Access_open Branded, co-packing of private label: slechts een kwestie van smaak?

    In dit artikel wordt een overzicht gegeven van de overwegingen die ten grondslag liggen aan de marktafbakening bij de productie van eigen merk (branded), co-packing (merk van een derde) en private label (huismerk). Hierbij zullen zaken en kernoverwegingen uit de beschikkingspraktijk van de Europese Commissie, de ACM en de Britse mededingingsautoriteit CMA worden besproken. Het artikel spitst zicht toe op overwegingen voor het upstream (productie)niveau aan de hand van beschikkingen inzake, met name, levensmiddelen.

    Sensitive interviews involve emotionally difficult topics which require participants to face issues that are deeply personal and possibly distressing. This paper draws together reflections concerning how researchers manage the challenges of conducting sensitive interviews, including the author’s own reflections concerning interviewing clinical negligence claimants. First, it examines the ethical guidelines that regulate sensitive research, and the challenges of obtaining informed consent and maintaining confidentiality. Ethical guidelines, however, provide limited assistance for ensuring the emotional care of research participants, and we also consider challenges that are not usually formally regulated. These include preparing for the interview, and then ensuring the emotional care of participants both during and after the interview itself. Sensitive research also raises deeper ethical issues concerning the negotiation of relations between researcher and participant, especially when this relationship is unequal. Finally, while previous research has generally focused on the need to take emotional care of research participants, less attention has been given to the emotional needs of researchers. It is argued that support systems for researchers are too often ad hoc, and that providing support is often not a priority of granting bodies, grant holders or supervisors, and that formal systems need to be put in place.

National variations in the implementation and enforcement of European food hygiene regulations

Comparing the structure of food controls and regulations between Scotland and the Netherlands

    Over the course of time the European Union has increased its powers considerably. Currently, almost all food safety regulations in the member states rest on European law. Despite this common legal base, several differences between member states still exist. This article compares the way Scottish and Dutch authorities deal with a particular item of European food law: the development of national guides to good practice for hygiene and for the application of HACCP principles by the food industry. The results of this investigation are consistent with the conclusion of Falkner et al. that the implementation of EU law in both the Netherlands and the UK depends on domestic issues. The dominant issue in Scotland (and the UK) is the FSA objective to bring consistent food controls and independency from industry which results in the development of governmental guidance. The prevailing issue in the Netherlands is making industry responsible for food safety which helps explain the extensive use of industry guides. This study shows that in order to understand what happens on the ground it is important to look beyond transposition or direct effect and also to investigate the implementation of regulations and to dig deeper than just their transposition.

Tetty Havinga is Associate Professor at the Institute for the Sociology of Law, Radboud University Nijmegen, The Netherlands. She has published on the regulation of food safety, policy implementation and law enforcement, equal opportunities law, asylum migration and migrant workers. Her recent research projects deal with the development and effects of private regulation of food safety, oversight and official controls in the food industry, and the experiences of large companies with Dutch special courts. She is co-editor of The Changing Landscape of Food Governance (to be published by Edward Elgar, 2015).

    In this article the author presents Latour’s negative analysis of modernity and his positive ethnographical studies of the modes of existence of our modern world. I will discuss the merits and disadvantages of his specific approach on law – an institutional ethnography of the French Conseil d’Etat – within this framework. The analysis will be supplemented with the results of a conflict-based approach to a case study in patent law at a law firm.
