Juvenile delinquents appear to be delayed in their moral development, more specific the development of their moral judgment, empathy, guilt and shame. Moral development also appears to predict recidivism. It is therefore plausible that interventions that focus on the moral development of juvenile delinquents could have a beneficial effect on reducing recidivism. However, our systematic review (i.e., meta-analysis) shows that with these so-called moral behavioral interventions the level of moral judgment of juvenile offenders can be significantly increased, by 22%, but that such interventions have no effect on recidivism. It may be possible to increase the effectiveness of moral interventions for juvenile delinquents by simultaneously influencing several aspects of moral development instead of, for example, only moral judgment or empathy. In addition, problems of poor aggression regulation, often caused by a history of traumatic events, may need to be addressed first before moral-behavioral interventions can be effective. |

This contribution reports on an ongoing study into the impact of the COVID pandemic on the rights of vulnerable litigants in the handling of court cases concerning supervision orders and custodial placements of juveniles. The research is based on interviews with judges, lawyers and other professionals in the youth protection chain and a survey among litigants. The central question is whether the handling of these cases should be considered acceptable from the perspective of procedural and fundamental rights. In addition, the procedural justice experienced by litigants is examined. The preliminary results, based on desk research and interviews, is that of varyingly successful improvisations with telephone and digital hearings, in which procedural and fundamental rights could not be fully realized. This is mainly due to technical problems and the complexity of judicial case management under these circumstances. The interviewees differed about whether the bottom of what is acceptable was reached and how often this was the case. The final report will take stock of this and draw lessons for the future. |

This article builds on two previous publications in this journal on the topic of the role of the parents of misbehaving children. We previously concluded that the family plays an important role in ending crime among young people. More recently, we sharpened that conclusion on the basis of long-term monitoring of a large group of young repeat offenders: they don’t stop because their parents say so. The role of the parents turned out to be much more fragile. This article aims to offer an extra insight into the complexity of the relationship between education and crime based on three recent cases. |

Fourthly, it argues that the current system should be reformed by introducing into Swedish law a review committee that administers applications for exoneration. |

The aim of this study was to provide more insight in prevalence and aetiology of juvenile frequent offending, employing police registered data as well as self-report information. We combined data about 519 youths that participated in a self-report study in the region of The Hague with police register data (the HKS system) from the police unit of The Hague. The results indicate that a substantial part of youths that report a large amount of offenses themselves are not formally known as ‘juvenile frequent offender’. Causal factors derived from four major criminological theories can be found in a more pronounced way among juvenile frequent offenders than among youths that incidentally commit offenses. In general, there are similarities between the characteristics of juvenile frequent offenders defined by police register data and those defined by self-reports, but, on average, frequent offenders that are known by the police spend more time unstructured socializing with friends. We conclude that research using the method of self-report is well capable to find juvenile frequent offenders, and that this method also leads to useful information about the causes of their delinquent behaviour. |

This article investigates whether cyber delinquent behaviour of school friends, other offline friends and online contacts is related to cyber delinquent behaviour of individuals, and whether this relation differs for cyber dependent, cyber enabled and traditional crime. We used both direct and indirect measures of cyber delinquency of friends. We employed data from the first wave of a large-scale study on the causes of online delinquency among Dutch juveniles (n=889; mean age=16.8 years). The results suggest that both direct and indirect measures of levels of friend delinquency were related to levels of individual cyber offending. However, indirect measures had a stronger association with individual online delinquency than direct measures. This suggests that respondents make incorrect estimates of their friends’ levels of online delinquency. Moreover, no differences were found in the strength of the relation between individual online offending and indirect measures of online offending of school friends, offline friends and online friends. This suggests that friends of different types all play an important role in individual online offending. |

Given that the social life of youngsters develops more and more online, attention for cybercrime has grown as well. However, no Flemish data is available yet. This study uses data from two representative samples of the Flemish youth to research the prevalence and risk profiles of on- and offline crime. Compared to offline crime, online crime is relatively limited. In addition, results showed that online offenders had the least severe risk profile, while offenders of both on- and offline delinquency had the most severe profile. For victimization, it appeared that it is important to consider individual types of offences, since complex differences were found between various crime types. These results indicate a limited, but not ignorable, occurrence of online crime, and a difference in risk profiles for offline and online crime. |

Since 1 April 2014, young adults aged 18 up to and including 22 years can be sentenced with juvenile sanctions in the Netherlands. This legislation is referred to as ‘adolescent criminal law’ (ACL). An important reason for the special treatment of young adults is their over-representation in crime. The underlying idea of ACL is that some young adult offenders are less mature than others. These young adults may benefit more from pedagogically oriented juvenile sanctions than from the deterrent focus of adult sanctions. Little is known, however, about the characteristics of the young adults sentenced with juvenile sanctions since the implementation of ACL. The aim of this study is to gain insight into the demographic, criminogenic and criminal case characteristics of young adult offenders sentenced with juvenile sanctions in the first year after the implementation of ACL. A cross-sectional study was conducted using a juvenile sanction group and an adult sanction group. Data on 583 criminal cases of young adults, sanctioned from 1 April 2014 up to March 2015, were included. Data were obtained from the Public Prosecution Service, the Dutch Probation Service and Statistics Netherlands. The results showed that characteristics indicating problems across different domains were more prevalent among young adults sentenced with juvenile sanctions. Furthermore, these young adults committed a greater number of serious offences compared with young adults who were sentenced with adult sanctions. The findings of this study provide support for the special treatment of young adult offenders in criminal law as intended by ACL. |

In this article a critical reflection upon age limits applied in the law is provided, in light of the tension that exists in international children’s rights law between the protection of children and the recognition of their evolving autonomy. The main research question that will be addressed is to what extent the use of (certain) age limits is justified under international children’s rights law. The complexity of applying open norms and theoretically underdeveloped concepts as laid down in the UN Convention on the Rights of the Child, related to the development and evolving capacities of children as rights holders, will be demonstrated. The UN Committee on the Rights of the Child struggles to provide comprehensive guidance to states regarding the manner in which the dynamic legal position of children should be applied in practice. The inconsistent application of age limits that govern the involvement of children in judicial procedures provides states leeway in granting children autonomy, potentially leading to the establishment of age limits based on inappropriate – practically, politically or ideologically motivated – grounds. |

Het VN-Kinderrechtencomité heeft recentelijk zijn nieuwe General Comment No. 24 gepubliceerd over kinderrechten in het jeugdstrafrecht. Deze bijdrage verkent de mogelijke implicaties van dit General Comment voor het Nederlandse jeugdstrafrecht, aan de hand van interviews met professionals uit de jeugdstrafrechtspraktijk. Hierbij wordt specifiek aandacht besteed aan de minimumleeftijdsgrens voor jeugdstrafrechtelijke aansprakelijkheid en de buitengerechtelijke afdoening van jeugdstrafzaken (‘diversion’). Ook wordt in bredere zin gereflecteerd op de potentiële meerwaarde van het IVRK en General Comment No. 24 voor het Nederlandse jeugdstrafrecht. |

The Dutch Government intends to implement a Juvenile Justice Law for the Caribbean Netherlands. This article addresses this development and gives some important considerations from a children’s rights perspective; particularly, the rights of children while in the juvenile justice system and the Government’s obligation to prevent children from entering into the system. The discussion hinges on the findings of UNICEF The Netherlands’ recently published Situation Analysis on the Rights of Children and Adolescents in the Caribbean Netherlands, focusing on child vulnerabilities that may eventually lead to criminality and recommendations regarding necessary provisions, collaboration between ministries and public entities, and the availability of data to monitor the effectiveness of government policy. |

In het conceptwetsvoorstel tot vaststelling van Boek 6 van het nieuwe Wetboek van Strafvordering wordt veel aandacht besteed aan de positie van ouders in het jeugdstrafproces. Bij het opstellen van deze bepalingen heeft de wetgever de tekst van Richtlijn (EU) 2016/800 betreffende procedurele waarborgen voor kinderen die verdachte of beklaagde zijn in een strafprocedure niet meegenomen, terwijl deze richtlijn belangrijke waarborgen bevat om te verzekeren dat jeugdige verdachten hun recht op een eerlijk proces kunnen uitoefenen. In dit artikel wordt nader ingegaan op de voorgestelde bepalingen rondom de positie van ouders in het conceptwetsvoorstel en wordt onderzocht in hoeverre deze positie in overeenstemming is met de Europese richtlijn. |

As part of the project aiming to modernise the Dutch Code of Criminal Procedure the regulation on pre-trial detention is being revised. The proposal is to replace the conditional suspension of remand detention for both adults and juveniles with a new modality of provisional restraint. Furthermore, the proposal in its current form implies the exclusion of the alternative enforcement and the possibility of night detention. In this article, the consequences of the proposal on juvenile suspects are being discussed. |
