    Organizing dog fights is prohibited in the Netherlands. In such fights, two dogs have to fight each other, sometimes to the death. The animal suffering behind this is enormous. Little is known in the Netherlands about the phenomenon of dog fighting, both from a scientific point of view and through criminal cases. In this contribution, we outline the world behind dog fights by describing how dog fights work, who are part of the entourage and within which criminal infrastructure the dog fights take place. Finally, the problem is discussed and the current approach by the appropriate authorities is discussed and which gaps can be discovered.

    Hesdy Gerges is a heavyweight kickboxer whose career was interrupted because of his involvement in an cocaine transport. This article is analyzes the biography of this top fighter, describing the macro context of an expanding market for full-contact martial arts, the meso level of the gym and its relation to the criminal milieu, and the fighter and his body on the micro level. Hesdy is used to set an example, and since it takes more than seven years to reach a verdict, the impact on his private life and his career as a fighter is large. The study is based on participant observation and 33 interviews, twenty of which with the protagonist.

    Steering on public values in Dutch smart cities, let alone their regulation, is complicated. This article situates this difficulty in the vested interests that Dutch local authorities have in public-private smart city projects, and in the fact that public values are narrowly defined in relation to the technology; not in relation to a vision for the city in which its communities thrive. A way out of this deadlock, the article proposes, is to understand smart cities in the Netherlands beyond the typically Dutch consensus politics (the ‘polder’) and, instead, as part of a broader (urban) governance tendency to push urban technologies through the recital of fixed urban problems and public values. Consequently, state regulation of the (Dutch) smart city should principally enable (local) public and political involvement in defining urban problems and urban dreams, and thus in deciding the public values that are at stake.

    The judicial landscape in Europe for commercial litigation is changing rapidly. Many EU countries are establishing international business courts or have done so recently. Unmistakably, the approaching Brexit has had an effect on this development. In the last decades England and Wales – more precise, the Commercial Court in London - has built up a leading position as the most popular jurisdiction for resolving commercial disputes. The central question for the coming years will be what effect the new commercial courts in practice will have on the current dominance of English law and the leading position of the London court. In this article I address this question by focusing on the development of a new commercial court in the Netherlands: the Netherlands Commercial Court (NCC).

    The liberal globalised order has brought increased focus on the regulation of international commerce, and especially dispute resolution. Enforcement of contracts has been a concern largely owing to the insufficiencies of the legal systems, especially relating to the institutional structure, and it holds true for India as well. The commercial courts mechanism – international and domestic – with innovative features aimed at providing expedited justice is witnessing much traction. India, similar to many other jurisdictions, legislated in favour of specialized dispute resolution mechanisms for commercial disputes that could help improve the procedures for enforcement of contracts. This research attempts to critique the comparable strengths and the reform spaces within the Indian legislation on commercial courts. It parses the status of commercial dispute resolution in India especially in the context of cross-border contracts and critiques India’s attempt to have specialised courts to address commercial dispute resolution.

    With more and more information disclosed online and with open-access policies on the rise, legal academic research is becoming more accessible. The potential impact of this development is enormous, particularly in areas or jurisdictions where offline information is scarce and where access to subscription-based journals or books is limited or non-existing. Because the current literature lacks materials that guide researchers who conduct legal research while relying on open access, this article discusses where and how to find and select relevant academic books, journal articles, and working papers in the open access world. The resources, selection tools, and search strategies explained in this article particularly focus on finding open access sources in English. Consequently, this article assists researchers who rely on materials that are freely accessible because they lack access to books and to subscription-based journals outside of their own jurisdiction. The section on search strategy is relevant for researchers who aim to identify sources in an effective and efficient way.

    In this article, the questions why scientific misconduct has become a subject of criminological research and how scientific misconduct relates to a production-oriented academic culture are examined. It is argued that the current academic career path produces an anomic academic culture. The authors further examine the slippery notion of the term ‘scientific misconduct’ and conclude that questions about the prevalence or increase of scientific misconduct are hardly answerable. They also point at a number of undesirable side-effects of the emerging culture of distrust and control in academia, amongst which socially disengaged, highly predictable and little innovative research. They end with a plea to recapture a truly academic culture.

    In this article I focus on the academic environment in which social psychologist Diederik Stapel worked and developed his career as a con academic. He published over 50 articles with fabricated data in top tier journals. This article is based on interviews with Stapel himself and document analysis. Especially, I pay attention to his socialization as an academic in his years at the University of Amsterdam, where he did his PhD (1986-2000). In my description of how social psychology developed in the nineties in Amsterdam it becomes clear that there was a strong emphasis on competition and publishing articles in top tier journals. Stapel conformed to this culture of competition and published almost as much as the two leading full professors of his department during the period 1995-2000. In the early nineties Stapel discovered that the use of questionable research procedures (QRPs) was common in social psychology. He realized that without using these procedures it was hardly possible to get good results and publish frequently in top tier journals. Though Stapel resented this partly and was disenchanted by this experience, he did integrate QRPs in his daily academic practice. He actually raised the issue of QRPs in a lecture in Oxford when he received the Jos Jaspars Early Career Award of the EAESP, but there was hardly any substantive response to his presentation. The academic culture in which Stapel developed his career can be described as ‘indifferent tolerant’. Though Stapel does refer to the circumstances which influenced his academic fraud, he does state that he himself is responsible for his massive scientific misconduct.

    Scientific misconduct takes place at the heart of higher education organizations. Organizational culture (meso level) shapes scholars’ behaviors and perceptions (micro level) about what should be problematized while conducting research and teaching. In this paper it is argued that there are organizational mechanisms at place by which organizational goals (funding) and professional goals (recognition) become indistinguishable. The mechanisms are: pressure, loose social control, scarce resources and lack of alternatives. Scholars may strategically react to these mechanisms by accepting, fitting in, resisting or giving up. It is at the heart of these mechanisms and strategies that problematic behaviors may emerge.

    The phenomenon of scientific fraud has to be studied within the context of neoliberal meritocracy. In this organisational system, the position of the individual within a group (society, university, etc.) is determined by his or her merits in terms of (economic) productivity. Although this sounds fair, neoliberal meritocracy leads to social inequality, unlimited competition between individuals, egoism, priority of quantity over quality, and the irrelevance of ethics. Within the world of scientific research, neoliberal meritocracy leads to sloppy or even fraudulent science, because it incites researchers to prioritize publication criteria before qualitative research.

    There is a distinct place for legal doctrinal methods in legal-interdisciplinary research methodologies, but there is value to be had in expounding that place – in developing a deeper understanding, for instance, of what legal doctrinal analysis has to offer, wherein lies its limitations, and how it could work in concert with methods and theories from disciplinary areas other than law. This article offers such perspectives, based on experiences with an ‘advanced’ legal-interdisciplinary methodology, which facilitates a long-term study of the growing body of practice generated by citizen-driven, independent accountability mechanisms (IAMs) that are institutionally affiliated with multilateral development banks. The article demonstrates how legal doctrinal methods have contributed towards the design and development of a multipurpose IAM-practice database. This database constitutes the analytical platform of the research project and also facilitates the integration of various types of research questions, methods and theories.

    De Inspectie voor de Gezondheidszorg (IGZ) heeft geëxperimenteerd met een nieuwe vorm van inspectie gebaseerd op systeemtoezicht (ST). Het experiment volgt uit voortgaande ontwikkelingen in de governance van zorginstellingen. Het experiment is gevolgd en ondersteund met formatief onderzoek. Geleerd is dat ST in de Nederlandse gezondheidszorg, mits gericht en evenwichtig toegepast, een bijdrage kan leveren aan de doelstellingen van de IGZ ten aanzien van effectief en efficiënt toezicht. ST maakt ‘inspectiemaatwerk’ mogelijk. Daarenboven geeft dit artikel inzicht in de werkwijze die gebruikt kan worden bij de modernisering van toezicht.

    Male inmate subcultures can be described as highly gendered settings where power relationships are based on a hierarchical gender order. Cultural idealized forms of masculinity provide an important foundation for these hierarchical rankings. Notions of hegemonic and subordinate masculinities offer a valuable theoretical framework for explaining the power relations and pecking order among male inmates. Drawing on observations and qualitative semi-structured interviews with prisoners in a medium-size Belgian male prison, this article analyses the various intermale dominance hierarchies among inmates and the discourses in which they are embedded: type of offence, social conduct, individual characteristics of the prisoners and the possession of different forms of capital. This article both stresses and nuances the importance of offence categories by explaining how hierarchical status can be enhanced through social performance and acting in accordance with the prison code. Additionally, it describes how hierarchical arrangements operate in the daily practice of prison life through spatial norms.

    Publieke organisaties staan van oudsher bekend als nieuwsmijdende organisaties. Ze voeren belangrijke publieke taken uit met een soms grote invloed op de samenleving, maar ze opereren relatief onzichtbaar achter gekozen politici die voor hen het woord voeren en op grond van bureaucratische routines en wettelijke regelingen.
    De analyse in dit artikel is erop gericht om aan de hand van voorlopige inzichten uit empirisch onderzoek te bekijken in welke mate de zorgen over de rol van de media in bestuur en toezicht gerechtvaardigd zijn en om kansen voor toezichthouders door medialogica te identificeren.
    Als men de conclusies op zich beziet, valt op dat de analyse op één cruciaal punt na, meer redenen voor geruststelling dan bezorgdheid biedt. Medialogica werkt, uitgaande van de sombere verwachtingen in een deel van de literatuur, vaker positief dan negatief uit voor toezichthouders.
