In 2020, the Belgian federal Government announced that it will recognize Buddhism as a non-confessional worldview. This recognition will give the Buddhists several privileges: the salaries and pensions of lama’s as well as of Buddhist consultants in prisons, hospitals and the army will be paid for by the state. In addition, state schools will be required to organize Buddhist education at parental request. From the perspective of equal treatment and within the current constitutional framework, the recognition of Buddhism can only be welcomed. But is this constitutional framework, which is amongst others indebted to the concordat between Napoleon and the Holy See (1801), still up to date? In 1983, the Dutch Government abolished this Napoleonic model of state financing and opted for a profound reform of the system. In this article, I will show why such a reform could also be useful and inspiring in the Belgian context. |

The article discusses a range of important normative questions raised by anti-COVID-19 measures and policies. Do governments have the right to impose such severe restrictions on individual freedom and furthermore do citizens have obligations vis-à-vis the state, others and themselves to accept such restrictions? I will argue that a democratic state may legitimately enforce publicly discussed, properly enacted and constitutionally tested laws and policies in order to protect its citizens from risks to life and limb. Even so, there is a natural limit, factual and normative, to what the state or a government can do in this respect. Citizens will also need to take it upon themselves not to harm and to protect others and in the context of a pandemic this means that endorsement of restrictions or other mandatory measures, notably vaccination, is not to be seen as a matter of personal preference concerning the supposedly inviolable sovereignty of one’s own body. |

The COVID-19 crisis has produced or amplified disruptive processes in societies. This article wants to argue for the fact that we understand the meaning of the COVID-19 crisis only if we relate it to the fundamental vulnerability of modern life and the awareness of vulnerability of whole societies. Vulnerability in modernity are expressions of a reality of freedom that is to some extent considered contingent and therefore unsecured. It is true that law is understood today as the protective power of freedom. The thesis of the article, however, boils down to the fact that the COVID-19 crisis has resulted in a new way of thinking about the protection of freedom. This also means that the principle of solidarity must be assigned a new social role. Individual and societal vulnerability refer thereafter to an interconnectedness, dependency, and a future perspective of freedom margins that, in addition to the moral one, can also indicate a need for legal protection. In this respect, law has not only a function of delimitation, but also one of inclusion. |

This article explores the drivers and dynamics that are directly and indirectly responsible for the environmental crisis in the Anthropocene by using a green and organizational criminology perspective and combining it with insights from perpetrator studies. Responsible actors and responsibilities are discussed on societal, organizational and individual level. Lessons are drawn on how existing insights in criminology can be challenged to better accommodate for the ecological challenges in the antropocene and on what that means for criminologists experiencing and researching the Anthropocene. |

While the early and more radical versions of the Green New Deal idea question the necessity of growth itself, the more moderate programmes now pursued by the EU and the Biden administration approach the Green New Deal as a new ‘growth strategy’ that will help western economies recover from the corona pandemic. |

Thought experiments have been widely used in virtually all sciences and humanities. Law is no exception. We can find countless instances of such experiments in both the legal practice and the legal theory. However, this method has hardly been studied by legal scholars, which contrasts with the vast literature devoted to it in other fields of knowledge. This article analyses the role that some thought experiments – those where an imaginary legal change is made, and its social effects are observed – may play in law. In particular, we show why these empirical legal thought experiments might be useful for the practice and theory of law, the main principles for conducting them and how the law deals with them. |

This article considers why image-based sexual abuse (‘ibsa’) should be classified as a sexual offence. The article briefly considers harmfulness, and then moves to discuss the principle of fair labelling. Classification of offences should be informed by the wrongdoing they address. A conceptual analysis of sexual offences shows that sexual wrongs warrant labelling as sexual offences. The infringement of the right to sexual autonomy in ibsa means the nature of the wrong is sexual. Ibsa should be a sex crime. |

This qualitative study examines how criminal careers in cybercrime start and can be explained. Based on offender and expert interviews, the authors conclude that traditional factors linked with the initiation, such as a maturity gap (for juvenile offenders) and opportunism (for adult offenders), in combination with different types of (online) disinhibition – social, technical, situational and psychological – can explain the start of a criminal career. Features of the digital context appear to play a major role in the development of a criminal career and this requires more online supervision and education about – among other things – legal alternatives and the risks and boundaries of the online environment. |

In the Netherlands, immigration detention is classified under administrative law. More precisely: it is a form of administrative coercion. But immigration detention is also deprivation of liberty, or a habeas corpus measure. This makes it the most far-reaching form of administrative coercion you can think of. The regime and house rules of immigration detention differ just a little from those of criminal deprivation of liberty. The draft bill on the Return and Detention Act provides some improvements. For asylum seekers that cause nuisance, there is the Enforcement and Supervision Location, where the foreign national is given an area restriction and must remain within the municipal boundaries. Due to the liberty restrictions, immigration detention should always be the last resort. |

This article adopts German philosopher Hans Vaihinger’s Philosophy of “as if” as a vehicle to sketch the main features of the emerging research domain of narrative victimology, as well as address some of its limitations. Vaihinger emphasizes the importance of useful untruths, i.e. things we know to be untrue, but nevertheless behave as if they are not, if that strengthens their use as instruments for us to find our way more easily in the world. This applies to our daily lives, but also to our societal institutions and the models and metaphors that underlie our approaches to (social) science. The paper argues that the narrative metaphor of the historical event is often more apt to enhance our understanding of victimological phenomena than that of the mechanism, which is the default metaphor of (social) science. The paper subsequently describes four areas of inquiry of narrative victimology: victimisation’s impact on (life) stories; narratives in the aftermath of victimization; narratives of victim’s experiences with justice processes and the coincidence and juxtaposition of the victims’ narrative with narratives of other significant parties. For all its merits however, the narrative metaphor is also a “useful untruth”, equipped with its own limitations, for instance the difficulty of language in describing first hand experiences of victims and the possibility that narrative structures will be imposed upon victim experiences. |

A recent rehabilitation theory, the ‘Good Lives Model’ (GLM), states that interventions that work towards a higher well-being can reduce recidivism risk more sustainably by promising a happier, pro-social life, rather than just a less harmful one. Although the GLM theory appears promising, limited empirical research has examined its underlying assumptions, applicability and its effectiveness. Research into the GLM with youth is even more limited. Therefore, in the current study, we investigate the main etiological assumptions of the GLM in a large group of adolescents between 14 and 18 years old from the general population (N=5.776), by means of self-report survey data on well-being, primary human goods and delinquency. The results show that a lower subjective global well-being is related to delinquent behavior. Especially the primary human goods of relatedness and working towards a financially stable future appear to be important goals for interventions aimed at rehabilitation of juvenile offenders. |

Ever since it was published in 2015, the judgment of the The Hague court in the so-called Urgenda-case, and the subsequent decisions of the appellate and cassation courts confirming it, have been met with repeated and vivid critiques. By recognizing the necessity of the reduction in greenhouse gas emissions, and furthermore imposing a certain reduction level on the Dutch state, the judgments in the cases at hand gave rise to many questions concerning the position of the judiciary in the matter, and in Dutch society as a whole. This article attempts in the first place to situate the positions of the different actors intervening in the Urgenda-case within a legal-theoretical framework. The contribution subsequently explores the strategic possibilities that an alternative understanding of law could offer to the judges, focusing specifically on the use of legal instruments stemming from international law, brought into the reasoning of the national judge. |

De opkomst van de platformeconomie, met als prominente voorbeelden Uber en Deliveroo, deed de discussies omtrent de aard van de arbeidsrelatie heropleven. Zijn deze platformwerkers in werkelijkheid werknemers, en is het arbeidsrecht aan hervorming toe indien ze het wel of niet zijn? Deze bijdrage heeft eveneens tot doel om de werkingssfeer van het arbeidsrecht ter discussie te stellen door de regelgeving omtrent private arbeidsbemiddeling en uitzendarbeid toe te passen op platformen. Dienaangaande bepleit deze bijdrage om ten eerste de regelgeving omtrent private arbeidsbemiddeling aan te wenden om ook de bemiddeling van dienstverleningsovereenkomsten tussen werkzoekenden en opdrachtgevers te omkaderen. Ten tweede wijst de bijdrage op de mogelijke totstandkoming van ‘verdoken’ uitzendarbeid door middel van digitale platformen. Om dit te voorkomen stellen de auteurs een ‘vermoeden van uitzendbureau’ voor. |
