    Arbeidsmigratie is in de EU een belangrijk en actueel onderwerp. Enerzijds, omdat steeds meer landen in de EU te kennen geven dat ze voor het op peil houden van het arbeidspotentieel hun toevlucht moeten nemen tot het aantrekken van arbeidsmigranten van buiten de EU. Anderzijds blijkt dat er regelmatig sprake is van uitbuiting van deze arbeidsmigranten. In EU-wetgeving in het algemeen en de regulering van migratie van onderdanen van derde landen (derdelanders) naar de EU in het bijzonder wordt aandacht besteed aan de kwetsbare positie van derdelanders en een eerlijke behandeling. Het doel van migratiewetgeving is echter met name ook het beheersen van migratie, het bestrijden van illegale migratie en het stimuleren van economische ontwikkeling. Deze verschillende doelen kunnen met elkaar botsen. In dit artikel wordt onderzocht wat de invloed is van de EU-migratiewetgeving op de uitbuiting van arbeidsmigranten.

    The Dobersberger decision of the Court of Justice of the European Union deals with the legal situation of posted workers on an international train. These workers, employed by a Hungarian company and based in Hungary, operate on a train connecting Budapest with Salzburg and Munich. The Court concludes against their inclusion under the Posting of Workers Directive, considering their connection to the Austrian territory as too limited. This decision is based on a selective representation of the facts and sits difficultly with the letter of the law and the intention of the legislator.

    In this article a critical reflection upon age limits applied in the law is provided, in light of the tension that exists in international children’s rights law between the protection of children and the recognition of their evolving autonomy. The main research question that will be addressed is to what extent the use of (certain) age limits is justified under international children’s rights law. The complexity of applying open norms and theoretically underdeveloped concepts as laid down in the UN Convention on the Rights of the Child, related to the development and evolving capacities of children as rights holders, will be demonstrated. The UN Committee on the Rights of the Child struggles to provide comprehensive guidance to states regarding the manner in which the dynamic legal position of children should be applied in practice. The inconsistent application of age limits that govern the involvement of children in judicial procedures provides states leeway in granting children autonomy, potentially leading to the establishment of age limits based on inappropriate – practically, politically or ideologically motivated – grounds.

    In dit themanummer wordt bijzondere aandacht gegeven aan sanctiewetgeving. In dit redactioneel wordt ingegaan op de mogelijkheden om betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen aan te pakken, naast het gebruik van de Sanctiewet. Verkend wordt wat de aard en omvang van dit fenomeen is en welke juridische en niet-juridische middelen worden ingezet om de betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen te voorkomen en wat daarvan het effect kan zijn. Vervolgens zullen de beschikbare juridische middelen en quasi-juridische reacties en het gebruik daarvan worden geïnventariseerd. Ten slotte wordt gereflecteerd op de mogelijke effecten van het gebruik van deze instrumenten ter preventie van de betrokkenheid van ondernemingen bij ernstige mensenrechtenschendingen.

Reassessing the labelling approach in the light of corporate deviance

    Multi-national corporations are increasingly facing attention and disapproval by different actors, including authorities, public and (non-) commercial organizations. Digital globalization and especially social media as a low-cost, highly interactive and multidirectional platform shape a unique context for this rising attention. In the literature, much attention has been devoted to top-down approaches and strategies that corporations use to avoid stigmatization and sanctioning of their behaviour. Reactions to corporate harm are, however, seldom researched from a labelling perspective. As a result, corporations are not considered as objects towards whom labelling is targeted but rather as actors who hamper such processes and who, as moral entrepreneurs, influence which behaviour is labelled deviant. Based on theoretical analysis of literature and case studies, this article will discuss how the process of labelling has changed in light of the digitalized, late-modern society and consequently, how the process should be revisited to be applicable for corporate deviance. Given a diversification of moral entrepreneurs and increasingly dependency of labelling and meaning-making on the online sphere, two new forms of labelling are introduced that specifically target institutions; that is bottom-up and horizontal labelling.

    What role do Dutch criminologists play in the – especially since the onset of the so-called migration crisis – heated national and international debates on the criminalization of migration and border mobility? This will be the central question in this publication. Based on an inventory of national and international peer-reviewed publications written by Dutch criminologists, the article will reflect upon Dutch criminologists’ public role. In addition, based on the observed ‘silences’ in the scholarly debates on the criminalization of migration and border mobility, three avenues for further criminological research will be identified.

    Since the introduction of a human rights chapter in the 2011 OECD Guidelines for Multinational Enterprises, National Contact Points (NCPs) have been increasingly dealing with specific instances referring to human rights violations by companies. According to the Organisation for Economic Cooperation and Development (OECD), the human rights provisions are the most cited provisions of the Guidelines. Specific instances include allegations such as a company’s failure to implement human rights due diligence, to apply the principles of free, prior and informed consent, to take supply chain responsibility, and/or to comply with the right to cultural heritage. Of all topics, human rights due diligence and human rights supply chain responsibilities are most commonly referred to in complaints based on the Guidelines. This article focuses on how NCPs have handled these topics of human rights due diligence and supply chain responsibility in specific instances. The Dutch NCP has been selected because it is celebrated in literature as the ‘gold standard’ because of its composition including independent members, its forward-looking approach, and because it is one of the most active NCPs in the world. All decisions of the Dutch NCP concerning these two topics are analysed in the light of the decisions of four other NCPs (UK, Denmark, Germany and Norway). A doctrinal methodology is used to analyse similarities and differences between the argumentations of the five NCPs.

    The past few decades have seen an increasing scrutiny of the impacts – both positive and negative – that companies have on the societies in which they operate. The search for adequate responses to such scrutiny is reflected in developments in the societal, political and academic debate on three separate but interrelated concepts: corporate social responsibility, business and human rights and responsible business conduct. The focus in this Special Issue will be on law and policy relating to responsible business conduct in global value chains. The contributions in this Special Issue identify relevant developments and institutions in the Netherlands, including rules and regulations related to trade, investment and corporate governance as well as cases related to corporate and consumer responsibilities, and assess their role in relation to the potential to provide a positive response to the concern about the human and environmental impacts of business activities. Together, they provide a multi-perspective view of relevant gaps and/or best practices with regard to regulatory governance in the Netherlands while at the same time enabling a comparative debate on the extent to which these diverse developments and institutions are in line with stated policy goals in this context both at national and EU levels. In doing so, this Special Issue aims to contribute to further coherence between national and EU policies with regard to RBC in global value chains and sustainable development.

    This article looks at how normative questions, i.e. ‘what should the law be?‘, are approached in modern labour law scholarship. A distinction is made between internal and external normative frameworks for analysis, whereby internal frameworks are made up of principles, values or standards that are part of the law and the external frameworks are made up of theories outside of law. As a functional legal field, labour law can also benefit to a great deal from empirical research. However, the article argues that empirical facts by themselves have a limited normative value and that we need a normative framework in order to answer normative and evaluative questions. Therefore, the aim of the article is to review, clarify and evaluate the internal normative framework of labour law.

Access_open Fostering Worker Cooperatives with Blockchain Technology: Lessons from the Colony Project

    In recent years, there has been growing policy support for expanding worker ownership of businesses in the European Union. Debates on stimulating worker ownership are a regular feature of discussions on the collaborative economy and the future of work, given anxieties regarding the reconfiguration of the nature of work and the decline of standardised employment contracts. Yet, worker ownership, in the form of labour-managed firms such as worker cooperatives, remains marginal. This article explains the appeal of worker cooperatives and examines the reasons why they continue to be relatively scarce. Taking its cue from Henry Hansmann’s hypothesis that organisational innovations can make worker ownership of firms viable in previously untenable circumstances, this article explores how organisational innovations, such as those embodied in the capital and governance structure of Decentralised (Autonomous) Organisations (D(A)Os), can potentially facilitate the growth of LMFs. It does so by undertaking a case study of a blockchain project, Colony, which seeks to create decentralised, self-organising companies where decision-making power derives from high-quality work. For worker cooperatives, seeking to connect globally dispersed workers through an online workplace, Colony’s proposed capital and governance structure, based on technological and game theoretic insight may offer useful lessons. Drawing from this pre-figurative structure, self-imposed institutional rules may be deployed by worker cooperatives in their by-laws to avoid some of the main pitfalls associated with labour management and thereby, potentially, vitalise the formation of the cooperative form.

    Human traffickers are usually depicted in public discourse as evil villains: the crème de la crème of organized crime. Although this image has also been dominant among scholars for a long time, it has become increasingly controversial. On the one hand, this debate is fueled by discussions amongst criminologists on criminal networks, on the other hand by the expansion of the legal definition of the crime since 2005. Apart from exploitation in the prostitution sector, various other forms of human trafficking are distinguished now, including labor exploitation. This article explores the question of which organizational forms play a role in labor exploitation. Through a review of the empirical research literature on labor exploitation, the authors show that in the field of labor exploitation, there is probably less involvement in criminal syndicates or criminal networks that maintain contacts with other criminal networks. In many cases, labor exploitation is committed by individuals or family businesses, or smaller loosely organized networks that are not necessarily embedded in other criminal networks. For researchers and policy makers alike, it is therefore advisable not to approach labor exploitation exclusively from the perspective of transnational organized crime.

State-corporate crime en niet-democratische regimes: betrokkenheid van bedrijven in internationale misdrijven

    Most state-corporate crime research is focused on crime or harmful outcomes in or by democratic states. The goal of this article is to investigate the applicability of this concept to relations between economic actors and non-democratic state actors. The concept of state-corporate crime is applied to three contexts in which corporations have become involved in international crimes such as genocide, war crimes and crimes against humanity. Each representing a turning point in the academic and public perception of ‘business and human rights’, the contexts that are analysed are Nazi Germany (1993-1945), Apartheid South Africa (1948-1994) and the Democratic Republic of the Congo (DRC; 1996-now). It is concluded that in non-democratic states with totalitarian of authoritarian regimes (such as Nazi Germany and Apartheid South Africa), the concept of state-corporate crime is applicable and explanatory. In such strong states, economic and state actors make use of mutual benefits while, on the whole, state-interests prevail. As a result, the harmful outcome of the dynamics between corporations and states can best be described as corporate facilitated state crime. In weak states (such as the DRC) economic actors are generally more powerful while their involvement in international crimes also runs via non-state actors. The blurred lines between economic actors and state actors (and their interests) makes it difficult to apply the concept, in its different forms, to state-corporate cooperation in weak states and ‘new’ wars.

    This paper examines three Inter-American Court (IACtHR) cases on behalf of the Enxet-Sur and Sanapana claims for communal territory in Paraguay. I argue that while the adjudication of the cases was successful, the aftereffects of adjudication have produced new legal geographies that threaten to undermine the advances made by adjudication. Structured in five parts, the paper begins with an overview of the opportunities and challenges to Indigenous rights in Paraguay followed by a detailed discussion of the adjudication of the Yakye Axa, Sawhoyamaxa, and Xákmok Kásek cases. Next, I draw from extensive ethnographic research investigating these cases in Paraguay to consider how implementation actually takes place and with what effects on the three claimant communities. The paper encourages a discussion between geographers and legal scholars, suggesting that adjudication only leads to greater social justice if it is coupled with effective and meaningful implementation.

    The German federal court for labour law matters, the Bundesarbeitsgericht (the ‘BAG’), has held that evidence cannot be used in a dismissal lawsuit if the employer has obtained it from long-term surveillance using keylogger-software. Employers must not keep their employees under constant surveillance and must therefore expect their legal position to be weak if they try to dismiss an employee based on findings from such monitoring. The court ruling preceded the ECtHR Barbulescu ruling of 5 September 2017 (featured in EELC 2017/4) in a similar case.

ADR Clauses and International Perceptions: A Preliminary Report

    This article provides a preliminary analysis of the 622 responses to a questionnaire conducted in the context of Maryam Salehijam’s PhD research which focuses on commercial parties’ agreement to mediate/conciliate. The questionnaire targeted ADR professionals and experts with experience in drafting, inserting, or enforcing dispute resolution clauses that provide for non-binding ADR mechanisms. Some of the key findings include that it is still not very common for commercial contracts to conclude agreements to mediate/conciliate. This begs the question of why the parties and/or their legal advisors do not conclude such agreements as regularly as agreements to arbitrate. Moreover, the questionnaire confirmed that there is widespread practice in contract drafting to copy and paste dispute resolution clauses. This practice is shocking in light of the rising number of cases in which the parties dis­agree regarding the binding nature of their dispute resolution clause.

    The international tax landscape is changing and it is changing fast. The political perception is that taxation of multinational enterprises is not aligned with the ‘economic activity’ that produces their profits (i.e. not aligned with ‘value creation’). The perception links ‘value creation’ with ‘employees and sales’.
    In the BEPS Project of the OECD, the OECD attempts to combat base erosion and profit shifting and to align taxation with value creation. In this article, the authors discuss the impact they expect BEPS to have on tax advisory and tax planning. The focus goes to BEPS Actions 7, 8-10 and 13.
    By maintaining the separate entity approach under BEPS for the taxation of multinationals, has the OECD been forced to ‘stretch’ existing rules beyond their limits? Will the created uncertainty lead to a shift from ‘aggressive tax planning’ by multinationals to ‘aggressive tax collection’ by tax administrations? Will the role of tax advisory change from advising on the lowest possible effective tax rate to a broader advice including risk appetite and public expectations?
