    Internationale kinderrechten genieten enerzijds vrijwel universele erkenning maar worden anderzijds ook stevig bekritiseerd. Vooral kinderrechten binnen het strafrecht worden als controversieel gezien. Tegelijkertijd is op dit gebied sprake van toenemende aandacht voor de ontwikkeling gedurende de adolescentie die door lijkt te lopen na de dominante leeftijdgrens van achttien jaar, alsmede de implicaties daarvan voor de positie van jongvolwassenen in het strafrecht. Deze bijdrage gaat nader in op de toepasselijkheid, en toegevoegde waarde, van het kinderrechtenperspectief voor jongvolwassenen in het strafrecht.

    This article relies on the premise that to understand the significance of Open Access Repositories (OARs) it is necessary to know the context of the debate. Therefore, it is necessary to trace the historical development of the concept of copyright as a property right. The continued relevance of the rationales for copyright interests, both philosophical and pragmatic, will be assessed against the contemporary times of digital publishing. It follows then discussion about the rise of Open Access (OA) practice and its impact on conventional publishing methods. The present article argues about the proper equilibrium between self-interest and social good. In other words, there is a need to find a tool in order to balance individuals’ interests and common will. Therefore, there is examination of the concept of property that interrelates justice (Plato), private ownership (Aristotle), labour (Locke), growth of personality (Hegel) and a bundle of rights that constitute legal relations (Hohfeld). This examination sets the context for the argument.

    This study describes the trend in victimization of homicide in the Netherlands in the period 1992-2016. Using data from the Dutch Homicide Monitor, the findings show that the homicide rate has been falling since the 1990s. This decrease is the greatest among male and female victims between the ages 20 and 39. This findings emphasize the importance of shifting the discussion about the general homicide drop to an in-depth analysis of gender and age of victims of homicide.

    This article relates criminological research on youth delinquency to the social development of adolescents. Starting point is a goal-framing approach which assumes that young people aim for the achievement of two goals: status (‘getting ahead’) and belonging (‘getting along’). Peers form an important context for achieving these goals. Therefore, the role of delinquency in peer networks is examined: on the one hand, the extent to which delinquency contributes to peer status, and on the other hand, how delinquency contributes to the formation of network relationships and, vice versa, how network relationships influence adolescents’ delinquency. Finally, several directions for further research are discussed.

    Attempting to understand the Greek narrative of crisis, this paper examines the most prominent forms of violence that emerged in the period of acute economic recession and political upheaval in Greece namely structural, institutional and anti-institutional violence. This paper aims to highlight existing theoretical gaps and avoid common fallacies of the current body of knowledge. In contrast to some of the more common features of the discussion on violence, this note sets out to: a) acknowledge that violence is not necessarily a physical act, b) acknowledge that the outcomes of violence performances might not be physical either, c) specify and adequately distinguish agency and structural dynamics and d) address the cultural and contextual aspects of violence. Vital to this endeavor is to acknowledge, identify and understand the interactive relation between different forms of violence that emerge during the same period of time in a context in which conflict escalates.

    In the Netherlands, over the past 25 years mayors have had an increasing number of formal powers, based on administrative law, to fight against crime and disorder. Now, the Dutch mayors have the power to impose a restraining order, to close houses in case of drugs and/or drugs trade, or to decline a request for a permit when it might be used for illegal activities.
    To implement these measures, the local government is highly dependent on (information provided by) the police. At this moment we do not have much information about this cooperation between local government and the police in the management of crime and disorder. This paper is based on an empirical study concerning this issue. It shows that the inter-organizational cooperation between local government and the police may differ strongly, however this cooperation still often depends on central factors and circumstances. An important factor is the (growing) distance between the police and local government in regard to the local approach of problems of crime and disorder. A significant number of local police officers concentrates mainly on the maintenance of law and order by criminal law enforcement instead of the implementation of administrative measures. As a result, local government is often unsatisfied about the contribution of the police. For example, the quality of the information provided by the police is often perceived as insufficient. In some cases local governments try to diminish the degree of interdependency with the police and to strengthen their own position in the local safety domain.

    Terrorism could be regarded as an extreme type of (violent) criminal behaviour. Against this background, there is much to gain if criminological attention would be extended to terrorism. In this overview, the authors describe how and to what extent criminological theories may provide a significant contribution to underlying causes of terrorism. Previous criminological contributions to the field of terrorism have primarily taken a theory-extended approach, including routine activity theory, rational choice theory and strain theory. However, so far such studies lacked empirical data. Further, to this day, not much is known about the empirical applicability of other criminological theories, including desistance theories, which warrant particular attention. In order for criminology literature to contribute effectively to our understanding of terrorism and to pursue better counter-terrorism policies, empirical evidence should first be obtained. In this way, terrorism researchers, in close collaboration with criminologists, can deepen our theoretical and empirical understanding of this relatively underexplored field.

    Intimate partner homicide (IPH) constitutes one of the most prevalent types of homicide. This study aims to assess the nature and prevalence of intimate partner homicide in the Netherlands in the period 2009-2014. In doing so, we make use of police data, court data, and media articles. Findings show that IPH occurs 29 times per year, resulting in a victimization rate of 0.20 per 100,000, similar to other Western-European countries. Our results further show a decline in IPH in the last years. IPH in the Netherlands mostly occurs in heterosexual relationships, and involves male perpetrators and female victims. Finally, we reflect on possible causes for the decline of this type of homicide.

    This paper starts by reviewing empirical research that threatens law and economics’ initial success. This research has demonstrated that the functioning of the law cannot be well understood based on the assumption of the rational actor and that policies which are based on this assumption are likely to be flawed. Subsequently, three responses to this criticism are discussed. Whereas the first response denounces this criticism by maintaining that the limitations attributed to the rational actor can easily be incorporated in rational choice theory, the second response welcomes the criticism as an opportunity to come up with an integrative theory of law and behavior. The third response also takes the criticism seriously but replaces the aspiration to come up with such an integrative theory by a context-sensitive approach. It will be argued that the first two responses fall short while the third response offers a promising way to go forward.

    Criminology traditionally focuses on the human experience. However, several criminologists have seriously criticized this anthropocentric perspective. In their view from a criminological perspective humans and other than human animals should be given equal attention. Although they advocate a non-speciesist criminology, they are not trying to fundamentally change criminology as we know it. Instead, their appeal is to not consider other than human creatures as passive objects and solely from the perspective of their usefulness for humans. Yet, this objective poses substantial methodological challenges to criminologists.

    Developing effective anti-poaching strategies is difficult because of complex interactions between animals, poachers, and rangers. This study shows the utility of agent-based models (ABM) for unraveling these interactions, and their underlying mechanisms, to identify relevant components for planning ranger operations. Here, two patrol strategies were simulated using an ABM for wildlife crime to quantify their effectiveness under different circumstances. The model showed border patrols to be more effective than search patrols in protecting both solitary and herd animals. Furthermore, the model suggests that rangers catch fewer poachers when patrols are overly focused on locations where poaching was detected previously. The study illustrates that disciplined model development and testing is required for useful conclusions to be drawn, from a fully understood ABM.

    Generally, large listed companies and banks immersed in a ‘risk and win’-culture do not have to deal with ‘deprivation of resources’ which may trigger violations of the law. The anomie-theory of Merton does not seem to fit in this context. It is more obvious that the pressure to realize lofty ambitions is the trigger for potential violations of the law. I therefore work out a ‘post-Mertonian’ anomie-concept using the ‘European Durkheim’ to examine some excessive tendencies of an originally American ‘risk and win’-culture. The aim is to work towards an anomie-theory of power illusions that makes sense in the context of corporate crime. The leading question is: which anomic attitudes prevail in an over-ambitious corporate culture and which aspirations and rationalizations can be distinguished? It is argued that an approach focused on CEO-personality traits is too limited and that the sociological approaches of Durkheim and Shover offer many points of departure to construct a plausible anomie-theory. The dimensions of that theory have been taken from studies which focus at two criminogenic norm-systems: an ‘ethos of winning at any price’ and an ‘ethos of entitlement’.

    According to police statistics, juvenile crime in the Netherlands decreased annually since 2007. Explanations for the crime drop primarily focused on single macro explanations, such as increasing prosperity, focused policing or decreasing alcohol use. The prevalence of self-reported delinquency also dropped in the period 2005 till 2015. In three consecutive cohorts of the Youth Delinquency Survey (YDS; 2005, 2010, 2015) changes in exposure to risk and protective factors offered potential explanations for the drop in juvenile delinquency. Compared to previous cohorts, juveniles in the 2015-cohort were less exposed to risk factors like alcohol use and delinquent friends, and more exposed to protective factors like perceived emotional support, solicitation and monitoring by parents. Amongst serious delinquents, however, the exposure to individual risk behavior and delinquent friends was stable over time. Serious delinquents also showed stability over the cohorts in frequency and seriousness of offenses. The vulnerability for risk and protective factors was consistent amongst the three cohorts, regardless the seriousness of delinquency. Changing social cultural attitudes towards risk behavior, e.g. delinquency, could be an additional explanation for the juvenile crime drop. Implications for theory and policy are discussed.
