moroccan Dutch criminals have been killing and killed in conflicts on drugs trade. The author signalizes a lack of ‘professionalism’ in contract killers today and draws a parallel with the period when Chinese criminals were fighting their wars in Amsterdam. The hitmen are young, have little experience, are not intelligent and use far too many bullets to do the job.

    The authors reflect on ‘Handelen naar waarheid’ (Acting on truth), an assessment of the state of criminal investigations in The Netherlands, which appeared in May 2016. This report, assigned by the police and public prosecution service and written by four inside experts, caused substantial turmoil in the police organization and beyond. The report addresses six domains: professionalism, attitude and behavior, direction and leadership, capacity for change, organizational structure and business management. The critical and transparent self-reflection by the police received praise from policymakers, journalists and academic observers. It also met with recognition and appreciation in the law enforcement community, in particular among investigators and prosecutors. In the wake of the report, a reform program was organized to modernize both the police and the prosecution service in order to increase the quality and effectiveness of their work. Such reform is deemed necessary because crime problems have become ever more complex and citizens increasingly organize their own (counter-)investigations. The authors conclude that in spite of many recent initiatives, truly innovative practices remain scarce. Also, the crucial ambitions to increase the educational level of investigators and the organizational culture are still far from realized.

    The UK government has embarked on an ambitious programme to reform the English and Welsh probation sector. Key to these reforms has been ‘marketisation’ involving Payment by Results. More recently the devolution of justice has become a key theme. This paper describes key reforms that have taken place since 2010 and sets out evidence for their effectiveness. Currently, the available evidence is limited, but more evidence is available from other sectors where similar models have also been used. This evidence base is discussed with particular reference to the potential for the reforms to promote innovation.

    Despite the positive development of the European Mediation Directive and its translation in the German Mediation Law, in 2014 only 1.5% of the cases in court proceedings at the lower German courts were referred to court mandated conciliation or mediation proceedings. Against this background and in the context of a broader ten years research project, PricewaterhouseCoopers and the Institute of Conflict Management at the European University Viadrina Frankfurt (Oder) initiated a series of studies in 2005. This series was recently concluded with the fifth study conducted end of 2015 and published in October 2016. In addition to assessing the overall corporate landscape in Germany with regard to commercial dispute resolution, the study also considered the future developments and the required changes for further advancing this field.

    Studies indicated that detainees are not always allocated to treatment programs based on official guidelines. Street-level bureaucracy theory suggests that this is because government employees do not always perform policies as prescribed. This study aimed to assess whether this also applies to the allocation of offenders to treatment in Dutch penitentiary institutions. This was studied among a group of 541 male prisoners who participated in the Recidivism Reduction program. The results showed that official policy guidelines were, in most cases, not leading when referring detainees to behavioral interventions. Instead, treatment referrals were influenced by a broad range of risk factors, as well as the length of an offender’s sentence.

    This article explores the investigative methods used by corporate security within organisations concerned about property misappropriation by their own staff and/or others. The research methods are qualitative: interviews, observations and case studies carried out between October 2012 and November 2015. The findings include that, even though corporate investigators do not have the formal investigative powers enjoyed by police and other public agencies, they do have multiple methods of investigation at their disposal, some of which are less used by public investigative agencies, for example the in-depth investigation of internal systems. Corporate investigators also rely heavily on interviews, the investigation of documentation and financial administration and the investigation of communication devices and open sources. However, there are many additional sources of information (for example, site visits or observations), which might be available to corporate investigators. The influences from people from different backgrounds, most notably (forensic) accountants, (former) police officers, private investigators and lawyers, together with the creativity that is necessary (and possible) when working without formal investigative powers, make corporate security a diverse field. It is argued that these factors contribute to a differentiation between public and private actors in the field of corporate security.
