Access_open Autonomy in old age

    Background: In many European countries caring responsibilities are being reallocated to the older people themselves to keep the welfare state affordable. This policy is often legitimized with reference to the ethical principle of autonomy. Older people are expected to be autonomous, have freedom to make their own decisions, and be self-reliant and self-sufficient as long as possible.
    Aim: The purpose of this article is to explore whether and how older people can remain autonomous in order to continue living their lives in accordance with their own values in the context of declining professional caring facilities and shrinking social networks, and which concepts of autonomy can guide professionals and other involved parties in facilitating the choices of older people.
    Method: An empirical-ethical approach is used to interpret the moral values enacted in the caring practice for older people. Two cases are presented. One is the narrative of a woman who lives by herself; she has been hospitalized after a fall and hip fracture, but does not want to be operatied. The second is the narrative of man living in a residential home; he wants to be actively involved, doing good deeds like he always did as a Scout. The cases are evaluated with the help of two concepts of autonomy: autonomy as self-determination and relational autonomy.
    Results: In both cases the enactment of autonomy remains problematic. In the case of the woman there was not enough care at home to live up to her own values. After she was admitted to a hospital her wish not to be operated was questioned but ultimately honoured due to compassionate interference by close relatives and her oncologist. In the second case there was not enough space for the man to lead his life in the way he always had; his plans for improving the social environment in the care home were torpedoed by management and ultimately the man decided to step back.
    Conclusion: In order to do justice to the complexity of each empirical case that involves autonomy of an older person more than one concept of autonomy needs to be applied. Relying on self-determination or relational autonomy exclusively will give professionals and all involved parties a restricted view on the situation, where the wishes of older people are at stake. In both cases autonomy was overruled by system procedures and stereotypical ideas about old people as being weak and not able to make their own decisions. Both cases show, however, that older people - even if they are physically and mentally frail - long to remain morally responsible for the direction their lives are taking, in accordance with their own values. They communicate their wish to determine their own future and at the same time they are interdependent on others to realize their (relational) autonomy and require support in their attempt to maintain their identity. This conclusion has implications for the normative behaviour of the professionals who are involved in care and treatment of older people.

    Achtergrond: In veel landen wordt de verantwoordelijkheid voor de zorg voor ouderen naar de ouderen zelf verplaatst, dit teneinde de welvaartstaat betaalbaar te houden. Dit beleid wordt veelal gelegitimeerd met referentie naar het ethische principe van autonomie. Oudere mensen worden geacht autonoom te zijn, vrij te zijn om hun eigen beslissingen te nemen, en om zo lang mogelijk zelfredzaam te blijven.
    Doel: Het doel van dit artikel is om te onderzoeken of en hoe oudere mensen autonoom kunnen blijven teneinde hun leven in overeenstemming met hun eigen waarden te kunnen voortzetten in de context van teruglopende professionele zorgactiviteiten en krimpende sociale netwerken, en welke concepten van autonomie zorgprofessionals en andere betrokken partijen kunnen helpen bij het faciliteren van de keuzes door ouderen.
    Methode: Een empirisch-ethische benadering wordt gebuikt om de morele waarden in de zorgpraktijk voor ouderen te interpreteren. Twee casussen worden gepresenteerd. De eerste is het verhaal van een vrouw die op zichzelf woont. Ze is na een val waarbij haar heup is gebroken, in een ziekenhuis opgenomen, maar ze wil niet geopereerd worden. De tweede is het verhaal van een man die in een verzorgingshuis woont. Hij wil actief betrokken worden en goede dingen doen zoals hij die altijd heeft gedaan toen hij padvinder was. Beide verhalen worden met behulp van twee concepten van autonomie geëvalueerd: autonomie als zelfbeschikking en relationele autonomie.
    Resultaat: In beide casussen blijft de verwezenlijking van autonomie problematisch. In het geval van de vrouw was er thuis onvoldoende zorg om volgens haar waarden te kunnen leven. Toen zij in het ziekenhuis was opgenomen werd haar wens om niet te worden geopereerd tegen gehouden, maar uiteindelijk ingewilligd als gevolg van bemoeienis uit hoofde van barmhartigheid door directe verwanten en haar oncoloog. In het tweede geval was er voor de man onvoldoende ruimte om zijn leven te leiden op de manier zoals hij dat altijd had gedaan. Zijn plannen om de sociale omgeving in het verzorgingshuis te verbeteren werden door het management getorpedeerd en uiteindelijk heeft hij zich ervan teruggetrokken.
    Conclusie: Teneinde recht te doen aan de complexiteit van beide casussen die betrekking hebben op de autonomie van een oudere, dient meer dan één concept voor autonomie te worden ingezet. Het vertrouwen in zelfbeschikking of relationele autonomie alleen zal aan de professionals en alle andere betrokken partijen een beperkt zicht geven van de situatie wanneer het de wensen van ouderen betreft. In beide gevallen werd de autonomie ter zijde geschoven door protocollen en stereotypische ideeën over ouderen als kwetsbare personen die niet in staat zouden zijn om zelf hun beslissingen te nemen. Echter tonen beide voorbeelden aan dat ouderen, zelfs als ze fysiek en mentaal kwetsbaar zijn, de wens hebben om moreel verantwoordelijk te blijven voor de richting die hun leven zal nemen, in overeenstemming met hun eigen waarden. Zij geven de wens aan om hun eigen toekomst te bepalen en tegelijkertijd zijn ze onderling afhankelijk van anderen om hun (relationele) autonomie te verwezenlijken, én hebben ze behoefte aan steun bij hun poging om hun identiteit te behouden. Deze conclusie heeft gevolgen voor het normatieve handelen van professionals die bij de zorg en behandeling van ouderen betrokken zijn.

    Illegal weed cultivation is increasingly perceived as an important societal problem. Most of existing research in this area focuses on the criminal organisations active on the cannabis market and the criminal profits that are gained here. The current study however focuses on the actors at the bottom of the cannabis market – the home growers – and aims at answering the following research question: what factors influence the chance of encountering an illegal weed cultivation at a certain residential address? In this study, the risk and protecting factors are taken into consideration on both the individual level (e.g. family composition and financial position of residents) and the neighbourhood level (e.g. social cohesion, physical disorganisation, level of criminality in a certain neighbourhood). In the current study, data of 401 illegal hemp cultivation sites discovered between 2011 and 2016 in homes in Eindhoven, the Netherlands, were analysed. Data from various quantitative data sources – like municipal data (BRP and data from the Social Domain) and data from the municipal neighbourhood monitors – were combined and analysed through a multilevel logistic regression. The results suggest that the likelihood of an illegal weed cultivation site is most prominently influenced by individual factors. Being married for instance seems to decrease the risk, whereas being divorced seems to increase the risk. The housing type also turns out to be of influence. On a neighbourhood level, physical disorganisation and the presence of other hemp cultivation sites in the neighbourhood are the only predictors for hemp cultivation. The results are discussed in the light of criminological theories regarding participation in crime, using the theoretical concepts motivation, opportunity, and control.

    The central aim of this article is to analyse the manner in which the legal structure of EU citizenship subjectifies Union citizens. I begin by explicating Alexander Somek’s account of individualism as a concept which captures EU citizenship and propose to update his analysis by coining the notion of mobile individualism. By looking at a range of CJEU’s case law on EU citizenship through the lens of the purely internal rule and the transnational character of EU citizenship, I suggest that movement sits at the core of EU citizenship. In order to adequately capture this unique structure of citizenship, we need a concept of individualism which takes movement rather than depoliticisation as its central object of analysis. I propose that the notion of mobile individualism can best capture the subjectivity of a model EU citizen, a citizen who is a-political due to being mobile.

    This article examines the hearing of children in Belgian and Dutch courts in return proceedings following an international child abduction. The analysis is based on the experience, insights and needs of both children who have experienced an abduction by one of their parents, and family judges. In this sensitive and often highly conflicted family context, hearing children in court is not self-evident. Challenges of both a judicial-institutional and communicative-relational nature can hinder the effective implementation of children’s right to be heard. This contribution seeks to answer the question of how to better support judges and children in addressing these challenges, with the aim of enabling children to fully and effectively participate in return procedures. Building on the interviews with children and judges, supplemented with findings from Belgian and Dutch case law and international literature, three key recommendations are formulated: 1) explore and evaluate opportunities for judges and children to experience support during the return procedure, for example via the figure of the guardian ad litem; 2) invest in training and opportunities for specialisation of judges with a view to strengthen their expertise in taking the best interests of the child into account; and 3) systematically pay attention to feedback to the children involved on how the final decision about their return is made – and this before, during and after the procedure.

    Dit artikel bestudeert het horen van kinderen in Belgische en Nederlandse rechtbanken in terugkeerprocedures volgend op een internationale kinderontvoering. De analyse vertrekt vanuit de beleving, ervaring, inzichten, noden en behoeften van zowel kinderen als van bevoegde familierechters. In deze gevoelige en vaak uiterst conflictueuze gezinscontext is het horen van kinderen door de rechter geen evidentie. Uitdagingen van zowel juridisch-institutionele als communicatieve-relationele aard kunnen een effectieve implementatie van het recht van kinderen om gehoord te worden in de weg staan. Dit artikel zoekt een antwoord op de vraag hoe rechters en kinderen beter kunnen worden ondersteund om deze uitdagingen aan te pakken, met als doel dat kinderen volwaardig kunnen participeren in de terugkeerprocedure. Voortbouwend op de interviews met kinderen en rechters, aangevuld met bevindingen uit Belgische en Nederlandse rechtspraak en internationale literatuur, worden drie sleutelaanbevelingen geformuleerd: 1) voorzie mogelijkheden voor rechters en kinderen om spanningsvelden weg te werken tijdens de terugkeerprocedure, bijvoorbeeld via de ondersteunende figuur van de bijzonder curator; 2) investeer in opleiding en groeiende specialisatiemogelijkheden bij rechters en 3) heb aandacht voor feedback en terugkoppeling naar de betrokken kinderen over hoe de eindbeslissing over hun terugkeer tot stand komt, en dit zowel voor, tijdens als na de procedure.

    When it comes to learning, mapping turns out to be an effective tool. There is a wide variety of information maps, such as mind maps, argument maps and concept maps. This paper develops a teaching method that puts mapping at the centre of a seminar. It builds upon ideas of cognitivism and constructivism. The proposed didactic method incorporates a new variant of mapping, Basic Building Blocks Map (BBB Map), with a specific style of teaching. It is argued that this teaching method leads to engaged and active student participation. By dividing the subject up into small pieces and searching for answers to questions interactively, the student will learn more effectively. The paper concludes by providing teachers tools to put the method of BBB Mapping into practice.

    The basics of how to conduct participant observation are not taught in law schools. This is striking because this methodology has become a common feature of qualitative research and could be very useful in sociolegal research. For those interested in studying ‘law in practice’ instead of ‘law in the books’, qualitative research methods like participant observation are inevitable. However, participant observation is, at best, secondary in the literature on qualitative research in the sociolegal discipline, while there is no guidance on how to conduct this technique whatsoever.Therefore, this article is written with two audiences in mind: It should serve as a useful reference and guide for those who teach qualitative research methods in legal education and who are looking to enhance their knowledge and skills concerning participant observation; it is also meant to serve as a basic primer for the beginning sociolegal researcher who is about to become a participating observer for the first time.

    This article builds upon the work of James Boyd White as well as on Shelley’s ‘A defence of Poetry’ (1840) and reports upon an experiment in which students use poetry as a means to understand philosophical texts. The experiment had a double goal: first, I sought to challenge students in reading a philosophical text differently with an aim to better understand the text. The second goal was to challenge students to think about the text differently, more critically and analyse its relevance for the contemporary world. In the end, using imagination, is the claim, contributes to students finding their own ‘voice’.

    Piracy holds a special place within the field of international law because of the universal jurisdiction that applies. This article reconsiders the role of piracy in the development of universal jurisdiction. While usually a connection is established between Cicero’s ‘enemy of all’ and modern conceptions of pirates, it is argued that ‘enemy of the human species’ or ‘enemy of humanity’ is a medieval creation, used by Bartolus, which must be understood in the wake of the Renaissance of the twelfth century and the increased interest for the study of Roman Law. The criminalization of the pirate in the late Middle Ages must be understood not only as a consequence of royal power claiming a monopoly of violence at sea. Both the Italian city-states and the Hanse may have preceded royal power in criminalizing pirates. All the while, political motives in doing so were never absent.

    More than sixty years after the adoption of the New York Convention, UNCITRAL finalised at its annual session, in July 2018, an instrument akin to the New York Convention in the area of mediation: the United Nations Convention on International Settlement Agreements Resulting from Mediation (‘the Singapore Convention on Mediation’ or ‘the Convention’), which was adopted by the United Nations General Assembly on 20 December 2018. In addition, UNCITRAL adopted the UNCITRAL Model Law on International Commercial Mediation and International Settlement Agreements Resulting from Mediation, (2018, amending the Model Law on International Commercial Conciliation (2002); ‘the revised Model Law’).
    This contribution gives an overview of these two texts and their drafting process, starting with an overview of the works done by UNCITRAL over the past decades in the field of international mediation.

    This article presents a perspective which focuses on the right to access information as a mean to ensure a non-discriminatory character of algorithms by providing an alternative to the right to explanation implemented in the General Data Protection Regulation (GDPR). I adopt the evidence-based assumption that automated decision-making technologies have an inherent discriminatory potential. The example of a regulatory means which to a certain extent addresses this problem is the approach based on privacy protection in regard to the right to explanation. The Articles 13-15 and 22 of the GDPR provide individual users with certain rights referring to the automated decision-making technologies. However, the right to explanation not only may have a very limited impact, but it also focuses on individuals thus overlooking potentially discriminated groups. Because of this, the article offers an alternative approach on the basis of the right to access information. It explores the possibility of using this right as a tool to receive information on the algorithms determining automated decision-making solutions. Tracking an evolution of the interpretation of Article 10 of the Convention for the Protection of Human Right and Fundamental Freedoms in the relevant case law aims to illustrate how the right to access information may become a collective-based approach towards the right to explanation. I consider both, the potential of this approach, such as its more collective character e.g. due to the unique role played by the media and NGOs in enforcing the right to access information, as well as its limitations.

    In recent years, there has been growing policy support for expanding worker ownership of businesses in the European Union. Debates on stimulating worker ownership are a regular feature of discussions on the collaborative economy and the future of work, given anxieties regarding the reconfiguration of the nature of work and the decline of standardised employment contracts. Yet, worker ownership, in the form of labour-managed firms such as worker cooperatives, remains marginal. This article explains the appeal of worker cooperatives and examines the reasons why they continue to be relatively scarce. Taking its cue from Henry Hansmann’s hypothesis that organisational innovations can make worker ownership of firms viable in previously untenable circumstances, this article explores how organisational innovations, such as those embodied in the capital and governance structure of Decentralised (Autonomous) Organisations (D(A)Os), can potentially facilitate the growth of LMFs. It does so by undertaking a case study of a blockchain project, Colony, which seeks to create decentralised, self-organising companies where decision-making power derives from high-quality work. For worker cooperatives, seeking to connect globally dispersed workers through an online workplace, Colony’s proposed capital and governance structure, based on technological and game theoretic insight may offer useful lessons. Drawing from this pre-figurative structure, self-imposed institutional rules may be deployed by worker cooperatives in their by-laws to avoid some of the main pitfalls associated with labour management and thereby, potentially, vitalise the formation of the cooperative form.

    These days, it appears to be common ground that what is illegal and punishable offline must also be treated as such in online formats. However, the enforcement of laws in the field of hate speech and fake news in social networks faces a number of challenges. Public policy makers increasingly rely on the regu-lation of user generated online content through private entities, i.e. through social networks as intermediaries. With this privat-ization of law enforcement, state actors hand the delicate bal-ancing of (fundamental) rights concerned off to private entities. Different strategies complementing traditional law enforcement mechanisms in Europe will be juxtaposed and analysed with particular regard to their respective incentive structures and consequential dangers for the exercise of fundamental rights. Propositions for a recommendable model honouring both pri-vate and public responsibilities will be presented.

    Jurisprudence is a domain related to terms such as rules, morality, principles, equality, justice, etc. Legal scholars have to teach the meaning of these terms. However, these are not terms, one can comprehend by just reading their standard definition. These are terms one must digest and learn to use. My argument is that literature or the law and literature movement can be used as a tool in order to explain and discuss these terms. For instance, beyond simply explaining or teaching legal positivism and natural law, Antigone helps students reflect upon the distinction between them. To cite another example, reading Nana can help students think about sex-workers in a way they would never think before. Moreover, the literature can be a useful means in teaching critical movements in law, such as critical legal studies, feminist legal theory and critical race theory. Finally, the terms I stated at the beginning are not only terms of jurisprudence, they are terms we should use properly in order to construct a healthy legal environment. Therefore, to get students comprehend these terms is a crucially important aim. I argue that literature can be a tool in order to achieve this aim.

    In 2015, deadly incidents of migrant smuggling in the Mediterranean were daily covered by everyday newspapers. Empirical research has shown that migrants themselves may be involved in these smuggling operations. If they apply for refugee protection, they may be excluded from refugee status under Article 1F of the Refugee Convention. Article 1F(b) excludes asylum seekers from international protection if serious reasons exist to consider that they have committed serious non-political crimes. This contribution discusses whether migrant smuggling can be considered as such and whether various forms of participation in smuggling operations give rise to individual responsibility and trigger application of article 1F(b).

    Studies have shown that the effects of scientific research on law and policy making are often fairly limited. Different reasons can be given for this: scientists are better at falsifying hypothesis than at predicting the future, the outcomes of academic research and empirical evidence can be inconclusive or even contradictory, the timing of the legislative cycle and the production of research show mismatches, there can be clashes between the political rationality and the economic or scientific rationality in the law making process et cetera. There is one ‘wicked’ methodological problem, though, that affects all regulatory policy making, namely: the ‘jump’ from empirical facts (e.g. there are too few organ donors in the Netherlands and the voluntary registration system is not working) to normative recommendations of what the law should regulate (e.g. we need to change the default rule so that everybody in principle becomes an organ donor unless one opts out). We are interested in how this translation process takes place and whether it could make a difference if the empirical research on which legislative drafts are build is more quantitative type of research or more qualitative. That is why we have selected two cases in which either type of research played a role during the drafting phase. We use the lens of the proportionality principle in order to see how empirical data and scientific evidence are used by legislative drafters to justify normative choices in the design of new laws.

    This paper presents a basic model of the imagination and offers pedagogical resources and activities for educating three related abilities to imagine. The basic model is that to imagine is to combine the process of awareness, framing and distancing, and the process of, simultaneously actively participate, by doing things with and thanks to artefacts. Artefacts, in turn, are fabricated forms (here, forms of language) that signal their own artifice and invite us to do things with them, across a spectrum of sensory, kinetic, and affective abilities. Modelled in this way, imagination plays a crucial role in legal reasoning, and is exemplified by the following kinds of artefacts in legal discourse: fictions, metaphors, hypothetical scenarios and figuration. These artefacts and their related processes of imagination are vital to legal reasoning at many levels, including the level of the individual lawyer or judge, the level of interaction in courtrooms, and the level of legal language over time. The paper offers nine learning activities corresponding to educating three abilities in the legal context: 1) to take epistemic distance and participate; 2) to generate alternatives and possibilities; and 3) to construct mental imagery.
