Triangulaire arbeidsrelaties in de platformeconomie: een voorstel tot een vermoeden van uitzendbureau

Tijdschrift Arbeidsrechtelijke Annotaties, Aflevering 3 2019
Trefwoorden Platformen, Platformwerk, Arbeidsbemiddeling, Uitzendarbeid, Terbeschikkingstelling
Auteurs Prof. dr. V. De Stefano en Mr. M. Wouters
SamenvattingAuteursinformatie

Researching elites at the margins of research ethics frameworks

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden code of ethics, corporate crime, research ethics, gaining access, interviewing elites
Auteurs Daniel Beizsley PhD
SamenvattingAuteursinformatie

For social scientists undertaking critical research on elites in organisational contexts securing access is a challenging exercise that may rely on the use of several access strategies over extended periods. This process is further complicated by the existence of research ethics frameworks that establish boundaries to access strategies, posing dilemmas on how to best balance access needs with a commitment to ethical practices. This article focuses on such dilemmas – or the ‘ethics of access’ – through a reflection on PhD fieldwork during 2016-2017 in Luxembourg spent researching the European Investment Bank. The paper will conclude by calling for an overhaul of existing frameworks in order to foster more research on elites.

The concept of violence in (times of) crisis

On structural, institutional and anti-institutional violence

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden structural violence, institutional violence, anti-institutional violence, economic crisis, Greece
Auteurs Marilena Drymioti
SamenvattingAuteursinformatie

Attempting to understand the Greek narrative of crisis, this paper examines the most prominent forms of violence that emerged in the period of acute economic recession and political upheaval in Greece namely structural, institutional and anti-institutional violence. This paper aims to highlight existing theoretical gaps and avoid common fallacies of the current body of knowledge. In contrast to some of the more common features of the discussion on violence, this note sets out to: a) acknowledge that violence is not necessarily a physical act, b) acknowledge that the outcomes of violence performances might not be physical either, c) specify and adequately distinguish agency and structural dynamics and d) address the cultural and contextual aspects of violence. Vital to this endeavor is to acknowledge, identify and understand the interactive relation between different forms of violence that emerge during the same period of time in a context in which conflict escalates.

2019/47 Transfer of undertakings does not include temporary agency workers (AT)

Tijdschrift European Employment Law Cases, Aflevering 4 2019
Trefwoorden Transfer of undertakings, Transfer, Employees who transfer/refuse to transfer
Auteurs Thomas B. Pfalz
SamenvattingAuteursinformatie

In a series of rulings the Austrian Supreme Court has made it clear that temporary agency workers are transferred to the transferee only if they are assigned to the transferor on a permanent basis. According to the Court, the facts of the cases at hand are not comparable to those of the ECJ ruling in Albron Catering BV (C-242/09). Hence the temporary agency workers remain with their original employer. However, some aspects of the Court’s reasoning seem unclear if not contradictory with regard to other recent judgments.

The Polish Supreme Court has held that a criterion of discrimination may also be a relationship of a social or familial nature that exists in the workplace and whose existence or absence on the part of the employee results in different treatment by the employer.

This was a case alleging detrimental treatment for whistleblowing brought by an employee working outside the UK against two co-workers also working abroad in the same location. The Court of Appeal (CA) ruled that there was no jurisdiction for the Employment Tribunal (ET) to hear the claim in relation to personal liability of the co-workers because they were outside the scope of UK employment law. The CA’s judgment potentially has implications for other types of claim brought by UK employees posted abroad where similar personal liability provisions apply, such as discrimination and harassment.

A number of collective labour agreements unjustifiably have excluded allowances from holiday pay. Recently, social partners have had difficulties in repairing these flaws. Two recent cases demonstrate this, both similar claims but with different outcomes. This leaves social partners with the problem of how to proceed.

Samenvatting

The Luxembourg Court of Appeal (Cour d’appel de Luxembourg) confirmed that an employee dismissed with notice and exempted from performing their work during the notice period is no longer bound by the non-competition duties arising from their loyalty obligation and can therefore engage in an employment contract with a direct competitor of their former employer during that exempted notice period. However, the Court of Appeal decided that, even if the former employee is in principle entitled to use the know-how and knowledge they acquired with their former employer, the poaching of clients during the notice period must, due to the facts and circumstances and in the light of the rules applicable in the financial sector, be considered as an unfair competition act and therefore constitutes serious misconduct justifying the termination of the employment contract with immediate effect.

In a recent judgment, the Danish Supreme Court has established that it does not constitute unlawful discrimination under the Anti-Discrimination Act when a disabled employee is dismissed. The employee had a publicly funded reduced-hours job, but reached the statutory retirement age for which reason the public funding lapsed, and that was the reason for the dismissal.
