Pro-cycling’s doping pentiti

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden doping, cycling, cultural criminology, crime facilitative system, organisational crime
Auteurs Dr. mr. Roland Moerland en Giulio Soana
SamenvattingAuteursinformatie

Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling.

De emotionele beleving van kwalitatief onderzoekers bij onderzoek naar kwetsbare groepen en gevoelige thema’s

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2019
Trefwoorden narrative review, qualitative research, emotions, sensitive topics, vulnerable groups
Auteurs Ciska Wittouck en Gwen Herkes
SamenvattingAuteursinformatie

A narrative review was conducted to develop more coherent awareness and knowledge regarding emotional experiences of qualitative researchers studying sensitive topics or vulnerable groups, as discussions about this topic are currently fragmented and scattered. Qualitative researchers experience many painful as well as enjoyable emotions, which can influence their personal, social and professional lives. These emotions are recurrently reported in relation to the unpredictability of qualitative research and the different roles of qualitative researchers. More structural and individual attention for emotional experiences of qualitative researchers is necessary, for instance, in academic (doctoral) training and general handbooks on qualitative research.

Access_open Autonomy in old age

Tijdschrift Family & Law, mei 2019
Auteurs prof. dr. Tineke Abma en dr. Elena Bendien
SamenvattingAuteursinformatie

Background: In many European countries caring responsibilities are being reallocated to the older people themselves to keep the welfare state affordable. This policy is often legitimized with reference to the ethical principle of autonomy. Older people are expected to be autonomous, have freedom to make their own decisions, and be self-reliant and self-sufficient as long as possible.
Aim: The purpose of this article is to explore whether and how older people can remain autonomous in order to continue living their lives in accordance with their own values in the context of declining professional caring facilities and shrinking social networks, and which concepts of autonomy can guide professionals and other involved parties in facilitating the choices of older people.
Method: An empirical-ethical approach is used to interpret the moral values enacted in the caring practice for older people. Two cases are presented. One is the narrative of a woman who lives by herself; she has been hospitalized after a fall and hip fracture, but does not want to be operatied. The second is the narrative of man living in a residential home; he wants to be actively involved, doing good deeds like he always did as a Scout. The cases are evaluated with the help of two concepts of autonomy: autonomy as self-determination and relational autonomy.
Results: In both cases the enactment of autonomy remains problematic. In the case of the woman there was not enough care at home to live up to her own values. After she was admitted to a hospital her wish not to be operated was questioned but ultimately honoured due to compassionate interference by close relatives and her oncologist. In the second case there was not enough space for the man to lead his life in the way he always had; his plans for improving the social environment in the care home were torpedoed by management and ultimately the man decided to step back.
Conclusion: In order to do justice to the complexity of each empirical case that involves autonomy of an older person more than one concept of autonomy needs to be applied. Relying on self-determination or relational autonomy exclusively will give professionals and all involved parties a restricted view on the situation, where the wishes of older people are at stake. In both cases autonomy was overruled by system procedures and stereotypical ideas about old people as being weak and not able to make their own decisions. Both cases show, however, that older people - even if they are physically and mentally frail - long to remain morally responsible for the direction their lives are taking, in accordance with their own values. They communicate their wish to determine their own future and at the same time they are interdependent on others to realize their (relational) autonomy and require support in their attempt to maintain their identity. This conclusion has implications for the normative behaviour of the professionals who are involved in care and treatment of older people.

Trefwoorden Aziatisch leiderschap, Koningschap, ideale staat in Azië
Auteurs Prof. dr. Paul van der Velde
SamenvattingAuteursinformatie

Buddhism has very specific ideas about an idealized form of government in Asia. These ideas may be ancient but they very often play a part in the background of politics up to modernity. Even within republics where religious monarchy has long since disappeared, a certain supernatural foundation on the basis of which a government functions may still be present. Opposition to a government can often imply resistance to a world order that is actually of supranatural origin. This article focuses on historical dimensions of this phenomenon (the position of the Buddha, the origin of the monarchy and Emperor Ashoka), but also on modern forms (Sri Lanka, Thailand and Myanmar). Concerning Myanmar, the recent developments around the Rohingyas are placed in a cultural perspective.

Trefwoorden hero, moral entrepreneur, Bill Cosby, Jimmy Savile, Gerrit Achterberg
Auteurs Dr. Frank van Gemert en Danaé Stad MSc
SamenvattingAuteursinformatie

Bill Cosby, Jimmy Savile and Gerrit Achterberg lived in different periods, in the US, UK, and the Netherlands. They were heroes because of what they accomplished during their professional careers but all three turned out to have committed serious crimes. Disclosure is painful, not only for the hero who comes to fall but also for the community that finds itself redefining moral standards when losing a celebrated insider. For this reason, the crimes of these three men have been concealed and kept secret for years. In comparing the three cases, this article tries to find out who decides on keeping the hero on his feet, how this is done, and if this changes over time.

De val van Jacobus Capitein en het debat over omstreden koloniale helden

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2018
Trefwoorden Jacobus Capitein, Atlantic history, Dutch history, slavery, postcolonialism
Auteurs Dr. Karwan Fatah-Black
SamenvattingAuteursinformatie

The post-colonial re-evaluation of prominent figures in Dutch history has been resisted fiercely in the public sphere. This article raises the question how lives from the colonial era that are a source of national pride, but are also tainted by their implication in the history of slavery, colonialism and racism can be presented in a way that does justice to their historical context. Jacobus Capitein, who was first enslaved and later became an advocate for slavery in the 1740s, was initially regarded a hero in the eighteenth century, but has received a far more critical evaluation since the second half of the twentieth century. This article takes the way in which professional historians and heritage institutions have dealt with the complex and layered life story of Jacobus Capitein as a model for approaching the lives of the canonical figures of Dutch Atlantic history.

Een wolf onder de wolven. Ethiek en Ethische Commissies in criminologisch onderzoek naar ‘the powerful’

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2018
Trefwoorden Ethics committees, The powerful, Moral entrepreneurs, Ethics creep, Arms trader
Auteurs Dr. Rita Faria en Dr. Yarin Eski
SamenvattingAuteursinformatie

For quite some years now, crimes of ‘the powerful’ have been studied by criminologists. While researching crimes of ‘the powerful’, researchers aim to maintain and safeguard their integrity and ethics. However, there seems to be a friction between, on the one hand, ethics of the researchers themselves and on the other hand, ethics (policies) of universities. Obviously, not only do they have to justify their actions and decisions to themselves and ‘science’ as a whole, they must justify their research to ethics committees (EC’s) of universities. It could result in complex and difficult situations when researchers suspect that EC’s themselves may be instruments and products of the powerful groups they are studying. In that case, EC’s might undermine ethics and research integrity themselves. What do certain EC- ‘conditions’ look like for research ethics and to which extent do they have to be adjusted or reconsidered when criminologists are researching ‘the powerful’? The key question that will be answered in this contribution is as follows: how can criminologist (re)act ethically responsibly when confronted with (un)ethical committees? To answer this and other relevant questions, after reviewing literature, we reflect on a biographical study of a legal arms trader. We then elaborate on the ‘ethics creep’ (Haggerty, 2004) that seems to haunt social sciences nowadays.

Indigenous claims have challenged a number of orthodoxies within state legal systems, one of them being the kinds of proof that can be admissible. In Canada, the focus has been on the admissibility and weight of oral traditions and histories. However, these novel forms are usually taken as alternative means of proving a set of facts that are not in themselves “cultural”, for example, the occupation by a group of people of an area of land that constitutes Aboriginal title. On this view, maps are a neutral technology for representing culturally different interests within those areas. Through Indigenous land use studies, claimants have been able to deploy the powerful symbolic capital of cartography to challenge dominant assumptions about “empty” land and the kinds of uses to which it can be put. There is a risk, though, that Indigenous understandings of land are captured or misrepresented by this technology, and that what appears neutral is in fact deeply implicated in the colonial project and occidental ideas of property. This paper will explore the possibilities for an alternative cartography suggested by digital technologies, by Indigenous artists, and by maps beyond the visual order.

The most important mechanism for crime prevention is just the presence of guardians. Some counter arguments against this thesis are discussed and rejected. By manipulating the presence of guardians it is possible to influence the level of prevention. It is argued that a large scale evaluation of such measures is wanted.

Honour-based violence (HBV) is a tight knot of conflict, gender and ethnicity. It is also the sensational subject of many bestselling books, in which mostly female victims of HBV tell their life stories. Researchers of feminism and multiculturalism argue that migrant women are often presented as passive victims, and migrant men as violent perpetrators. In our first article for PROCES on this subject, we analysed ten (auto)biographies of female victims of HBV, using theoretical insights on stigmatization. After the publication of this article, we continued to collect these true life stories. In our current article, we analyse two new aspects: how do these stories find their way to the Internet, and are there any HBV stories by male authors? Do stories by male authors shed a different light on honour conflicts and on stereotypes of culture and gender?

‘Trots’, ‘eer’ en ‘medeplichtigheid’: de Vrije Universiteit en Zuid-Afrika

Tijdschrift PROCES, Aflevering 6 2014
Trefwoorden Zuid-Afrika, Medeplichtigheid, trots, Vrije Universiteit
Auteurs Harry Wels
SamenvattingAuteursinformatie

‘Pride’ and ‘honour’ are two concepts that are closely related and in the context of South Africa, are often based on a history of violent battles between various groups in society. VU University Amsterdam has lifelong relations with the historically Afrikaner universities in South Africa. During the Apartheid years the Afrikaner universities scientifically legitimized many of the apartheid policies and practices. In that sense VU University Amsterdam, through its relations to South African counterparts, may be considered complicit with the policies and practices of the Apartheid regime. Consequently, there seems little reason for pride and honour, but rather shame about having sided with academic partners who have at least passively supported the regime? Starting with an explicit acknowledgement of this complicity, the oeuvre of former Archbishop Desmond Tutu may open a path of hope for VUA to contribute to mending past injustices and by, together with its South African academic partners, working towards equality and building new relations in the present South African society.

Access_open Imagining the Rule of Law in Nineteenth-Century Britain: Liberal Society and the Dialectic of the Clan

Tijdschrift Erasmus Law Review, Aflevering 3/4 2013
Trefwoorden clan, rule of law, Albert Venn Dicey, Walter Scott, legal memory
Auteurs Dr. Mark S. Weiner
SamenvattingAuteursinformatie

In this essay, I provide a historical and theoretical framework for understanding the imaginative relation between the liberal rule of law and the kin-based form of socio-legal organization I call ‘the rule of the clan’ – a classic example of law created ‘from below’. Specifically, I believe that a culturalist disciplinary perspective reveals that the modern liberal state and its more centralized rule of law always stand in an ironic, dialectical relation to the rule of the clan as a legal form. Liberal society, that is, nurtures itself through an anti-liberal utopian imaginary. This article provides an intellectual history backdrop for theorizing that dialectical relationship by examining two contrasting ways in which nineteenth-cen‍tu‍ry British intellectuals imagined the rule of law. Following the work of Charles Taylor and, more specifically in the legal field, Paul Kahn, my goal is to depict a social imaginary of modern liberalism that has been neglected within contemporary liberal theory – and, in doing so, pro‍vi‍de a way to appreciate the cultural foundations of liberal legality. The article considers the stories that nineteenth-century British intellectuals told about the relation between the rule of law and the rule of the clan as a way to think about the rule of law today. It thus tacks between three different shores: the world of legal pluralism (the rule of the clan), the world of nineteenth-cen‍tu‍ry British analysis of the rule of the clan and the contemporary relation between culture and modern liberal society.

SamenvattingAuteursinformatie

In this article on the social production of the book Outsiders, I will situate its production in the daily practice of the social worlds in which Becker was involved. Therefore I focus on the relations, interactions and situations which were relevant for the form, content and success of Outsiders. For data, I use fragments from my email communication with Howard Becker, the collected interviews and other publications which show that Becker seeks to demystify Outsiders. My main contribution is that I use Becker’s own words to demystify the ethnographic practice of Outsiders and describe its mundane backstage reality, which is described by Fine as ‘the underside’ of ethnography (1993).

In this article I will explore the concept of transgression within the realm of rock music using the biography of Lou Reed, known for such songs as ‘Walk on the Wild Side’ and ’I’m Waiting for the Man’. I discuss Lou Reed’s social transgressions as a reaction to and resistance toward institutions of social control such as family, media and the music industry, which stigmatized him as an outsider. This study, which is based on secondary material, such as biographies, interviews and songs, shows how Lou Reed transgressed social norms with respect to drugs, sex, and gender.

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 2 2013
Trefwoorden Oresteia, tragedy, conflict resolution, truth and reconciliation commission, restorative justice
Auteurs Lukas van den Berge
SamenvattingAuteursinformatie

This article explores the themes of injustice and dehumanization in Aeschylus’ Oresteia and Yael Farber’s Molora, in which the story of the Oresteia is dramatized against the backdrop of post-apartheid South Africa. It is argued that both plays depict wrongdoers and victims alike as social outcasts. Thus, they can both be described with Paul Ricoeur as ‘sketches of a man,’ not being able to live up to their full human potential. Borrowing from Ricoeur’s legal philosophy, it is then explained how public trials and hearings help them to reintegrate into society, in which they can regain their full humanity.
