Access_open Art, Science and the Poetry of Justice – Pragmatist Aesthetics and Its Importance for Law and Legal Education

Special Issue on Pragmatism and Legal Education Sanne Taekema & Thomas Riesthuis (eds.)

Tijdschrift Law and Method, maart 2021
Trefwoorden legal research, legal education, epistemology, law, science and art
Auteurs Wouter de Been
SamenvattingAuteursinformatie

Classic pragmatists like John Dewey entertained an encompassing notion of science. This pragmatic belief in the continuities between a scientific, ethical and cultural understanding of the world went into decline in the middle of the 20th century. To many mid-century American and English philosophers it suggested a simplistic faith that philosophy and science could address substantive questions about values, ethics and aesthetics in a rigorous way. This critique of classic pragmatism has lost some of its force in the last few decades with the rise of neo-pragmatism, but it still has a hold over disciplines like economics and law. In this article I argue that this criticism of pragmatism is rooted in a narrow conception of what science entails and what philosophy should encompass. I primarily focus on one facet: John Dewey’s work on art and aesthetics. I explain why grappling with the world aesthetically, according to Dewey, is closely related to dealing with it scientifically, for instance, through the poetic and aesthetic development of metaphors and concepts to come to terms with reality. This makes his theory of art relevant, I argue, not only to studying and understanding law, but also to teaching law.

Wouter de Been
Wouter de Been is a legal theorist who has written widely on pragmatism and legal realism. I would like to thank the reviewers for their comments. Their critical commentary made this a much better article. Any remaining shortcomings are of course my own. I dedicate this article to the memory of Willem Witteveen, who always saw the art in law.

Fiscaal toezicht in tijden van crisis

Tijdschrift Tijdschrift voor Toezicht, Aflevering 1 2021
Trefwoorden COVID-19, Belastingdienst, fiscaal toezicht, toezichtstrategie, crisis
Auteurs Lisette van der Hel-van Dijk en Sjoerd Goslinga
SamenvattingAuteursinformatie

SamenvattingAuteursinformatie

Qualitative research in an immigration detention center in the Netherlands shows that detained unauthorized migrants consider the entry procedure in Immigration Centre Rotterdam procedurally just. These migrants are generally positive on the fairness of the entry procedure as their safety and welfare are guaranteed and existing procedural justice criteria are respected. However, they believe that immigration detention in itself is illegitimate and that they do not deserve to be detained. This shows that the focus on procedures and interactions is insufficient to understand the perceived legitimacy of immigration detention if shared values and consent with the legal basis of immigration detention are lacking.

Pro-cycling’s doping pentiti

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden doping, cycling, cultural criminology, crime facilitative system, organisational crime
Auteurs Dr. mr. Roland Moerland en Giulio Soana
SamenvattingAuteursinformatie

Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling.

Auteurs Prof. dr. Frank Weerman, Prof. dr. Gerben Bruinsma, Prof. dr. Wim Bernasco e.a.
SamenvattingAuteursinformatie

The aim of this study was to provide more insight in prevalence and aetiology of juvenile frequent offending, employing police registered data as well as self-report information. We combined data about 519 youths that participated in a self-report study in the region of The Hague with police register data (the HKS system) from the police unit of The Hague. The results indicate that a substantial part of youths that report a large amount of offenses themselves are not formally known as ‘juvenile frequent offender’. Causal factors derived from four major criminological theories can be found in a more pronounced way among juvenile frequent offenders than among youths that incidentally commit offenses. In general, there are similarities between the characteristics of juvenile frequent offenders defined by police register data and those defined by self-reports, but, on average, frequent offenders that are known by the police spend more time unstructured socializing with friends. We conclude that research using the method of self-report is well capable to find juvenile frequent offenders, and that this method also leads to useful information about the causes of their delinquent behaviour.

The concept of violence in (times of) crisis

On structural, institutional and anti-institutional violence

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden structural violence, institutional violence, anti-institutional violence, economic crisis, Greece
Auteurs Marilena Drymioti
SamenvattingAuteursinformatie

Attempting to understand the Greek narrative of crisis, this paper examines the most prominent forms of violence that emerged in the period of acute economic recession and political upheaval in Greece namely structural, institutional and anti-institutional violence. This paper aims to highlight existing theoretical gaps and avoid common fallacies of the current body of knowledge. In contrast to some of the more common features of the discussion on violence, this note sets out to: a) acknowledge that violence is not necessarily a physical act, b) acknowledge that the outcomes of violence performances might not be physical either, c) specify and adequately distinguish agency and structural dynamics and d) address the cultural and contextual aspects of violence. Vital to this endeavor is to acknowledge, identify and understand the interactive relation between different forms of violence that emerge during the same period of time in a context in which conflict escalates.

Auteurs Prof. dr. Frank Weerman
SamenvattingAuteursinformatie

This contribution reflects on the criminological meaning of the still ongoing trend of digitalisation. What does this mean for crime as a phenomenon and for the explanation of criminal behaviour? Not only did we see the emergence of new types of offending, also the context of crime has changed. In principle, the underlying explanatory processes can remain the same, but their application in the online world is complex and deserves further attention. Online social interactions are not only important for online crime, but also for traditional offenses. However, systematic research on how this actually takes place is scarce.

Jonge daders: worstelen met sorry-zeggen

Is oprecht spijt betuigen doenlijk?

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2018
Trefwoorden Young offenders, Remorse, Sincerity, Perceptions-mismatch, victims
Auteurs Bas van Stokkom
SamenvattingAuteursinformatie

The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. This perception-mismatch also occurs among victims: what one victim considers sincere is ‘fake’ for another. Many people
    – also advocates of restorative justice – trust that the offender will offer a sincere apology, without realizing that this is not self-evident in a thorny confrontation setting. This article aims to temper this sincerity-expectation.

Access_open Legality of the World Bank’s Informal Decisions to Expand into the Tax Field, and Implications of These Decisions for Its Legitimacy

Tijdschrift Erasmus Law Review, Aflevering 2 2017
Trefwoorden World Bank, legality, legitimacy, global tax governance, tax policy and tax administration reforms
Auteurs Uyanga Berkel-Dorlig
SamenvattingAuteursinformatie

The emergence of global tax governance was triggered by common tax problems, which are now still being faced by international society of nation-states. In the creation of this framework, international institutions have been playing a major role. One of these institutions is the World Bank (Bank). However, those who write about the virtues and vices of the main creators of the framework usually disregard the Bank. This article, therefore, argues that this disregard is not justified because the Bank has also been playing a prominent role. Since two informal decisions taken in the past have contributed to this position of the Bank, the article gives in addition to it answers to the following two related questions: whether these informal decisions of the Bank were legal and if so, what implications, if any, they have for the Bank’s legitimacy.

Tijdschrift Netherlands Journal of Legal Philosophy, Aflevering 2 2017
Trefwoorden empirical legal studies, apologies, procedural justice, humiliation, victim rights
Auteurs Vincent Geeraets en Wouter Veraart
SamenvattingAuteursinformatie

The central question in this article is whether an empirical-legal approach of victimhood and victim rights could offer a sufficient basis for proposals of legal reform of the legal system. In this article, we choose a normative-critical approach and raise some objections to the way in which part of such research is currently taking place in the Netherlands, on the basis of two examples of research in this field, one dealing with compelled apologies as a possible remedy within civil procedural law and the other with the victim’s right to be heard within the criminal legal procedure. In both cases, we argue, the strong focus on the measurable needs of victims can lead to a relatively instrumental view of the legal system. The legal system must then increasingly be tailored to the wishes and needs of victims. Within this legal-empirical, victim-oriented approach, there is little regard for the general normative principles of our present legal system, in which an equal and respectful treatment of each human being as a free and responsible legal subject is a central value. We argue that results of empirical-legal research should not too easily or too quickly be translated into proposals for legal reform, but first become part of a hermeneutical discussion about norms and legal principles, specific to the normative quality of legal science itself.

Auteurs Marc Wever LLM
SamenvattingAuteursinformatie

If someone disagrees with an administrative order, he or she has to lodge an objection with the administrative authority responsible for the order. Only after the administrative authority has fully reconsidered the contested order is the interested party allowed to seek redress with the administrative courts. Estimates are that around 2.6 million objections are filled each year, making the administrative objection procedure the most frequently used dispute resolution procedure in the Netherlands. Numerous variations can be found in the way administrative authorities handle objections. Does this affect how professional users evaluate its quality? And if so, how can this be explained?

Kartels ontsluierd: heimelijkheid, vertrouwen en sociale inbedding

Hoe kartels erin slagen verborgen te blijven

Tijdschrift Tijdschrift voor Criminologie, Aflevering 3 2017
Trefwoorden social embeddedness of crime, corporate crime, white-collar crime, illegal networks, business cartels
Auteurs Jelle David Jaspers MSc
SamenvattingAuteursinformatie

In this article notions from literature on covert and illegal networks are applied to business cartels. Comparable to most criminal networks, cartel participants need to communicate in order to coordinate their activities, whilst under the risk of getting caught. Previous studies however show cartels can remain hidden from outsiders for long periods of time. Based on an analysis of fourteen Dutch cartel cases, this article addresses the question how cartels can remain hidden from outsiders for long periods of time. The analysis shows cartel participants communicate predominantly centralized and frequent. Moreover, the results show that not concealment but social embeddedness provides a strong explanation for the longevity of secrecy regarding cartels.

‘Troostmeisjes’: Over de structurele ontkenning van seksuele slavernij en voortschrijdende victimisatie

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2017
Trefwoorden comfort women, denial, sexual slavery, discourse analysis
Auteurs dr. mr. Roland Moerland
Samenvatting

In 2015, South-Korea and Japan came to a ‘final’ agreement concerning the ‘comfort women’ issue. This contribution reveals that this deal signals the next stage in a process of denial through which Japanese authorities have structurally denied the women’s’ victimhood. Taking a discourse analytical approach, the contribution investigates this historical process of denial and its implications. The analysis shows that denial takes several forms and performs different functions throughout the process. It demonstrates that denial is an interactional phenomenon, has different psychologies underlying it, and that it operates on different levels. Denial ultimately contributes to a state of continued victimization.

Trefwoorden experimental scenario study, frustration aggression, informational justice, workplace violence, negative affect
Auteurs Natascha Sprado MSc, Dr. Tamar Fischer en Lisa van Reemst MSc
SamenvattingAuteursinformatie

This study investigates the effect of providing information about decision making on aggression of clients of the Dutch Employee Insurance Agency (UWV). The expectation is that providing adequate information leads to a decrease in aggression, because it influences feelings of informational justice and frustration. UWV-clients (N=1.415) participated in an experimental scenario study (adequate vs. limited information providing). Next to aggression, psychological, UWV and social demographic characteristics were measured. Compared to limited information, receiving adequate information results in lower aggression. Clients with more negative affect show more aggression, but receiving adequate information especially reduces aggression in these clients.

Immigration and the Criminalisation of Youth Hanging around in the Netherlands

Tijdschrift Erasmus Law Review, Aflevering 1 2016
Trefwoorden Criminalisation of youth hanging around, culture of control, immigration and discrimination
Auteurs Thaddeus Muller
SamenvattingAuteursinformatie

The focus in this article is the ‘criminalisation’ of youth hanging around with the emergence of bans on hanging around. A critical social constructivist approach is used in this study, which draws predominantly on qualitative primary data collected between the late 1980s and 2010s. The article compares indigenous with immigrant youth, which coincides with, respectively, youth in rural communities and youth in urban communities. This study shows that there is discrimination of immigrant youth, which is shaped by several intertwining social phenomena, such as the ‘geography of policing’ – more police in urban areas – familiarity, sharing biographical information (in smaller communities), and the character of the interaction, normalising versus stigmatising. In further research on this topic we have to study (the reaction to) the transgressions of immigrant youth, and compare it with (the reaction to) the transgressions of indigenous youth, which is a blind spot in Dutch criminology.

Tijdschrift PROCES, Aflevering 3 2016
Trefwoorden ervaringen, verdachten, kanton, rechtvaardigheid, rechter
Auteurs Kiki Twisk BSc, Roosmarijn van Es BSc en Rosa Utermark
SamenvattingAuteursinformatie

The purpose of this study is to investigate how fair or unfair defendants in the cantonal court experience their treatment during the process and which factors influence that experience. Very little research is done in this area. In a survey defendants were asked to evaluate how they were treated during the process. The results show that defendants who were convicted have a more negative judgement about fairness than defendants who weren’t convicted. Significant predictors of judgement about fair treatment are: the impression that the judge was listening, the overall impression of the way the case was treated by the court and the impression that the judge was patient.

The paper aims at justifying an interpretation of Dworkin’s theory of Law as Integrity that brings it closer to philosophical pragmatism despite his rejection of legal pragmatism. In order to achieve this aim, this work employs a classification of philosophical commitments that define pragmatism in a broad and in a narrow sense and shows that legal pragmatism follows the main thinkers of pragmatism in the narrow sense in committing to instrumentalism. The attribution of a pragmatist character to Dworkin’s theory of law rests on the idea that the adoption of a commitment to instrumentalism is not implicated by its adoption of other pragmatist commitments.

Access_open Expounding the Place of Legal Doctrinal Methods in Legal-Interdisciplinary Research

Experiences with Studying the Practice of Independent Accountability Mechanisms at Multilateral Development Banks

Tijdschrift Erasmus Law Review, Aflevering 3 2015
Auteurs Andria Naudé Fourie
SamenvattingAuteursinformatie

There is a distinct place for legal doctrinal methods in legal-interdisciplinary research methodologies, but there is value to be had in expounding that place – in developing a deeper understanding, for instance, of what legal doctrinal analysis has to offer, wherein lies its limitations, and how it could work in concert with methods and theories from disciplinary areas other than law. This article offers such perspectives, based on experiences with an ‘advanced’ legal-interdisciplinary methodology, which facilitates a long-term study of the growing body of practice generated by citizen-driven, independent accountability mechanisms (IAMs) that are institutionally affiliated with multilateral development banks. The article demonstrates how legal doctrinal methods have contributed towards the design and development of a multipurpose IAM-practice database. This database constitutes the analytical platform of the research project and also facilitates the integration of various types of research questions, methods and theories.
